There is no single “low-pollution factory” permit in the United States. Before construction and startup, a facility must be screened for several separate triggers: air emissions, process wastewater, industrial stormwater, construction runoff, hazardous-waste activities, zoning and building rules, fire safety, sewer connections, utilities and business licensing. The correct permits depend on the site, process, equipment, chemicals, waste streams and receiving waters—not on the facility’s marketing description or the fact that emissions are expected to be small.
Federal programs are administered by the U.S. Environmental Protection Agency (EPA) in some locations and by authorized state, territorial, tribal or local agencies in others. Treat this as a U.S. framework; exact forms, thresholds, exemptions and deadlines must be confirmed with the authority for the proposed site.

Start with a facility profile, not a permit list
Permitting agencies decide applicability from facts about the project. Assemble one reliable profile before asking whether a permit is needed:

- Parcel zoning, site plan and nearby water bodies, wetlands or public sewers.
- Every production step, including heating, coating, mixing, cutting, printing, cleaning and packaging.
- Fuel-burning equipment, boilers, generators, ovens, stacks, vents and proposed pollution controls.
- Raw materials and chemicals, including quantities and outdoor storage locations.
- Expected process wastewater, cooling water, washdown, sanitary sewage and discharge points.
- Outdoor loading, maintenance, waste handling and material-storage areas exposed to rain.
- Waste streams and whether any waste will be treated, stored or disposed of on site.
- Construction acreage to be disturbed, grading plans and where runoff will go.
- Planned production capacity, operating hours and any future expansion or equipment changes.
This inventory lets an agency screen the project against each permit family. A short process description that omits a backup generator, solvent-cleaning station or outdoor waste container can produce the wrong answer.

Air permits: check construction first, then operation
New Source Review before building or modifying equipment
Clean Air Act New Source Review (NSR) can apply before construction of a new stationary source or a qualifying modification to an existing source. The review considers projected emissions and the applicable attainment or nonattainment requirements. A plant that expects low emissions is not automatically exempt; the agency needs an emissions inventory and control information to make that determination.
Do not order, install or begin construction of potentially regulated air equipment on the assumption that a permit can be obtained later. Ask the state, local or EPA permitting office whether the project requires a construction permit, a minor-source authorization, a registration, a general permit or a documented exemption. Keep calculations showing emission factors, operating hours, fuel use, material usage and proposed controls.
Title V operating permits
Title V is a separate operating-permit program for stationary sources that meet its applicability requirements. NSR approval to construct does not by itself answer the Title V question, and a source that does not need Title V may still need another air authorization. The completed equipment list and maximum potential emissions should be reviewed again before startup, especially if production capacity, fuels or controls changed during construction.
Ask the administering authority for its current applicability thresholds and forms. Thresholds and delegated procedures vary by jurisdiction, and the agency may require monitoring, recordkeeping, reporting or public participation even where emissions are comparatively modest.

Water permits: separate process discharges, sewer connections and stormwater
Process wastewater and NPDES
Identify every liquid leaving the property: process wastewater, cooling water, equipment washdown, boiler blowdown, contaminated runoff and sanitary sewage. A discharge of pollutants from a point source to waters of the United States generally requires authorization under the National Pollutant Discharge Elimination System (NPDES). The discharge point, pollutants, flow, receiving water and treatment system determine whether the authorization is a general permit or an individual permit.
Discharging to a publicly owned treatment works (POTW) is not the same as discharging directly to a river, lake or other receiving water. The sewer authority may impose pretreatment, sampling, prohibited-discharge, spill-response and sewer-use requirements, while the state NPDES agency may have additional approvals. Obtain written acceptance of the proposed wastewater characteristics and connection before relying on a sewer tie-in.
Industrial stormwater from operating areas
Stormwater is a distinct permit screen even when the manufacturing process itself is dry. Determine whether rain can contact raw materials, products, waste, loading areas, vehicle maintenance, process equipment or other industrial activity. EPA’s industrial-stormwater program lists 11 categories of regulated industrial activity. Examples include food processing, printing and publishing, electronic and electrical equipment manufacturing, and public warehousing and storage.

Most states administer industrial-stormwater requirements, although EPA remains the permitting authority in some locations. The applicable instrument may be a current general permit requiring a notice of intent, a stormwater pollution prevention plan, inspections, sampling and annual or event-based reports. Permit versions and filing dates change, so use the current authorization for the site rather than an old form retained from another project.

Construction stormwater
Construction runoff is reviewed separately from stormwater generated after the factory opens. Federal rules generally cover projects that disturb five acres or more. Operators covered by the construction general-permit process must install stormwater controls and develop a Stormwater Pollution Prevention Plan (SWPPP). The plan normally documents erosion and sediment controls, stabilization, inspections, corrective actions and responsible personnel.
A project disturbing less than five acres can still be regulated by state or local rules. EPA’s construction-stormwater guidance also describes a potential no-permit situation when all construction runoff is captured on site and does not discharge to a water of the United States. That outcome depends on the actual drainage design and should be confirmed by the permitting authority; a drawing that merely labels a basin “contained” is not proof of compliance.
Hazardous waste: determine what happens on site
RCRA permits for treatment, storage or disposal
The Resource Conservation and Recovery Act (RCRA) permit question turns on the facility’s waste activities. EPA states: “All facilities that currently treat, store or dispose of hazardous wastes or plan to do so must obtain a RCRA permit.” A RCRA permit establishes legally binding conditions for waste-management methods, facility design and operation, safety, monitoring and reporting.
Examples of activities that can change the analysis include operating a hazardous-waste treatment unit, storing hazardous waste beyond applicable accumulation rules, or disposing of hazardous waste in an on-site unit. Describe each unit, container or tank, waste code, maximum quantity and planned accumulation period to the administering agency.

Generators may have obligations without a RCRA treatment, storage or disposal permit
A factory that only generates hazardous waste and ships it to an authorized off-site facility may face generator requirements rather than a treatment, storage or disposal facility permit. Generator category, accumulation limits, labeling, manifests, emergency procedures, training and state-specific rules still require a facility-specific determination. Do not infer the category from the word “small”; the classification depends on the types and quantities generated over the relevant period.
Local approvals can stop a legally permitted project
Federal environmental authorization does not replace local development approvals. Before construction, confirm:
- Zoning and conditional-use approval for the proposed industrial activity.
- Site-plan, grading, building and occupancy permits.
- Fire-code review, hazardous-material storage approval and emergency access.
- Water, sewer and industrial pretreatment connection approvals.
- Storm-drain, road-opening, utility and excavation permissions.
- Business registration and any local operating license.
These approvals can impose setbacks, hours, truck routes, noise controls, fire-flow requirements or limits on outdoor storage that affect the environmental permit design. EPA recommends that potential permit applicants contact the relevant EPA headquarters or regional office or the state permitting authority, as appropriate, for additional information on permitting requirements. The same early coordination should include the municipality, fire marshal and sewer authority.

| Permit family | Main trigger | Typical phase | Likely authority | What to prepare |
|---|---|---|---|---|
| Air—NSR | New or modified stationary source with qualifying emissions | Before construction | State, local agency or EPA, depending on delegation | Equipment list, emission calculations, fuels, controls and stack information |
| Air—Title V | Stationary source meeting Title V applicability requirements | Before or during operation, as required | State, local agency or EPA | Maximum potential emissions, operating limits, monitoring and reporting information |
| NPDES process discharge | Point-source discharge of pollutants to waters of the United States | Before discharge | State NPDES agency or EPA | Outfalls, flow, pollutants, treatment, receiving water and sampling information |
| Industrial stormwater | Regulated industrial activity with exposed materials or operations | Before covered discharge or as the permit requires | Usually state; EPA in some locations | Site map, exposed areas, controls, SWPPP, inspection and sampling procedures |
| Construction stormwater | Construction disturbance, generally five acres or more federally | Before covered construction activity | State or EPA, with possible local requirements | Disturbance limits, erosion controls, SWPPP, inspections and stabilization plan |
| RCRA facility permit | On-site treatment, storage or disposal of hazardous waste | Before regulated activity | EPA or an authorized state | Part A and Part B information, design, operations, safety, monitoring and contingency plans |
| Local development and safety approvals | Use of the site, construction, fire, sewer, utilities and business activity | Often before construction or occupancy | Municipality, fire authority, sewer authority or utility | Site plans, building documents, chemical inventories, utility loads and operating details |
A general permit can simplify an otherwise standard activity, but it is not automatic permission. Confirm eligibility, submit the required notice or registration, follow all conditions and retain the agency’s acknowledgement.

How to sequence the work before breaking ground
- Fix the jurisdiction. Record the exact parcel, municipality, state or territory and any tribal status. Identify which agency administers each program.
- Freeze the preliminary design. Map process units, stacks, tanks, drains, outfalls, sewer connections, outdoor storage, waste areas and construction limits. Mark what is inside and outside.
- Run the air screen. Calculate potential emissions for each new or modified stationary source and ask whether NSR applies. Separately screen the finished source for Title V and other operating requirements.
- Map every water pathway. Distinguish direct discharges, sewer discharges, closed-loop systems, sanitary flows and stormwater. Obtain wastewater acceptance and pretreatment conditions from the sewer authority where applicable.
- Screen operating stormwater. Compare exposed activities with the applicable industrial categories, then identify the current general or individual permit and its SWPPP, inspection, sampling and reporting obligations.
- Screen construction stormwater. Calculate disturbed acreage, design controls and determine whether the five-acre federal threshold or a stricter state or local rule applies. Document any claimed on-site containment.
- Classify each waste stream. Determine whether waste is hazardous, how it is accumulated and whether any treatment, storage or disposal occurs on site. Seek a written generator or RCRA-facility determination when uncertain.
- Obtain local approvals. Coordinate zoning, site plan, building, fire, sewer, utility, storm-drain and business approvals with the environmental schedule.
- Submit complete applications. Use current forms and attach drawings, calculations, control descriptions, ownership information and responsible contacts. Incomplete applications commonly generate deficiency notices and redesign work.
- Set a no-start gate. List every authorization required before construction, discharge, occupancy and production. Assign an owner and retain the permit, coverage letter, approved plans and agency correspondence at the site.
What happens during a formal permit review?
RCRA applications illustrate the level of process that can apply to a complex facility. EPA describes a pre-application meeting, submission of Part A and Part B materials, a completeness review, notices of deficiency, draft-permit public review and a final decision. The agency can continue monitoring construction and operation after issuance.
Other programs use different forms, review periods and public-participation rules. An air or water authorization may be issued through a general permit, an individual permit, a registration or a written exemption. Ask the issuing authority what event authorizes construction, what event authorizes discharge and what event authorizes operation; those are not necessarily the same date.
Can production begin while a permit is pending?
Do not treat a pending application as permission to start. If a permit is required before construction, discharge or operation, wait for the authorization or for written confirmation that a specific coverage, exemption or interim provision applies. Starting early can create an unauthorized discharge, unpermitted air source, illegal waste activity or construction violation that is harder to correct than a delayed startup.
Before commissioning, verify that the installed equipment matches the application, control devices work as designed, outfalls and sewer connections are documented, stormwater controls are in place and required personnel are trained. If the design changed, notify the agency before startup; a change in fuel, capacity, chemical, stack, outfall or waste handling can alter permit applicability.
Common mistakes and how to avoid them
- Relying on the label “low pollution.” Replace the label with measured or calculated emissions, discharge routes, waste quantities and disturbed acreage.
- Checking only air permits. Run separate water, stormwater, construction, hazardous-waste and local-approval screens.
- Assuming a sewer connection eliminates environmental review. Obtain POTW pretreatment and sewer-use requirements and confirm whether any discharge reaches waters of the United States.
- Using the five-acre rule as a universal exemption. Smaller projects can be covered by state or local construction-stormwater rules, and containment claims require factual confirmation.
- Confusing a generator with a permitted waste facility. Decide whether the site merely generates waste or treats, stores or disposes of it.
- Designing first and contacting agencies last. Early agency review can prevent an outfall, stack, tank or access road from having to be relocated.
- Keeping obsolete permit forms. Industrial-stormwater instruments and filing requirements change; use the current version for the jurisdiction and application date.
- Starting construction after filing but before authorization. Identify the precise authorization-to-construct condition and retain proof of coverage before work begins.
The information that remains location-dependent
No national checklist can supply the exact zoning district, building permit, fire approval, sewer connection, utility authorization, occupational-safety obligations or state environmental forms for an unnamed site. Those answers require the location, process design, emissions inventory, acreage, receiving-water information and waste profile. The safest next step is a coordinated pre-application discussion with the relevant EPA office or delegated state, territorial, tribal or local agencies, followed by written confirmation of each required authorization and its timing.
