It concerns which laws and authorities may apply to data, and whether your organization can govern where that data is stored, processed, accessed and managed. A region setting can support sovereignty, but it does not by itself establish who can access data, how operations are controlled, where backups go or whether the workload can be moved.
How data sovereignty differs from data residency
Data residency means keeping data in a specified jurisdiction. Data sovereignty asks which laws and regulations may apply to data because of its physical location, and whether the organization has practical controls over access, operations, keys, transparency and movement. Residency is one part of sovereignty, not a substitute for it.

The term digital or cloud sovereignty is broader still: it can include strategic, legal, data, operational, supply-chain, technology, security and environmental considerations in cloud procurement. A provider’s “sovereign” product label, data ownership language or regional storage option does not, on its own, settle jurisdiction or prove compliance with a particular obligation.

What to assess for each workload
There is no universal sovereign configuration. Scope the assessment to the workload’s data, applicable laws, sector rules, contracts and continuity needs. Record answers for the full data lifecycle, not just the primary database.

| Area | Questions to answer |
|---|---|
| Data and rules | Which data classes are involved? Are personal and non-personal data mixed? Which country, regional, sector and contractual rules apply? |
| Storage and processing | Where are primary data, replicas, logs, backups, metadata and derived data stored or processed? Can support or a service feature move data beyond the intended boundary? |
| Access and jurisdiction | Which provider employees, subcontractors and customer administrators can access the data, from where, under what approval process and under which legal regimes? |
| Cryptographic keys | Who controls key use and administration? Can customer-controlled or external key management provide the required separation, and is key access auditable? |
| Operations and support | Where are support and operational functions delivered? Can the workload be operated without an out-of-jurisdiction provider or operator if that is required? |
| Audit evidence | Can you retain evidence of data access, administrative changes, key use, deletion and, where relevant, AI processing? Is the evidence suitable for your audit obligations? |
| Continuity | Can backup, replication, failover and disaster recovery remain in approved jurisdictions while meeting recovery objectives? |
| Portability and exit | Can data be exported in a usable format and can the workload move to another provider or on-premises environment? What dependencies or egress charges affect exit? |
| Supply chain and technology | Which critical suppliers, hardware and software sources, update paths, proprietary interfaces and other dependencies are involved? |
The European Commission’s procurement criteria include customer control of cryptographic access, visibility into when, where and by whom data is accessed, confinement of storage and processing, operational support arrangements, verifiable removal and migration away from a vendor. AWS’s Digital Sovereignty Lens similarly treats locality, access control, continuity, transparency and auditability, and interoperability and portability as architecture concerns. These are useful checklists, not independent certifications or legal opinions.
What EU rules and policy frameworks say
EU data location depends on data type and context
The European Commission’s Your Europe guidance says non-personal data can generally be stored and processed anywhere in the EU, subject to limited public-security exceptions under national rules. Personal data remains subject to GDPR. Where personal and non-personal data are inextricably linked in a mixed dataset, the guidance says GDPR rules generally apply to the dataset. This is not a blanket answer for every transfer, sector rule or contract; organizations still need to assess the actual data and applicable obligations.

The same guidance describes portability and switching protections. It states that switching and data-movement charges become completely free from January 2027; that is a future change as of October 2026, not a claim that those charges are already universally free.
Commission procurement framework
In June 2026, the Commission described its Cloud Sovereignty Framework as a procurement tool that calculates an overall score from 48 criteria across eight categories: strategic; legal and jurisdictional; data and AI; operational; supply chain; technological; security and compliance; and environmental sustainability. The Commission also reported a €180 million value for an April 2026 sovereign-cloud procurement contract for EU entities. That figure is the reported value of that contract, not a market-size estimate or evidence of program effectiveness.

Proposed Cloud and AI Development Act
The Commission’s Cloud and AI Development Act page describes a legislative proposal with four sovereignty assurance levels. In the Commission’s summary, Level 1 focuses on storage and processing in the Union; higher levels add criteria concerning third-country independence and supply-chain transparency, EU ownership or control and personnel, and full software supply-chain transparency and freedom from third-country interference. The page frames these levels as proposed legislation, not binding requirements. Check the current legislative status and any implementing rules before relying on them for a procurement or compliance decision.
How to compare cloud approaches
Compare service and contract details rather than treating sovereignty as a yes-or-no product label. Provider documentation can describe available capabilities, but the actual boundary depends on the chosen package, covered services, region, configuration and contract.

| Comparison axis | What to establish before choosing |
|---|---|
| Data boundary | Which locations cover storage, processing, logs, backups and failover? Can the service prevent fallback outside the boundary? |
| Legal and jurisdictional exposure | Which provider entity and subcontractors deliver the service? Which laws may compel access or constrain transfers? |
| Personnel and support | Where are support personnel located? Are location, citizenship or screening restrictions required, and are they available for the services in scope? |
| Key control | Who can use or administer keys? Are customer-managed keys, external key management, hardware security module-backed options and separation of duties supported for these services? |
| Transparency and audit | Can you see and retain evidence of access, operator actions, service changes, deletion and relevant AI processing? |
| Continuity | Can the backup and disaster-recovery design stay in approved jurisdictions while meeting recovery targets? |
| Portability | Are formats and interfaces portable? What are the exit steps, charges and workload dependencies? |
| Operational and supply-chain autonomy | Can the workload be maintained within the required jurisdiction? How transparent are suppliers, software and update paths? |
For example, Google documents control packages with different regional boundaries, personnel rules, support scopes and key-management options. That documentation describes configurable capabilities, not a blanket legal conclusion for every customer workload. AWS’s Lens is AWS-authored architecture guidance, not an independent certification. For either provider, confirm current availability, supported services, package terms and contract commitments for the particular workload.

Trade-offs and common failure points
Stricter location, support, redundancy or portability requirements can narrow the services and architectures available. A design that confines more operations to one jurisdiction may also constrain the continuity options a team would otherwise choose. The right balance depends on legal exposure, operational needs, recovery objectives and cost; there is no universal trade-off figure.

- Assuming a region setting settles sovereignty: Check processing, logs, backups, support access, operational control and jurisdiction as well as primary storage.
- Ignoring dependencies around the data: Metadata, replicas, derived data and service operations may matter to the boundary you intend to enforce.
- Taking a product label as assurance: Verify the service-by-service scope, configuration, contractual terms and audit evidence rather than inferring compliance from a name.
- Designing continuity outside the approved boundary: AWS advises keeping backup and failover systems within the relevant region for sovereignty-sensitive arrangements. Confirm that the resulting design still meets recovery objectives.
- Leaving exit until later: Test export formats and document migration steps, dependencies and charges before treating portability as an effective control.
A practical decision rule
For each workload, write down the data classes and rules that apply, define the required jurisdictional boundary, and map every storage, processing, access, support, key, backup and exit path against it. Then verify the provider’s evidence and contractual commitments for the services you will actually use. A workload is only as well governed as its least-controlled dependency; regional storage alone cannot answer the full sovereignty question.
