First determine whether the game’s release date changed, a physical order has not shipped, or an eShop preload simply is not playable yet. Then check the current release date and your order status. Your next step depends on the country, seller, and whether you bought a digital or physical copy.
First, identify what is delayed
Check the game’s current release date in its official listing, then compare it with the date and status in your order confirmation or latest notice. A publisher changing a game’s release date is different from a retailer failing to ship a physical copy on time. An eShop preload that has not unlocked may not be delayed at all.

- Release date changed: Read the publisher’s announcement and the seller’s notice. Check that seller’s cancellation and refund terms.
- Physical order has not shipped: Ask the seller for a definite revised shipping date and whether you can cancel for a refund.
- eShop game is preloaded but will not launch: Check the official release date and unlock information before treating it as a problem.
Keep your order confirmation and any delay notice. The relevant process can depend on where you bought the game, your country, and its format.
If your Nintendo eShop preorder is delayed
Nintendo of America’s guidance says a digital preorder can be canceled only before payment is processed, at least seven days before release. Nintendo says it collects payment no sooner than seven days before release; its preorder FAQ says cancellation is possible before payment processing and preload. If payment fails, the preorder is canceled. These are Nintendo US support terms, not a universal statement of consumer rights. See Nintendo’s US preorder cancellation instructions and preorder FAQ.

If the normal cancellation option is unavailable, Nintendo’s support article directs customers to contact Nintendo Support. Check the current order status and available options in your Nintendo Account, and contact support promptly if you cannot cancel yourself.
Nintendo UK describes a voluntary cancellation right for a digital preorder exercised seven or more days before release, and says that right does not affect statutory cancellation rights. If a physical copy has not shipped
Nintendo Store orders
Nintendo of America distinguishes physical pre-purchases through Nintendo Store from eShop preorders: it says physical pre-purchases are charged immediately and ship one to three business days after release. To cancel one, contact Nintendo Support. This process applies to Nintendo Store orders, not automatically to orders placed with other retailers. For most online merchandise orders in the United States, the Federal Trade Commission’s Mail, Internet, or Telephone Order Merchandise Rule requires a seller to ship within the promised period—or within 30 days if no shipping time was stated. If shipment is delayed, the seller must notify you and offer the choice to accept the delay or cancel for a full refund. The FTC’s consumer guidance puts it this way: “If there’s a delay shipping your order, the seller has to tell you and give you the choice of either agreeing to the delay or canceling your order for a full refund.” Read the FTC consumer advice and its business guide to the rule.

This US rule concerns delayed shipment of merchandise. It does not establish the answer to every dispute about a publisher changing a software release date, and it should not be treated as a rule for orders placed outside the United States. For another country or seller, check the applicable terms and consumer protections.

A game icon or downloaded preload does not necessarily mean the game is ready to play. Nintendo says a non-playable version can appear on the HOME Menu before release and that play starts after the release-time update. Check the title’s release date in Nintendo eShop or Nintendo Store; some third-party titles may have a different stated unlock time. Nintendo’s guidance for a preloaded game that will not play.

Decide whether to wait or cancel
Before choosing, compare the seller’s confirmed revised date with the cancellation terms that apply to your order. Also check whether you have already been charged, how a refund would be issued and when, and whether an exact physical edition is actually available elsewhere with a confirmed date. Do not assume another listing is the same platform edition or will arrive sooner; verify the title, edition, seller, and availability date first.
