What to Ask Before Your Town Approves a Data Center Tax Incentive

Before a town approves a data-center tax incentive, require a written comparison with the no-incentive alternative. The analysis should show foregone revenue for every taxing body, public costs for power, water, roads and emergency services, independently verifiable jobs and wages, neighborhood and environmental effects, and enforceable remedies if the project changes or misses its promises.

Start by identifying the exact incentive, its term and recipient, the project’s end user if known, and every agency that must approve it. A local abatement or payment-in-lieu arrangement is different from a state sales-tax exemption or other state support; the agreement should show how those programs interact. This guide helps residents, council members, municipal staff and journalists test a proposal, but it does not determine a particular town’s legal authority or project finances.

1. What exactly is the town being asked to approve?

Do not evaluate a headline promise such as “a billion-dollar investment” until you can identify the legal instrument and all of its moving parts. Obtain the draft ordinance, incentive agreement, development agreement, site plans and any state applications before the vote.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.
  • Incentive type: Determine whether the proposal is a property-tax abatement, payment in lieu of taxes, tax increment arrangement, fee waiver, infrastructure subsidy or another local tool. List any state sales-tax, use-tax, income-tax or energy incentives separately.
  • Term and value: Record the start date, end date, phase-in schedule, percentage or payment formula, eligible equipment and buildings, and whether the benefit can be extended.
  • Parties and taxing bodies: Name the developer, parent company, end user where known, utility, county, school district, special districts and state agencies. Each may gain revenue or bear costs.
  • Conditions: Identify required investment, operating dates, jobs, wages, local hiring, apprenticeships, energy and water plans, community benefits, reporting and insurance.
  • Decision points: Create a calendar of zoning, conditional-use, building, utility, environmental and state reviews. A council vote may not be the only approval that shapes the project.

Maryland’s Executive Order 01.01.2026.16 directs future guidance to address first-contact questions such as the end user, power demand, water needs, energy plan, timeline and signs of a speculative proposal, as well as the interaction between state and local approvals. Use those questions as a starting checklist, not as a substitute for reviewing your own statutes and ordinances.

2. What will the incentive cost the town over its full term?

Require a transparent fiscal model that compares the proposal with a no-incentive baseline. A gross tax receipt or assessed-value increase is not the same as a net public benefit.

Model component Documentation to request Why it matters
Foregone revenue Annual tax that each county, municipality, school district and special district would collect without the incentive The same exemption can shift costs among taxing bodies.
New revenue Property, sales, utility, permit and other receipts, with assessment dates and phase-in assumptions Receipts depend on completion, assessed value and taxable activity.
Public service costs Police, fire, emergency medical, inspection, road maintenance, planning and legal costs during construction and operation Large facilities can require recurring services even when they create few permanent jobs.
Infrastructure costs Electric, water, wastewater, stormwater, road and communications upgrades, with the payer and schedule for each A project can be fiscally positive on paper while the public finances its capacity expansion.
Risk and sensitivity Scenarios for delayed construction, lower occupancy, lower assessed value, higher interest or utility costs, closure and expansion The council can see which assumptions drive the result.

Ask who prepared the model, whether an independent reviewer checked it, and whether figures are nominal or inflation-adjusted. Require annual cash flows rather than a single total. The agreement should state what protections apply if projected revenue does not materialize: repayment, a reduced benefit, a minimum payment, a bond, or another remedy. The New Jersey Economic Development Authority’s Data Center Municipal Resource Hub identifies assumption-building, comparison with other agreements and protections communities have sought when projections fail. Maryland’s order also calls for long-term abatement analysis, service costs and reopener terms.

3. How many permanent jobs and other benefits are additional and enforceable?

Separate temporary construction employment from ongoing operations. Request a job definition that excludes contractors who work only during build-out, and specify whether positions are full-time, part-time, on-site or remote.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Set measurable commitments

  • State a number of permanent jobs, wage floors, benefits and a deadline for reaching them.
  • Define local hiring by residence, not by a contractor’s headquarters, and identify the geographic area used.
  • Specify apprenticeship hours, training providers and the occupations covered.
  • List capital-investment milestones by date and phase.
  • Require payroll, wage and workforce reports that a third party can audit.

Require verification and remedies

Maryland’s order calls for standard methods to measure jobs, wages, local hiring, apprenticeship use and net fiscal impact, with time-bound commitments, periodic review and remedies. Put those methods in the agreement. Specify a reporting date, public release format, audit rights and consequences for a shortfall, such as a clawback or suspension of future benefits.

Comparative figures need careful qualification. In a 2026 review of a Washington urban-county preference, the Washington State Joint Legislative Audit and Review Committee reported nearly 300 temporary construction jobs and 53 permanent family-wage jobs claimed by beneficiaries; the Department of Revenue had not verified those job numbers. The same review found at least $111 million in assessed value and $1.2 million in property taxes added in two counties. Those results describe that Washington program and do not establish a net benefit for another town.

4. Who will pay for the electric system and grid upgrades?

Data centers can create a concentrated, high-load demand. Ask the developer and the utility for the same technical facts, then reconcile any differences.

  • Expected annual consumption and maximum coincident demand, by phase.
  • Interconnection request date, study status, queue position and required upgrades.
  • Construction schedule for substations, transmission, distribution and on-site generation.
  • Applicable large-load tariff or rate classification, demand charges and minimum-usage obligations.
  • Who pays for each upgrade, security deposit or stranded-asset risk if the facility is delayed or cancelled.
  • Energy plan, renewable procurement claims, backup generation and emissions controls.

Ask the utility to explain whether other customers could bear costs through rates or delayed reliability work. Maryland’s guidance specifically raises ratepayer and utility-infrastructure effects. Pennsylvania’s GRID standards announcement describes a state-support program in which covered applicants provide an energy plan and pay specified project-caused electricity-system costs. Those are Pennsylvania program standards, not automatic requirements for every town.

5. How much water and wastewater capacity will the facility use?

Request annual demand and peak-day demand for each phase, the water source, cooling technology, discharge quality and wastewater volume. Average use can conceal a capacity problem on the hottest or driest days, so compare peak demand with the utility’s firm capacity and drought plans.

  • Calculate wastewater flow and pollutant load, pretreatment needs, discharge location and monitoring.
  • Show who finances mains, pumps, treatment expansion, storage, fire-flow upgrades and stormwater controls.
  • Model water availability during drought, outages and simultaneous demand from existing customers.

The New Jersey municipal hub highlights peak-day usage and water projections. Maryland’s order identifies water supply, cooling alternatives, stormwater and discharges for agency review. A condition requiring the developer to pay connection and capacity costs should be tied to an engineering estimate and a schedule, not a broad promise to “coordinate with the utility.”

6. What land-use and neighborhood conditions apply?

A tax agreement does not replace zoning, building, environmental or public-safety review. Ask for enforceable conditions on the facility and its construction period.

  • Site and setbacks: Confirm zoning district, conditional-use authority, building height, setbacks, buffers and screening from homes.
  • Noise and lighting: Set measurable limits for cooling equipment, generators, alarms, construction hours, façade lighting and glare, with a complaint and correction process.
  • Traffic: Model construction haul routes, worker traffic, road wear, deliveries and emergency access; identify improvements and the payer.
  • Emergency readiness: Plan for fire suppression, hazardous materials, medical calls, generator incidents and coordination with local responders. Include equipment, training and recurring-service funding.
  • Air and climate effects: Disclose backup-generator fuel, operating hours, permits, emissions and testing; evaluate heat, noise, stormwater and other environmental effects.
  • Construction impacts: Require dust, vibration, erosion, work-hour, restoration and neighbor-notification controls.

Maryland’s order lists zoning, conditional-use review, setbacks, noise, lighting, buffering, traffic, emergency services and environmental considerations. The New Jersey guidance likewise advises assessing infrastructure, utilities, emergency response and community effects before finalizing community-benefit terms.

7. Can residents see the agreement and the assumptions before the vote?

Meaningful participation requires more than a presentation after negotiations are complete. Publish the draft agreement and supporting files early enough for residents and affected taxing bodies to review them.

Minimum public file

  • Developer, parent company and end user, with ownership changes disclosed.
  • Site footprint, building phases, projected power and water demand, cooling and backup-generation plans.
  • Fiscal model, no-incentive comparison, sensitivity cases and a list of assumptions.
  • Draft ordinances, community-benefit terms, utility commitments and state applications.
  • Job, wage, local-hiring and apprenticeship definitions, reporting forms and audit provisions.
  • Environmental, traffic, emergency-service and decommissioning plans.

Set a public comment period, hold meetings at accessible times, and explain which body can change each term. The City of South Bend’s Data Center Framework is one local example calling for public agreements, regular meetings and annual reporting, along with full property taxes, developer-paid utility upgrades, neighborhood investment and local labor priorities. Its choices are not universal law or proof that another jurisdiction has the same authority.

8. What happens if the project changes, underperforms or closes?

Insist that the agreement remain enforceable after a sale, redesign, delayed phase or closure. Include:

  • Quarterly or annual reports covering investment, assessed value, jobs, wages, water, energy, incidents and compliance.
  • Periodic review dates and clearly defined reopener triggers, such as a material change in ownership, load, footprint, schedule or public cost.
  • Successor obligations binding a purchaser or tenant, with notice and assumption requirements.
  • Audit access, records retention, cure periods, penalties, benefit suspension and clawback formulas.
  • Decommissioning, site restoration, equipment removal, financial security and responsibility for abandoned infrastructure.
  • A process for resolving disputes and publishing enforcement decisions.

Maryland’s order specifically directs guidance on reopener terms, successor obligations, remedies, decommissioning, reporting and periodic review. A promise without a measurement date, responsible party and consequence is not a reliable public benefit.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

9. Would the project proceed without the incentive?

Ask the developer to document alternatives: other sites, different financing, existing utility capacity, a smaller facility, a later phase or no incentive. Then have the town test those claims rather than accepting a stated “but for” assertion.

The 2026 Washington JLARC review found that the preference lowered costs and that some owners said it helped attract tenants, but it could not determine how much activity occurred because of the preference. Some capital investment likely would have happened anyway, and factors such as proximity to customers also influenced location decisions. The review reported that eligible equipment purchases rose from $40.6 million in fiscal year 2023 to $141.7 million in fiscal year 2026, while noting uncertainty about how much of that spending was attributable to the exemption. Treat those figures as evidence of one program’s experience, not as a forecast for your town.

10. How should the council compare the actual choices?

Put the offered incentive, no incentive, a smaller or shorter incentive, stronger conditions and no project approval on one scorecard. Use the same assumptions and time horizon for every option.

Decision axis Questions for every option
Net fiscal return What is the discounted and undiscounted public cash flow after foregone revenue, service costs and infrastructure?
Workforce benefit How many additional, verified jobs and wages result, and how much local hiring or apprenticeship use is enforceable?
Cost allocation Who pays for grid, energy, water, wastewater, roads, emergency services and environmental mitigation?
Neighborhood and environment What are the noise, lighting, traffic, emissions, water, stormwater and land-use effects, and can conditions be monitored?
Transparency Are the agreement, assumptions, reports and meetings public before and after approval?
Enforcement What review dates, reopener triggers, successor duties, security and remedies apply?

Do not treat another state’s threshold or municipal framework as controlling law. For context, Washington JLARC reported in 2026 that at least 38 states offered some form of preferential tax treatment specifically targeting data centers. That count shows how widespread the policy is, not that any particular incentive works. Its review estimated about $42.4 million in beneficiary savings across the Washington urban preference program; the estimate is not a measure of net public return.

11. A practical pre-vote work plan

  1. Collect the documents: Obtain the draft agreement, ordinances, site plans, utility filings, fiscal model, environmental studies and state incentive applications.
  2. Map the obligations: Create a table assigning every revenue, cost, milestone, report and remedy to the responsible party and taxing body.
  3. Validate technical demand: Ask the utility and water authority to confirm peak load, interconnection, capacity, upgrade timing and cost allocation.
  4. Test the counterfactual: Compare no incentive, alternative incentive sizes and project phases using identical assumptions.
  5. Publish and hear comments: Release the draft and model, allow sufficient review time, and record responses to material questions.
  6. Condition approval: Make benefits, reporting, audits, security, reopener rights and decommissioning obligations conditions of receiving each installment of the incentive.
  7. Schedule oversight: Assign staff, dates and public reporting duties for the entire term, not just the approval meeting.

A sound vote is therefore not simply “approve” or “reject” a promised investment. It is a decision about whether measurable benefits exceed the town’s full, risk-adjusted costs and whether the agreement can prove and enforce that result over time.
