A free scan shows the junk files, broken settings and background clutter dragging Windows down - then fixes them in one click.Free scan · Windows 10 & 11Short answer: a crypto custodian can pause withdrawals, investigate unauthorized transfers, or enter bankruptcy without any automatic government reimbursement. If the firm is hacked, stolen assets may be unrecoverable. If it becomes insolvent, you may have to file a claim and could be treated as an unsecured creditor. Your outcome depends on the account agreement, the type of asset, whether customer property was segregated or reused, the custodian’s legal entity and jurisdiction, and what remains in the estate. FDIC insurance generally does not cover crypto held by a non-bank custodian, and SIPC generally does not cover non-security crypto.
Act quickly: stop sending funds, secure your accounts, preserve statements and transaction records, read official notices, and follow court or receiver instructions. For long-term holdings, cold storage can reduce exposure to an online custodian, but it makes you responsible for the private keys and backups.

What each type of failure can mean
After a hack
A successful attack may compromise customer credentials, an exchange’s signing keys, an internal wallet, or a transfer-control system. The custodian may disable withdrawals while it identifies the breach, traces blockchain movements, and resets security controls. A freeze therefore does not prove that all customer assets are gone.

Losses become permanent if the attacker’s transfers cannot be reversed and the custodian lacks enough assets, insurance, or other resources to replace them. The Federal Trade Commission warns that when a crypto-storage provider is hacked or goes out of business, the government has no obligation to recover customers’ funds.

SEC custody guidance for broker-dealers expects contingency planning for hacks, blockchain failures, lawful freezes, and transferring assets to a receiver or successor if the firm cannot continue. That guidance does not guarantee the same process for every crypto exchange or wallet provider.
After insolvency or bankruptcy
Bankruptcy does not automatically mean that every customer loses everything, nor does it guarantee a full return. A court will examine the contract, asset type, custody structure, ownership records, and applicable law. If the agreement allows lending, rehypothecation, pledging, or broad use of customer assets, those assets may be part of the estate rather than immediately returnable.
Customers can be treated as unsecured creditors, placing them behind secured creditors and certain administrative or priority claims. Unsecured claims can take years to resolve and may receive only a fraction of the recorded balance. Properly segregated assets with clear customer ownership records can have stronger property protection, but no authoritative universal recovery percentage exists.

When withdrawals are frozen
A freeze can result from a security incident, a technical or blockchain problem, a lawful order, maintenance, or a liquidity shortfall. Platforms facing insufficient liquid assets may suspend withdrawals, leaving users unable to move funds while a restructuring, receivership, or bankruptcy proceeds. Treat the freeze as a warning to preserve evidence and read official notices—not as proof of either recovery or total loss.
Why your legal position varies
Two users on different platforms can receive very different outcomes because custody is a legal arrangement, not simply an entry in an app. Review these factors in the account agreement and the custodian’s disclosures:
- Legal entity and jurisdiction: identify the contracting company, its regulators, incorporation state or country, and where a court case would be filed.
- Asset segregation: determine whether customer coins are held in identified wallets or pooled and whether records distinguish each customer’s entitlement.
- Reuse rights: look for permission to lend, stake, rehypothecate, pledge, or otherwise use assets. Reuse can expose customers to the borrower’s or counterparty’s failure.
- Bankruptcy-remoteness language: check whether the contract says customer assets are held for the customer and excluded from the custodian’s operating estate. Contract wording is important but may still be tested in court.
- Withdrawal and freeze powers: note when the firm may delay transfers, impose limits, or comply with a regulator, court, or law-enforcement order.
- Insurance wording: distinguish protection for the custodian’s commercial crime or cyber policy from insurance that directly covers your balance. Read exclusions and per-customer limits.
- Successor arrangements: find out how assets would be transferred to a receiver or replacement custodian if the service closes.
What protection do FDIC and SIPC provide?
| Program or rule | What it generally covers | What it means for crypto |
|---|---|---|
| FDIC deposit insurance | Qualifying deposits held at an FDIC-insured bank, subject to program limits and ownership rules | The FDIC’s July 28, 2022 fact sheet says insurance does not protect against default, insolvency, or bankruptcy of a non-bank crypto custodian, exchange, broker, wallet provider, or neobank. A crypto balance shown in an app is not an insured bank deposit merely because the app uses a bank partner. |
| SIPC protection | Covered securities and cash at a SIPC-member broker-dealer; SEC staff describes a maximum of $500,000 per customer, including a $250,000 cash sublimit | SEC staff’s 2025 FAQ says SIPC generally does not cover customer claims for non-security crypto assets. The limits do not convert ordinary cryptocurrency held at an exchange into SIPC-protected property. |
| Government recovery | No blanket program for losses at private crypto-storage providers | FTC consumer guidance says the government has no obligation to recover funds when a storage company is hacked or goes out of business. |
Whether a particular token is legally a security and whether a particular intermediary is a SIPC member require a fact-specific analysis. Do not infer coverage from a platform’s use of words such as “insured,” “protected,” or “custodied.”

What to do immediately after a hack or withdrawal freeze
- Stop sending more money. Do not deposit additional crypto to “unlock” withdrawals or pay a person who promises guaranteed recovery for an upfront fee. Recovery scams often target users during public incidents.
- Secure access from a clean device. Change the email password first, then the custodian password. Revoke unfamiliar sessions and API keys, replace compromised two-factor-authentication methods, and contact your mobile carrier if a SIM takeover is possible.
- Preserve the evidence. Export account statements, transaction histories, wallet addresses, transaction hashes, tax-lot data, screenshots, support tickets, and the complete user agreement. Save files locally and in a separate backup while you still have access.
- Check official notices. Use the custodian’s verified website, email domain, regulator notices, and court or receiver docket. Distinguish a scheduled maintenance window from a security incident, a formal receivership, or a bankruptcy petition.
- Record the timeline. Note when you noticed the problem, the last successful withdrawal, every unauthorized transaction, and each message from the company. Include the blockchain network and time zone.
- Report suspected theft. Follow the custodian’s incident-reporting procedure and consider reports to the relevant law-enforcement or financial regulator. A report does not guarantee reimbursement, but it creates a contemporaneous record.
- Do not interfere with tracing. Avoid sending funds through mixers or repeatedly moving related assets in ways that could complicate a forensic investigation. Follow lawful instructions from investigators or a receiver.
How to respond when bankruptcy or receivership begins
Find the official case and deadline
A formal case normally identifies the court, case number, debtor or receiver, claims agent, and deadline for filing a proof of claim. Use the court-appointed process rather than an unofficial social-media form. Keep the confirmation number, submitted documents, and copies of every communication.

- State the asset, quantity, account identifier, and valuation date required by the claim form.
- Attach statements, deposits and withdrawals, transaction hashes, and the agreement in effect when the transactions occurred.
- Explain any unauthorized transfer and include your incident report or support ticket number.
- Track distributions separately from tax records; a bankruptcy payment may not equal the original cost basis or restore the same coins.
Understand creditor ranking
If the court treats you as an unsecured creditor, repayment depends on the estate after secured and priority claims and the costs of administration. A customer who can establish ownership of segregated property may argue for return of that property instead of a general monetary claim. The result is determined by the contract, evidence, local insolvency law, and court rulings.
In the European Union, MiCA Article 70 requires crypto-asset service providers that hold client crypto-assets or the means of access to make adequate arrangements to safeguard clients’ ownership rights, especially if the provider becomes insolvent. The rule strengthens the framework but does not create a guaranteed recovery percentage or determine every dispute. U.S. results vary by entity and jurisdiction. NYDFS updated custodial-structure guidance on September 30, 2025, addressing customer protection when a virtual-currency custodian becomes insolvent.

How to evaluate a custodian before a crisis
| Question | Why it matters | Evidence to request |
|---|---|---|
| Who is the contracting legal entity? | Determines regulators, governing law, and the likely court or receiver. | Terms of service, licensing disclosures, and corporate name. |
| Are assets segregated? | Identified customer property may be easier to return than pooled or reused assets. | Custody policy, wallet structure, reconciliation and audit descriptions. |
| Can the firm lend or pledge assets? | Reuse introduces counterparty and insolvency exposure. | Lending, staking, margin, rehypothecation, and collateral clauses. |
| What triggers a freeze? | Broad discretion can leave you unable to exit during an incident. | Withdrawal-control, lawful-order, maintenance, and force-majeure terms. |
| What does “insurance” actually cover? | Cyber or crime coverage may protect the company, not your individual balance. | Policy type, exclusions, per-event limits, and beneficiary language. |
| How transparent are reserves and controls? | Evidence of liabilities, wallet holdings, and independent controls can reveal concentration risk. | Audits, attestations, reserve reports, and incident-history disclosures. |
| What happens if the firm closes? | A defined successor process can reduce disruption and missed deadlines. | Transfer-to-successor, receiver, and customer-notice procedures. |
Should you move long-term holdings to cold storage?
Cold storage keeps signing keys offline, commonly on a hardware device or another offline system. It reduces dependence on an exchange’s online controls and withdrawal availability, which can be valuable for assets you do not need to trade regularly. It does not eliminate all risk: the device can be lost or damaged, firmware or transaction errors can cause loss, and anyone who obtains the recovery seed can control the funds.
Responsibilities that move to you
- Generate and record the recovery seed privately; never photograph it or enter it on a website.
- Keep multiple durable backups in separate secure locations and plan for inheritance or incapacity.
- Verify the receiving address and network on the device screen before approving a transfer.
- Test a small transaction before moving a large balance.
- Buy devices through an authorized channel, keep firmware current, and treat unexpected support messages as potential scams.
Self-custody is a trade-off, not insurance. A custodian may offer account recovery and operational support; a cold-storage owner has direct control but bears the full private-key and backup risk. Many users keep trading liquidity with a regulated service and place only a planned long-term allocation in cold storage.

Common mistakes during a failure
- Assuming a withdrawal pause proves theft or, conversely, assuming every freeze is harmless.
- Deleting emails, statements, or tax records before downloading them.
- Missing a claims deadline because an unofficial social account was mistaken for the court or receiver.
- Paying a recovery agent, “tax,” or unlock fee without independently verifying the legal process.
- Assuming FDIC or SIPC coverage from a logo, bank partnership, or the word “broker.”
- Moving all assets to self-custody without testing backups, address checks, and an inheritance plan.
What you can realistically expect
There is no single timetable or recovery rate. A temporary technical freeze may end after controls are restored; a hack may produce a negotiated reimbursement, litigation, or an unrecoverable shortfall; and a bankruptcy claim may wait through investigation, asset sales, and court distributions. The decisive evidence is your agreement, the custodian’s records, proof of segregation or reuse, the applicable jurisdiction, and the assets that remain.
