Short answer: In the U.S. federal system, seized bitcoin is moved into government-controlled custody while a forfeiture case proceeds. It is not automatically auctioned the moment agents take it. If holding the coins risks a loss or creates excessive custody costs, the government can sell them before the case ends; the sale proceeds then represent the bitcoin in court. After final forfeiture, the U.S. Marshals Service (USMS) generally sells or otherwise disposes of the asset and deposits net proceeds into the applicable forfeiture fund. Allowable expenses, liens and approved claims are addressed before money is distributed to eligible victims, owners, lienholders, participating agencies or program operations.
Seizure is custody, not the end of the case
A seizure gives the government control of property; it does not by itself decide who ultimately owns the value. Bitcoin can remain tied up in a civil or criminal forfeiture proceeding while prosecutors provide notice, resolve claims and seek a final order. The important distinction is between seized bitcoin, which is being held during the case, and forfeited bitcoin, which a court or other authorized process has determined can be taken permanently.

The federal process described here is based on U.S. Department of Justice (DOJ) guidance. State, local, foreign, bankruptcy and other civil-forfeiture systems can use different custodians, deadlines, funds and claimant rules.
Two routes into government custody
- Self-custodied or cold-storage seizure: The seizing agency transfers the cryptocurrency to a government-controlled wallet. DOJ’s 2025 Asset Forfeiture Policy Manual says every seizing agency must have a government-controlled self-custodial or cold-storage wallet for temporary storage before custody moves to USMS or a USMS contractor.
- Hosted-service seizure: If the bitcoin is held by a U.S.-based virtual-asset service provider, the agency serves a seizure warrant on that provider. The provider then restricts the account and transfers control as directed by the warrant and the custodial process.
The policy manual also cautions that some cryptocurrency types may not be storable or liquidatable by USMS. That means the practical handling of an asset depends on its technical form, liquidity and the government’s ability to secure it.

What happens while the forfeiture case is pending?
Once secured, the bitcoin is treated as property in government custody rather than as spendable agency revenue. The agency and USMS preserve records of the amount, wallet or account, transfer history and custody changes. A claimant may contest the forfeiture, assert an ownership interest or raise a lien. Until the case is resolved, the government must decide whether continued holding is sensible and legally permissible.
Why the government might sell before a final order
Bitcoin’s price can change sharply, and digital-asset custody can create security, insurance and administrative expenses. DOJ guidance allows an interlocutory, or pre-forfeiture, sale when the property is declining in value or when custody costs are excessive. The sale is not an admission that the claimant loses; it changes what is being held.
After an authorized early sale, the bitcoin is replaced by its proceeds. DOJ guidance says those proceeds are promptly deposited into the Seized Asset Deposit Fund while the forfeiture action continues. If a court later orders the property returned, the relevant monetary amount is the substitute proceeds, subject to the governing rules and deductions.

What an early sale does not mean
- It does not mean every seized bitcoin balance is immediately sold.
- It does not end the forfeiture case.
- It does not guarantee that the eventual proceeds equal the bitcoin’s value on the seizure date.
- It does not eliminate claims by owners, lienholders or victims.
What happens after final forfeiture?
When forfeiture succeeds, property that is not retained for official use or transferred to another government agency is generally disposed of promptly. The Justice Manual states that the Attorney General may dispose of forfeited property by sale or any other commercially feasible means without obtaining another court approval. For bitcoin, that can mean a market sale or another legally permitted liquidation method rather than a single type of auction.
DOJ’s guidance says that, after successful forfeiture and absent an official-use or agency-transfer decision, the property is promptly sold and the proceeds are promptly deposited into the DOJ Assets Forfeiture Fund. The fund is an accounting destination for forfeiture proceeds; it is not a statement that the government receives the headline market value without deductions.
Process at a glance
| Stage | What is held | Typical federal handling |
|---|---|---|
| Initial seizure | Bitcoin or control of an account | Government-controlled wallet, cold storage or a warrant served on a U.S.-based hosted provider |
| Pending case | Bitcoin, unless converted | Custody continues while notice, claims and forfeiture litigation proceed |
| Pre-forfeiture sale | Sale proceeds substitute for the coins | Used when value is declining or custody costs are excessive; proceeds go to the Seized Asset Deposit Fund |
| Final forfeiture | Forfeited property or its substitute proceeds | Prompt sale or another commercially feasible disposition unless retained or transferred for official use |
| Distribution | Net money after allowed deductions | Deposited in the applicable forfeiture fund and used under federal remission, mitigation and sharing rules |
How the government determines bitcoin’s value
There is no single valuation number that controls every stage. Bitcoin can have one market price when agents seize it, another when a judge authorizes an early sale and a third when USMS completes a post-forfeiture disposition. The relevant documents may therefore show different amounts for the same coins.

The key valuation points
- Value at seizure: An appraisal or market calculation may establish the property’s value when it was taken. This date can matter when a claimant seeks monetary relief.
- Value at an early sale: If the coins are liquidated during the case, the actual sale proceeds become the substitute asset. Market movement after that sale does not change the amount received from the transaction.
- Amount realized at final disposition: If the government holds the bitcoin until forfeiture, the realized sale amount reflects the price, execution method and costs at the time of disposition.
- Net amount available: Expenses, liens and legally authorized claims reduce the amount that can be distributed.
Under 28 CFR Part 9, monetary relief cannot exceed the appraised value at seizure or the amount realized from sale or another disposition, depending on the rule being applied. That ceiling prevents a claimant from receiving more than the value recognized under the applicable measure. It also means a headline estimate is not necessarily the amount a person will receive.

- A market estimate may be calculated at the time of seizure, while the coins are sold months or years later.
- A large balance can be sold in stages or through a method that produces a different execution price than a simple spot-price multiplication.
- Custody, brokerage, storage, court and investigative expenses may be deducted before distribution.
- A legal claim may be limited by an appraisal, the sale proceeds or both, rather than by the highest market price reached after seizure.
Which costs and claims come out first?
Forfeiture accounting starts with the gross value and subtracts allowable amounts. DOJ rules identify categories that can include court costs, storage, brokerage and sales expenses, liens, investigative or prosecutorial costs and petition-processing expenses. The exact deduction depends on the proceeding and the governing authority.
A lienholder is not automatically paid the full amount asserted. The lien must be legally recognized, tied to the property and eligible under the applicable remission or mitigation process. Similarly, a victim must satisfy the federal eligibility and proof requirements; a general allegation of loss is not enough.

Where does the money go?
USMS materials describe forfeited proceeds as supporting several lawful purposes: operating the asset-forfeiture program, compensating eligible victims and supporting law-enforcement efforts. The order and eligibility requirements matter more than the publicized gross value.
| Potential recipient or use | How it works |
|---|---|
| Allowable expenses | Court, storage, brokerage, sale, investigative, prosecutorial and petition-processing costs may be deducted as authorized. |
| Owners and lienholders | Eligible parties can seek remission or mitigation, subject to proof, legal priority and the applicable monetary limits. |
| Victims | Victim compensation is possible when the loss and eligibility are established under federal rules; it is not automatic for every person connected to the case. |
| Program operations | Remaining forfeiture money can support the federal forfeiture program and related authorized activities. |
| Equitable sharing | State, local, tribal or foreign agencies that directly participated in the investigation may receive a payment when sharing requirements are met. |
Remission versus mitigation
Remission generally addresses compensating victims or returning value to eligible owners and lienholders under an administrative process. Mitigation can reduce the forfeiture or provide relief in circumstances recognized by the rules. Both require an eligible claim and supporting documentation. A final forfeiture order does not itself promise that every claimant will be paid.

Those figures are case-specific official amounts. They are not a formula for valuing every seized bitcoin balance, and they do not predict the coins’ later market price. A seizure estimate, an order amount and a payment received by USMS can represent different stages of the process.
How to compare two seized-bitcoin cases
Two cases that both involve bitcoin can produce very different financial outcomes. Compare them using the facts that actually drive custody, valuation and distribution:
- Custody route: Was the cryptocurrency moved to a government-controlled self-custody or cold-storage wallet, or seized from a hosted U.S. service provider?
- Conversion timing: Was an early sale needed because the value was falling or custody was too expensive, or were the coins held through final forfeiture?
- Valuation date: Is the published number a seizure appraisal, an early-sale receipt, a final sale amount or a partial payment?
- Deductions: Which court, storage, brokerage, investigative and sale expenses were allowed?
- Third-party rights: Were there proven owners, lienholders or victims eligible for remission or mitigation?
- Sharing: Did another state, local, tribal or foreign agency directly participate and qualify for equitable sharing?
What owners and victims should expect
Anyone seeking money from a forfeited bitcoin case should identify the proceeding, preserve records showing ownership or loss, and follow the notice and petition instructions for that case. Useful records can include transaction histories, account statements, contracts, loan or lien documents and proof of the specific victim loss. Deadlines and required forms are case-specific, so a claimant should rely on the official notice and applicable regulation rather than assume that a different cryptocurrency case used the same process.
Owners should also distinguish a challenge to forfeiture from a request for remission or mitigation. A challenge disputes the government’s right to forfeit the property; remission or mitigation seeks relief under the administrative rules after considering eligibility, proof and available funds.
Limits of the federal explanation
The sequence above describes the U.S. federal framework reflected in DOJ and USMS materials. A state seizure may use a state-controlled wallet and a state forfeiture fund. Foreign authorities can apply entirely different procedures. Bankruptcy cases can add trustee, creditor and court-supervision issues, while private exchange terms can affect how an account is frozen and documented. The phrase confiscated bitcoin therefore does not identify one universal process.
The safest general rule is to ask four questions: who has legal custody, whether forfeiture is final, what valuation date is being used, and what deductions or claims stand ahead of distribution. Those answers explain why the government may hold coins for a period, sell them before judgment, or report several different dollar figures without contradiction.
