The key distinction is whether a person makes the decisions to select and attack a target, or whether the aircraft or weapon system can select and engage a target after activation without further human intervention. That difference shapes the safety questions, but it does not remove the human obligations of international humanitarian law (IHL).
When is a combat aircraft an autonomous weapon?
“Drone” describes a range of aircraft and uses; it does not, by itself, describe how target decisions are made. The International Committee of the Red Cross (ICRC) defines an autonomous weapon system (AWS) by its function: once activated, it can select and engage one or more targets without further human intervention. It may use sensor information and a generalized target profile, so the user may not choose or know the precise target, place, or timing of the resulting use of force. This is the definition set out in the ICRC’s 2025 position paper.

A remotely piloted aircraft can carry out an attack based on a person’s decisions and still be uncrewed. Conversely, an aircraft or weapon with autonomous target-selection and engagement functions raises AWS questions. The ICRC’s drone guidance also distinguishes between an aircraft that delivers a munition, a one-way drone that is itself the munition, and a drone with autonomous functions. The platform’s label alone does not settle its legal treatment.

| Question | Remotely piloted attack | Autonomous weapon function |
|---|---|---|
| Who selects and engages the target? | A human makes the relevant decisions through remote operation. | After activation, the system can select and engage a target without further human intervention. |
| What must be understood? | The operator needs information to direct the particular attack and assess its effects. | The user also needs to understand how the system’s target profile and sensor-driven behavior may operate in the intended environment. |
| What is the central control concern? | Whether the person can make and carry out lawful attack decisions. | Whether the system’s target, operating, and time limits—and the user’s supervision and ability to intervene—allow meaningful human judgment. |
This distinction concerns the weapon function, not whether an aircraft has a pilot aboard. A remotely piloted aircraft may be armed without being an AWS, while autonomy in a particular weapon function can make that function relevant to AWS analysis.

- Centerline and inner wing pylons as well as tail assembly feature polycaps to allow easy detachment for storage.
What safety questions matter before and during use?
The central safety issue is not simply whether the aircraft can fly reliably. It is whether people responsible for its use can anticipate and limit the effects of its target-selection and engagement functions under the actual conditions in which it will operate. The ICRC identifies difficulty predicting and limiting effects, civilian and combatant harm, and conflict escalation as concerns. The available ICRC materials do not establish an aircraft-specific safety-performance threshold.
- Target recognition: What can the system recognize, and can it distinguish lawful military objectives from civilians and civilian objects in the intended environment? A system’s ability to match a target profile is not, by itself, proof that a particular attack will comply with IHL.
- Predictability and testing: Can users anticipate the system’s behavior across the relevant environments and conditions? Testing should inform what the system can and cannot reliably do; the cited ICRC materials do not provide a complete engineering test protocol.
- Human understanding and supervision: Does the operator have enough information to understand the system’s behavior and supervise its use? Can they intervene or deactivate it in time if circumstances change or an unsafe effect becomes apparent?
- Limits on use: Are the permitted target types, geographic area, duration, scale, and operating conditions narrow enough to constrain foreseeable effects and support human judgment?
- Effects beyond the intended target: Could the system harm civilians or combatants, or contribute to escalation? The assessment must consider the conditions of use, not just the system’s intended function.
These are questions for assessing a system and a proposed use, not a claim that every autonomous aircraft has the same capabilities or risks. The cited materials establish no aircraft-specific accident rate, certification regime, or named-platform performance data.

Which laws apply to attacks by drones and autonomous systems?
IHL applies to attacks regardless of whether they are conducted from a crewed aircraft, a drone, or a weapon with autonomous functions. The ICRC says armed drones are not expressly prohibited by treaty or customary IHL as a category and are legally comparable to weapons launched from crewed aircraft. That does not make every drone strike lawful: an aircraft or drone may also be prohibited if it deploys a weapon that is banned outright.

- Distinguish: Direct attacks against combatants and military objectives, not civilians or civilian objects.
- Apply proportionality: Refrain from an attack when expected incidental civilian harm would be excessive in relation to the concrete and direct military advantage anticipated.
- Take feasible precautions: Take feasible steps to avoid or minimize civilian harm.
These obligations apply to attacks from drones as well as crewed aircraft, according to the ICRC’s drone FAQ. The ICRC’s 2025 paper emphasizes that IHL duties must be fulfilled by humans using weapon systems: “It is not the weapon system that must comply with IHL, but the humans using it.” The system does not become the legal decision-maker merely because it performs target selection or engagement after activation.
The ICRC also cautions that states differ on what requirements for autonomous weapon systems follow from existing IHL, and that current rules do not answer every humanitarian, legal, and ethical question raised by such systems. Applying general IHL rules to a particular system or attack therefore requires attention to the system’s functions and the circumstances of use; the platform category alone cannot resolve the analysis.

Who is accountable if an autonomous attack causes unlawful harm?
Human users’ obligations do not transfer to the machine. But that principle does not, on its own, settle who may be legally accountable in a particular case. Questions about individual criminal liability, command responsibility, state responsibility, procurement decisions, and remedies involve distinct issues. The ICRC’s 2025 position paper places detailed accountability challenges outside its scope, so it does not provide a complete answer for every actor or legal route.

The ICRC advocates new, legally binding international rules for autonomous weapon systems. It recommends prohibiting systems that are unpredictable and systems designed or used to apply force against persons. For other systems, it recommends restrictions intended to reduce risks, which may include:

- Limiting the types of targets a system can engage.
- Restricting how long and where it can operate, and the scale of its use.
- Limiting use to situations where civilians or civilian objects are absent.
- Requiring effective human supervision and the ability to intervene or deactivate the system in time.
These are the ICRC’s proposals, not a description of prohibitions and restrictions already binding universally. A 2020 ICRC-SIPRI analysis groups practical human-control measures into controls on weapon parameters, the environment of use, and human supervision. It presents these as ways to reduce or compensate for unpredictability and civilian risk—not as a treaty or an aircraft airworthiness standard.
How can a system or policy be assessed in practice?
A useful review asks the same questions of each proposed system or policy, rather than treating “human control” as a single switch. The ICRC materials support these comparison areas as legal and human-control questions, but do not supply a complete engineering test protocol.
- Autonomy: Can the system select and engage targets after activation without further human intervention?
- Target limits: Which target categories may it engage, and how tightly is its target profile constrained?
- Predictability: How predictable and testable is its behavior in the intended environment?
- Operator control: What information does the operator receive, how well can they understand and supervise the system, and how much time do they have to intervene?
- Operating boundaries: What geographic, temporal, and scale limits apply?
- IHL support: How do the system’s design and proposed use support distinction, proportionality, and feasible precautions?
The answers help identify where safeguards or tighter limits may be needed. They do not replace assessment of the circumstances of a particular attack under IHL.
