AI can widen that monitoring through tools such as facial recognition and automated analysis, but the term is a metaphor, not the name of one product or a settled legal category.
What does “digital panopticon” mean?
The idea draws on the panopticon, a prison design associated with philosopher Jeremy Bentham, in which a central observer could potentially watch people in surrounding cells without being seen. Michel Foucault later used the panopticon as a way to analyze surveillance, discipline, and work. In digital settings, the metaphor describes systems that make people observable at scale—and how the possibility of observation can influence their behavior. The European Parliamentary Research Service discusses this history in its study of digital surveillance, AI and the future of work.

It does not mean that one observer is literally watching every person at every moment. Digital monitoring may be continuous or occasional, live or retrospective, and limited to particular settings or purposes. The metaphor is most useful for considering the power created when people cannot easily tell what is being collected, who can see it, or how it may affect them.
How can AI surveillance work?
AI surveillance is not one technology. Some monitoring systems use AI to classify, compare, or analyze information; others collect data without using AI. Facial recognition is one example, but workplace monitoring, location tracking, and commercial data collection can raise related questions without necessarily involving facial recognition.

Facial recognition: verification, identification, and live scanning
Facial-recognition software can use algorithms and machine learning to estimate how similar a captured face is to a stored facial template. That comparison can serve different purposes. Verification checks whether someone is the person they claim to be, such as when matching a face to an enrolled account. Identification searches for who someone might be, for example by comparing an image with a watchlist. Live facial recognition applies identification to people in a public place in real time. These uses are not interchangeable: they involve different contexts and consequences. The UK Information Commissioner’s Office explains the technology and surveillance considerations in its facial-recognition guidance, while the UK government’s Centre for Data Ethics and Innovation distinguishes verification from searching a crowd against a watchlist in its AI Barometer.
Workplace monitoring
Employers may monitor work through cameras or microphones, computer-monitoring software, location trackers, phone applications, or wearable devices. Depending on the system, the data may relate to productivity, performance, safety, health, or security. Some tools can measure activity or location; others may generate assessments from those signals. A measure of activity is not automatically a reliable measure of the quality or value of someone’s work.

Government and commercial uses
A 2024 U.S. Commission on Civil Rights report described facial-recognition or biometric uses by the Departments of Justice and Homeland Security, as well as facial recognition incorporated into cameras in some federally funded public housing. The Commission said meaningful federal guidelines and oversight had lagged behind real-world use. Its report is a dated account of particular U.S. federal settings, not a complete inventory of current systems or a description of rules worldwide. Read the Commission’s 2024 report for its findings.

AI can also shape commercial data collection. In 2022, the U.S. Federal Trade Commission warned that using AI to address online harms can produce inaccurate, biased, or discriminatory results and can create incentives for more invasive surveillance and data extraction. That warning concerns potential risks and incentives; it does not establish that every AI service conducts surveillance. The FTC’s report announcement explains the concern.

Why can monitoring help—or harm—people?
Monitoring can support legitimate goals, including identifying safety problems, protecting security, or spotting health risks. But the same systems can also create pressure, misread people, or affect decisions about work and opportunity. Their effects depend on what is collected, how results are interpreted, and what employers or other institutions do with them.
The U.S. Government Accountability Office (GAO) assessed 122 studies published from 2020 through 2024 that it judged sufficiently robust to examine digital surveillance’s effects on workers. Its 2025 report found potential benefits as well as risks, including anxiety, pressure to work faster, injury risk, and unfair employment assessments based on inadequate metrics. GAO’s worker-effects report discusses the evidence and the roles of federal agencies.

Stakeholder views also differed. In a separate 2024 report, GAO analyzed 217 public comments submitted by 211 stakeholders to the White House Office of Science and Technology Policy from May to June 2023. Some comments described gains in productivity, security, or safety; others raised concerns about stress, morale, distrust, and monitoring that failed to measure actual work well. Those comments show a range of perspectives, not a representative survey of workers or employers. See GAO’s report on workplace surveillance tools, uses, and stakeholder perspectives.

A system’s output can influence real decisions even when it is uncertain. A mistaken facial match or an unreliable productivity score may have consequences for access, discipline, pay, policing, or services. Automated analysis can also perform unevenly across groups, and a person affected by a result may have little ability to understand or challenge it.

Privacy and civil-rights concerns therefore depend on more than whether a system uses AI. Relevant questions include whether the data collection is necessary for its stated purpose, how accurate the system is in the actual setting, whether errors differ across relevant groups, who reviews its output, and what happens after a mistake. The FTC’s 2022 warning and the U.S. Commission on Civil Rights’ 2024 report describe concerns about error, bias, discrimination, and oversight in their respective contexts; neither establishes that all systems have the same risks or are governed by the same rules.
Legal requirements also vary by jurisdiction and use. The ICO’s guidance concerns UK data-protection law; the Commission’s account concerns U.S. federal uses; and GAO’s reports examine U.S. workplaces and federal agency roles. These sources are dated, so they should not be treated as a complete statement of current law or practice everywhere.
How to assess a surveillance system
When comparing a monitoring tool or policy, look beyond the label “AI.” These questions help reveal what the system does and what is at stake:
- Purpose and setting: Is it verifying an identity, searching for a watchlisted person, measuring workplace activity, monitoring safety, or serving another purpose?
- Data and persistence: Does it collect images, location, activity, health signals, or other information? Is collection live or retrospective, how long is data retained, and who can access it?
- Consequences: Does the system only flag a case for human review, or can its output affect access, discipline, pay, policing, or services?
- Accuracy and fairness: Is there evidence about errors in the relevant setting and across relevant groups? Can people challenge a mistaken match or assessment?
- Transparency and governance: Are people told what is collected and why? What legal basis, oversight, accountability, and limits on reuse apply?
The sources cited here do not provide a single performance comparison across products or jurisdictions. A meaningful assessment needs evidence for the specific system, purpose, population, and decision involved.
