Milestone payments and planned production capacity usually stop first. The studio may cut staff, reduce the game’s scope, pause development, transfer the project, continue independently, or cancel it. If the game has already shipped, the publisher may delist it, limit refunds, stop updates, or shut down online services.
The eventual outcome depends on five things: the financing contract, who owns the intellectual property, access to source code and assets, the money still needed to finish or operate the game, and whether another financier is willing to assume the risk.

Why a funding withdrawal can stop development immediately
Most publisher-funded games are not financed with one payment. The developer commonly receives a recoupable advance in installments tied to milestones. A contract may define payment triggers such as approved design documents, an alpha build, a beta build, or a feature-complete submission. The advance covers salaries, contractors, software, office costs and other production expenses; the publisher recoups it from future revenue.

If a milestone payment is withheld or the publisher terminates the project, the studio must cover the shortfall from cash reserves, find another investor or publisher, shrink the team, or stop work. A company can be contractually entitled to payment for accepted work and still lack the cash to keep the whole team employed while a dispute is resolved.

Stopping a payment also removes planned capacity. Contractors may not be renewed, external art or testing may be cancelled, and internal staff can be reassigned to a different project. A game that was technically viable with 40 developers can become impossible to finish with 10, especially when the remaining work includes certification, localization, backend operations and launch support.
The main paths for the project

Pause or indefinite hold
A hold is not a promise that development will resume. Spearhead Games said Unforetold: Witchstone was suspended indefinitely after its primary funding source fell through. A paused project can remain in that state for years if the rights are tied up or the cost to restart is too high.
Reduced scope or reprioritization
A studio may preserve a smaller, shippable version by removing modes, platforms, story content or live-service features. Bungie said in 2024 that it would focus development entirely on Destiny and Marathon and move an incubation project into a new PlayStation Studios team. That kind of move can save some work while ending the original team or changing the project’s identity.

Cancellation or discontinuation
Cancellation can occur before public announcement, after years of development, or after release. Ubisoft said XDefiant was too far from the results needed to justify further investment and announced a sunset. In 2026, Ubisoft’s Prince of Persia Team stated: “We’ve made the difficult decision to stop development on Prince of Persia: The Sands of Time Remake.” The team said completing it would require more time and investment than the company could responsibly commit.

Transfer or independent continuation
A developer can seek a new publisher, self-fund a smaller release, sell the project, or license the technology. None of these is automatic. A new partner must be able to obtain the necessary rights, inspect the code and assets, hire or retain a team, and finance the remaining work. A project that looks nearly complete may still need substantial spending on testing, certification, localization, legal clearances and launch operations.
What happens to developers and studios
When funding ends, people are often affected before the public receives a cancellation notice. Studios may freeze hiring, end contracts, lay off employees, redeploy staff, close an office or merge a team into another company. Some employees transfer with a project; others lose their jobs when the replacement project is in a different location or requires different skills.
Bungie CEO Pete Parsons said in 2024 that the company was “deepening our integration with Sony Interactive Entertainment” and working to integrate 155 roles, roughly 12% of its workforce, into Sony over the following quarters. That illustrates a transfer of roles rather than a simple continuation of the same development structure.
Spearhead Games described a harsher result after its funding source failed: “we could no longer support our amazing team. As a result, we were forced to let most of our people go and halt production, leaving Unforetold: Witchstone in an unfinished state.” The studio had grown from a prototype team of 10 to nearly 40 people. Once the budget disappeared, that larger organization could not be maintained.

Studio employees may also face uncertainty over severance, unpaid invoices, benefits and the fate of work they created. Those issues are governed by employment law and individual contracts, so the consequences differ by country and by whether a person is an employee, contractor or vendor.
Who owns an unfinished game?
Funding alone does not answer ownership. The signed publishing and development agreements control who owns the copyright, trademarks, characters, code, artwork, narrative, music and other assets, and what happens when the deal ends.
When a publisher finances most or all development, it will often seek ownership of the game’s intellectual property. In a distribution-only arrangement, the developer may retain ownership while granting the publisher release and marketing rights. A licensed property adds another layer: the developer may own its code but have no right to use the underlying characters or world after the license ends.
Important clauses include:
- Termination rights: A termination-for-convenience clause may let the publisher end the deal without proving breach, subject to notice and payment terms.
- Kill fee: The contract may specify a predetermined amount owed when the publisher cancels.
- Milestone acceptance: The agreement may define when a build is accepted and when the related payment becomes due.
- Source-code delivery or escrow: The publisher may receive code at milestones or hold a copy that can be released under specified conditions.
- Assignment: One party may be allowed to transfer the agreement to another company, sometimes only with consent.
- Rights reversion: Copyright, trademarks or other rights may return to the developer after termination, non-payment or a defined period.
These provisions can conflict. A developer might regain its copyright but still lack a licensed soundtrack, third-party middleware rights, publisher-owned characters or the source code needed to build the game. Conversely, a publisher may own the IP but have no practical team left to finish it. Jurisdiction also matters: insolvency, copyright assignment and contract remedies differ between countries.

What players experience
An unreleased game
An announced game that has not shipped may simply disappear from the schedule. Pre-orders can be cancelled or refunded according to the store’s policy and local law, but an announcement itself does not guarantee a refund entitlement. Crowdfunding, deposits and physical merchandise may be governed by different terms.
An Early Access game
Early Access can leave players with a downloadable but unfinished build. Spearhead said Unforetold: Witchstone remained on Steam because of legal obligations, was marked as no longer supported, and was subject to Steam’s standard two-hour refund limit unless Steam granted an exception. Ownership of a copy does not create a right to future patches, new content or a completed version.
A released live-service game
A publisher may stop new sales first, keep servers online temporarily and then announce a shutdown date. In Ubisoft’s XDefiant notice, new downloads, registrations and purchases ended immediately while servers were scheduled to remain active until June 3, 2025. The same announcement reported studio closures and employee departures. After a server shutdown, an online-only game may become completely unplayable even if it remains installed.

Delisting removes a title from a store for new customers. Existing players may retain downloads and re-download rights, or they may lose access when authentication or server services end. Store policies, platform rules, regional consumer law and the game’s technical design determine the result; there is no universal industry rule.
How to assess the risk in a specific case
- Check the latest official notice. Look for the publisher’s support page, the developer’s statement and the platform’s store message. Distinguish a delay from a cancellation or a fixed sunset date.
- Identify whether the game is online-only. Record which features require authentication, matchmaking or a remote server. Offline modes may survive a shutdown; server-dependent modes generally do not.
- Review purchase and refund terms. Save receipts, order confirmations and the store’s refund window. A publisher’s announcement does not automatically override the platform’s policy.
- Download permitted files while access remains available. This cannot preserve a server-dependent game, but it can protect an offline build, save data or purchased add-ons where the platform allows it.
- Watch for a transfer or rights announcement. A new publisher may restore development, but a teaser or trademark filing is not proof that financing, staff and code have transferred.
What determines whether another publisher can save the game?
A takeover is feasible only when the commercial and technical pieces line up. The parties must establish who can license the IP, whether the original publisher will assign or sell its rights, and whether the developer can access the complete source repository and build tools. They must also account for middleware, music, voice performances, union obligations, privacy compliance and platform certification.
The replacement financier then estimates the remaining cost rather than relying on the previous budget. A half-finished game may need expensive rework if its architecture, performance or design no longer meets current platform requirements. If projected sales cannot cover that cost and the existing obligations, cancellation remains rational even when a playable prototype exists.
For players, the most reliable signs of a real rescue are a named rights holder, a confirmed development team, a financing or publishing agreement, and a concrete update plan. Until those appear, treat the project as uncertain and avoid spending money solely on a promise of future completion.
