When a U.S. federal agency seizes Bitcoin, the coins do not automatically become government property or get sent to an auction. Investigators transfer control to government-managed self-custodial or cold-storage wallets, preserve the cryptocurrency in the form seized under Justice Department policy, and then pursue one of three forfeiture tracks: criminal forfeiture, civil judicial forfeiture, or administrative forfeiture.
Ownership is decided through the applicable court or agency process. The government must connect the Bitcoin to a forfeiture theory, while a person claiming the coins must establish a legally recognized interest and meet the procedure and deadline in the seizure notice or case. A seizure can end in forfeiture, but it can also result in denial of forfeiture, restoration to a victim, remission, or return of the cryptocurrency or its net proceeds.

What happens immediately after federal agents seize Bitcoin?
Agents first secure the asset rather than treating it like cash in a physical evidence room. The cryptocurrency is moved into a government-controlled wallet, which may be self-custodial or a cold-storage wallet. Agencies assign tracking information and, under current procedures, may transfer custody to the U.S. Marshals Service or an authorized contractor.
Control of the wallet matters legally as well as operationally. Possession of the private keys lets the government safeguard the coins and supports the court’s in-rem jurisdiction—the court’s authority over the property itself. Moving the Bitcoin to a government wallet does not, by itself, decide who ultimately owns it.

The coins generally stay in Bitcoin form
The Justice Department’s 2025 Asset Forfeiture Policy Manual says: “Cryptocurrency should be kept in the form it was seized and not liquidated … until a final order of forfeiture is entered or an administrative forfeiture is final.” That policy means a price increase or drop while a case is pending does not automatically trigger conversion to dollars.
The policy is about custody and preservation, not a guarantee that every coin will remain untouched in every circumstance. An interlocutory sale can be authorized when the governing rules and circumstances support it. The manual discusses requests or consent from parties with ownership interests. An interlocutory sale is therefore a specific legal procedure, not the automatic result of a seizure.
The three federal forfeiture paths
The path depends on the government’s legal theory, the type of case, and whether someone contests the seizure. These are federal U.S. procedures; state and non-U.S. rules can differ.

Criminal forfeiture
Criminal forfeiture is tied to a person’s conviction and is imposed as part of the sentence. Prosecutors typically allege that the Bitcoin was proceeds of, or involved in, specified unlawful conduct. The defendant’s conviction does not automatically resolve every third party’s claim. Someone else who says the coins belong to them can use the applicable ancillary proceeding to establish a superior legal interest.

Civil judicial forfeiture
Civil judicial forfeiture names the property as the defendant. The government files a complaint explaining why the Bitcoin is allegedly forfeitable—for example, as proceeds of fraud, ransomware, theft, or money laundering. Anyone asserting an interest must file the required claim and respond to the complaint under the schedule in the notice or docket. The court then decides whether the government proved forfeiture and whether a claimant has an interest that defeats it or qualifies for statutory protection.
Administrative forfeiture
Administrative forfeiture can become final without a trial when no one files a timely claim after proper notice. Because the operative deadline is tied to the particular notice and procedure, there is no single deadline that applies to every federal seizure. Missing that deadline can end the administrative contest, so a recipient should read the notice immediately and preserve proof of when it arrived.
How investigators connect Bitcoin to alleged crime
Bitcoin’s public ledger supplies transaction history, but an address alone is not a person and address control alone does not conclusively prove legal ownership. Investigators combine several kinds of evidence:

- Exchange and account records: Records can connect an address to an account holder, deposit, withdrawal, or identity-verification information.
- Devices and communications: Phones, computers, hardware wallets, seed phrases, messages, and files can show who controlled keys and what transactions represented.
- Transaction context: The history may show whether the coins were payment, proceeds, a transfer for another person, or property used to facilitate an offense.
These facts support the government’s allegations; a complaint’s allegations are not a final finding. A claimant can challenge the tracing, the factual connection to the offense, the government’s jurisdiction, or the conclusion that the particular coins are forfeitable.

What a claimant must prove to recover seized Bitcoin
The practical question is not simply “Can I sign a message from this address?” The claimant must show a legally recognized ownership or other interest and use the correct procedure. Useful evidence can include:
- Purchase, deposit, or withdrawal records from an exchange or custodian;
- Wallet creation and transfer records that identify when and why the coins moved;
- Transaction IDs and a clear timeline matching the government’s tracing;
- Device, hardware-wallet, seed-phrase, or key-control evidence, handled without disclosing sensitive credentials publicly;
- Contracts, invoices, loan or agency agreements, and communications showing whether the claimant held the coins for someone else;
- Evidence that the claimant did not participate in, consent to, or know about the unlawful conduct when an innocent-owner rule is available.
Private-key control can help prove possession or control, but it is not the whole legal test. A person may control keys as a custodian, nominee, employee, or thief. Conversely, a beneficial owner may lack immediate key access. Courts examine the legally recognized interest and the facts surrounding the transactions.
Notice, claims, and deadlines
The seizure notice or court docket should identify the asset, the asserted forfeiture theory, the procedure for filing a claim, and the response deadline. Those instructions control the next step. The cited federal materials do not establish one universal deadline for criminal, civil, and administrative matters.
- Preserve the notice and docket information. Save the envelope, email headers, attachments, case number, and every page describing the claim process.
- Identify the track. Determine whether the matter is a criminal case, a civil complaint against the property, or an administrative notice from an agency.
- File the required claim on time. Use the method and form specified in the notice; an informal letter may not substitute for a proper claim.
- Prepare the ownership record. Build a transaction timeline and collect documents that connect the claimant to the Bitcoin and explain any custody arrangement.
- Answer the government’s allegations. In a civil case, filing a claim is followed by the required answer or motion practice under the court’s schedule.
- Protect digital evidence. Do not send seed phrases or private keys in ordinary email or pleadings. Provide proof of control through a secure, legally supervised process.
Because a missed administrative deadline can make forfeiture final, and because civil and criminal cases have different pleadings, a claimant should obtain advice from a lawyer experienced in federal asset forfeiture before filing or waiving a response.

Innocent owners and victims
Federal forfeiture law can protect an innocent owner when the facts and governing statute satisfy the applicable requirements. The claimant generally must show an actual legal interest and address what they knew, consented to, or reasonably could have done about the conduct. The test is fact-specific; merely saying “I did not commit the crime” does not replace the required ownership and knowledge evidence.
Victims may have a separate route through restoration or remission. These remedies are not identical to defeating forfeiture on the merits. A court or agency can clear title and direct return of cryptocurrency or net proceeds even when the property was used in an unlawful scheme, if the victim and program requirements are met.
In June 2025, the Justice Department reported that it had recovered and cleared title to more than $680,000 worth of stolen cryptocurrency and was preparing to return it to the victim. The same matter involved 480.996 BNB. It illustrates that seizure is an interim control measure, not proof that the government has acquired final ownership.
What happens if forfeiture is ordered?
A final forfeiture order gives the United States the disposition rights provided by the governing law and the order. The exact handling—sale, liquidation, or deposit through the applicable asset-forfeiture program—depends on the case and program rules. The order, rather than a general assumption that “seized Bitcoin is auctioned,” controls.
If the court rejects forfeiture, or if a victim’s restoration or remission request succeeds, the government may return the cryptocurrency or its net proceeds as directed. The dollar value can differ from the value on seizure day because Bitcoin’s market price changes while a case proceeds. The preservation policy avoids an automatic conversion solely because of that volatility, but it does not promise that a claimant will receive the same dollar amount or the same number of coins in every disposition.
Recent federal examples
Ransomware-related laundering allegation
A July 2025 complaint in the Northern District of Texas alleged that 20.2891382 BTC seized by the Dallas FBI on April 15, 2025, was tied to ransomware-related money laundering. “Alleged” is important: a complaint states the government’s theory, while the court must still decide forfeiture and any competing claims.
Investment-fraud laundering allegation
In 2025, the Justice Department announced a civil forfeiture complaint involving more than $225.3 million in cryptocurrency allegedly connected to laundering from an investment-fraud scheme. The amount identifies the scale of the allegation, not a final adjudication of ownership.

SIM-swapping theft allegation
A 2025 District of Columbia announcement described a civil forfeiture complaint involving more than $5 million in Bitcoin allegedly traceable to SIM-swapping thefts from five victims. Victims’ ability to recover depends on establishing their interests and satisfying the applicable restoration, remission, or judicial procedures.
Does the government always auction seized Bitcoin?
No. Federal policy favors keeping cryptocurrency in the form seized until a final forfeiture order or final administrative forfeiture. An interlocutory sale is possible when specifically authorized, but it is not automatic. If forfeiture becomes final, the applicable order and asset-forfeiture program determine whether the asset is sold, liquidated, or handled another way. If forfeiture fails or a victim remedy succeeds, the result can instead be return of the coins or proceeds.
Federal rules are not universal
This framework describes U.S. federal matters. A state agency may follow different statutes, notice rules, deadlines, custody arrangements, and victim-compensation procedures. Other countries use their own forfeiture and property laws. For a particular seizure, the controlling documents are the agency notice, court docket, governing statute, and any order addressing custody or disposition.
