If police arrive at your gaming bootcamp or esports venue, do not physically interfere, argue about the search, or start moving files and equipment. Keep everyone safe, designate one manager to deal with the lead agent, ask what legal authority officers are using, call criminal-defense counsel, and avoid consenting to any broader search or interview than the law requires.
The warrant, issuing agency, venue location and any connection to wagering determine what officers may take and what staff must do. The steps below help you preserve evidence, protect privileged material and keep a defensible record without obstructing a lawful operation.

First minutes: make the scene safe and controlled
A raid is stressful, but impulsive actions can create obstruction, evidence-tampering or separate employment problems. Management should give staff a short, neutral instruction: remain calm, follow lawful directions, do not touch equipment or records unless officers direct you, and do not delete, hide, move or alter anything.

Select one manager to greet the lead agent and speak for the venue. That manager should ask each officer for a name, agency and badge or identification number when practical, then note the arrival time, vehicles and stated purpose. Other employees should continue normal safety procedures and avoid crowding officers.

Ask what authority officers are using
Politely ask whether the operation is based on a search warrant, subpoena, consent, an arrest warrant or an emergency exception. Request a copy of the warrant and any supporting papers. Do not sign a consent form, statement, property receipt or waiver before counsel reviews it. Asking to see paperwork is not the same as resisting; physically blocking an officer is.
Call counsel immediately
Contact criminal-defense counsel as soon as possible, and use a second lawyer with gaming or regulatory experience if the facts involve wagering, licensing or a tournament dispute. Ask the lead agent whether the search can wait for counsel. Agents are not necessarily required to pause, so continue cooperating with lawful instructions while counsel travels.
Understanding the warrant and its limits
A warrant is not permission to take everything in a building. Federal Rule of Criminal Procedure 41 covers warrants for evidence of a crime, contraband, the fruits or instrumentalities of a crime, property designed for or used in a crime, or a person to be arrested. In federal court, a judge must find probable cause before issuing the warrant. State warrants follow local procedures, which may differ.
Read the sections that define scope
With counsel, identify the address, rooms, containers, devices, accounts, records and categories of property listed. A warrant may distinguish between a server room, tournament office, employee lockers, point-of-sale station and public gaming floor. Note any date range, file type, user account or search method. Do not volunteer access to an unlisted room, account or device merely because officers ask casually.

When officers appear to exceed scope
Do not physically block an officer or seize an item back. Tell the lead agent, calmly and once, which location or item appears outside the warrant and ask that your objection be noted. Write down the time, words used and people present. Counsel can raise the issue through the court or agency process; confrontation at the scene can escalate the situation and create safety risks.
Different legal instruments, different duties

Employees, contractors and visitors: what to say
A search warrant does not automatically give agents a general right to interrogate every employee. The American Bar Association’s business guidance states that a warrant does not itself give agents the legal right to interrogate employees. A person who is not detained may ask, “Am I free to leave?” and may decline substantive questions. That decision should be made individually and, where possible, with counsel.
Use a simple script
- “I want to cooperate with the search, but I would like to speak with a lawyer before answering questions.”
- “Am I free to leave?”
- “I do not consent to any search beyond the warrant.”
- “I do not recall” is safer than guessing; never knowingly provide a false statement.
Employees should not speculate about tournament results, payments, customer identities or a manager’s instructions. They should not coordinate stories, text colleagues to delete chats, or post about the raid while officers are present. Management may tell staff how to stay safe and where to wait, but must not coach anyone to conceal information.
Protecting privileged communications
Tell counsel if officers encounter attorney-client emails, legal memoranda, investigation work product or a folder marked for counsel. Do not physically withhold a laptop or snatch a paper away. Ask that the item be segregated or sealed while counsel raises the privilege issue through the proper procedure. A label alone does not make every business document privileged, and only counsel can assess the claim.

Computers, CCTV and cloud accounts
Gaming venues hold unusually large volumes of digital evidence: workstation images, anti-cheat logs, tournament registrations, chat, access-control events, payment records, camera footage and cloud dashboards. The safest rule is preservation without alteration. Do not power-cycle a computer, wipe a phone, change a password, run cleanup software, unplug a server or ask a cloud administrator to “tidy” files unless counsel and a qualified forensic professional direct the step.
Build a preservation list
- CCTV footage, including cameras covering entrances, cash desks, server rooms and loading areas.
- Door-access, alarm and visitor logs, with the system’s time zone recorded.
- Point-of-sale, payment-processor and refund data.
- Tournament brackets, registrations, prize-payment records and platform exports.
- Chat, email, direct messages and moderation records relevant to the event or account.
- Computer, console, router and storage-device serial numbers, assigned users and physical locations.
- Cloud-service names, administrator accounts, retention settings and existing legal holds.
Preserve the original data and make working copies only under a documented plan. Record who collected each item, when, from which system and where it was stored. That chain-of-custody information helps counsel challenge an inaccurate or incomplete collection.
Provider preservation under federal law
Under 18 U.S.C. §2703(f), when a governmental entity requests preservation, a provider of electronic-communications or remote-computing services generally must preserve records for 90 days, with a possible additional 90-day renewal. Ask counsel to send preservation requests promptly to relevant providers and suspend routine deletion at the venue. The 90-day period preserves records; it does not decide whether a search or seizure was lawful and does not replace a forensic collection plan.

Department of Justice guidance on privacy expectations in business computers cautions that an employer’s consent does not automatically authorize government seizure of every employee or customer file. Identify personal accounts, employee-owned devices and unrelated customer data for counsel. Let counsel determine whether a segregated copy, filter protocol or protective order is appropriate.

Document the operation without obstructing it
A contemporaneous record can be more useful than memories formed after a long search. Keep one written timeline in a place officers do not need to enter. Note the warrant number, agencies, rooms entered, major events, requests made, breaks in activity and the time agents leave.
Recording and photography
If lawful and safe, photograph or video the search from a position that does not interfere. Avoid recording audio where state law requires consent from the participants. Never follow officers into a restricted area, shine lights into equipment they are examining or use a camera as a way to delay them.
Obtain an inventory
Request a property inventory, receipt or copy of the seizure list before agents depart. Compare it with your own notes. If officers take a server, workstation or camera recorder, record its make, model, serial number and condition when known. Ask whether a forensic image or operational copy can be made, especially where the venue needs records to meet payroll, answer customer disputes or maintain other lawful operations. Officers may decline, but the request creates a documented starting point for counsel.

- Secure the premises. Check doors, cabinets, network closets and safety systems without disturbing remaining evidence. Photograph damage or missing items.
- Continue the hold. Through counsel, issue a litigation or investigation hold covering email, chat, CCTV, POS, tournament files, cloud accounts and social-media content. Suspend automatic deletion and rotating camera storage where feasible.
- Notify selectively. Tell insurers, landlords, payment partners or regulators only as counsel advises. Contractual notice deadlines can apply, but an unnecessary disclosure can complicate the investigation.
- Prepare a factual message. A staff or customer notice should state only verified operational facts, such as a temporary closure or delayed event. Do not speculate about guilt, identify cooperating witnesses or publish the warrant.
- Review every item taken. Counsel should compare the inventory with the warrant, request return of non-responsive property where appropriate and seek access to essential business records.
- Decide whether to reopen. Do not resume wagering, prize promotions or restricted services until counsel confirms that licenses, preservation duties and any agency conditions are satisfied.
Why esports venues can face gaming and wagering exposure
An esports venue can attract regulatory attention even when it describes itself as a training facility. Entry fees, cash or merchandise prizes, sponsorship arrangements, betting integrations, age controls, payment flows and tournament terms can affect whether an activity is treated as a contest, sweepstakes, gambling or sports wagering under local law.
Rules are jurisdiction-specific. A United States legal summary from DLA Piper states that a gambling operation may legally operate only in a state that allows gambling and when it is licensed by the relevant gaming commission. Ohio’s Casino Control Commission says sports-gaming proprietors, service providers and suppliers must be licensed to operate in Ohio. Those examples do not establish the rule for another state or country.
Questions counsel should review before operations resume
- Does the entry fee purchase training or access, or does it function as a wager?
- How are prizes funded, and are outcomes based on skill, chance or a combination?
- Are minors allowed to participate, watch or create accounts?
- Do sponsors, platforms or payment processors impose additional restrictions?
- Does any betting interface, odds feed or revenue share require a separate license?
- Do tournament rules clearly explain eligibility, refunds, disputes and prize delivery?
Choosing outside response help
A venue may need criminal-defense counsel, a gaming-regulatory lawyer, a digital-forensics firm or an incident-response provider. Compare candidates against the actual risks rather than choosing solely on hourly rate.

Prepare before the next event
A written raid plan reduces confusion without encouraging staff to interfere. Keep a current emergency contact card with counsel’s number, the designated manager and an alternate. Store a read-only copy of the venue map, device inventory, cloud-account list, retention schedule and key licenses where it can be reached if the main office is sealed.

Train staff on three rules: do not obstruct, do not alter evidence and do not guess in an interview. Run a tabletop exercise that covers a warrant at the front desk, a seizure of the CCTV recorder, a request for an employee’s phone and a search of a cloud account. Test whether camera footage and access logs can actually be exported, and document the time zone and retention period for each system.
Finally, have counsel review tournament terms, payment flows, prize structures, sponsorships, age verification and any wagering connection before a new event launches. Prevention cannot guarantee that officers will never appear, but it gives the venue a lawful, organized response when they do.
