First choose a precise activity, identify a paying customer and capital plan, then map the venture to IN-SPACe authorization, telecommunications or broadcasting rules, foreign-investment limits and the infrastructure it will need.
Indian Space Policy 2023 allows non-government entities to pursue activities across the space value chain, from applications and satellite data to launch vehicles and in-space operations. The practical path depends on what your company will actually build, operate or sell.

Start by defining the business, not the company name
“Space technology” covers businesses with radically different customers, costs and approvals. A software company turning satellite imagery into crop-insurance analytics has a different path from a manufacturer of propulsion components or an operator of a launch vehicle. Before incorporation, write a one-sentence description of the activity and the transaction that creates revenue.
Common activity categories
- Satellite data and applications: Earth-observation analytics, navigation applications, climate intelligence, mapping, disaster response or other services built on purchased, leased or self-operated capacity.
- Communications: satellite-enabled connectivity, capacity resale, user terminals, ground systems or services using owned, procured or leased satellites.
- Hardware and components: satellite subsystems, sensors, avionics, communications equipment, ground and user-segment systems, test equipment or manufacturing services.
- Spacecraft and operations: designing, establishing or operating satellites and other space objects, including control and tracking functions.
- Launch and launch infrastructure: launch vehicles, associated systems and subsystems, launch pads, spaceports and related services, including sub-orbital activity.
- Ground infrastructure: telemetry, tracking and command (TT&C) earth stations, satellite control centres and data-reception stations.
- In-space services: in-orbit servicing, maintenance, transfers, space situational awareness and space-sustainability research and development.
Indian Space Policy 2023 describes an end-to-end role for non-government entities in these areas. That does not mean every activity is unregulated or that the policy guarantees a market. It means a founder can enter through data, software, components, ground infrastructure or services without necessarily owning and launching a satellite.

What Indian Space Policy 2023 changes for private companies
The policy’s stated vision is “to augment space capabilities; enable, encourage and develop a flourishing commercial presence in space; use space as a driver of technology development and derived benefits in allied areas; pursue international relations, and create an ecosystem for effective implementation of space applications among all stakeholders.” It permits non-government entities (NGEs) to establish and operate space objects, ground-based assets and space services, subject to authorization and other government requirements.
Private entities may provide services to public or private customers, and customers may procure space services from public or private sources. This creates permission to compete; it is not a promise of government contracts, launch slots or commercial demand. Your business plan still needs a specific first customer, a route to that customer and evidence that the customer will pay.
What IN-SPACe does—and when you need it
IN-SPACe is an autonomous agency in the Department of Space and a single-window interface between ISRO and private entities. It promotes, enables, authorizes and supervises space activities, including building launch vehicles or satellites, providing services, accessing public infrastructure and establishing new facilities. The policy identifies IN-SPACe as “the single window agency for the authorisation of space activities by government entities as well as NGEs.”

Activities specifically identified for authorization
The policy makes authorization activity-specific. Examples include:
- Establishing or operating space objects and launch vehicles.
- Conducting orbital and sub-orbital launches.
- Establishing and operating launch pads and other launch infrastructure.
- Planned re-entry of space objects.
- Operating TT&C earth stations.
- Operating satellite control centres and satellite data-reception stations.
- Disseminating high-resolution Earth-observation data.
- In-orbit sale, purchase or transfer of space objects or related assets.
IN-SPACe’s decision-making is subject to government directions and considerations including safety, national security, international obligations and foreign-policy interests. It also has roles relating to space-object registration, safety and security guidance, and liability guidance.
Remote-sensing data threshold
For remote sensing, dissemination of data with a ground sampling distance of 30 centimetres or finer requires IN-SPACe authorization on national-security grounds. Dissemination of data coarser than 30 centimetres requires intimation. The policy says these categorization thresholds may be reviewed, so confirm the current threshold and procedure before releasing a product.

Other regulators can still apply
IN-SPACe authorization is not a substitute for every approval. The policy assigns telecommunications policy to the Department of Telecommunications (DoT) and broadcasting policy to the Ministry of Information and Broadcasting. Communication and broadcast uses authorized through the space framework must be coordinated with those departments. Depending on your product, you may also need to address spectrum, safety, security, registration, liability, export-control, data or other requirements. The exact incorporation, tax, employment and compliance obligations depend on the proposed company and activity and require current professional advice.

- Define the activity and deliverable. State whether you sell hardware, launch capacity, satellite capacity, data, analytics, communications, ground support or an in-space service. Identify whether you will own, lease, procure or merely process space assets.
- Choose the first customer. Identify a named customer category and its buying process. Government procurement, a telecom operator, an insurer, a manufacturer and a consumer application each have different sales cycles and technical requirements.
- Map the authorization boundary. Compare the planned operations with IN-SPACe’s current forms and activity list. Mark every point at which the company will operate a space object, launch, ground station, control centre, data-reception facility, high-resolution Earth-observation product or in-orbit transfer.
- Separate regulated and unregulated components. A software analytics layer may be able to launch through a data provider, while the provider operating the satellite or receiving station carries separate obligations. Document who owns each asset, who controls it and who is responsible for safety and liability.
- Build a capital and infrastructure plan. Compare owned assets with leased or procured satellite capacity, shared test facilities, contract manufacturing and public infrastructure access. Include qualification, testing, insurance, launch, operations and replacement costs—not just prototype engineering.
- Incorporate after the structure is clear. Select the legal and ownership structure with advice on tax, employment, intellectual property, export controls and foreign investment. The available evidence does not establish a single incorporation form that suits every space company.
- Prepare the authorization package. Assemble the technical design, mission or service description, safety and security controls, ownership and funding information, liability approach, facilities, personnel and operating procedures requested by the current IN-SPACe process.
- Secure tests, partners and customers in parallel. Use letters of intent, paid pilots or validated technical demonstrations to reduce financing risk. Do not assume an authorization itself creates a contract.
- Recheck the rules before launch or release. Space policy, authorization forms, data thresholds and support-program terms can change. Confirm the current requirements immediately before filing, launch, data dissemination or fundraising.
Capital requirements differ by business model
A data or applications company can begin with licensed or procured data and cloud or ground-processing infrastructure. A spacecraft operator adds design, manufacturing, testing, launch, insurance, tracking and mission operations. A launch or spaceport company requires large-scale facilities, safety systems, range coordination and a longer route to revenue. Component manufacturers may need expensive qualification and customer audits even when they do not operate a space object.
The policy and Department of Space support landscape make shared resources worth investigating. The Department reports an IN-SPACe Technical Centre, discounted access to ISRO facilities, mentorship, skills initiatives, an affordable technical centre, technology transfer and opportunities for spaceworthiness validation through POEM. Availability, price, eligibility and technical suitability must be checked directly; none is automatic.

Public funding and support available to investigate
A Department of Space parliamentary reply in 2026 listed several mechanisms:
| Mechanism | What the government description indicates | How to treat it in a plan |
|---|---|---|
| Venture capital fund | ₹1,000 crore fund under the aegis of IN-SPACe | Investigate operating status, mandate, application route and eligibility; do not count it as committed capital. |
| Technology Adoption Fund | ₹500 crore support mechanism | Confirm the current call, eligible technologies, co-funding and selection terms. |
| IN-SPACe seed support | Seed assistance for qualifying early ventures | Check whether a current window is open and what technical milestones are required. |
| Public infrastructure and ISRO facilities | Discounted access, technical centres, validation and technology-transfer opportunities | Verify capacity, pricing, scheduling, licensing and technical fit before relying on access. |
The Prime Minister’s Office described the ₹1,000 crore venture-capital fund as intended to deploy capital over up to five years from the actual start of fund operations. The announcement gave an indicative investment range of ₹10 crore to ₹60 crore, depending on company stage, growth and impact on national space capability. Those are announced terms, not a guarantee that every startup can apply or receive money.

Foreign-investment limits by activity
The 21 February 2024 Press Information Bureau announcement on the amended FDI policy sets different automatic-route ceilings. Classify the company by its actual operations before presenting an ownership structure to investors.
Best Value
| Activity | Automatic-route ceiling | Above the ceiling |
|---|---|---|
| Satellite manufacturing and operation; satellite data products; ground and user segments | Up to 74% | Government route |
| Launch vehicles and associated systems or subsystems; spaceports | Up to 49% | Government route |
| Manufacturing components and systems or subsystems for satellites and ground or user segments | Up to 100% | Automatic route within the stated category |
These ceilings are category-specific. A company combining satellite operations, launch hardware and component manufacturing should obtain advice on how the rules apply to each activity rather than assuming the most favorable category covers the whole business.
How to compare possible space ventures
Use the following questions before choosing a product or fundraising narrative:
- What exactly is sold? Separate a physical subsystem from a launch service, satellite capacity, raw data, analytics, communications or ground support.
- Which asset is operated? Ownership, procurement and leasing can change capital needs and the authorization boundary.
- Which activity needs authorization? Flag launch, space-object operation, ground stations, control centres, data reception, high-resolution Earth-observation dissemination and in-orbit transfers.
- What infrastructure is essential? Determine whether you need a cleanroom, environmental testing, antenna access, tracking, a launch site, cloud processing or a partner’s facility.
- Which FDI category applies? Match the operating activity to the relevant automatic-route ceiling before accepting foreign capital.
- Who pays first? Name the buyer, procurement route, technical acceptance test and renewal or repeat-purchase logic.
This framework is an analytical planning tool, not an official scoring system. A lower-capital data business may reach revenue sooner but depend on data access and customer adoption; a launch or spacecraft business may create defensible technology but require substantially more capital, testing and regulatory coordination.
Current scale of India’s private space ecosystem
In a 2026 parliamentary reply, the Department of Space reported more than 400 active space startups, more than $600 million in private investment and $618.5 million in cumulative funding as of 31 March 2026. The same reply reported 108 IN-SPACe authorizations granted to non-government entities. These are government-reported ecosystem measures, not a forecast of any new company’s probability of success.
Common mistakes and how to avoid them
- Calling every space business an “upstream” company. A data product, ground system and launch vehicle have different rules and financing needs. Define the actual operation.
- Assuming incorporation equals permission to operate. Company registration does not replace IN-SPACe authorization, telecom or broadcasting compliance, safety controls or liability planning.
- Using the 30-centimetre threshold as a permanent rule. The policy allows categorization thresholds to be reviewed; verify the current position before dissemination.
- Budgeting only for research and development. Include qualification, testing, launch, insurance, operations, data rights, security and replacement or failure scenarios.
- Relying on announced funds as guaranteed grants. Check whether a scheme is operational, open, eligible for your stage and available for your technology.
- Applying one FDI limit to a mixed business. Separate activities and obtain an activity-specific analysis.
- Ignoring customer procurement. Policy permission does not create demand. Secure a credible buyer, pilot, channel or partnership.
- Filing against outdated requirements. Confirm current IN-SPACe forms, activity lists, safety guidance and other departmental rules immediately before submission.
What to verify before committing money
Before signing a lease, ordering hardware or accepting investment, obtain current answers on the proposed entity and activity for incorporation and tax treatment, employment obligations, intellectual-property ownership, export controls, spectrum and telecom permissions, data handling, insurance, liability, launch or range coordination, foreign-investment classification and customer procurement. The policy framework is broad, but the detailed obligations are venture-specific and can evolve.
A sound launch plan therefore has two parallel tracks: commercial validation with a first paying customer and a written compliance map showing which entity operates each asset, which authorization applies, which department must be consulted and which technical evidence is required. That discipline is what turns India’s policy opening into an investable, operable company.
