If you can’t pay your restaurant bill, tell the server or manager promptly and ask to discuss a realistic way to settle it. Don’t leave without paying or without clearly explaining the situation and agreeing on next steps. Whether a restaurant must accept a payment method, and what legal consequences may follow, depends on where you are and what happened.
What to do before you leave
- Tell the server or manager promptly. Explain plainly that you cannot pay the full amount now. If you would rather not discuss your finances in front of others, ask to speak privately.
- Ask whether the restaurant will agree to a specific arrangement. You might propose paying part now and the balance by a date you can meet, or ask whether the manager authorizes payment later or another method. The restaurant is not necessarily required to accept any of these proposals.
- Record the agreement. If the manager agrees, write down the amount due, deadline, accepted payment method, and the manager’s name. Ask for a receipt or confirmation by text or email. Be honest about when you can pay; don’t promise a date you cannot meet.
- Make your intentions and contact details clear before leaving. If no arrangement is accepted, keep communicating with the manager and ask what they expect you to do next. Simply disappearing can make the situation worse.
Prompt, direct communication is also a sensible way to approach other unpaid bills. The Consumer Financial Protection Bureau’s advice for a credit-card bill suggests telling the creditor what you can afford and what arrangement you are requesting. That guidance is about credit cards, not restaurant bills, and does not require a restaurant to agree.

If you have money but the restaurant refuses your payment method
Ask which payment methods the restaurant accepts and whether the manager can authorize another option. Don’t assume that “legal tender” means every private restaurant has to accept cash.
United States
The Federal Reserve says: “Private businesses are free to develop their own policies on whether to accept cash unless there is a state law that says otherwise.” There is no general federal requirement that every private business accept cash, but state or local law may affect the answer. Check the rules for your location rather than treating this as a nationwide rule. See the Federal Reserve’s explanation of cash acceptance.

Could leaving without paying be a crime?
There is no universal answer: the relevant law and facts depend on the jurisdiction. In England and Wales, Ask the Police describes “making off without payment” as an offence when someone knows payment for goods or services is due then, dishonestly leaves without paying as required or expected, and intends to avoid the amount. Its example is someone who intentionally eats a meal and leaves without paying. The explanation is specific to England and Wales; it does not establish that a diner who promptly discloses a genuine inability to pay automatically commits an offence. Read Ask the Police’s explanation.
Do not assume that a general invoicing rule gives restaurant diners extra time. GOV.UK says that where no payment date has been agreed, a customer must pay within 30 days of receiving an invoice, but that guidance concerns business invoicing. It is not a rule that restaurant diners automatically get 30 days to pay: GOV.UK’s commercial-debt guidance.

If you are contacted about the bill later
- Keep the bill, receipt, messages, and any written payment agreement.
- Verify who is contacting you and check that the amount claimed matches what you owe.
- If the amount is wrong or you do not recognize the debt, dispute it through the process that applies where you live.
- If the amount is correct, discuss a realistic payment amount and schedule, and keep any new agreement in writing.
For applicable US debt-collection situations, the CFPB explains how to request information from a collector and dispute a debt. This is general US collection guidance, not a special rule for restaurant balances; which protections apply depends on the collector and circumstances.
