CHIPS for America describes $50 billion in federal support: $39 billion for manufacturing incentives and $11 billion for research and development, according to the National Institute of Standards and Technology (NIST) program description updated in 2026. Commerce can combine negotiated direct awards with loans or loan guarantees, while Section 48D provides a separate tax credit for qualifying advanced-manufacturing investment.
The statute reaches beyond chip fabrication. Eligible activities can include assembly, testing, advanced packaging, semiconductor materials, manufacturing equipment and research. Workforce commitments and state or local grants, loans, tax incentives and infrastructure support can be layered onto federal assistance, but every package has its own milestones, reporting duties, restrictions and potential clawbacks.

What the CHIPS Act funds
The core authority is 15 U.S.C. §4652. It directs the Commerce Department to provide federal financial assistance for facilities and equipment in the United States used for the “fabrication, assembly, testing, advanced packaging, production, or research and development” of semiconductors, materials used to manufacture semiconductors, or semiconductor-manufacturing equipment.
That language makes the program broader than a conventional fab-construction subsidy. A project can be in the middle of the supply chain, provided it fits the statutory scope and the negotiated program terms.

| CHIPS for America component | Amount or scope | What it supports |
|---|---|---|
| Manufacturing incentives | $39 billion (NIST, 2026) | Construction, expansion or modernization of U.S. facilities and equipment for semiconductor and related manufacturing |
| Research and development | $11 billion (NIST, 2026) | National technology programs, advanced packaging, metrology, pilot capabilities and related R&D |
| Workforce | Project-specific commitments | Training partnerships and skilled technical workforce development associated with funded projects |
| Loans and loan guarantees | Negotiated authority alongside direct funding | Debt financing or guarantees that can be combined with a direct award, subject to terms and milestones |
The $50 billion headline is therefore an authorized portfolio, not a promise that every applicant receives a fixed share. Commerce negotiates the amount, form and conditions of each award.
Which activities and facilities can qualify
Fabrication and production
Projects that build, expand or modernize semiconductor fabrication capacity are the most visible use of the program. Commerce assistance can cover eligible facilities and equipment located in the United States, with payment tied to the project’s agreement and performance milestones.
Assembly, testing and advanced packaging
Packaging and back-end operations are expressly within the statute. A project focused on assembly, testing or advanced packaging does not have to be a traditional front-end wafer fab to fall within the covered activities.
Materials and manufacturing equipment
Facilities producing materials used to manufacture semiconductors and facilities making semiconductor-manufacturing equipment are also covered. This allows support for parts of the supply chain that can be bottlenecks even when wafer fabrication capacity exists.
Research and development
The R&D side is organized around four named programs: the National Semiconductor Technology Center (NSTC), the National Advanced Packaging Manufacturing Program (NAPMP), the CHIPS Metrology Program and the CHIPS Manufacturing USA Institute. Commerce announced more than $5 billion in expected R&D, workforce and related investments in February 2024, within the broader CHIPS R&D effort.

How the federal incentive stack works
1. Negotiated direct awards
The CHIPS Program Office evaluates applications and negotiates agreements for projects that build, expand or modernize eligible U.S. facilities and equipment. A direct award resembles a grant in that it provides federal funding, but the amount is negotiated and paid against agreed milestones rather than automatically delivered in a lump sum.
Agreements can include construction, production, workforce, financial and reporting requirements. The practical question is not simply whether a project is eligible; it is whether the applicant can meet the milestones and public-interest conditions attached to the award.
Do these 3 things before closing this tab:
1Scan for outdated or missing drivers - takes under a minute2Clear out junk files and repair common Windows errors3Fix the driver behind crashes, sound loss and screen glitches2. Loans and loan guarantees
CHIPS authority also includes loans and loan guarantees. A project may receive a direct award, debt support or a combination. Loans must be repaid, and a guarantee can reduce a lender’s risk without being the same as a cash grant. Government Accountability Office (GAO) reporting distinguishes direct funding from loans and tracks milestone oversight, so applicants should model debt service and any guarantee conditions separately from grant proceeds.
3. Section 48D advanced-manufacturing tax credit
Section 48D is a tax mechanism separate from Commerce’s negotiated awards. IRS guidance in 2026 describes a credit for qualified investment in an advanced manufacturing facility whose primary purpose is manufacturing semiconductors or semiconductor-manufacturing equipment.
| Qualified property placed in service | Credit rate in current IRS guidance | Important qualification |
|---|---|---|
| Through December 31, 2025 | 25% | Must be qualified property in an eligible advanced manufacturing facility |
| After December 31, 2025 | 35% | Statutory and regulatory conditions still apply |
The rate is based on when qualified property is placed in service, not merely when a project is announced or when construction begins. Treasury and IRS regulations also include a 10-year recapture rule for certain significant transactions involving expansion in a foreign country of concern. A company considering an acquisition, transfer or overseas expansion needs tax advice on whether the transaction could trigger recapture.

Treasury said on October 22, 2024 that the Advanced Manufacturing Investment Tax Credit, when paired with CHIPS direct funding and loans, provides a comprehensive federal incentive set for expanding U.S. semiconductor manufacturing. The credit should nevertheless be modeled as a tax benefit, with its own eligibility, basis, timing and recapture analysis, rather than treated as grant cash.

4. Research, pilot and measurement infrastructure
The NSTC, NAPMP, CHIPS Metrology Program and CHIPS Manufacturing USA Institute address technology development and commercialization barriers that individual factories cannot efficiently solve alone. Their purposes differ: advanced packaging, measurement capabilities, pilot-scale development and shared research infrastructure are distinct from a production-facility award.
Execution is still evolving. In August 2026, GAO reported that Commerce needed plans and timelines to meet statutory R&D requirements after delays or cancellations in some efforts. That status matters to companies planning around a future pilot line or shared facility: an announced program is not the same as an available capability or a guaranteed schedule.
5. Workforce and education
Workforce development can be a condition of a facility award. The statute’s objectives include bolstering U.S. semiconductor and skilled technical workforces, and agreements can require training partnerships, hiring targets or related commitments. In a GAO sample through July 2025, 13 of 19 companies received workforce-development funding associated with their projects.
Who can receive CHIPS support?
Eligibility depends on the covered activity, the proposed U.S. facility or equipment, the applicant’s ability to complete the project and the terms of the applicable funding opportunity. The statute is written for “covered entities” carrying out semiconductor, materials, equipment or R&D activities; it does not create an automatic entitlement for every company that buys or uses chips.

- Manufacturers: Companies proposing eligible fabrication, assembly, testing or packaging capacity in the United States.
- Supply-chain producers: Companies making semiconductor materials or manufacturing equipment.
- Research organizations and consortia: Entities participating in the named CHIPS R&D programs or related shared capabilities.
- Workforce partners: Training institutions and other partners included in an eligible project’s workforce plan.
An applicant should map each line item to a covered activity, identify the U.S. facility and equipment involved, and separate eligible capital from corporate spending that the statute or agreement does not cover. Commerce’s negotiated process means that technical eligibility is only the starting point.
How an award is made and paid
- Define the project boundary. Specify the facility, equipment, process, production or R&D activity, location and planned stages. Include assembly, testing, packaging, materials or equipment operations when they are part of the same investment case.
- Build the capital and financing model. Separate requested direct funding, possible loans or guarantees, the Section 48D tax benefit and state or local assistance. Show which costs are eligible for each instrument and when cash or tax value arrives.
- Prepare a milestone plan. Tie construction, equipment installation, workforce actions, production or research deliverables to dates and verification evidence. Do not present a federal award as a guaranteed completion date.
- Address workforce commitments. Identify training partners, job categories, hiring assumptions and any wage or workforce conditions the project can actually meet.
- Submit through the applicable Commerce process. Funding opportunities and application windows can change, so the current CHIPS Program Office notice controls the required forms, deadlines and evaluation criteria.
- Negotiate the agreement. Commerce and the applicant settle the award amount, funding instrument, milestones, reporting, safeguards and remedies. A ceiling stated in an announcement is an “up to” amount, not necessarily the amount paid.
- Execute and document performance. Draws and other support follow the agreement. Maintain cost, construction, production, workforce and compliance records for audits and milestone reviews.
State and local incentives: how stacking works
Federal support is only one layer of a semiconductor project’s financing. GAO identifies state and local grants, loans and tax incentives as additional sources. Jurisdictions may also contribute infrastructure support or negotiate commitments related to jobs and wages.
Compare a local package on the terms that affect the project’s net value and risk:
- Value and form: Up-front grant cash, refundable or nonrefundable tax benefits, low-interest loans and infrastructure work do not have the same timing or accounting effect.
- Performance conditions: Job counts, wage levels, construction dates, production targets and community commitments can trigger payment schedules or clawbacks.
- Tax treatment: Determine whether state benefits affect federal tax basis, taxable income or the amount of other incentives.
- Compatibility: Check whether a state or local covenant conflicts with federal milestone, reporting, security or foreign-country-of-concern provisions.
- Certainty and timing: A legislated credit, an appropriated grant and a negotiated infrastructure commitment have different approval and execution risks.
There is no nationwide “standard” state package. The relevant comparison is between specific jurisdictions and the obligations each one would impose.

Federal support can carry restrictions on certain transactions and expansion plans involving a foreign country of concern. The Section 48D regulations’ 10-year recapture rule is one example. Direct-award agreements can contain additional safeguards, reporting and milestone requirements.

Before accepting support, a company should review ownership, joint ventures, technology transfers, supply contracts, overseas expansion and significant transactions for compliance consequences. A package with a larger nominal award can be less valuable if its restrictions prevent a planned transaction or create a recapture exposure.
What has been awarded so far
Award totals are snapshots, not forecasts of final production. GAO reported approximately $31.7 billion in direct funding for 49 projects across 24 companies as of July 15, 2026. The comparable GAO figure in July 2025 was $30.9 billion across 40 projects and 19 companies.
These figures describe direct funding. They should not be read as the total value of loans, loan guarantees, Section 48D tax credits or state and local incentives, and they do not guarantee that every project will finish on a particular date. The difference between a negotiated award, a loan commitment and a tax expenditure is material when estimating public support.
How to compare two incentive packages
| Decision question | Why it changes the economics |
|---|---|
| Is the support cash, debt or a tax credit? | Cash improves project liquidity; debt requires repayment; a tax credit depends on qualified investment, tax position and placed-in-service timing. |
| What triggers repayment or recapture? | Milestone failures, loan terms, clawbacks and the Section 48D 10-year rule can reduce realized value. |
| Which project stage is eligible? | Fabrication, assembly, testing, packaging, materials, equipment and R&D have different capital profiles and program pathways. |
| What workforce obligations apply? | Training, hiring and wage commitments affect operating cost, schedule and compliance risk. |
| Are foreign-country-of-concern restrictions acceptable? | Restrictions can limit overseas expansion, transactions or technology arrangements. |
| Can state and local benefits be layered? | Stacking may improve total value, but overlapping conditions and tax treatment must be reconciled. |
| How certain is the timing? | Application windows, appropriations, negotiations and infrastructure delivery determine when the benefit is usable. |
Common mistakes to avoid
- Calling the entire $50 billion a grant pool: The portfolio includes manufacturing incentives, R&D, loans and other mechanisms.
- Treating 48D as Commerce funding: It is a separate tax credit with different qualification and recapture rules.
- Using an award ceiling as an expected payment: Negotiated agreements and milestones determine what is actually disbursed.
- Ignoring back-end and supply-chain projects: Assembly, testing, advanced packaging, materials and equipment are expressly covered activities.
- Assuming an announced R&D program is fully operational: GAO’s August 2026 findings show that some R&D efforts still required implementation plans and timelines.
- Overlooking local conditions: A state tax credit can carry job, wage, schedule or clawback obligations that materially change its value.
Bottom line for applicants and policymakers
The CHIPS Act works as an incentive stack. Commerce can negotiate direct manufacturing or R&D awards and pair them with loans or guarantees; Section 48D can reduce the tax cost of qualifying advanced-manufacturing investment; and state or local governments can add their own financing and infrastructure support. The strongest analysis keeps each instrument separate, tests milestones and recapture scenarios, and values the package by usable timing and obligations rather than by headline dollars alone.
