Stop modifying the card, preserve every transaction record, document the mismatch, and open the seller or marketplace case promptly. Use diagnostics and benchmarks to build evidence—not as a standalone authentication verdict—then pursue the payment and warranty routes that fit your country, seller, marketplace and payment method.
Act before troubleshooting changes the evidence
A graphics card that reports the wrong model, has less memory than advertised, arrives with altered labels, or performs dramatically below a comparable card may be counterfeit, misrepresented, damaged or simply affected by another system problem. Your first priority is not disassembly or repeated benchmarking. It is preserving what was promised and what arrived.

- Stop physical changes. Do not flash firmware, remove the cooler, replace components or alter labels while a return or warranty claim is possible. The effect of opening a card depends on the seller’s and manufacturer’s actual terms, so document the card as received and check those terms before changing its condition.
- Save the listing. Capture the exact model name, claimed memory capacity, photographs, condition description, seller identity, price, shipping terms and return policy. Save a page copy or screenshots showing the date if the marketplace allows it.
- Preserve transaction records. Keep the order confirmation, invoice, payment record, shipping label, packaging, serial-number stickers and all correspondence. The Federal Trade Commission (FTC) says receipts and order-confirmation details can help when seeking money back; its marketplace guidance also recommends retaining emails and messages.
- Photograph the hardware. Take clear, dated photos of both sides of the card, labels, connectors, screws, cooler, PCB edge and packaging. Include any visible damage, mismatched stickers or signs that a label was replaced.
- Write a symptom log. Record the date, software version, driver version, game or workload, resolution, quality settings, frame rate, crashes, temperatures, clock speeds and power behavior. Keep original screenshots and exported reports.
Keep conversations inside the marketplace’s messaging and case system whenever possible. A private chat or phone call can be useful, but it should not replace a written record attached to the order.
Check what the card actually is
Match the installed identity to the listing
Start with the exact model and board variant shown on the product page, not just the broad GPU family. A desktop version, laptop version, factory-overclocked board and reference design can have different specifications. Compare:

- GPU model and generation
- Video-memory amount and memory type
- Memory-bus width and advertised bandwidth
- Boost or game-clock claims
- Power connectors and stated board power
- Outputs, cooler design and board-partner model number
Record what the operating system and a reputable GPU-information utility report. GPU-Z has historically documented features intended to identify some counterfeit cards, including older GPUs relabeled as newer models, according to a TechPowerUp release note. That makes it a useful evidence source, not a universal authentication service. A single utility reading can be wrong, spoofed or misinterpreted, and it does not establish that every current card is genuine.
Corroborate an unexpected identity or memory reading with the card maker’s model information, the GPU vendor’s specifications and the marketplace record. If the physical model number, firmware-reported model and listing disagree, preserve screenshots of each disagreement.
Test performance under repeatable conditions
A low score is evidence of a problem, but it does not by itself prove counterfeit hardware. Before drawing a conclusion, record the conditions that can change a result:

- Resolution, graphics preset, ray-tracing and upscaling settings
- CPU, memory, motherboard and operating-system configuration
- Graphics driver version and background software
- GPU temperature, clock speed, utilization, power draw and fan behavior
- Whether the card is in the intended PCIe slot and receives all required power connectors
Repeat a test after the system is idle and use the same settings for every run. Compare only with results for the same card variant or a closely matching configuration. Do not treat a laptop GPU, a reduced-power model or a different board design as identical to a desktop card.

The available official guidance does not establish a universal percentage below specification that proves fraud. A card can underperform because of thermal throttling, an inadequate power supply, a driver problem, a CPU bottleneck, an incorrect setting, a damaged cooler or a defective board. Describe the result as suspected misrepresentation or unexplained underperformance unless a reliable source confirms the hardware is counterfeit.
Separate a wrong card from a poorly configured system
Signs that strengthen a misrepresentation claim
- The model reported by software is different from the model in the listing.
- The installed memory is materially lower than the advertised capacity.
- The board-partner model number or serial label does not match the order.
- Physical connectors, cooler, outputs or PCB markings correspond to another model.
- Repeatable results remain far below comparable results after drivers, power and thermal limits are checked.
- The packaging, card and invoice carry inconsistent names or serial numbers.
Checks that can explain low performance without proving fraud
- Temperature or power limits force the GPU to lower clocks.
- The card is running in a restricted slot or without every required power lead.
- A driver, game profile, resolution or quality setting differs from the comparison.
- The processor or system memory limits frame rates in the selected workload.
- The card is a legitimate lower-power, mobile or board-specific variant.
These checks are not a requirement to keep a defective product. They help you describe the problem accurately and prevent a seller from dismissing a genuine claim as a configuration error.
Open the seller and marketplace case promptly
- Use the order page’s official return, “item not as described,” counterfeit or defective-item flow—whichever accurately matches the facts.
- State the advertised model and the observed discrepancy in separate sentences. For example: “The listing says model X with 12 GB; the installed report shows model Y with 4 GB.”
- Attach the listing capture, order record, photographs, diagnostic report and dated test notes. Keep files in their original form when possible.
- Request the remedy available under the actual policy: a return for a refund, a replacement or another stated resolution. Do not demand a remedy that the policy or local law does not provide.
- Follow the marketplace’s return-label, shipping and inspection instructions. Keep the tracking number and a photograph of the packed parcel.
If the seller does not resolve the issue, escalate through the marketplace’s buyer-protection or dispute system before its claim window closes. FTC marketplace guidance emphasizes prompt action, reporting unresolved problems to the marketplace and keeping copies of communications. FTC consumer guidance also warns against paying a marketplace seller outside the platform because off-platform payment can remove site protections.

Do not send the card to an address supplied only in an informal message if the case system specifies a different return process. Ask the marketplace to confirm the authorized return route in writing.

Ask your payment provider about a dispute
Contact the bank or card issuer early, even while the seller or marketplace case is open. Ask which dispute category applies, what documents are required, how to submit them and when written notice must arrive. Describe the facts precisely: a different item, a counterfeit suspicion, physical damage or a performance problem are not interchangeable claims.
Credit cards in the United States
FTC guidance explains that certain credit-card billing errors must be disputed in writing within 60 days of the first statement showing the error. The same guidance says an item’s quality dispute is not itself a billing error. Therefore, do not assume that every underperforming graphics card qualifies under the statutory billing-error process. Send the notice in the manner and to the address specified by the issuer, and keep proof of delivery.
Debit cards and other payment methods
Debit-card protections differ from credit-card rules, and electronic-wallet, bank-transfer and cash transactions have their own procedures. Ask the provider for its applicable time limit and evidence requirements immediately. A provider may investigate without guaranteeing a reversal, so continue the marketplace process and keep the transaction record intact.

Identify the actual board partner and model, not only the GPU-chip brand. Warranty eligibility can depend on the country, seller, original-purchase status, authorized distribution and whether the product is a specific branded card.

For example, NVIDIA’s US warranty information describes coverage for specified NVIDIA-branded products and directs customers with problems to Customer Care. NVIDIA’s European guidance tells buyers to contact the local distributor or reseller first and limits coverage to original purchases through NVIDIA or an authorized seller. These terms do not create a universal warranty for every card sold with an NVIDIA GPU.
Read the warranty for your region and purchase channel. Save the serial number, proof of purchase and seller identity, and ask support whether a second-hand, marketplace or imported card is eligible before shipping it anywhere. A warranty claim does not replace a return or payment dispute when the item was misrepresented by the seller.

A report can help authorities and marketplaces identify repeat sellers, but it does not itself obtain a refund. In the United States, the FTC directs consumers who spot a scam to ReportFraud.ftc.gov. The FTC has also described marketplace duties under the INFORM Consumers Act, including identity verification for high-volume third-party sellers and ways for consumers to report suspicious activity.
“The INFORM Consumers Act requires online marketplaces to protect consumers from counterfeit, unsafe, and stolen goods by verifying their high-volume third-party sellers’ identities, and making it easier for consumers to report suspicious marketplace activity,” said Samuel Levine, Director of the FTC’s Bureau of Consumer Protection.
That 2023 statement describes marketplace obligations; it is not a promise that an individual claim will be decided in a buyer’s favor. Outside the United States, use the consumer-protection or fraud-reporting agency for your jurisdiction and keep pursuing the seller, marketplace and payment-provider remedies independently.
Choose the remedy that fits your facts
Evaluate each route against the same five questions:
- What is the mismatch? A materially different model or memory capacity is easier to describe than an unexplained benchmark gap.
- Which deadline comes first? Check the listing’s return period, marketplace claim window and payment-provider notice period on the actual transaction.
- What payment instrument was used? Credit-card, debit-card, bank-transfer and wallet procedures differ.
- Is manufacturer coverage plausible? Confirm region, seller authorization, original-purchase status and the exact board partner.
- Which route has the strongest evidence? Combine the saved listing, physical photos, diagnostic report, repeatable test notes and written communications.
Do not close one route merely because another is available. Tell each party when another case is open and provide consistent documentation. Never claim a card is definitively counterfeit when your records show only low performance; state what was advertised, what was measured and what remains unconfirmed.

Common mistakes that weaken a claim
- Returning the card before saving the listing, serial numbers and packaging photographs.
- Relying on a single benchmark with no settings, temperatures or system details.
- Flashing firmware or disassembling the cooler before checking return and warranty terms.
- Moving payment or the dispute conversation outside the marketplace.
- Waiting until the marketplace or issuer deadline has passed.
- Using “counterfeit” as a conclusion when the available evidence shows only a configuration or cooling problem.
- Sending a return without an authorized label, tracking number or proof of contents.
What a complete evidence packet contains
Assemble one folder with the saved listing, order confirmation, payment record, invoice, seller details, packaging and shipping-label photos, card and serial-number photos, operating-system and GPU-information reports, driver version, repeatable test results, temperature and power observations, all messages and a timeline of dates. Use the same factual summary in the marketplace case, issuer dispute and support request. This makes the discrepancy easy to verify without overstating what the tests prove.
Limits that depend on location and transaction details
Return rights, chargeback procedures, warranty coverage and fraud-reporting bodies vary by country, marketplace, seller, product and payment method. The US 60-day written period applies to certain credit-card billing errors, not automatically to every product-quality complaint. The current marketplace terms, card issuer instructions, manufacturer warranty and local consumer law control your specific case. If a substantial amount of money is involved or the seller threatens you, consult an appropriate local consumer agency or legal professional.
