What to Do If an AI Tool Exposes Your Company’s Sensitive Data

If company information may have been exposed through an AI tool, report it promptly, limit further access, preserve evidence, and investigate the scope with security and legal support.
Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Treat a possible exposure through an AI tool as a security and privacy incident. Tell your organization’s security or incident-response contact immediately, limit further access where you can, and preserve evidence while the response team establishes what was involved and who could access it. Don’t assume the cause—or that deleting a prompt or file will resolve the incident.

Report the incident and limit further exposure

Notify the right person immediately

Contact your organization’s security team, incident-response contact, or designated incident lead. If you are unsure whether a mistaken submission counts as an incident, report it anyway; the organization needs the chance to assess the facts.

Stop access carefully

With security or IT, identify the practical way to prevent additional access. Depending on what happened, that could mean disabling a shared link, restricting a workspace or file permission, pausing a connector or integration, or securing the affected account. A prompt submitted privately is not the same situation as a conversation or file made accessible through a link, workspace permission, or connected system.

Containment and evidence preservation are concurrent priorities. Don’t delete conversations, files, accounts, or logs, or make broad configuration changes, before the incident lead can assess whether they could disrupt investigation or erase useful evidence.

Preserve a clear record of what happened

Write down what you know while it is fresh. Keep original evidence in an approved, access-restricted location and avoid making extra copies of sensitive content. Record facts and unknowns separately; update the timeline as new information is confirmed.

  • When you discovered the issue, including the date, time, and timezone, and when the submission or exposure may have occurred.
  • The AI product, account type, plan, workspace, and account identity involved.
  • The prompts, files, or other data involved. Describe sensitive material with care; don’t paste it into a new ticket or message unless the incident team directs you to.
  • Relevant sharing-link, workspace, connector, integration, and access settings, plus any changes made after discovery.
  • Available logs, alerts, notifications, screenshots, support messages, and other relevant records.
  • Who you notified, when you notified them, and each containment or other action taken.

Incident-response guidance from the FTC recommends preserving evidence and documenting the response. NIST’s SP 800-61 Rev. 3, published April 3, 2025, places incident response within broader cybersecurity risk management; NIST SP 1800-29 addresses detecting, responding to, and recovering from data breaches.

Establish what data and access were involved

Security and the relevant data owners should build a timeline and determine the scope. Don’t treat an unanswered question as proof that no one was affected.

  • What data? Identify the information submitted or exposed, such as business-confidential material, personal data, regulated information, or information protected by a contract.
  • Whose data? Identify the people, customers, employees, partners, or business units the information relates to.
  • When and where? Establish when it was entered, uploaded, shared, retrieved, or otherwise exposed, and which account, workspace, service, or connected system was involved.
  • Who or what could access it? Check the audience for any shared link, workspace membership and permissions, connector access, and relevant provider or administrator access. Distinguish possible access from confirmed viewing or retrieval.
  • Is the exposure ongoing? Confirm whether a link, permission, account, or integration remains active and whether any further access is known.

A general privacy statement cannot establish what occurred in a particular incident. The product, account tier, contract, region, settings, sharing, connected tools, and retention policy can all affect what needs to be checked.

Bring in the response team and the AI provider

Mobilize internal support

Involve security or IT and the designated incident lead. Add privacy and legal counsel, data owners, HR, operations, communications, leadership, forensics, or law enforcement when the facts warrant it. The FTC notes that the response team’s composition depends on the company and the nature of the incident. NIST SP 800-171 Rev. 3 describes incident handling—including preparation, detection and analysis, containment, eradication, recovery, and documentation—in the specific context of protecting controlled unclassified information in nonfederal systems; it does not make those requirements universal for every company.

Contact the provider through a known channel

Use the service’s established support or security contact for the affected account, rather than relying on an unsolicited message or an unverified contact. Ask what help is available to restrict access and establish the exposure scope. Record the product and account type, plan, applicable terms, retention configuration, model-improvement setting, shared links, connected tools, and the provider’s response.

Ask specifically what records or content may be retained, what access or retrieval the provider can confirm, whether relevant logs can be preserved, and what containment options exist. Have counsel guide requests to preserve or delete content: deletion may be appropriate in some cases, but it should not destroy evidence or conflict with legal, contractual, or investigative needs.

Do not assume consumer and managed business accounts have the same controls. OpenAI states that data from its listed business products and API is not used to train or improve models by default, and that qualifying organizations can configure retention controls; its help page also says removing a member from a workspace does not necessarily delete content, with behavior varying by product and retention policy. These are provider statements, not findings about a particular incident: check the exact service and governing terms. See OpenAI’s business data information and its workspace-removal retention guidance. Microsoft says Enterprise Data Protection applies to covered commercial use of Copilot and Copilot Chat, with stated commitments and controls including permissions, retention, and auditing; verify the affected account’s license and terms in force. Have counsel assess notification and other duties

Promptly ask privacy or legal counsel to assess whether personal, regulated, confidential, or contractually protected information is involved; which jurisdictions and sector rules apply; and whether a regulator, customer, employee, partner, or law-enforcement notification is required. The answer depends on the information, affected people, locations, contractual roles, and timeline. Don’t apply a deadline from one jurisdiction to every incident.

For example, the UK Information Commissioner’s Office says a personal-data breach meeting its reporting threshold must be reported to the ICO without undue delay and within 72 hours. Its guidance says the clock starts when the breach is discovered, recommends logging breaches even when reportability is uncertain, and advises gathering facts and containing the incident quickly. The ICO flags that this guidance is under review following UK legislative change, so counsel should verify current applicability and requirements. See the ICO’s 72-hour response guidance. This example is not a global deadline for all company information.

Communicate verified facts, then strengthen controls

Keep incident communications accurate

Use the designated spokesperson and provide verified facts, known unknowns, current containment status, and next steps. Avoid claiming that nobody accessed the information—or that it was exposed—unless the evidence supports that statement. Share only the detail needed by each audience; unnecessary repetition of sensitive content can create another exposure.

Review what allowed the incident

After immediate containment, use the incident findings to review permissions, approved AI services, acceptable-use rules, training, logging, and data-handling controls. Check whether staff know how to report mistaken submissions and whether connected tools receive only the access they need. Document corrective actions and assign owners through the normal incident process.
