Human review of AI-assisted professional work is a control, not a ceremonial click. A suitably competent professional must understand the system’s relevant limits, inspect the actual output, apply independent judgment, correct or reject it, and be able to intervene or stop use. The depth of that review should rise with the potential harm, the system’s autonomy and the surrounding context.
That principle has binding force for specified high-risk AI systems under Article 14 of the EU AI Act. Outside that scope, professional duties, regulator guidance, contracts and firm policy still determine what responsible practice requires. There is no universal sampling rate, review duration or documentation form that makes every AI-assisted service safe.

Human review means meaningful control
A reviewer is not providing meaningful oversight merely by reading an AI-generated paragraph after it has been inserted into a client deliverable. The reviewer needs a realistic opportunity to detect a problem and enough authority to change the result, withhold it, escalate the matter or stop the AI-assisted workflow.

The European Commission AI Act Service Desk presents the purpose this way:

“Human oversight shall aim to prevent or minimise the risks to health, safety or fundamental rights that may emerge when a high-risk AI system is used in accordance with its intended purpose or under conditions of reasonably foreseeable misuse.”
In practical terms, a real review has five elements:
- Understanding: the reviewer knows what the system is intended to do, where it is unreliable and what kinds of error are likely.
- Inspection: the reviewer examines the output itself, not just a confidence score, a green status indicator or the fact that the prompt ran successfully.
- Independent judgment: the professional compares the output with authoritative information, the client’s circumstances and the service’s purpose.
- Correction or rejection: the reviewer can amend the work, request a fresh analysis or discard the result.
- Intervention: the reviewer can escalate, pause or stop AI use when the system behaves unexpectedly or the risk changes.
If any of those powers exist only on paper, the process is closer to passive approval than human oversight.
Do these 3 things before closing this tab:
1Repair Windows errors before they cause bigger problems2Fix the driver behind crashes, sound loss and screen glitches3Clear out junk files and repair common Windows errorsWhy the required review level changes
The European Commission’s explanation of Article 14 ties oversight measures to the system’s risks, autonomy and context. A single “human in the loop” rule therefore cannot fit every professional service. A model producing an internal list of possible agenda topics does not create the same exposure as a system that influences a medical recommendation, a legal position or a financial decision.
Assess the consequence of an error
Start with what could happen if an answer is wrong, incomplete or misleading. Consider physical or mental harm, loss of rights, financial loss, confidentiality damage, discrimination, missed deadlines, regulatory breaches and damage to a client relationship. A high-consequence task warrants verification of the underlying substance, not just proofreading.
Assess how much the system is deciding
Autonomy matters. A tool that suggests language for a professional to rewrite is different from one that ranks cases, selects an action or sends a client-facing communication automatically. The more the system determines the outcome, the earlier and stronger the human intervention must be.
Assess the surrounding context
The same output can have different implications depending on who is affected, what information was supplied, whether the client can challenge the result and whether a professional can still prevent harm. Time pressure, vulnerable people, cross-border work, sensitive data and irreversible decisions all justify a more cautious design.

Who is responsible for AI-generated work?
The professional who delivers or relies on the work remains responsible for the professional judgment applied to it. AI output does not transfer that responsibility to the software provider or to an unnamed “human reviewer.” The reviewer’s identity, competence and authority should be clear before the system is used.

Competence includes subject knowledge and AI literacy
Recital 73 of the EU AI Act and European Commission deployer guidance describe the need for people assigned to oversight to have appropriate competence, training and authority. Competence has two dimensions: enough subject expertise to evaluate the service, and enough understanding of the AI system to recognize its relevant limitations and failure modes.
A technically confident operator who cannot assess the professional substance is not an adequate reviewer. Conversely, a subject expert who does not know that the system can invent citations, omit context or misread data may accept a polished error. Training should address both sides.

Authority must be usable in the real workflow
Give the reviewer time to investigate, access to the authoritative materials needed for checking and permission to delay delivery. If a reviewer is measured only on throughput, told that the AI result is already approved or unable to escalate without penalty, the nominal control is unlikely to work.
Professional rules still apply
ABA Formal Opinion 512 describes how existing lawyer duties—competence, informed consent, confidentiality, communication and fees—apply when lawyers use generative AI. Florida Bar Opinion 24-1 likewise states that lawyers remain responsible for their work product and professional judgment. Florida’s opinion is advisory rather than binding, and ABA guidance is not a statute binding every lawyer. They are examples of how existing duties continue to govern technology-assisted work.
Design the review before deploying the system
Retrofitting a review step after a failure usually produces a checklist that is too vague to guide a decision. Set the control in advance, while the intended use and the consequences of error are still being considered.
- Define the intended purpose. Describe the service, the users, the affected people, the input data, the expected output and whether the output is internal, advisory or client-facing.
- Map the consequences of being wrong. List plausible harms, professional duties, deadlines, contractual limits and decisions that cannot easily be reversed.
- Determine the system’s autonomy. Record whether it drafts, recommends, ranks, decides, takes an external action or communicates without a further approval.
- Set review levels. Identify uses requiring full verification, a second professional opinion, escalation to a specialist, client communication or a prohibition on AI assistance.
- Assign the reviewer. Name the role, required subject expertise, AI training, access rights, time allowance and authority to correct, reject, override or stop the process.
- Define evidence for acceptance. Specify which facts, calculations, citations, assumptions, personal data and contextual details must be checked before release.
- Define stop and escalation triggers. Include unexplained conclusions, missing sources, contradictory evidence, sensitive-data exposure, unusual confidence, a material change in facts or an output outside the system’s intended purpose.
For EU high-risk systems, the oversight measures must be aligned with risk, autonomy and context. For other systems, the same planning discipline is a practical way to translate professional duties into an operable control.

Run a substantive review, not a spell-check
Once the output exists, the reviewer should work through checks tailored to the service. Legal and regulatory guidance emphasizes scrutiny, professional judgment and verification; the following sequence turns those ideas into a repeatable practice.
- Confirm the input and assignment. Check that the system received the correct version of the client’s facts, instructions, dates, jurisdiction and constraints. A correct answer to the wrong question is still a failure.
- Verify material facts. Compare factual assertions with authoritative records, primary legal or regulatory materials, clinical references, financial statements or other sources appropriate to the task. Do not treat fluent wording as evidence.
- Recalculate important numbers. Independently check formulas, totals, units, rates, assumptions, ranges and dates. Where a number drives a decision, preserve the calculation or source needed for another person to reproduce it.
- Check citations and authorities. Open the cited authority, confirm that it exists and make sure it supports the proposition stated. An invented case, regulation, study or link is a substantive defect, not a formatting issue.
- Test completeness and context. Look for omitted exceptions, counterarguments, limitations, adverse facts, eligibility conditions and downstream effects. Ask what a reasonable client or affected person would need to know before acting.
- Assess professional fit. Decide whether the result is appropriate for this client, engagement, jurisdiction, risk tolerance and intended purpose. A technically accurate passage can still be unsuitable advice.
- Resolve uncertainty openly. Mark unresolved issues, state assumptions and seek additional information when the output cannot support a reliable conclusion. Do not convert a model’s speculation into a definitive statement.
- Make and record the decision. Accept, edit, reject, escalate or stop. The decision should reflect the reviewer’s own professional judgment, not an automatic acceptance rule.
Protect confidentiality, privacy and client expectations
Review quality cannot be separated from information handling. Before sending data to an AI system, determine what the tool stores, who can access it, whether inputs are used for further training, where processing occurs and how deletion or retention works. Apply the confidentiality, privacy and security rules that govern the particular profession and engagement.
For lawyers, ABA Formal Opinion 512 identifies confidentiality, communication and informed consent among the duties that can arise when using generative AI. Florida Bar Opinion 24-1 addresses similar professional responsibility concerns. The CFP Board’s February 2025 guide addresses ethical use of generative AI by CFP professionals, including confidentiality and privacy-law compliance. These materials do not create one universal disclosure script; they show why the client relationship and the data involved must be considered.

Ask whether the client’s consent, a disclosure, a contractual restriction or a regulator’s requirement applies. Explain material use of AI when the applicable professional rule or the nature of the service makes that communication relevant. Do not disclose confidential information merely because a tool makes it convenient to do so.
Record enough to make the decision traceable
Traceability supports accountability. The OECD AI Principles, updated in 2024, call for traceability across datasets, processes and decisions as appropriate to the role and context. The EU AI Act and European Commission guidance also address monitoring and record-keeping for high-risk deployment.
A proportionate review record can identify:
- the task and output that were reviewed;
- the system and version or configuration used, where available;
- the reviewer and their role;
- the authoritative sources, calculations or tests used;
- material errors, corrections, overrides and unresolved limitations;
- the final professional decision and any escalation; and
- the date and the facts or system conditions that could require a later review.
This is an implementation pattern, not a form prescribed for every service. Keep only what is justified by the risk, confidentiality obligations and applicable retention rules. The record should let the firm explain what was checked and why the final result was accepted or changed without creating an unnecessary cache of sensitive client data.
Monitor the system after launch
A review process can degrade as models, prompts, connected data and user behavior change. Monitor recurring errors, near misses, complaints, overrides, escalations and incidents. Analyze whether the same failure appears across matters or only in a particular context.
When a pattern appears, update the prompt or workflow only after determining whether the underlying problem is the model, the data, the reviewer’s training, the task definition or an unrealistic deadline. Revisit the review level when the system changes, a new use is proposed, the affected population changes or a previously reversible decision becomes consequential. European Commission guidance for high-risk deployers includes monitoring and action on identified risks or serious incidents; the same feedback loop is useful for lower-risk professional applications.

Before adopting a workflow, check the regulator, bar, professional body, privacy law, engagement terms and internal policy that actually govern the service. A statement that is binding for an EU high-risk deployment may be guidance for a U.S. professional, while a regulator’s supervision expectation may apply only to its own members.

The reviewer lacks authority to delay delivery
Why it fails: a reviewer who cannot reject or escalate an output cannot provide effective oversight.
Fix: give the role explicit stop, override and escalation powers, and protect the time needed to use them.
The reviewer checks style but not substance
Why it fails: polished prose can conceal fabricated authorities, missing exceptions or a wrong interpretation of client facts.
Fix: verify against authoritative materials and independently recalculate consequential figures.
One checklist is used for every task
Why it fails: review appropriate for an internal draft may be inadequate for a high-impact recommendation or client communication.
Fix: set review levels from the task’s harms, autonomy, context, data sensitivity and professional obligations.
Client communication is treated as optional
Why it fails: confidentiality, consent, disclosure and contractual duties differ by service and jurisdiction.
Fix: decide at intake whether AI use must be disclosed, consented to, restricted or prohibited.
No record exists after approval
Why it fails: the firm cannot explain who checked the work, what evidence was considered or why an override was made.
Best Value
Fix: keep a proportionate trace of the output, reviewer, material checks, changes and final judgment.
Compare review approaches by control quality
When choosing among workflows, score each approach against the factors that determine whether oversight will work in practice:
- Risk coverage: Does it address the harms and professional duties relevant to the task?
- Reviewer capability: Does the reviewer have subject expertise, AI literacy, training, authority and sufficient time?
- Verification depth: Are the claims, calculations, citations and context that matter independently checked?
- Traceability: Can the firm explain what was reviewed and why the final decision was accepted or changed?
- Workflow fit: Does intervention occur while a mistake can still be prevented?
- Client and data protection: Does the process respect confidentiality, consent, privacy and contractual limits?
A faster workflow is not better if it moves the review after an irreversible action or leaves the reviewer unable to challenge the model. Conversely, a full manual re-performance of every low-consequence draft may consume attention that should be reserved for higher-risk work. The comparison should be made against the actual service and its failure modes.

A practical approval checklist
Before releasing AI-assisted professional work, the responsible reviewer should be able to answer yes to the checks that apply:
- The task, intended audience and decision context are clear.
- The input facts, dates, jurisdiction and constraints are correct.
- Material factual claims are checked against authoritative sources.
- Important calculations and assumptions are independently verified.
- Citations and authorities exist and support the statements made.
- Relevant exceptions, limitations, uncertainty and adverse information are addressed.
- The output is suitable for this client and purpose, not merely well written.
- Confidentiality, privacy, consent, disclosure and contractual requirements have been considered.
- The reviewer has corrected, rejected, escalated or stopped the output where necessary.
- The decision and material checks are recorded at a level proportionate to risk.
This checklist should be adapted to the profession and engagement. It is a practical implementation of the cited principles, not a universally mandated legal form.
How much human review is enough?
Enough review is the amount that gives a qualified person a genuine chance to prevent the reasonably foreseeable harm of the particular use. That normally means more than proofreading when the system supplies analysis, recommendations, calculations or facts on which a client or affected person may rely.
Set the level before deployment, document the rationale, and increase it when the system is more autonomous, the consequences are more serious, the context is less understood or the data is more sensitive. Decrease it only when the lower-risk assessment is deliberate and supported by the applicable professional and organizational rules.
No source cited here supplies a universal review percentage, mandatory second-review rule or one-size-fits-all retention period. The defensible standard is a qualified reviewer with the competence, information, time and authority to understand the output, challenge it and intervene before harm occurs.
