What Rules Apply to Trading Commodity Futures and Options in the U.S.?

The CEA and CFTC generally require exchange trading through registered intermediaries, risk disclosures, daily settlement and customer-fund safeguards. This guide explains the roles, limits and foreign-market rules that apply to U.S. customers.

U.S. commodity futures and options on futures are governed primarily by the Commodity Exchange Act (CEA) and regulations of the Commodity Futures Trading Commission (CFTC). In general, contracts must trade through an authorized exchange and appropriately registered intermediaries, with rules covering disclosures, margin, settlement, customer funds, recordkeeping and market oversight. Limited exceptions exist, and each contract and firm can have additional rules.

The legal framework in one view

The CEA is the federal statute that establishes the basic framework for commodity futures and options markets. The CFTC administers and enforces that framework through regulations and supervision of market participants. Designated contract markets, derivatives clearing organizations and the National Futures Association (NFA) perform self-regulatory functions within the federal system.

This framework is different from the rules for securities options, stocks or many off-exchange retail products. A commodity futures contract is an agreement to buy or sell a commodity at a future date for a price fixed when the contract is entered. Some contracts call for physical delivery; others are cash-settled, and many positions are closed by an offsetting trade before delivery. An option on a commodity future gives the purchaser the right, but not the obligation, to buy or sell a specified futures contract at a stated price and within a specified period or on a specified date.

The CFTC describes speculation in commodity futures and options as “a volatile, complex and risky venture that is rarely suitable for individual investors or ‘retail customers.’” That warning is central to understanding the rules: registration and disclosure requirements are designed to inform and supervise trading, not to make a leveraged product safe or suitable for everyone.

Where U.S. commodity contracts may be traded

With limited exceptions, commodity futures and options must be traded on an exchange that is authorized under the CEA and through persons or firms registered with the CFTC in the capacity required for their activity. The exact route depends on the product, the venue and what the intermediary does. An asserted exemption should be verified rather than assumed.

Exchange rules add product-specific requirements. They can specify contract size, delivery points, final settlement procedures, trading hours, position limits, price limits, exercise and assignment procedures, and margin levels. Those details vary by contract and can change over time. There is no universal margin amount or single set of delivery terms for all commodities.

Which intermediaries are involved?

“Broker” is not a single legal category in the CFTC system. A firm’s registration status indicates what it is permitted to do and which customer-protection obligations apply.

Intermediary category Typical function Customer funds in the CFTC overview Registration and oversight
Futures commission merchant (FCM) Accepts orders for futures or options and generally handles customer money, margin and account administration. FCMs hold customer funds subject to applicable requirements. Generally must register with the CFTC unless an exemption applies; registered FCMs must be NFA members.
Introducing broker (IB) Solicits or accepts orders but does not hold customer funds in the CFTC overview. Does not hold customer funds under this role description. Generally must register unless exempt; registered IBs must be NFA members.
Commodity trading advisor (CTA) Provides advice about the value or advisability of trading commodity interests. Its advisory status does not by itself mean it holds customer funds. Registration or an available exemption depends on its activities and clients.
Commodity pool operator (CPO) Operates a pooled investment vehicle that trades commodity interests. Funds are handled through the pool’s structure and service providers. Registration or an exemption depends on the pool and operator’s circumstances.

FCMs and IBs generally face capital, customer-fund, disclosure and financial-reporting requirements. Registration is not an endorsement by the CFTC or NFA and is not a guarantee against fraud, insolvency or trading losses.

What a retail customer must receive before opening an account

Before an FCM or IB opens a retail customer’s futures account, the customer must receive a written risk disclosure statement and return a signed and dated acknowledgment that the statement was received and understood. Comparable disclosure requirements apply to commodity options.

The disclosure is intended to explain the inherent risks and prompt the customer to consider whether they can financially bear them. Read the actual document supplied for the account rather than relying on a summary or sales presentation. It should be clear what products and markets the account can access, how margin calls work, what settlement or delivery obligations may arise, and how to contact the firm about an account problem.

Customers trading non-U.S. markets receive additional warnings about differences in laws and regulations and the effect of foreign-exchange movements. A foreign-market disclosure does not turn an offshore product into a U.S.-regulated deposit or eliminate the possibility of a loss.

Margin, daily settlement and the possibility of losses above the deposit

Margin in futures trading is a performance deposit, not a down payment that limits the total amount at risk. The required amount varies by contract, exchange, market conditions, account type and time. It can be increased when volatility rises, and an FCM may impose requirements above the exchange minimum.

Futures positions are marked to market. CFTC educational material describes customer accounts as being adjusted to reflect each trading day’s current market value at the close. A losing position can therefore create a payment obligation before the contract’s expiration. If available funds fall below the firm’s requirement, the customer may have to provide additional money or reduce the position.

Losses can exceed the amount initially deposited. A customer should not assume that an automatic liquidation, a stop order or a margin deposit caps liability. Fast markets, gaps, transaction costs and execution conditions can leave a deficit, and the account agreement determines how the firm may pursue amounts owed.

Options have a different payoff structure, but they are not automatically low-risk. The purchaser pays a premium for a right connected to a futures contract; the option’s terms specify the exercise price and expiration or exercise window. An option position can expire worthless, and an option writer or other participant can face obligations defined by the contract and exchange rules. The account disclosure should be reviewed for exercise, assignment, premium and margin treatment.

How customer funds are protected—and what that protection does not promise

CFTC materials describe customer funds as being maintained separately from the firm’s own funds, with customer accounts valued daily. These segregation and accounting requirements are important safeguards, but they are not deposit insurance and do not guarantee that every dollar will be recovered if a firm fails.

The protection that applies can depend on the regulatory category, the type of account, the records maintained and the circumstances of an insolvency. Segregation does not prevent market losses, eliminate a customer’s obligation to pay a deficit, or assure immediate access to funds during a failure.

On January 22, 2025, the CFTC published a final rule changing which investments FCMs and derivatives clearing organizations may make with customer funds and setting concentration limits. Those are technical investment rules; they do not change the basic point that customer-fund protections are safeguards rather than a promise of no loss.

Foreign futures and options sold to people in the United States

CFTC Part 30 addresses foreign futures and options offered or sold to customers located in the United States. A person or firm acting for U.S. customers in a capacity such as FCM, IB, CTA or CPO generally must register in the appropriate capacity or qualify for an exemption.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Registration relief is not blanket immunity. The CFTC states that antifraud provisions apply even where an exemption from registration is available. A foreign exchange, foreign broker or offshore account therefore should not be treated as outside all U.S. requirements simply because the contract trades abroad.

Foreign-market trading also adds practical risks: different trading hours, settlement conventions, legal remedies, insolvency regimes, disclosure standards and currency movements. The required customer disclosures should identify these differences. Verify both the firm’s U.S. status and the foreign venue’s identity before sending money or placing an order.

Self-regulation, records and complaints

Exchanges establish and enforce rules for listed contracts, trading conduct, position limits and settlement. The NFA performs self-regulatory functions for registered firms and associated persons. These organizations operate within the CEA and CFTC framework; their rules do not replace federal requirements.

The CFTC directs prospective customers to check a firm’s or individual’s registration and disciplinary history through NFA BASIC. A record showing registration means the person or firm is in the regulatory system, not that the CFTC or NFA has approved its strategy or guaranteed its financial condition.

Keep the account agreement, risk disclosures, statements, order records, margin notices and communications. If a dispute arises, first identify whether the issue concerns execution, an unauthorized trade, a margin call, a fund-transfer problem, a disclosure or suspected fraud. The firm’s complaint procedure, the exchange or NFA process and CFTC reporting channels can involve different facts and deadlines.

A practical compliance checklist before placing a trade

  1. Identify the exact product. Confirm whether it is a futures contract, an option on a futures contract, a security option or an off-exchange product. Record the contract month, underlying commodity, contract size, settlement method and expiration.
  2. Confirm the venue. Determine which exchange lists the contract and read its current contract specifications, trading hours, exercise rules, delivery terms and position limits.
  3. Check the intermediary’s capacity. Ask whether you are dealing with an FCM, IB, CTA, CPO or another category, and whether the person or firm is registered or relying on a stated exemption.
  4. Verify the background. Use NFA BASIC to check registration and disciplinary information. Treat a clean record as a verification step, not as a guarantee.
  5. Read and sign the disclosure. Review the written futures or options risk disclosure before the account opens. For foreign markets, read the additional warnings about legal, regulatory and currency differences.
  6. Model the cash obligations. Ask what the initial and maintenance margin are today, how often requirements can change, how variation payments are collected, and whether the agreement permits liquidation without advance notice in fast markets.
  7. Plan for settlement or delivery. Know the last trading day, first notice day where applicable, delivery location or cash-index methodology, and the steps required to close or roll a position.
  8. Confirm money movement. Send funds only to the account and entity identified in the firm’s official documentation. Understand where customer money is held and how withdrawals are requested.

Common misunderstandings and the correct rule

  • “My margin deposit is my maximum loss.” False. Futures losses can exceed the initial amount deposited, and options can create obligations depending on whether the customer buys or writes them.
  • “Registration means the firm is safe.” False. Registration and NFA membership place a firm within a regulatory framework but do not guarantee performance, solvency or an investment outcome.
  • “Segregated funds cannot be lost.” False. Segregation separates customer money from the firm’s proprietary funds; it does not insure against market losses or guarantee full recovery in an insolvency.
  • “All commodity products follow one margin rule.” False. Margin is contract-, exchange- and market-specific and can change.
  • “An offshore contract avoids U.S. law.” False. Part 30 generally applies when foreign futures or options are offered to U.S.-located customers, subject to registration and exemption rules, and antifraud provisions still apply.
  • “An introducing broker holds my money.” Not in the CFTC role description summarized here. An IB may solicit or accept orders, while an FCM generally handles customer funds.

What this framework does not decide for you

The federal overview does not determine whether a particular strategy is suitable, how a customer’s taxes will be calculated, which state-law requirements apply, or whether a specific person qualifies for an exemption. Contract-specific exchange rules, account agreements and current CFTC and NFA requirements control those questions. Obtain advice tailored to the product, account and jurisdiction when the consequences are material.
