Brazil’s president leads the federal executive and has substantial authority over administration, legislation, foreign relations, appointments, the Armed Forces and budget proposals. The office is not unchecked: the 1988 Constitution gives Congress roles in lawmaking, treaty approval and oversight, and provides for judicial review and proceedings against a president.
What does the president lead?
Brazil’s 1988 Constitution says the Executive Power is exercised by the president, assisted by ministers of state (Article 76). The president has superior direction of the federal administration and appoints and dismisses ministers. The Supreme Federal Court’s constitutional portal likewise describes the president as head of the federal public administration, with ministers subordinate to the office.

That leadership includes limited authority to organize the federal administration by decree. Under Article 84, a decree may address the organization and functioning of the administration only when it does not increase expenditure or create or abolish public bodies. The president may abolish vacant functions or positions by decree.

How can the president affect laws?
Legislative proposals, sanctions and vetoes
The president may introduce bills in circumstances specified by the Constitution. Once a bill passes Congress, the president may sanction and promulgate it or veto it wholly or in part. A veto must be issued within 15 working days and must be based on unconstitutionality or conflict with the public interest. It is not final: Congress may reject it by an absolute majority of deputies and senators.
Provisional measures
In cases of relevance and urgency, the president may issue a provisional measure with force of law and must submit it immediately to Congress. It is a temporary, reviewable instrument—not an unrestricted way to replace the legislative process. A measure generally loses effect unless converted into law within 60 days; that period may be extended once for an equal period.
The Constitution bars provisional measures on various subjects, including criminal and electoral matters, matters reserved to complementary law, and certain budget topics. Congress’s review and the subject-matter restrictions are set out in Article 62 of the current constitutional text.

The president maintains relations with foreign states and accredits diplomatic representatives. Treaties and international acts, however, require Congress’s approval under the constitutional framework.
The president is supreme commander of the Armed Forces and may appoint their service commanders. The president also makes appointments to offices identified in the Constitution, but some important appointments are subject to Senate approval. These include ministers of the Supreme Federal Court and other higher courts. The Constitution therefore does not make every senior appointment a unilateral presidential decision.
Can the president use emergency or security powers?
Article 84 lists powers that include decreeing a state of defense, a state of siege and federal intervention. Declaring war or making peace is also subject to congressional authorization or approval in the situations specified by the Constitution. These are exceptional powers with constitutional conditions; the list does not mean the president may invoke them without following the relevant procedures.

Does the president control the federal budget?
The president submits the multi-year plan, the budget-guidelines bill and federal budget proposals to Congress, and presents annual accounts. This gives the executive a central role in planning and proposing federal spending, but does not let the president set the budget unilaterally.

Congress has several constitutional checks: it reviews provisional measures, participates in treaty approval, confirms specified appointments and can override a veto. The courts also exercise judicial review under the constitutional system.

Articles 85 and 86 establish responsibility grounds and procedures for accusation and trial. After approval by two-thirds of the Chamber of Deputies, a case involving a common crime goes to the Supreme Federal Court; a responsibility-crime case goes to the Senate. These are constitutional procedures, not a claim that any particular case has occurred.
Formal powers do not guarantee political results
The Constitution defines what the office may do and where other institutions must participate. It does not by itself establish how much support a president can assemble in Congress or how effectively an incumbent can pursue a program. A constitutional power—such as proposing a bill or budget—is not the same as an assured political outcome.
