What Data Sovereignty Means for Cloud Storage and Backups

Data residency tells you where cloud data is stored; sovereignty concerns the laws and authorities that may govern it. Assess backups, access and recovery as well as the primary region.

Data sovereignty is about which laws and authorities may govern your data and who may be able to access or disclose it; data residency is about where it is physically stored. Choosing a cloud region in your country can help meet a location requirement, but it does not by itself settle which laws apply to the provider, where support and service operations occur, or where backups and snapshots are kept. To assess a cloud setup, map every copy and access path, then check the rules that apply to your data and organization.

Data sovereignty, residency and localization are different questions

These terms are related, but they do not mean the same thing. Keeping them separate helps you ask a cloud provider the right questions.

  • Data sovereignty: the legal authority and jurisdiction that may govern data, access to it or its disclosure. Canada’s government cloud guidance notes that data stored in Canada may still be exposed to laws applicable to a provider.
  • Data residency: the geographic place where data is physically stored. Canadian service guidance describes residency as the location of data at rest; its residency policy concerns storage and does not restrict data in transit in the same way.
  • Data localization: a specific law or policy requiring certain data to be stored, processed or kept within a jurisdiction. It applies to defined circumstances; it is not a synonym for every sovereignty concern.

A region selector mainly addresses location. It does not necessarily tell you which company entity provides the service, which law may apply to that provider, whether personnel in another country can administer or support the service, or where replicas and recovery copies are stored. The UK public-sector guide treats overseas hosting as involving location, management and access—not location alone.

Why the primary region does not answer the backup question

Cloud services may create or use more copies than the primary files you see in a console. Depending on the service and configuration, those can include replicas, snapshots, archives, logs and backup copies. Each may have a different purpose, retention period, location or access path. Confirm which copies actually exist for the service you use rather than assuming that a region setting covers them all.

Backups also change the recovery and risk picture. A copy in a separate location may help protect against an outage or account-level incident, but it remains data that needs appropriate access controls and a permitted location. Singapore Government cloud controls call for backups in a secure and separate location; UK guidance identifies multi-region arrangements as one possible resilience measure. Neither statement means that every organization should place every backup in a different country.

Ask the provider or service owner to identify the location of primary data, replicas, snapshots, archives and backups; whether a copy crosses a border during transfer or recovery; who can restore it; and what happens to it at expiration or account closure. Include support access, subprocessors and operational management in that map.

What jurisdiction-specific guidance illustrates

Requirements depend on jurisdiction, sector, data category, provider arrangement and contract. These official examples are bounded to their stated contexts; they are not universal rules for every organization.

Example What the guidance says What not to infer
Canada government cloud guidance It distinguishes residency from sovereignty and explains that a provider operating in Canada may remain subject to foreign laws. Its service guidance describes residency as storage location and says data in transit is not restricted by that residency requirement. A Canadian region alone does not establish that only Canadian law applies or that there can be no foreign access or disclosure exposure. The material also discusses historical plans; those plans should not be treated as current rules.
United Kingdom public-sector guidance Guidance published 5 February 2025 says there is no universal requirement for OFFICIAL government data to be physically located in the UK. Overseas regions may be used when legal, data-protection and security practices are satisfactory; multi-region use is presented as a possible resilience option. This concerns the named government classification and context. It does not establish a location rule for every UK data set, organization or sector.
United States Department of Defense procurement DFARS 239.7602-2 requires covered government data to remain within the 50 states, the District of Columbia or outlying areas unless the specified authorization permits otherwise. This is a procurement rule for covered government data, not a general rule for all US cloud users.
European Union Data Act The European Commission’s explainer says the Act does not prohibit cross-border data flows and describes safeguards for transfers outside the EU, including reasonable measures by providers in the situations it covers. The explainer is not a determination that a particular transfer is permitted. Check the current legal text and applicability for the specific transfer.

These differences are why broad claims such as “all data must stay in its country” or “a local region makes data sovereign” are unreliable. The applicable answer depends on the actual rule and circumstances.

A practical checklist for storage and backups

  1. Classify the information

Identify whether the data is personal, regulated, government-classified, commercially sensitive or subject to a specific location or transfer rule. Canadian guidance recommends categorizing information by the potential injury from loss of confidentiality, integrity or availability. That classification can determine which legal and security checks are relevant.

  2. Map copies, operations and access

Record where primary storage, replicas, snapshots, archives, logs and backups are located. Ask where service operations and support take place, which personnel can access the data, and where subcontractors operate. Include recovery and restore operations in the map, not just routine storage.

    • Vast capacities up to 6TB[1] to store your photos, videos, music, important documents and more
    • SuperSpeed USB 3.2 Gen 1 (5Gbps)
  3. Identify the rule before choosing a region

Determine whether a binding requirement concerns storage, processing, access, transfer or a defined data classification. Compare that requirement with the actual service configuration and contract. The Canadian, UK and US DoD examples above address different contexts, so none can stand in for the rule that applies to your organization.

  4. Check encryption and key control

Ask what is encrypted at rest and in transit, who controls and can use the encryption keys, and what happens while the service processes the data. Canada’s cloud white paper notes that applications may need decrypted data for processing. Encryption and customer key control can reduce some risks, but they do not necessarily prevent exposure while data is in use or resolve every jurisdiction question.

  5. Review contracts and access procedures

Check terms for provider disclosure commitments, handling of legal requests, audit rights, subprocessors, portability, deletion and exit. Understand how the provider handles a request from an authority. Some legal restrictions may prevent a provider from notifying a customer about a demand, so do not assume notice is guaranteed.

  6. Design and validate recovery

Decide how many backup copies you need, where they may reside, who can restore them, and how they are protected from account compromise. Set a recovery approach that fits your organization’s requirements, then validate that a restore works and that the recovered data is usable. A backup that cannot be retrieved or restored as needed does not meet its recovery purpose.

  7. Check portability and exit

Find out whether backup data can be exported in a usable format, how long retrieval takes, and how it can be moved if a provider or region no longer meets your requirements. World Bank cloud procurement guidance identifies portability, backup plans and redundancy as contract and procurement considerations.

How to compare cloud storage or backup arrangements

Compare the configured service and its contract, not just a “sovereign” product label. A useful comparison records the permitted locations for primary data and backups alongside the controls and recovery steps that matter to your use case.

  • Permitted storage and backup regions, including any exceptions for replicas, archives or support data.
  • Provider and support-personnel jurisdiction, access permissions and operational processes.
  • Encryption coverage, key control and how data is handled during processing.
  • Legal-request procedures, disclosure terms, audit rights and subprocessors.
  • Data export, deletion, retention and exit arrangements.
  • Recovery objectives, restore access and how restore procedures are validated.
  • Whether multi-region resilience is compatible with applicable location or transfer obligations.

A separate external hard drive or SSD can be one option for an additional local backup copy, but it is an implementation choice—not a sovereignty solution or compliance guarantee. Check capacity, device and operating-system compatibility, encryption needs and whether the backup can be kept offline when appropriate. The same questions about access, protection and successful recovery still apply.
