What to Do When a Solar Installation Is Delayed by Equipment Shortages

If your solar installer says panels, an inverter, a battery, racking, or another component is backordered, do not rely on verbal assurances. Ask for the exact bottleneck, supplier status, a dated recovery schedule, and a written explanation of how any substitute would affect system output, price, warranties, financing, permits, utility approval, and tax treatment. Then compare that plan with your signed contract before paying more or accepting a change.

Keep a dated file containing the contract, invoices, delivery notices, permit records, inspection results, utility correspondence, and every promise made by the installer. Equipment shortages can be genuine—the U.S. Department of Energy has warned that trade and supply-chain frictions created an acute shortage of photovoltaic equipment that could slow installations and cause project delays or cancellations—but a shortage does not erase your contractual rights.

1. Get the shortage and recovery plan in writing

Send the installer a written request rather than relying on a phone call. Ask for answers to each of these questions:

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.
  • Which component is unavailable: a specific panel model, inverter, battery, racking part, transformer, or another item?
  • What is the manufacturer or distributor order status, order date, and latest estimated delivery date?
  • Has the installer physically reserved the equipment, or is the date only a supplier estimate?
  • What installation milestone was missed, and what are the new dates for delivery, construction, inspection, interconnection, and permission to operate?
  • Could another component be installed first, or would the missing item prevent a code-compliant system?
  • Is the installer proposing a substitute? If so, provide the exact make, model, ratings, quantity, and data sheets.

Require the company to identify what it can control and what it cannot. A supplier delay may explain why a delivery date moved, but it does not by itself prove that every later milestone must move. Ask for a schedule showing procurement, site work, permit amendments, inspection, utility approval, and final activation as separate dates.

Why a firm date matters

There is no authoritative nationwide average delay length or standard refund amount. Solar delays vary by component, supplier, permitting authority, utility, weather, and local labor. A credible plan therefore includes project-specific dates and dependencies, not a promise to “keep you posted.” Ask the installer to update the schedule whenever a supplier date changes.

2. Read the signed contract before agreeing to anything

The contract controls more than the equipment list. Locate the sections covering milestones, payment, substitutions, force majeure or supply shortages, change orders, cancellation, termination fees, warranties, dispute notices, and responsibility for permits and utility work. Save the version you signed, including attachments, system drawings, proposal pages, financing documents, and electronic disclosures.

Federal Trade Commission consumer guidance says written solar terms should identify system size, total cost, warranties, production promises, repairs, fees, and termination provisions. Check whether your agreement also specifies who submits permits, schedules inspections, files the interconnection application, responds to utility requests, and obtains permission to operate.

Milestones and delay clauses

Some contracts promise installation by a calendar date; others use an estimated window or make the date contingent on permits, utility approval, or equipment availability. Note every defined deadline and any extension language. A force-majeure clause may excuse a particular delay, but its wording, notice requirements, and limits vary. It may not authorize an indefinite delay, a higher price, or equipment that differs from the approved design.

Payment and cancellation terms

Follow the payment schedule in the contract and do not make an unlisted progress payment merely because the installer says equipment is scarce. Check whether a deposit becomes nonrefundable after ordering equipment, and whether the agreement allows cancellation after a missed milestone, a specified number of days, or a material equipment change. Before stopping payment, asserting breach, or hiring another installer, obtain local legal advice; doing so unilaterally can trigger default claims or financing problems.

3. Evaluate a substitute component without losing the system you bought

Never approve a substitute by text message alone. Request a revised equipment schedule and written answers confirming whether the replacement preserves:

  • DC array size, inverter capacity, battery usable capacity, and the system’s expected design output;
  • electrical ratings, rapid-shutdown features, grounding, fire setbacks, structural loading, and other code requirements;
  • manufacturer equipment warranties and the installer’s workmanship warranty;
  • loan, lease, power-purchase, or other financing terms, including any production guarantee;
  • the approved permit drawings and inspection requirements;
  • utility interconnection approval, export limits, meter specifications, and permission-to-operate conditions; and
  • the total price, taxes, credits, and any redesign or reinspection charges.

Ask who pays if the substitute requires an engineering revision, permit amendment, new inspection, additional labor, or a utility resubmission. Get the answer in the change order before work starts. A lower-wattage panel, different inverter firmware, or battery with a different operating mode can alter production, backup behavior, and utility acceptance even when the brand appears similar.

Use a side-by-side decision record

Question Original contract Proposed substitute or revised plan What to require
Delivery Contract milestone and promised date Firm date, not only a supplier estimate Written schedule and update obligation
Design and output Panel, inverter, battery ratings and system size Exact make, model, quantity and ratings Engineer or installer confirmation of equivalent design capacity
Price and financing Contract total and payment milestones Any increase, credit, or changed financing term Signed change order with no hidden fees
Warranties Manufacturer and workmanship coverage Term, exclusions and warranty administrator Warranty documents attached to the change order
Permits and utility Approved drawings and interconnection status Amendment, resubmission or new approval needed? Party responsible and all added costs in writing
Tax timing Installation or placed-in-service date Likely completion date after the delay Tax professional’s advice based on records
Exit rights Cancellation, refund and termination-fee clauses Effect of a missed milestone or material change Written explanation of your options under the contract

4. Protect your money and document what the installer already bought

Ask for an accounting of your deposit: amount received, invoices paid to suppliers, equipment held for your project, and amounts still uncommitted. Request receipts or purchase confirmations where the contract says equipment was ordered. Do not send extra money to “lock in” scarce equipment unless a signed amendment states the amount, purpose, ownership, refund treatment, and delivery obligation.

  • [Dont Hesite to Order] 24 hours customer services and professional technology team are standing by

Keep copies of cancelled checks, card statements, financing draw requests, invoices, and receipts. If equipment has been delivered, photograph serial numbers and storage condition without taking possession if the contract says the installer owns it. Ask who bears theft, damage, storage, and insurance risk while the project waits.

5. Track permits, inspections, interconnection, and permission to operate separately

Equipment delivery is only one workstream. A permit, utility queue, inspection, or meter requirement can create an independent delay even after all hardware arrives. Request the following identifiers and dates:

  • building or electrical permit number, submission date, approval date, expiration date, and any correction notice;
  • inspection appointments, failed-inspection items, reinspection date, and the authority responsible for scheduling;
  • utility interconnection application number, submission and acceptance dates, requests for more information, study or upgrade requirements, and current queue status;
  • meter or service-upgrade requirements, including who pays and who schedules the work; and
  • the conditions for permission to operate and the date the installer expects to satisfy them.

Ask the installer to state in writing whether a substitute requires revised drawings, a new permit, a new utility review, or another inspection. Do not turn on or export power before the utility grants permission to operate; unauthorized energization can create safety, warranty, and interconnection problems.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

6. Send a written cure notice if the schedule is not credible

If the installer will not provide a plan or has missed a contractual milestone, send a concise notice using the delivery method required by the contract (for example, certified mail or a designated email address). Include:

  1. the project address, contract date, and the missed milestone;
  2. the unavailable component and the information you requested;
  3. the response deadline, set to a reasonable period under the contract and local law;
  4. the remedy you seek: a firm compliant installation date, an approved substitute, a price adjustment, or cancellation and refund if the contract permits it; and
  5. a statement that you reserve rights without waiving any contractual or legal remedy.

Attach the relevant contract page, prior messages, and a dated list of payments. Keep proof of delivery. A cure notice creates a clear record of what the installer needed to do and when, which can matter in a later complaint, mediation, or legal dispute.

7. Understand the federal tax-credit deadline and your evidence

The Internal Revenue Service states that the Residential Clean Energy Credit is 30% of qualified costs for eligible property installed from 2022 through December 31, 2025, and is unavailable for property placed in service after December 31, 2025. IRS FAQ guidance treats an expenditure as made when original installation is completed. Under that rule, finishing after December 31, 2025 prevents claiming the section 25D credit for that installation; paying a deposit, signing a contract, or receiving a panel is not the same as completing installation.

Because tax treatment is fact-specific and can change, do not assume a delayed project qualifies or fails solely from the payment date. Preserve the signed contract, itemized invoices, equipment identifiers, inspection approval, installation-completion or placed-in-service record, utility permission to operate, and the documentation needed for Form 5695. Ask a qualified tax professional to evaluate your particular property, completion date, ownership structure, and any amended equipment.

Questions to ask about a delayed completion

  • What exact date does the installer consider the original installation complete?
  • Was the system operational and accepted, or were substantial components still missing?
  • Does a replacement component change the qualified property or the cost basis?
  • Which records support the completion or placed-in-service date?

8. Escalate when the installer will not cure the delay

Start by asking for a supervisor or contract administrator and propose a written settlement: a firm date, compliant substitute, price adjustment, or contract termination. If that fails, check the contractor’s state license and complaint history. Depending on your location and contract, potential channels include the state contractor licensing board, attorney general or consumer-protection office, utility consumer-affairs office, local building department, an industry ombudsman, or mediation and arbitration named in the agreement.

Give each agency a focused packet: contract, change orders, payment ledger, chronology, delivery evidence, permit and utility records, cure notice, and the installer’s response. Agencies may investigate licensing or deceptive conduct but may not order every remedy available in court. Consult a local attorney before declaring a breach, withholding a scheduled payment, signing a release, or contracting with a second installer. A replacement installer may need to inspect unfinished work, obtain new permits, resolve warranty responsibility, and coordinate with the original financier.

9. A practical recordkeeping system

Create one project folder—digital and, if possible, paper—with these subfolders:

  • Contract: signed agreement, proposal, design drawings, financing documents and cancellation terms.
  • Equipment: approved and proposed models, data sheets, serial numbers, supplier notices and storage photos.
  • Money: deposits, invoices, receipts, payment schedule, credits and refund requests.
  • Permits: applications, approvals, correction notices, inspection reports and expiration dates.
  • Utility: interconnection number, correspondence, studies, meter work and permission-to-operate notice.
  • Communications: dated emails, call notes, text exports, cure notices and delivery confirmations.

After every call, write the date, participants, exact promises, next action, and deadline. Send a short confirmation email asking the installer to correct any misunderstanding. This record helps you distinguish a supplier delay from an installer failure, prove what was promised, and preserve tax and warranty evidence.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

10. When accepting the delay is reasonable—and when it is not

Accept a revised plan only when all of these are true

  • The missing component and supplier status are identified.
  • The new schedule has dated milestones through permission to operate.
  • Any substitute is documented as design-, code-, warranty-, financing-, permit- and utility-compliant.
  • The price, payment timing and responsibility for redesign or reinspection are unchanged or clearly amended.
  • The contract’s tax-date consequences have been reviewed with a tax professional.

Consider cancellation or escalation when warning signs persist

  • The installer refuses to identify the component or provide order evidence.
  • Dates repeatedly move without a written explanation or cure plan.
  • You are asked for unlisted payments or pressured to approve an undocumented substitute.
  • The proposed equipment reduces capacity, changes warranties or financing, or lacks permit or utility acceptance.
  • Your contract’s cancellation or termination conditions have been met and the installer will not honor them.

The DOE’s warning about supply-chain shortages explains why a project may be delayed, but it does not determine your remedy. Your signed terms, the documented facts, and the law where the property is located determine whether you receive a revised installation, a price adjustment, a refund, or another remedy.
