Section 129 of the Central Goods and Services Tax (CGST) Act provides a notice, hearing, payment and security process; it does not permit an unexplained or purely verbal detention. A State-issued e-way bill is generally valid while the consignment moves through every Indian State and Union territory, but that validity does not cure an incorrect bill, an expired validity period, missing documents or a different compliance breach.
What to do in the first hour
The driver should remain cooperative while asking the officer to identify the legal basis for the stop. Do not argue about the amount of tax or sign a statement that you have not read. Ask for copies or photographs of each written document that has been served.

- Obtain the written detention or seizure order. Record the officer’s name, designation, department, checkpoint or location, date and time, vehicle registration number, e-way bill number and the discrepancy alleged. Section 129 requires service of an order of detention or seizure on the person transporting the goods.
- Notify everyone responsible for the consignment. Contact the goods owner, consignor, consignee, transporter and the business’s GST contact. Designate one person to communicate with the officer so that inconsistent explanations are avoided.
- Secure the evidence. Download or preserve the e-way bill, invoice or bill of sale, delivery challan where used, transporter ID or transport document, vehicle papers, driver details, route records, toll or loading records and any portal communications. Keep the original files and the time they were downloaded.
- Compare the allegation with the records. Check the GSTINs, product description, HSN, quantity, value, invoice date, vehicle number, transporter details, Part B entry, route and e-way bill validity. Check whether a vehicle was changed after a breakdown or trans-shipment and whether that change was recorded in the permitted manner.
- Ask when the statutory notice will be served. A verbal objection is not a substitute for a written response. Request an opportunity to be heard before any penalty is determined, as section 129 expressly requires.
- Obtain case-specific advice before choosing release. The owner or authorised representative should promptly have a qualified GST professional examine the applicable section 129 clause, calculation and security requirements. Do not assume that the figure quoted at a checkpoint is the only legally available amount.
Do not recreate an e-way bill, change an invoice retrospectively or delete portal records to make the documents appear consistent. Preserve the state of the records at the time of interception; explain genuine corrections through the proper process.

Can another state detain my truck over an e-way bill?
Yes. An officer in a State through which the consignment is passing may intercept goods and the conveyance when the officer alleges that the transport or goods are in contravention of the CGST Act or rules. The power is about the alleged compliance breach, not about where the e-way bill was issued.

CBIC’s e-way bill rule states: The e-way bill generated under this rule or under rule 138 of the Goods and Services Tax Rules of any State or Union territory shall be valid in every State and Union territory.
Therefore, issuance in another State by itself is not a sound reason to call the e-way bill geographically invalid. The bill can still be questioned if its fields are wrong, its validity has ended, the vehicle or Part B information does not match, required accompanying records are absent, or the movement is otherwise contrary to law.
Ask the officer to identify the specific mismatch rather than accepting a general statement that an out-of-State bill cannot be used. Keep the order and notice, because the stated reason controls the response and any later challenge.
What documents should the driver show?
The driver should be able to show the documents that establish both the taxable supply and the physical movement. The exact combination depends on the transaction, but the usual set is:
- the e-way bill number and a readable electronic or printed copy;
- the tax invoice, bill of sale or delivery challan, as applicable;
- transporter ID, transport document or consignment note;
- vehicle registration and details of the vehicle actually carrying the goods;
- driver identity and authorisation to carry the consignment;
- records of a vehicle replacement, breakdown, trans-shipment or route change, where relevant; and
- any permit or document required for the particular goods or mode of transport.
The e-way bill system FAQ explains that validity for road movement starts when the first transport detail is entered in Part B, such as the first vehicle entry. A vehicle change may require an update in the portal. Exceptional-circumstance extensions and other portal actions depend on the applicable rule and current system behaviour, so verify the status rather than promising that an extension is available.

Section 129: notice, hearing and order
Section 129 covers detention or seizure of goods and the conveyance used to transport them when they are moved or stored in transit in contravention of the Act or rules. Amendments effective 1 January 2022 changed the section’s framework, so the version of the statute in force on the date of the alleged contravention matters.
| Stage | What the law or record should show | What you should do |
|---|---|---|
| Detention or seizure | The officer serves a written detention or seizure order on the person transporting the goods. | Obtain the document, note service time and check the goods, vehicle and alleged discrepancy. |
| Notice | Notice under section 129 is to be issued within seven days of detention or seizure. | Read every field, identify the calculation and prepare evidence addressing each allegation. |
| Hearing | No penalty may be determined without giving the person concerned an opportunity to be heard. | Submit a factual response and request a hearing; keep proof of submission and attendance. |
| Order | The officer is to pass an order within seven days from service of the notice. | Record when the order is communicated because release and appeal decisions run from specific events. |
| Payment or security | The section provides payment-based release alternatives and release against security equivalent to the applicable amount, with the clause depending on the facts and owner status. | Have the owner or authorised representative verify the calculation and acceptable security format before furnishing anything. |
“No penalty shall be determined under sub-section (3) without giving the person concerned an opportunity of being heard.”
These periods are statutory directions, not a promise that a vehicle will move automatically when a deadline passes. If a notice or order is late, incomplete or inconsistent, preserve evidence of the dates and raise the point in the response or appropriate remedy.
How to answer the notice
Address the notice allegation by allegation. A useful response has a short chronology, a document index and a clear request. Explain what was loaded, when it left, which vehicle carried it, when Part B was entered, where the inspection occurred and what the records show. Attach the invoice, e-way bill history, delivery challan, transport document, vehicle-change evidence and correspondence that directly answers the alleged mismatch.

Separate an innocent data-entry issue from a movement that actually differs from the invoice. For example, if the vehicle was replaced after a breakdown, show the breakdown or trans-shipment record and the portal update permitted at that time. If the product, quantity or GSTIN is wrong on the source document, do not describe a retrospective edit as a correction; explain the original record and seek advice on the lawful remedy.
Ask for a personal hearing and identify the authorised representative who will attend. Keep the acknowledgement, email, portal reference or other proof that the response was filed. A response should not concede tax or penalty merely because the truck is waiting; any payment decision should follow review of the statutory clause and evidence.
How do I get the goods and vehicle released?
Section 129 offers two broad routes: payment of the amount specified under the applicable clause, or furnishing security equivalent to that amount. The correct amount depends on facts such as whether the owner comes forward, the nature of the contravention and the statutory text effective on the relevant date.

| Cash-flow impact | Funds leave the business immediately, subject to the statutory treatment of the payment. | Cash may remain available, but a bank guarantee or other accepted security can tie up limits and incur fees. |
| Evidence and calculation | Confirm the officer’s calculation, tax basis and applicable section before paying. | Confirm the security is for the full amount, in the format and from the institution the jurisdiction accepts. |
| Practical ability | Useful where payment can be made promptly and the business prioritises rapid release. | Useful only if the owner can furnish acceptable security without delay. |
| Effect on the dispute | Payment under section 129 can conclude proceedings in respect of the notice as provided by the section; obtain the written release and payment record. | Release is conditional on accepted security; retain the bond, guarantee and release order. |
| Risk of waiting | Delay can increase storage, demurrage and commercial loss. | Arranging a guarantee can also take time; ask the authority what it will accept before issuing one. |
A Delhi GST circular describes FORM GST MOV-08 for a bond with bank guarantee and MOV-05 as a release order. Those identifiers are administrative guidance, not a guarantee that every State or Union territory uses the same sequence or accepts identical wording. Read the document actually issued and check current local instructions before signing a bond or arranging a guarantee.

What happens if the amount is not paid?
Section 129 also deals with sale or other disposal of the goods or conveyance after failure to pay within fifteen days of receiving the order, subject to the section’s terms and exceptions. Because disposal can permanently affect the goods, escalate immediately to the owner, insurer where relevant and a GST professional when the order is received. Do not wait for a commercial deadline to expire while assuming that an appeal alone keeps the vehicle at the checkpoint.
Ask the authority in writing what amount remains due, what security is acceptable, where the goods are held and what deadline applies. Preserve photographs, inventory and condition reports if storage or handling could affect the value of the goods.

Usually, the first statutory appeal from an adjudicating authority’s decision or order is governed by section 107. It generally allows three months from the date the order is communicated to the aggrieved person. The communication date, the identity of the adjudicating authority and the nature of the document must be verified before calculating the deadline.
Do not confuse a response to a section 129 notice with an appeal. At the notice stage, submit evidence and request a hearing. Once a final order has been communicated, assess the first appeal and any applicable pre-deposit, limitation or stay requirements with a qualified adviser. Other remedies may exist in particular facts, but they have different deadlines and standards; a general article cannot select one without reviewing the order.

Movement and portal problems that commonly trigger detention
Vehicle number or Part B does not match
Compare the vehicle actually inspected with the first Part B entry and every authorised update. A breakdown or trans-shipment can explain a change only when supported by contemporaneous records and a permitted portal update.
The e-way bill has expired
Establish when the first transport detail was entered and calculate validity under the rule applicable to the goods and mode of transport. Do not promise an extension merely because the delay was caused by traffic, a checkpoint or a mechanical failure; exceptional provisions and portal behaviour must be checked for the particular movement.
An entry was submitted incorrectly
The e-way bill FAQ states that an incorrect submitted entry cannot simply be edited. Cancellation and generation of a new bill may be necessary in permitted circumstances. When goods are already detained, first preserve the original bill and obtain professional advice; never create a replacement solely to conceal what the officer saw.

The driver has waited more than 30 minutes
CBIC’s e-way bill rules allow a transporter to upload information in FORM GST INS-04 when a vehicle has been intercepted and detained for more than thirty minutes. This is a reporting option. Filing it does not itself order release, cancel the notice or replace the section 129 process.
Identifying forms without assuming uniform State practice
A Delhi circular describes MOV-06 as a detention order, MOV-07 as a notice, MOV-09 as a speaking order quantifying tax and penalty, MOV-08 as the bond and security form, and MOV-05 as the release order. A Tripura circular example refers to MOV-10 in a later confiscation process. Other jurisdictions may use different labels, sequencing or electronic workflows.
Use the form number as a clue to the stage, then read the title, statutory section, date, issuing authority and relief sought. The document’s contents and the current instructions of the State or Union territory control, not an assumed national form sequence.
Practical checklist before the truck moves
- Written detention or seizure order and all notices saved in original form.
- Officer identity, location, dates, times, vehicle and e-way bill numbers recorded.
- Invoice, bill of sale or delivery challan, transporter document and vehicle records matched line by line.
- Part B history, vehicle changes, route evidence and portal communications preserved.
- Written response filed with a hearing request and proof of acknowledgement.
- Payment calculation or security wording reviewed by the owner or authorised representative.
- Release order, payment receipt, bond and bank guarantee collected before departure.
- Order-communication date entered in a calendar so the three-month section 107 appeal period is not missed.
The safest approach is procedural: document the detention, answer the stated discrepancy with contemporaneous records, use the statutory release route that the facts support, and obtain advice before a payment, security or appeal deadline expires.
