Under section 29(3) of the Central Goods and Services Tax Act, tax, interest, penalties, other dues and outstanding compliance obligations can still be determined and recovered after cancellation. If a notice arrives, download it and its annexures, identify the legal section and tax periods, check the stated deadline, reconcile your records, and submit a point-by-point reply through the GST Portal. If a final demand order has already been issued, the ordinary appeal period is three months from communication, subject to a possible one-month condonation and a statutory pre-deposit.
Why a GST notice can arrive after cancellation
GST registration cancellation ends the registration prospectively or from the effective date stated in the order; it does not provide immunity for transactions, returns or tax periods before that date. Section 29(3) expressly preserves liability for prior periods, whether the tax and other dues were determined before or after cancellation. The provision covers both payment of tax and discharge of obligations under the GST Act and rules.

This means an officer may examine returns filed before closure, periods for which returns were never filed, input tax credit claimed or used, refunds, outward supplies reported by customers, e-way-bill data, or discrepancies found during departmental verification. A notice is not automatically proof that the department is correct, but ignoring it can remove your opportunity to explain the figures before an order is passed.
The notice may relate to cancellation itself, missing returns, tax that was allegedly not paid or was short paid, an erroneous refund, or wrongly availed or utilised input tax credit. The applicable section, tax period, state jurisdiction and communication date determine what you must do.

First response: secure the notice and deadline
Do not rely only on an SMS, email or a message from a former employee. Sign in to the GST Portal using the taxpayer credentials and retrieve the complete notice, annexures, order history and any demand summary. Save the files in their original form and record the date and time on which the notice was communicated, the reply due date, the GSTIN, the issuing officer and the relevant tax periods.
- Open the notice in the relevant dashboard. Check whether it is a show-cause notice, a return-defaulter communication, a tax or input-tax-credit proceeding, or an order confirming a demand.
- Read the legal section and form number. A cancellation proceeding commonly uses REG-17 for the show-cause notice, REG-18 for the taxpayer’s reply and REG-19 for the cancellation order. Other proceedings use different portal workflows.
- Download every attachment. The allegation may be explained in an annexure, computation sheet, DRC summary or officer’s comparison of returns and third-party data.
- Calendar the deadline immediately. Portal availability does not extend a statutory or notice-specific deadline. If access credentials, a deceased proprietor’s documents or a closed bank account are creating problems, arrange access and professional help at once.
Identify which kind of proceeding you have
The correct response depends on whether the department is asking why registration should be cancelled, seeking missing compliance, proposing a tax demand, or communicating a final order. Use the section and wording in the notice rather than assuming every post-closure communication is a demand.
| Proceeding | What it usually addresses | Immediate route | What determines the next step |
|---|---|---|---|
| Cancellation show-cause notice (often REG-17) | Reasons registration should be cancelled, such as non-compliance or ineligibility | Reply in the cancellation workflow using the deadline shown in the notice | Whether the officer accepts the explanation, drops the proceeding or issues REG-19 |
| Non-filing or return-compliance notice | Unfiled GSTR-1, GSTR-3B, annual returns or other periods | File the outstanding returns where permitted and explain any period that was not applicable | Return status, late fees, interest, tax payable and evidence of non-liability |
| Section 73 tax or ITC proceeding | Tax not paid or short paid, erroneous refund, or wrongly availed or utilised input tax credit for reasons other than fraud or wilful misstatement | Submit a factual, document-backed reply to the notice and attend any required hearing | Reconciliation of the officer’s computation with books, invoices, returns and payments |
| Final demand order | An order confirming tax, interest or penalty after the reply stage | Pay according to the order or file an appeal in FORM GST APL-01 | Communication date, disputed amount, pre-deposit and whether a condonation request is needed |
Section 73 is generally used where the department alleges non-fraudulent short payment, non-payment, erroneous refund or ineligible input tax credit. If the notice alleges fraud, wilful misstatement or suppression, the legal provision and exposure may be different; obtain advice before filing a casual explanation.

Check the cancellation and filing history
Use the GST Portal’s taxpayer search and account history to verify the effective registration status, cancellation date, stated reason for cancellation and return-filing details. Compare those dates with the notice. A cancellation application date is not necessarily the effective cancellation date, and an order may state a retrospective date.
- Download the cancellation application, officer queries and cancellation order.
- Record the effective date, the date the order was issued and the date it was communicated.
- List every return period from registration through the effective cancellation date.
- Mark each period as filed, filed late, amended, unpaid, or apparently missing on the portal.
- Check whether the notice’s GSTIN, state code, tax period and legal name match your records.
If the portal history conflicts with your downloaded acknowledgements, preserve the ARN, filing timestamp and payment challan. Those records can show that a return was filed even if the dashboard later displays an error.
File the final return, GSTR-10, when it applies
GSTR-10 is the GST final return. The GST Portal’s welcome guidance states that it is due “within three months of the date of cancellation or date of cancellation order, whichever is later.” The same guidance says filing is mandatory even if the taxpayer has not done any business.

On the portal, the path is Services > Returns > Final Return. Complete the form for the cancelled GSTIN, disclose the required closing stock and tax details, pay any amount shown as payable, and retain the ARN and filed copy. After filing, the final return becomes available to tax officials. GSTR-10 does not replace a reply to a separate notice: if a notice alleges a different liability or asks for documents, answer that proceeding independently.

If the final-return tile is unavailable, the cancellation date is disputed, or the filing period has lapsed, capture screenshots and raise a portal ticket while seeking advice. Do not claim that no sales means no filing obligation; the portal guidance expressly treats filing as mandatory even for a business with no business activity.
Build the evidence file before drafting the reply
A persuasive response connects each allegation to a number, document and legal explanation. Assemble an indexed PDF folder or equivalent set of clearly named files.
- Cancellation application, clarification replies, REG-17 notice, REG-18 reply and REG-19 order, if issued.
- Proof of closure, such as lease surrender, dissolution documents, board or partner resolutions, licence cancellation and final bank statements.
- Sales and purchase registers, tax invoices, credit notes, debit notes and stock records for every period mentioned.
- Filed GSTR-1, GSTR-3B, annual returns, GSTR-2B or other reconciliation data used to support input-tax-credit figures.
- Bank statements, electronic cash and credit ledgers, payment challans and refund records.
- E-way bills, shipping or delivery evidence and customer confirmations where outward-supply figures are disputed.
- Correspondence with the department, portal tickets, acknowledgement receipts and proof of service.
Prepare a period-by-period reconciliation showing the officer’s figure, your books, the relevant return, tax already paid and the difference. Explain each difference separately instead of submitting an unstructured document dump.

- Use the specified workflow. Open the notice in the GST Portal and select the reply option associated with that proceeding. A letter emailed to an officer may not count as a portal reply.
- Start with jurisdiction and chronology. State the GSTIN, business name, cancellation effective date, periods concerned and the date you received the notice.
- Answer every allegation in the same order as the notice. Quote the allegation briefly, state whether you accept or dispute it, and provide the calculation and evidence.
- Separate admitted amounts from disputed amounts. If a small amount is payable, identify it and explain payment; do not concede unrelated allegations by silence.
- Explain missing records honestly. State what was destroyed, unavailable or held by an accountant, and attach replacement evidence such as bank statements or customer confirmations.
- Request a personal hearing when the facts or computation are disputed. Keep the request specific and identify the points that require oral clarification.
- Upload an index and readable files. Use consistent filenames, number each annexure and cross-reference it in the reply.
- Submit and preserve proof. Save the ARN, acknowledgement, final submitted PDF and every uploaded attachment. Do not assume a draft saved in the portal was filed.
For a cancellation notice, follow the exact response form and deadline stated in the communication. The registration rules describe the REG-17 and REG-18 process, but the portal’s current form and proceeding-specific instructions control the practical submission.

If a demand order has already been issued
A reply to a show-cause notice and an appeal against a final order are different remedies. Once a demand order is communicated, immediately record that communication date and calculate the appeal deadline. The GST Portal FAQ states that an appeal is filed within three months from communication of the order. The appellate authority may condone a delay of up to one additional month when sufficient cause is shown.
The ordinary appeal is filed in FORM GST APL-01. The FAQ also states that a minimum pre-deposit of 10% of the disputed tax is required before the appeal is entertained. This is a cash-flow issue as well as a legal one: calculate the disputed tax precisely, distinguish tax from interest and penalty, and retain proof of the pre-deposit.
- Obtain the signed order, relied-upon documents and demand summary.
- Identify each disputed issue and the exact tax, interest and penalty amounts.
- Check the communication date, not merely the date printed on the order.
- Calculate the 10% disputed-tax pre-deposit and confirm any additional amount required for recovery protection under the applicable rules.
- Prepare FORM GST APL-01 with grounds of appeal, statement of facts and supporting documents.
- If outside three months, include a specific condonation request explaining the delay and attach proof.
Do not wait for recovery notices before considering an appeal. The three-month period and pre-deposit requirement can make an otherwise arguable case difficult to pursue if ignored.
Common mistakes and how to avoid them
Assuming cancellation ends every obligation
Section 29(3) preserves prior-period liabilities. Treat the cancellation date as the boundary for new registration activity, not as a release from earlier compliance.
Best Value
Ignoring a notice because the business had no sales
No sales may support a factual defence, but it does not automatically cancel return or GSTR-10 obligations. File the required return and provide books, bank statements and other evidence supporting zero activity.
Replying without checking the tax period
A notice can combine several months or compare a pre-cancellation period with a later amendment. Reconcile each period separately and point out periods outside the GSTIN’s registration or effective date.
Uploading documents without a map
Unindexed files make it harder for the officer to verify your position. Use an annexure list and cross-references, and keep the submitted package exactly as filed.
Do these 3 things before closing this tab:
1Repair Windows errors before they cause bigger problems2Scan for outdated or missing drivers - takes under a minute3Clear out junk files and repair common Windows errorsMissing the appeal date
The appeal clock runs from communication of the order. Set reminders for the three-month deadline as soon as the order is downloaded; a condonation request is limited and not automatic.
When professional help is justified
Consult a GST practitioner or chartered accountant when records are incomplete, the amount is material, input tax credit is disputed, the notice alleges fraud or suppression, several GSTINs or states are involved, or a demand order requires an appeal. A professional can reconcile books to returns, identify whether section 73 or another provision applies, prepare the pre-deposit calculation and monitor portal acknowledgements. The GST Portal’s final-return workflow also includes optional particulars for a certifying Chartered Accountant or Cost Accountant.
Even with professional assistance, the former owner or authorised signatory should personally verify the chronology, figures and documents. The notice’s section, issue date, communication date, tax period, state jurisdiction and any amendments in force control the outcome; general guidance cannot determine liability in an individual case.
Quick Recap
A practical timeline
| When | Action |
|---|---|
| Day of receipt | Download the notice and annexures, record service details, identify the deadline and secure portal access. |
| Next 1–3 days | Classify the proceeding, verify cancellation and return history, and list missing periods and documents. |
| Before drafting | Complete or arrange GSTR-10 where applicable, reconcile books with returns and prepare an indexed evidence file. |
| Before the notice deadline | Submit the point-by-point portal reply, request a hearing if needed, and save the ARN and acknowledgement. |
| On an order | Calculate the three-month appeal period from communication, assess the 10% disputed-tax pre-deposit and obtain advice on FORM GST APL-01. |
