Revocation of a plot allotment usually ends or threatens the allottee’s right to occupy the land, but it does not automatically cancel the borrower’s bank loan, erase a completed building, or terminate every tenancy. The result depends on the legal status of the allotment, the executed lease or sale documents, mortgage permission, the reason for cancellation, and the procedure the authority followed.
This is an India-focused explanation. Plot-allotment rules differ between states and development authorities, so the allotment letter, lease deed, mortgage documents and tenancy agreement must be read together before anyone stops paying, surrenders possession or removes occupants.

First identify what was actually allotted
The most important distinction is whether the allottee still held only a contractual licence or had received an executed lease, sale deed or lease-cum-sale agreement. The authority’s power to cancel, the bank’s security and the treatment of construction can change substantially at that point.
Before a lease or sale agreement is executed
Some authority regulations treat the allottee as a licensee until the formal instrument is signed. Regulation 15 quoted by the Karnataka High Court in IDBI Bank Limited v Karnataka Industrial Areas Development Board states: “Till the agreement for lease, sale or lease-cum-sale is executed, the allottee will be considered as a mere licensee…” Such a licence may permit entry, possession or limited construction, but it is not necessarily a transferable ownership interest.

The same regulation says the allottee may not legally alienate the interest except as allowed by the Board for raising loans. A bank therefore cannot assume that an allotment letter alone creates mortgageable property. Written permission, the authority’s conditions and the form of security are critical.
After an executed lease, sale or lease-cum-sale instrument
An executed instrument normally supplies more defined rights, but it also contains enforceable covenants. Typical clauses address payment of premium and rent, approved plans, construction deadlines, transfer restrictions, mortgage permission, re-entry and the treatment of improvements. Cancellation must then be tested against those clauses and the governing statute or regulations.
| Document status | What it usually means | Questions that control risk |
|---|---|---|
| Allotment or offer letter only | Often a conditional licence or promise to grant a later interest, not unrestricted ownership. | Was possession delivered? Were construction or transfer rights expressly granted? What events permit cancellation? |
| Executed lease or lease-cum-sale agreement | A defined contractual estate subject to rent, development and re-entry covenants. | What are the default, cure, extension, re-entry and refund clauses? |
| Registered sale deed or completed transfer | A stronger property interest, although statutory restrictions, unpaid dues and fraud provisions may still apply. | Does the authority retain a first charge, consent right or cancellation power? |
What happens to the bank loan and mortgage?
Revocation does not ordinarily extinguish the borrower’s loan contract. Unless the lender agrees to a restructuring or a court grants relief, instalments and interest remain due. The bank can pursue the borrower personally even when its security over the plot or building becomes disputed.

Check whether the bank received a valid security interest
Review the sanction letter, loan agreement, mortgage deed, authority permission or no-objection certificate, registration records and every condition attached to the allotment. The decisive questions are:
- Did the allottee have a transferable or mortgageable interest when the mortgage was created?
- Did the authority give written permission, and were its fees, premium and current lease rent paid?
- Was the charge registered in the required record?
- Does the lease reserve the authority’s dues as a first charge or give it a contractual right of re-entry ahead of the lender?
- Was the bank promised notice before re-entry, and was that notice actually sent?
If no valid mortgage was created, the bank may have only personal recovery remedies against the borrower rather than an enforceable security interest in the plot or building. If a mortgage was valid, enforcement still cannot automatically override the lessor’s re-entry rights or statutory restrictions on transfer.
Priority between the authority and the lender
The priority arrangement is document-specific. Conditions reproduced in a Supreme Court record for Noida required payment of the authority’s premium and current lease rent before mortgage permission. They preserved a first charge for the authority, placed the financing institution in second position and required the authority to give nationalised banks or financial institutions 30 days’ notice before exercising re-entry.

That 30-day period is a Noida contractual condition described in the cited record, not a universal Indian rule. Another authority may prescribe a different period, no lender notice, or a statutory process. A borrower should notify the bank immediately and ask for written confirmation of the security-protection steps it will take.
Do not treat cancellation as permission to stop paying
Stopping instalments can create a separate loan default, additional interest and enforcement action. A cancellation challenge, stay application or negotiated settlement should be pursued while payments continue unless a written lender arrangement or court order changes the obligation. The bank and the authority may have conflicting claims, but that dispute does not by itself suspend the loan contract.

What happens to construction and improvements?
Construction is governed by the allotment and lease covenants, not simply by whether a building exists. Authorities commonly require plan approval, commencement and completion by stated dates. They may allow extensions, charge fees, or reserve re-entry when construction is not completed or the site is used contrary to the grant.
Possible outcomes after revocation
| Possible result | When it may arise | What to verify |
|---|---|---|
| Refund with deductions | The instrument provides for cancellation and return of amounts after forfeiture, costs or other contractual deductions. | Refund formula, interest treatment, unpaid rent, restoration costs and the date of payment. |
| Forfeiture or re-entry | A proved default triggers the authority’s contractual or statutory right to take possession. | Default notice, cure period, hearing, re-entry clause and authority’s possession procedure. |
| Removal or takeover of improvements | The lease specifies what happens to a building, equipment or other improvements on termination. | Demolition, handover, compensation and safety obligations; do not remove assets without legal advice. |
| Regularisation or extension | The authority has an extension or compounding policy and the breach can be cured. | Eligibility, fees, approvals and whether an application must be made before re-entry. |
| Judicial restoration | Cancellation is procedurally defective, disproportionate or inconsistent with the authority’s conduct. | Evidence of reliance, expenditure, approvals, completed construction and the exact relief sought. |
Completed construction is important but not conclusive
A finished building does not automatically defeat cancellation. A lease may make construction the purpose of the grant while still restricting transfer or mortgage until construction or permission is obtained. Conversely, courts have sometimes protected substantial reliance.
In Sunil Pannalal Banthia, the Supreme Court record states that CIDCO could not unilaterally cancel after its conduct induced the allottee to alter position and spend substantially on construction. A January 2026 court order also restored an allotment where construction was complete and students were enrolled, while expressly saying the decision was peculiar to its facts and not a precedent. Those decisions show why approvals, expenditure records, correspondence and the authority’s conduct matter; they do not create an automatic rule that every completed building must be preserved.

What happens to tenants and other occupants?
A tenant’s rights come from the tenant’s own lease and applicable local law, not solely from the allotment letter. Revocation may put the authority and allottee in a possession dispute, but it does not answer whether a tenant can be evicted immediately, must receive notice, can claim a deposit, or has statutory protection.
Documents and legal regimes to check
- The tenant’s lease, registration status, term, renewal and notice clauses.
- Security deposit, advance rent, arrears and the person legally entitled to receive rent.
- Whether rent-control legislation, public-premises law, municipal rules or another special statute applies.
- Whether the head lease permits sub-leases and whether the lessor’s transfer policy was followed.
- Any direct re-entry, demolition, relocation or compensation clause benefiting or binding occupants.
Group-housing arrangements can permit sub-leases only under the lessor’s transfer policy. A sub-lessee may therefore face restrictions under both the head lease and local tenancy law. An authority may seek possession from the allottee while a tenant asserts independent contractual or statutory protections. Neither automatic eviction nor automatic tenant compensation should be assumed without the jurisdiction and documents.
Practical rules for landlords and tenants
The allottee should not promise continued occupation, demand surrender, or change locks solely because a cancellation notice arrived. The tenant should continue documenting rent payments, preserve the lease and deposit evidence, and respond to any notice within its stated period. If demolition, sealing or forcible dispossession is threatened, obtain urgent advice on an injunction, rent deposit and the forum with jurisdiction.
Do these 3 things before closing this tab:
1Fix the driver behind crashes, sound loss and screen glitches2Clear out junk files and repair common Windows errors3Scan for outdated or missing drivers - takes under a minuteCan the allottee challenge the revocation?
Procedure often decides the dispute as much as the underlying default. The authority should be held to the notice, hearing, cure, extension and appeal requirements in the governing instrument and regulations.
Common issues to test
- Wrong or unproved default: The notice must identify whether the allegation is non-payment, non-construction, unauthorised transfer, insolvency, fraud, planning breach or an authority error.
- Insufficient notice: Compare the notice actually given with the contractual period and any statutory minimum.
- No meaningful hearing: Check whether documents and explanations were considered before the final order.
- Ignored cure or extension rights: A valid application for additional construction time may have to be decided before cancellation.
- Disproportionate action: Consider whether a monetary cure, extension or regularisation was available instead of re-entry.
- Failure to notify the lender: Where the lease promises lender notice, omission may affect the re-entry process and the bank’s ability to protect its security.
A reported RIICO decision treated failure to give a 30-day notice and failure to consider a construction extension as defects. That is an example of how procedural failures can matter; it is not a universal 30-day rule for every authority.
What to do immediately after receiving a cancellation notice
- Collect the complete record. Obtain the allotment letter, payment ledger, possession letter, lease or sale deed, every extension, sanctioned plans, completion evidence, mortgage permission, charge-registration record, tenant leases and all notices.
- Make a chronology. Record allotment, payments, possession, approvals, construction milestones, mortgage creation, tenant occupation, alleged default and the cancellation date.
- Identify the exact legal trigger. Separate payment arrears from non-construction, unauthorised transfer, planning breach, fraud or an administrative mistake; each may have different cure and appeal rules.
- Check the remedy path and deadlines. Look for show-cause reply periods, personal hearing, extension applications, appeal or review, arbitration clauses and judicial-review routes.
- Notify the lender in writing. Send the notice and security documents, ask whether the authority gave lender notice, and request a plan for protecting the charge.
- Protect possession lawfully. Do not demolish, remove fixtures, surrender keys or evict tenants without advice on the lease and applicable law.
- Continue contractual payments unless changed in writing. Keep loan instalments and, where appropriate, rent or lease payments current while seeking a stay, injunction, settlement or other relief.
How the main fact patterns differ
| Fact pattern | Primary risk | Most important evidence |
|---|---|---|
| Licence only, no executed lease | Limited property rights and weak mortgage or transfer position. | Regulation, allotment conditions, possession terms and permission letters. |
| Executed lease with authorised mortgage | Authority re-entry may rank ahead of the lender under the lease. | Mortgage NOC, first-charge clause, lender-notice clause and payment record. |
| Completed building with approvals | Re-entry remains possible, but reliance and proportionality arguments may be stronger. | Sanctioned plans, completion proof, expenditure, correspondence and occupancy evidence. |
| Vacant or incomplete site | Construction-default and forfeiture provisions may be easier to invoke. | Construction deadline, extension requests, site inspections and cause of delay. |
| Contractual tenant | Tenancy may end under the lease, subject to notice and possession law. | Lease, registration, deposit, notice clause and head-lease consent. |
| Statutorily protected tenant | Authority action may not bypass rent-control or public-premises procedure. | Applicable statute, protected-status facts, notices and arrears record. |
| Cancellation caused by authority error | Restoration, injunction or compensation arguments may be available. | Official representations, payment proof, approvals and evidence of reliance. |
The governing state or country, authority rules, reason for revocation and wording of every document are essential. A lawyer handling property, banking and local tenancy law can determine whether the immediate objective should be a reply, negotiated regularisation, lender intervention, stay, injunction, appeal or judicial review.
