If police stop you at a peaceful protest in India, stay calm, do not physically resist, and ask whether you are free to leave or under arrest. Ask where you are being taken, the grounds for any arrest, and for a lawyer and a trusted-person notification. If you are formally arrested, the Bharatiya Nagarik Suraksha Sanhita, 2023 (BNSS) and Article 22 of the Constitution provide safeguards including an arrest memo, information about the grounds of arrest, access to an advocate during interrogation, notification of a nominated person, medical care and prompt production before a magistrate.
This is general information, not individual legal advice. Police powers and procedure can differ by state, alleged offence and special legislation. Contact a local criminal lawyer or the relevant State or District Legal Services Authority as soon as possible.

Do these things first
- Ask what is happening. Say, “Am I free to leave, or am I under arrest?” A brief police stop, a claimed detention and a formal arrest do not necessarily trigger identical procedures. The term “detention” is not defined as a single general procedure in the BNSS. Ask which police station or authority is taking you.
- Ask for the grounds. If police say you are arrested, ask which offence or legal grounds are being relied on. Do not argue the facts at the roadside; listen and remember the exact words used.
- Request a lawyer and a trusted-person notification. Give the name and contact details of a relative, friend or other trusted person and ask police to inform them where you are held. Ask to contact a lawyer. BNSS sections 36–38, 47 and 48 address these safeguards. The Supreme Court’s directions reproduced by the Ministry of Home Affairs say an arrested person must be made aware of the right to have someone informed “as soon as he is put under arrest or is detained.” Read the MHA-hosted D.K. Basu directions.
- Keep a factual record if it is safe. Note the time and place of the stop, the route and police station, officers’ names or identification numbers, witnesses, case or FIR details, and anything taken from you. If your phone is seized or inaccessible, tell your lawyer or trusted contact what was on it and when you lost access.
- Report health needs immediately. Tell officers about injuries, illness, medication, pregnancy, disability or other urgent needs. Ask for medical attention and for injuries to be recorded. BNSS section 56 requires reasonable care for an arrested person’s health and safety.
- Do not sign blindly. Read every document. Do not sign a blank, incomplete or inaccurate statement. Ask for a copy and ask your lawyer to explain anything you do not understand.
Do not delete messages, alter files, hide items or coordinate a false account with other protesters. Preserve the original facts and let counsel advise you.
Know whether this is a stop, detention or formal arrest
People often use “detained” for any period when police prevent them from leaving. Legally, however, the practical consequences depend on what police have done and whether there is a formal arrest. The Indian Express explainer dated October 7, 2026 notes that the BNSS does not create one all-purpose definition of detention. Ask police to state your status and record their answer.

| Situation | What you should clarify | Why it matters |
|---|---|---|
| Police stop or questioning at the protest site | Whether you are free to leave; officers’ names; destination if moved | A short stop and a formal arrest are not governed by exactly the same paperwork and time limits. |
| Police say you are being detained or taken for inquiry | The legal basis, destination and whether you may contact a trusted person or lawyer | Use the time to create an accurate record and obtain legal help; do not assume “detention” means there is no arrest. |
| Formal arrest | Grounds of arrest, arrest memo, nominated-person notification and access to counsel | BNSS arrest safeguards and constitutional protections apply. The 24-hour production rule becomes relevant. |
| Preventive detention or a special security law is mentioned | The exact statute, written order and review or challenge procedure | Different rules may apply. Obtain local advice immediately rather than relying on the ordinary BNSS pathway. |
Peaceful conduct does not create automatic immunity from arrest. Lawfulness depends on the facts, the alleged offence and any applicable special law.
Safeguards after a formal arrest
Grounds and arrest documentation
India Code’s official BNSS text sets out the principal safeguards. Section 35 concerns police arrest powers and, in covered situations where arrest is not required, a notice to appear. Section 36 requires an arresting officer to carry clear identification and prepare an arrest memo attested by a witness and countersigned by the arrested person. It also addresses informing a person of the right to have someone nominated notified, unless a family member attests the memo. Sections 47 and 48 concern information about the grounds of arrest and notice to a nominated person. Read the official BNSS text on India Code.

Ask when the arrest was recorded, who attested the memo and where your copy is. If details are wrong, point that out and ask counsel how to record the objection; never invent a correction yourself.

BNSS section 38 states: “When any person is arrested and interrogated by the police, he shall be entitled to meet an advocate of his choice during interrogation, though not throughout interrogation.” This gives a right to meet counsel during interrogation, not a promise that the lawyer will sit beside you for every question. Tell officers clearly that you want to meet your chosen advocate, and repeat the request to the station officer if necessary.

Notification of a relative or another trusted person
Give one reliable contact, with a number that works. Ask officers to record that request and the time they made the notification. If a family member is already present and can attest the arrest memo, ask your lawyer to explain how that affects the separate notification requirement. The D.K. Basu directions also require custody records and prompt communication of the arrest and place of custody.
Medical examination and safety
Tell police about every injury, even one that seems minor, and ask that it be entered in the medical record. Mention medication schedules, allergies, mental-health needs and accessibility requirements. Request a copy or other proof of the examination where available. If your condition worsens, repeat the request immediately and tell your trusted contact and lawyer.

Production before a magistrate and the 24-hour limit
BNSS sections 57 and 58 require an arrested person to be taken before the appropriate magistrate or officer without unnecessary delay. The statute restricts detention beyond 24 hours without further lawful authority; section 187 governs further detention authorised through the legal process. Article 22 of the Constitution similarly protects the right to be informed of the grounds of arrest, to consult and be defended by a legal practitioner, and to be produced before a magistrate within 24 hours, subject to constitutional exceptions.

The 24-hour figure is not an automatic release guarantee. A magistrate may authorise further detention under law. Ask counsel to calculate the time from the recorded arrest, check for delays in production and inspect any remand order.

What to do at the police station
- Repeat your basic requests calmly: “Please tell me whether I am under arrest, the grounds, the station record, and the time of arrest. I want to contact my lawyer and [name of trusted person].”
- Identify property taken. Ask officers to list your phone, identity documents, medication, cash and other belongings. Do not unlock a device, provide a password or hand over additional material without legal advice if you are unsure of your obligations.
- Read statements and forms. Ask for an interpreter or explanation if you do not understand the language. Do not sign a blank page or a document that omits your objection to an inaccurate detail.
- Keep answers factual. You may tell police that you want your lawyer before answering questions that could expose you to criminal liability. Do not guess, speculate or adopt someone else’s account.
- Track time. Record arrival, questioning, medical examination, transfers and production before the magistrate. Give the timeline to counsel.
Finding legal help quickly
Choose help based on what is available now, criminal-procedure and local-state experience, ability to attend the police station and court, cost or legal-aid eligibility, and whether the lawyer can communicate with family and verify custody and remand records.
| Route | When it helps | What to ask |
|---|---|---|
| Local criminal lawyer of your choice | When a trusted lawyer can reach the station or magistrate quickly | Can you attend now? Have you handled the relevant state procedure and alleged offence? Can you obtain the arrest memo and remand papers? |
| State or District Legal Services Authority | If you cannot afford private representation or need an official legal-aid route | Am I eligible? How can a lawyer be assigned for police custody and first production? What local contact should my family use? |
| Trusted person or family member | To locate the station, preserve documents, arrange medicines and contact counsel | Who will keep the timeline, receipts and copies, and who will attend court with the lawyer? |
Official police guidance states that free legal aid is available in police custody and at first production or remand. A family member should contact the relevant State or District Legal Services Authority and seek local counsel. A nationwide protest-specific phone number or universal detainee-locating procedure has not been established; do not rely on an unverified helpline.
At the first magistrate production
Tell your lawyer privately about the time and place of arrest, any force used, injuries, medication denied, documents you were asked to sign, property taken and whether a trusted person was notified. Ask counsel to check:
The Tool Desk
Outbyte Driver Updater FREEFix the driver behind crashes, sound loss and screen glitchesFind Drivers →Outbyte PC Repair FREEClear out junk files and repair common Windows errorsFree Scan →- the arrest time and arrest memo;
- the stated grounds and sections of law;
- whether the 24-hour production requirement was met;
- any medical examination and injury record;
- the proposed police or judicial remand period; and
- conditions for release or further communication with family.
If a safeguard was skipped or a record is inaccurate, tell the magistrate through counsel and ask that the concern be recorded. Preserve copies of orders and receipts; do not post an unverified account online while proceedings are active.
Situations requiring extra local advice
The general BNSS pathway may not answer every case. Children, women, people with disabilities, people who need an interpreter, and anyone held under preventive-detention or special security legislation may have additional protections or different procedures. The material available here does not provide a complete state-by-state legal-aid directory or a universal protest-arrest protocol. Treat those variations as a reason to obtain prompt local legal review, not as proof that no additional safeguard exists.
