What to Do After a Car Accident With an Uninsured Driver

A practical U.S. guide to handling a crash with a driver who appears uninsured: safety, evidence, possible insurance routes, and escalation options.
Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

If the other driver appears uninsured after a crash, first protect people and get medical help; then record what happened and contact your own insurer promptly. You may have a route to payment through coverage on your policy, but what applies depends on your policy and your state. Do not assume the other driver’s apparent lack of insurance means you have no options—or that your policy includes a particular coverage.

What should you do first after the crash?

Protect people before gathering evidence

  1. Check for injuries and call 911. The National Association of Insurance Commissioners (NAIC) advises: “Call 911 if someone is injured.”
  2. Move out of danger if it is safe. If the car can be driven, move it out of traffic when safe. Do not leave occupants exposed to traffic to take photos or collect information. Do not drive a vehicle that may be unsafe.
  3. Exchange and record identifying details. Get the other driver’s name and contact information, license number, license plate, and vehicle make, model, and year. If the driver cannot provide insurance details, record the information available and give it to your insurer. Collect witness names and contact information, too.
  4. Document the scene when safe. Record the date, time, exact location, weather and road conditions, and visible details. Take photographs or sketch a diagram only when it is safe to do so. Note the responding officer’s name, badge number, and contact details; ask how to obtain the accident report and record its report number.
  5. Notify your insurer promptly. Use the number on your insurance card or the insurer’s app. Ask which parts of your policy may apply and what documentation or notice conditions govern a claim. Keep claim, repair, medical, and communication records.

Who pays if an uninsured driver hits your car?

Possible payment routes depend on the loss, the coverage you actually have, and state rules. An apparent lack of insurance is not the same as a confirmed coverage determination, so provide the facts to your insurer and ask it to explain the options under your policy.

Possible route Loss it may cover What to check
Collision coverage Damage to your vehicle Whether you purchased it, the deductible, limits, and claim requirements. A deductible applies.
Uninsured motorist property damage (UMPD) Damage to your vehicle Whether it is available and included under your policy and state rules, plus the deductible, limits, and claim requirements. A deductible applies.
Uninsured motorist bodily injury (UMBI) Injuries to an insured person when an at-fault driver is uninsured Eligibility, limits, exclusions, deadlines, and coordination rules in your policy and jurisdiction.
Medical payments or personal injury protection (PIP) Specified medical or injury losses, depending on the coverage Whether the coverage applies, its limits, and how it coordinates with other claims under your policy and state system.

The NAIC notes that if an uninsured driver totals your car, you may have to rely on collision coverage or UMPD, if you purchased it; either route has a deductible. Neither coverage should be assumed to be part of every policy.

How does your state’s insurance system affect an injury claim?

Rules differ by state. In a no-fault system, a person’s own insurer may pay specified injury losses regardless of fault. Tort systems use different recovery paths. Which rules apply, and how they interact with your policy, depends on where the crash occurred and the coverage involved. Check with your insurer and consult your policy rather than assuming a uniform deadline or eligibility rule.

Uninsured drivers are a meaningful risk, but the available statistic is not a current-year estimate: the NAIC reported that the Insurance Research Council estimated 15.4% of motorists—about one in seven—were uninsured in 2023. The NAIC’s state estimates for that year ranged from 5.7% in Maine to 28.2% in Mississippi.

What if your insurer delays or denies the claim?

  1. Contact the insurer about the specific issue. Ask what information it needs, which policy terms it is applying, and what the next step is.
  2. Keep a communication timeline. Save claim numbers, letters, emails, and notes of calls, including dates and the names of people you spoke with. Preserve repair and medical records.
  3. Consider contacting your state insurance department. If the issue remains unresolved, the department may review complaints involving delay, denial, alleged policy or law violations, or poor communication. Complaint procedures vary by state.

What not to do

  • Do not put yourself or passengers in danger to collect evidence.
  • Do not confront the other driver or make a cash settlement on the spot.
  • Do not admit fault at the scene. Give accurate information and let the insurers investigate.
  • Do not assume a coverage applies, that payment is guaranteed, or that every state uses the same claim rules or deadlines.
