Access to a repository or download is separate from permission to use, modify, redistribute, or resell the code. GitHub explains that public repositories can be viewed and forked under its Terms of Service, while a license is needed to grant others permission to use, change, and distribute software as open source. Commercial code marketplaces also illustrate why buyers should read the actual license. For this marketplace, the account needs to state whether the buyer received a defined license or a copyright transfer, and whether commercial use, modification, sublicensing, embedding in another product, or redistribution was allowed. How could a buyer judge a listing and its seller?
Trust depends on more than whether a download works. A seller must have authority to offer the code, and the listing must accurately describe it. GitHub’s Marketplace Developer Agreement requires developers to represent that they have the authority and permissions needed to distribute their products, and requires listing text and images to be truthful and not misleading. A useful founder account should explain how seller eligibility and product claims were handled in practice:
- What evidence, if any, sellers supplied to show they could distribute the code.
- Whether anyone checked code ownership, third-party dependencies, or license obligations.
- Whether submissions were manually reviewed and what that review covered.
- How buyers could report copied, misleading, vulnerable, or malicious listings.
- What happened after a complaint, including any takedown, refund, or appeal process.
These checks matter because code can carry obligations and risks beyond its visible files.
