Why the U.S. Blacklists Foreign Banks—and What Happens Next

The United States blacklists foreign banks to cut payment, financing and service channels connected to sanctioned governments, military-industrial programs, proliferation, terrorism, corruption or sanctions evasion. The result depends on the authority used: an SDN blocking designation can freeze a bank’s property under U.S. jurisdiction, while a CAPTA restriction can bar U.S. banks from maintaining correspondent or payable-through accounts and from processing covered transactions without necessarily blocking every asset. Customers may see payments rejected, accounts frozen or services withdrawn, but a sanction does not automatically mean that the U.S. government has seized their money.

“Blacklisted” is not one legal action

In everyday language, a foreign bank is “blacklisted” when the U.S. Treasury Department’s Office of Foreign Assets Control (OFAC) places it on a sanctions list or subjects it to a directive. Legally, however, different programs impose different consequences.

As an Amazon Associate I earn from qualifying purchases.

Two outcomes matter most:

  • Blocking sanctions: Property and interests in property in the United States, or in the possession or control of a U.S. person, must be frozen and reported. The bank may also be unable to deal with U.S. persons.
  • Correspondent-account and transaction restrictions: A CAPTA directive can prohibit U.S. financial institutions from opening or maintaining correspondent or payable-through accounts for the foreign bank and from processing covered transactions. CAPTA restrictions do not, by themselves, require all of the bank’s assets to be blocked.

A bank can face both types of authority at once. Its current OFAC list entry, the applicable directive or regulation, general licenses and effective date determine the real-world result.

Why Treasury targets foreign banks

Banks sit at the center of international commerce. They hold accounts, clear payments, provide trade finance, issue guarantees, arrange insurance and transmit information that identifies the parties to a transaction. Cutting a bank out of those channels can make it harder for a sanctioned government, company or military supplier to obtain money, equipment and professional services.

OFAC’s Russia advisory describes the policy as targeting foreign financial institutions that conduct or facilitate significant transactions, or provide services, involving Russia’s military-industrial base. The objective is also to deter evasion and hold facilitators accountable, not merely to punish the originally sanctioned customer.

Conduct that can create sanctions exposure

The June 12, 2024 OFAC advisory identifies several risk patterns for a foreign bank:

  • Maintaining accounts, transferring funds or providing payment processing, trade finance or insurance for people blocked under Executive Order 14024.
  • Serving people that support Russia’s military-industrial base or facilitating transfers of specified items to Russia.
  • Helping customers evade sanctions through opaque payment mechanisms, altered payment-field information or concealment of the true parties or purpose of a transaction.

The same advisory recommends screening customers, transactions, counterparties and associated parties against sanctions lists; reviewing exposure to higher-risk customers and jurisdictions; applying customer-due-diligence and anti-money-laundering controls; and using risk-based restrictions, exits, attestations and escalation procedures.

How a foreign bank becomes subject to a restriction

1. Treasury makes a legal determination

For Iranian Financial Sanctions Regulations account restrictions, OFAC says Treasury must first find that a foreign financial institution knowingly engaged in sanctionable activity. That finding is necessary before Treasury can prohibit or impose strict conditions on U.S. correspondent or payable-through accounts.

2. Treasury publishes the action

Treasury issues an order, directive or regulation describing the prohibited conduct and conditions. The action is published in the Federal Register, and the institution is identified on the applicable OFAC list, such as the CAPTA List or the Specially Designated Nationals and Blocked Persons List (SDN List).

3. The effective date arrives

The effective date controls when U.S. institutions must stop covered activity. For Russia-related CAPTA restrictions, Annex 1 institutions became subject to the prohibitions at 12:01 a.m. Eastern daylight time on March 26, 2022. Institutions added later generally become subject at 12:01 a.m. Eastern time 30 days after the determination. A bank and its customers must therefore check the entry and directive rather than rely on the date a headline was published.

4. Ownership can trigger blocking automatically

Under OFAC’s cited ownership rule, an entity owned 50 percent or more, directly or indirectly, in the aggregate by one or more blocked persons is itself blocked, even if it does not appear under a separate name on the SDN List. The calculation follows direct and indirect ownership chains, so a bank’s apparent absence from a list is not conclusive.

SDN and CAPTA: the practical difference

Question SDN blocking designation CAPTA restriction
Primary effect Blocks property and interests in property in U.S. jurisdiction or under U.S.-person control. Prohibits U.S. correspondent or payable-through accounts and covered transaction processing.
Are all assets automatically frozen? Assets within the blocking rule must be frozen and reported. No. CAPTA alone does not require asset blocking.
U.S. account access U.S. persons generally cannot transact with the blocked bank unless authorized. U.S. banks must close or refuse the covered correspondent or payable-through relationship.
Payments Transactions involving blocked property generally must be blocked. Transactions involving the covered foreign institution must be rejected unless an exemption or authorization applies.
Securities Property interests, including securities, may be blocked under the applicable authority. The Russia-related CAPTA prohibition also reaches transactions involving securities issued by the covered bank, including secondary-market trading.
Can both apply? Yes. A bank may be subject to a CAPTA directive and a separate blocking authority at the same time.

OFAC’s Russia-related CAPTA FAQ summarizes the rule this way: U.S. financial institutions may not open or maintain a correspondent or payable-through account for a covered foreign financial institution and may not process transactions involving it, unless an exception or authorization applies.

What happens to the bank’s operations

Correspondent and payable-through accounts close

After a CAPTA prohibition becomes effective, a U.S. financial institution must close covered correspondent or payable-through accounts and reject covered transactions. A correspondent account lets a foreign bank access U.S. payment services; a payable-through account lets the foreign bank’s customers conduct transactions through that account. Losing either relationship can interrupt dollar clearing, international transfers, card settlement and trade-finance services.

Payments are rejected, not necessarily frozen

A rejected payment is returned because the transaction cannot legally be processed. A blocked payment is held by the institution and reported because it involves blocked property. The distinction affects whether money is returned, where it remains and what authorization is needed.

Blocked property is held by the financial institution

When blocking sanctions apply, a U.S. financial institution must freeze the property and report it to OFAC. OFAC states: “OFAC itself does not seize or hold blocked funds.” The bank or other U.S. person holding the property keeps it blocked, and OFAC authorization is required before it can be released or transferred.

Secondary-market securities can be affected

The Russia-related CAPTA restrictions expressly cover transactions involving securities issued by a covered bank, including secondary-market trading. A broker, custodian or clearing agent may therefore stop dealing in the bank’s bonds or other covered instruments even when the investor is not the sanctioned bank.

What happens to a customer’s money

The customer’s outcome depends on where the funds are held, which parties are involved and whether the bank is subject to blocking sanctions, a CAPTA restriction or another program.

If a U.S. institution blocks the funds

  1. Contact the bank’s customer-service channel and ask for its sanctions-compliance or legal team.
  2. Ask the bank to confirm that the funds were blocked, identify the institution that filed the blocking report and provide the report reference or other case information it can lawfully disclose.
  3. Gather account statements, wire instructions, payment messages, invoices, contracts, identification documents and evidence showing the parties, purpose and source of funds.
  4. Determine whether a general license already covers the transaction. If not, consider an OFAC specific-license application describing the funds, all parties and the requested release in detail.

A blocked balance is not automatically forfeited. It remains unavailable until OFAC authorizes a release or another legal basis applies. A rejected payment, by contrast, may be returned by the processing bank, although return procedures can take time and may be impossible if another sanctions issue prevents the return.

If the foreign bank loses its U.S. correspondent

The bank may close accounts, stop dollar services, restrict international wires or move customers to another institution. Those are private compliance decisions that can occur alongside the legal prohibition. Customers should obtain written instructions for withdrawing or transferring funds and check whether the receiving institution will accept the payment and the customer’s country and counterparties.

If the customer is not a sanctioned person

Being an innocent customer does not by itself override a prohibition. A transaction can still be stopped because it passes through a blocked bank, involves blocked property or lacks required information. Documentation showing that the customer, goods and purpose are outside the prohibition can help the bank decide whether to reject, release or seek authorization, but it does not guarantee approval.

Can a sanctioned bank still use U.S. dollars?

There is no single answer. A CAPTA restriction specifically removes the covered U.S. correspondent and payable-through relationships and bars covered transaction processing. A blocking designation prevents U.S. persons from dealing with the bank or its blocked property. In either case, ordinary access to dollar clearing through the United States is effectively unavailable unless an exemption, general license or specific OFAC authorization applies.

A payment denominated in dollars but routed entirely outside U.S. jurisdiction is not automatically lawful. Banks must analyze the parties, payment path, sanctions program and any U.S. nexus. Foreign banks commonly decline high-risk dollar transactions even where a narrow legal argument might exist, because processing can expose them to enforcement, correspondent loss and reputational damage.

General licenses and other exceptions

General licenses authorize defined categories of activity without an individual application. OFAC’s CAPTA FAQ gives examples that can include agricultural commodities and equipment, medicine and medical devices, certain aviation payments, nongovernmental-organization activity and civil nuclear transactions. The exact authorization, dates, reporting duties and conditions vary by sanctions program.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

A general license is not a blanket permission to transact with a sanctioned bank. It may cover only specified goods, services, parties, payment channels or wind-down activities. Banks must verify that every condition is met.

Why banks choose to exit customers before a formal ban

Sanctions compliance is risk-based. A bank may restrict or close an account when it cannot reliably identify the beneficial owner, understand the source and destination of funds, screen associated parties or explain unusual payment-field changes. It may also exit a relationship because a U.S. correspondent requires it to do so, even before Treasury imposes a formal prohibition.

These precautions reflect the same risks highlighted by OFAC: opaque payment structures, manipulated messages, hidden counterparties and transactions supporting a military-industrial network. A customer can reduce avoidable delays by providing complete ownership information, accurate invoice descriptions, consistent payment references and prompt responses to compliance questions.

Penalties for violations

OFAC states that violations of the Iranian Financial Sanctions Regulations may carry a civil penalty of up to the greater of $250,000 or twice the transaction value. Willful criminal violations may carry a fine of up to $1 million and as much as 20 years in prison. The applicable penalty depends on the law, the conduct, the person or institution involved and the facts of the case.

Penalties can affect more than the bank that made the payment. Employees, managers, counterparties and service providers may face investigations, account termination, loss of correspondent access or separate enforcement under other laws.

How a bank can seek removal

Delisting is not automatic when a bank changes ownership or stops one transaction. The institution must address the legal basis for the designation or restriction. A submission to OFAC should explain the relevant authority, describe remedial actions, provide ownership and control records, identify changed business practices and include supporting documents.

Useful evidence can include termination of high-risk relationships, stronger screening and transaction-monitoring controls, independent testing, staff training, corrected payment data and proof that sanctioned owners no longer hold the interest that triggered blocking. OFAC evaluates the record under the applicable program; there is no universal timetable or guarantee of removal.

If Treasury removes the bank from a list or amends the directive, banks still need to verify the effective date and any remaining restrictions. A delisting from one list does not erase a separate designation or the 50-percent ownership rule.

A practical checklist before sending or receiving funds

  • Check the bank’s current OFAC entries, including the SDN and CAPTA Lists where relevant.
  • Review the applicable directive, regulation, general licenses and effective date.
  • Screen the bank’s direct and indirect owners against blocking lists.
  • Identify every correspondent, intermediary, beneficiary and ordering customer.
  • Confirm whether goods, services, securities or payments fall within a licensed category.
  • Keep invoices, contracts, ownership records and payment messages that explain the transaction.
  • Ask the bank whether it will accept the route before initiating a time-sensitive transfer.
  • If funds are blocked, request the bank’s sanctions contact and pursue authorization through the documented OFAC process rather than attempting repeated transfers.

Sanctions change frequently. The controlling answer is always the current OFAC list entry and legal instrument for the particular bank, transaction and date—not the shorthand label “blacklisted.”
