If you suspect someone accessed your IRS records, first secure your IRS online account, save the evidence, and identify what happened: a compromised login, a fraudulent tax return, an unfamiliar transcript entry, or suspected snooping by an IRS employee or contractor require different routes. Don’t assume an unfamiliar notice proves that your records were accessed, and don’t file Form 14039 automatically; the IRS limits that form to specified tax-related identity-theft situations.
First, identify the kind of access you suspect
“Someone accessed my tax records” can describe several different problems. A suspicious message or unfamiliar notice alone does not establish that anyone entered your account or viewed your records; the IRS says some identity-theft warning signs may have other explanations. Review the IRS identity theft guide and match the facts to the appropriate route.

- Possible IRS online-account compromise: someone may have signed in or changed account details.
- Tax-related identity theft: someone may have used your identifying information to file a return or otherwise affect your tax account.
- Suspected IRS employee or contractor access: you believe an IRS worker improperly inspected records. This is an allegation of unauthorized access, commonly called UNAX.
- Unfamiliar transcript information: a transcript contains entries you do not recognize, but the cause is not yet clear.
Secure your account and preserve evidence
- Stop engaging with a suspected impersonator. Do not click links in suspicious messages, send money, or provide more personal or financial information. If you clicked a suspicious link or opened an attachment, the IRS guide advises running antivirus software.
- Change your IRS online-account password. Use a complex, unique password, then review account details for changes or activity you do not recognize. Follow instructions in a genuine IRS letter or notice. Reach the IRS through contact details independently verified on IRS.gov or on an authentic notice, not a number or link supplied in an unsolicited message.
- Keep a record of what happened. Save letters, notices, emails, relevant dates, and notes of calls. Do not send tax or identity details to a contact you have not verified.
The IRS’s Identity theft guide for individuals sets out protective steps for suspected tax-related identity theft. It does not establish a separate public form for every possible IRS online-account access concern.
Choose the reporting route that fits
| What you suspect | What to do | Important limit |
|---|---|---|
| Someone may have compromised your IRS online login | Change the password, review account details, preserve evidence, and follow the IRS identity-theft guide or instructions in a genuine IRS notice. | The IRS guide describes protective steps; it does not provide a general unauthorized-account-access form for every case. |
| Your identifying information was used for tax-related identity theft | Report the issue to the IRS and check whether your situation matches Form 14039, Identity Theft Affidavit. | The current form says not to file it if your situation is outside its listed scenarios. |
| You suspect an IRS employee or contractor improperly inspected records | Report the suspected UNAX allegation to TIGTA. The IRS lists 1-800-366-4484. | TIGTA investigates misconduct allegations; reporting there is separate from resolving or securing your tax account. |
| A fraudulent return was filed using your name and SSN | Request a masked copy through your IRS online account or by using Form 4506-F. | You generally must appear on the return as a primary or secondary taxpayer. Being listed only as a dependent does not qualify for this request. |
| A transcript has unfamiliar information | Check the IRS transcript services information and call 800-829-1040 if a transcript seems incorrect or unfamiliar. | Use contact details from official IRS pages or notices, not suspicious messages. |
When to file Form 14039
Form 14039 is an Identity Theft Affidavit for particular tax-related identity-theft situations, not a general privacy complaint or a universal response to a data breach, suspicious notice, or suspected account login. Read the current form and file it only if your circumstances match a listed category. The revision dated 02-2026 states: “If your situation is not one of the scenarios above, do not file a Form 14039.” Do not submit a second Form 14039 for the same incident.

Report suspected IRS employee or contractor snooping to TIGTA
If you suspect an IRS employee or contractor accessed or inspected taxpayer records without authorization, report the allegation to the Treasury Inspector General for Tax Administration (TIGTA), rather than treating it as an ordinary tax-return identity-theft claim. The IRS’s UNAX program policy says TIGTA is responsible for investigating UNAX allegations. The IRS’s reporting information page lists the TIGTA hotline as 1-800-366-4484. Separately secure your IRS account and use IRS channels to address any account or return problem.

- SECURE YOUR WALLET FROM e-PICKPOCKETING: Prevent potential identity and financial theft through your contactless cards. This is the simplest and most effective prevention solution! Block RFID and NFC signals, protect your personal information, and enjoy peace of mind wherever your travels or business take you.
- JAMMING CHIP: An antenna and jamming chip makes up the main components of the card. The antenna will sense incoming radio waves and draw power for the chip to create a jamming signal. Lifetime usage as the card does not require battery.
- BROAD WORKING DISTANCE: With a 2.4” working distance, your entire wallet stays protected. The premium RFID blocking card helps secure cards within 1.2” on either side, providing reliable protection against electronic pickpocketing.
- ULTRA-THIN & COMPACT: At the size of a standard credit card and at only 0.03” thick, the card will fit into any wallet, purse or card case. Keep your wallet compact with no added bulk from this card. Best for travel, business, and everyday use.
- TEST THE CARD: Test the card is working at your local supermarket. At the self-service checkout machines, combine the card and a contactless card on the payment reader. Payment with the contactless card will be blocked and an error message should occur on the reader.
Request a copy of a fraudulent return, if eligible
If someone filed a fraudulent federal return using your name and Social Security number, you may request a masked copy through your IRS online account or with Form 4506-F. The IRS masks information to protect privacy. The person requesting the copy generally must be named as the primary or secondary taxpayer on the fraudulent return; a person listed only as a dependent cannot request it through this process. Follow the current form’s submission instructions and use only one submission method.

The IRS says eligible taxpayers can request one online, at a Taxpayer Assistance Center appointment, or by filing Form 15227. If personal information was exposed, the IRS also directs people to IdentityTheft.gov for recovery guidance. A credit freeze is one protective option after a data breach. Exposure of personal data does not by itself establish tax-related identity theft: the IRS distinguishes a breach from a case in which someone uses an SSN to file a fraudulent return. See the IRS’s data breach information for taxpayers for guidance relevant to that situation.
