Short answer: In the United States, a city or resident usually cannot veto a video game merely because it portrays a real neighborhood, street, or public-facing building. The legal risk comes from something more specific: copied creative assets, official marks, implied sponsorship, contracts, an identifiable person’s likeness or private information, defamatory implications, or another jurisdiction-specific right. Video games are protected expressive works, but that protection does not override generally applicable laws.
This is a U.S.-focused explanation, not legal advice. The result can change by state, country, the exact asset shown, how realistic the portrayal is, and what the game’s marketing suggests.

What a real neighborhood does—and does not—give a game developer
A neighborhood’s existence, public geography, street names, and general look are not normally owned as a single copyrightable asset by the city or by the people who live there. A developer can generally create an expressive setting based on a real place without obtaining a blanket permission letter from the municipality or every resident.
Do these 3 things before closing this tab:
1Fix the driver behind crashes, sound loss and screen glitches2Clear out junk files and repair common Windows errors3Scan for outdated or missing drivers - takes under a minuteThe key question is what the developer actually copied or communicated. Independently built geometry, original textures, and fictional events raise different issues from copying a photographer’s image, scanning a privately supplied interior, reproducing a business’s distinctive logo, or portraying a recognizable person as making a false statement. A realistic map-like setting is not itself a universal license to reuse every item visible in that setting.

Nor is the answer simply that a city can never sue. A municipality or another claimant may have a case involving a particular mark, a city-owned creative work, a contract, false endorsement, or a factual and defamatory portrayal. The claim must connect to a recognized legal right rather than to the mere fact that the game resembles the city.
Why First Amendment protection matters
The Supreme Court held in Brown v. Entertainment Merchants Association, decided June 27, 2011, that “video games qualify for First Amendment protection.” That ruling treated games as expressive media rather than as unprotected conduct and rejected a content-based California restriction under strict scrutiny.
Protection for expressive speech is important when a game uses a real city to establish setting, realism, commentary, criticism, satire, or a fictional story. It does not create immunity from laws that apply regardless of viewpoint. Copyright, trademark-confusion rules, publicity and privacy rights, defamation law, and enforceable contracts can still apply. Courts therefore tend to ask both whether the use is expressive and whether the challenged conduct violates a separate, generally applicable rule.

No general ownership of public geography
A municipality ordinarily does not own the fact that a neighborhood exists, the public street grid, or the idea of placing a fictional story in that city. The federal government-work rule in copyright law concerns works of the United States Government; it does not automatically settle ownership of every state or municipal asset. A city’s rights depend on the particular work, agreement, mark, or conduct involved.
Official names, seals, logos, and slogans
City seals, department emblems, slogans, and other source-identifying marks can create trademark or related concerns. Risk increases when the game uses an official symbol as part of its own branding, packaging, store listing, or promotional campaign, or when an ordinary player could reasonably think the city sponsored, licensed, or approved the game.
A seal appearing incidentally on a fictional police vehicle is a different question from putting that seal on the game’s box art or presenting the title as an official municipal project. The analysis looks at source designation, likely confusion, artistic relevance, and the overall presentation, not merely whether the symbol appears on screen.

City-owned photographs, maps, databases, and commissioned work
A city may control particular photographs, promotional illustrations, databases, maps, or other creative works under copyright or contract, depending on who created them and what rights were transferred. Rebuilding a streetscape from independent observation is not the same as importing a city’s protected image file or database. Developers should identify the source of each asset and confirm the applicable ownership and license terms.

Contracts, permits, and location agreements
A permit, filming agreement, location release, procurement contract, or other promise may restrict how a city-owned location or material is used. Contract liability does not depend on whether the underlying neighborhood could otherwise be depicted. The relevant parties, language, duration, territory, and remedies must be reviewed separately.
False endorsement and misleading affiliation
The Lanham Act addresses false designations, false descriptions, and dilution while preserving certain fair uses, news reporting, commentary, and noncommercial uses. A city may have a stronger argument when the game’s advertising, title, or presentation implies official approval or production. A neutral disclaimer may reduce confusion, but it cannot erase a misleading campaign or authorize use of a protected mark.
Defamation involving officials or institutions
Using a city as a fictional setting is not the same as publishing a factual accusation about an identifiable official or institution. If the game communicates a provably false factual implication that harms reputation, defamation or a related claim may be considered. Fictional context matters, but labeling something “fiction” does not automatically defeat a portrayal that players would understand as asserting real facts.
What rights do residents have?
Living on a street does not create a veto
Residents generally do not control a public street’s depiction merely because they live there. A background neighborhood, anonymous house exterior, or ordinary street scene usually does not identify a person or appropriate an individual’s commercial identity.

Recognizable likenesses and publicity rights
The risk changes when a game depicts a recognizable individual. State right-of-publicity laws can restrict commercial appropriation of a person’s name, portrait, image, voice, or likeness. The elements and exemptions vary widely. Courts may examine whether the person is actually recognizable, whether the use is commercial or expressive, and how the relevant statute is worded.
New York Court of Appeals litigation involving Lindsay Lohan illustrates why an avatar and a commercial game are not automatically enough to establish a statutory publicity claim. Recognizability, the exact statutory language, and the legal character of the use all mattered. That decision should not be treated as a universal rule for every state.
Privacy and private material
Potential privacy theories can include intrusion into seclusion, public disclosure of private facts, or other state-law claims. A developer who models a public facade from observation faces a different question from one who reproduces a private home interior, family photograph, personal artwork, or information supplied under an expectation of confidentiality.
Defamation and false light
A character that merely resembles a resident is not automatically defamatory. The concern is a communication that a reasonable player would understand as a factual, false, and reputation-harming assertion about an identifiable person. False-light claims, where recognized, similarly depend on the jurisdiction and the portrayal’s implications. Fictional names or disclaimers may help, but they do not decide whether the overall message identifies someone and conveys actionable facts.
Buildings, photographs, maps, and other creative assets
Copyright protects original expression, not facts, ideas, locations, or the bare existence of a street. The practical issue is the asset reproduced. Original photographs, graphics, music, code, textures, map data, and sufficiently original designs may be protected even when they depict a public place.

Federal copyright law contains specific rules for architectural works and exclusive rights. Consequently, neither “every public building is free to reproduce” nor “every building requires permission” is reliable. Review the particular building, when and where it was designed, the source of the reference material, and the manner in which the game reproduces it.
An independently modeled exterior based on public observation is materially different from copying a photographer’s image pixel for pixel, extracting a commercial texture pack, or importing a third party’s 3-D scan. Ownership and license records should follow each asset into the project.
Fair use is also fact-specific. The Copyright Office’s Fair Use Index includes disputes involving photographs, graphics, news reporting, commentary, and video-game-related material, but those examples do not create an automatic safe harbor. Purpose, transformation, the nature of the work, the amount taken, and market effects must be evaluated for the particular use.
Using real businesses, logos, landmarks, and trade dress
A business name or logo can function as an expressive reference in a game, especially when it helps establish a believable setting. Risk rises when the mark becomes the game’s own source identifier, suggests sponsorship, or is presented in a way likely to confuse players about affiliation.
The Ninth Circuit’s Grand Theft Auto decision is a leading example. The court considered an expressive use of a potentially confusing business mark in a fictional city modeled on real urban areas and applied a First Amendment balancing framework. The decision does not mean every branded depiction is lawful; it shows why artistic relevance and the total context matter.
Best Value
| Use being evaluated | Questions that drive the analysis |
|---|---|
| Expressive reference | Does the mark or landmark contribute to setting, realism, criticism, commentary, or satire? |
| Source designation | Does it identify the game itself, its publisher, a level, or merchandise rather than the fictional world? |
| Implied endorsement | Would an ordinary player think the city, business, or person sponsored, licensed, or approved the game? |
| Accuracy and reputational effect | Is the depiction artistic and fictional, or does it communicate damaging factual claims as true? |
| Asset provenance | Did the developer create the depiction, obtain a license, or copy a third party’s photograph, map, artwork, or texture? |
Landmarks deserve the same item-by-item review. A public monument’s visible form, a privately owned artwork installed in a plaza, a mural, and a business’s distinctive trade dress can involve different owners and different rights. The fact that an object can be seen from a public place does not answer whether a particular photograph, artwork, logo, or scan was copied.
Is a disclaimer enough?
A disclaimer can help address confusion by stating that the game is fictional and not affiliated with or endorsed by a city, business, or person. It is a supporting measure, not a universal clearance strategy.

Placement and prominence matter: a barely visible notice cannot reliably undo a title, trailer, or store page that prominently implies official approval.
A practical pre-release clearance process
- Inventory every real-world reference. List city and neighborhood names, street layouts, landmarks, businesses, logos, signs, murals, public art, homes, interiors, and identifiable people appearing in the game and its marketing.
- Trace each asset’s source. Separate independently created geometry and textures from copied photographs, scans, maps, databases, licensed libraries, and material supplied by residents or businesses.
- Confirm ownership and permission. Obtain a license or release where a specific photograph, artwork, logo, contract, private location, or other protected asset requires one. Record scope, territory, duration, media, and modification rights.
- Review people separately. For every recognizable person, assess publicity, privacy, false-light, and defamation exposure under the jurisdictions most connected to the release and the person.
- Audit the marketing. Examine the title, key art, trailer, store listing, packaging, social posts, and influencer materials for language or design that implies municipal, business, or celebrity sponsorship.
- Use a carefully drafted disclaimer. Place it where players will see it, while treating it as a supplement to—not a replacement for—clearance.
- Preserve project records. Keep source files, creation dates, licenses, permissions, location agreements, and the editorial reason for each significant real-world reference.
- Escalate unusual risks. Obtain advice from counsel familiar with the relevant jurisdictions before launch when the game uses real residents, controversial allegations, private interiors, protected landmarks, official marks, or a highly realistic likeness.
When the answer changes by jurisdiction
There is no single nationwide rule for publicity, privacy, false light, municipal marks, architectural rights, or contract remedies. State statutes and common law differ, and other countries may apply personality, moral-rights, trademark, privacy, or cultural-property rules that have no direct U.S. equivalent.
For a U.S. release, analyze the states most connected to the person, business, city, developer, and distribution—not only the state where the fictional neighborhood is located. A game that is low-risk as an expressive setting can become higher-risk through its promotional language, copied source material, or an identifiable resident’s portrayal.
Bottom-line test for a real-neighborhood depiction
Ask four questions in order: What exactly was copied? Who owns or controls that asset or identity? Does the presentation imply sponsorship or state damaging facts about an identifiable person? Which jurisdiction’s law applies? If the answers point only to an independently created fictional setting, First Amendment protection is a substantial part of the analysis. If they point to a copied creative work, official mark, contract, private material, recognizable likeness, or misleading factual claim, obtain a targeted legal review rather than relying on the realism of the setting or a disclaimer.
