Communities can evaluate a proposed data center by building a project-specific record before decisions are made: identify the approvals and decision-makers, test the site against local plans, request utility and infrastructure analyses, examine environmental and quality-of-life effects, verify the fiscal case, and turn negotiated promises into enforceable, monitorable commitments.
Start by establishing what is being proposed
Before weighing benefits or impacts, gather the facts that define the project and its review path. Ask the developer or the relevant public office for the site location, project phases and schedule, requested approvals, zoning status, and any disclosed operator or anchor tenant. Collect the application materials, plans, studies, and public meeting records as they become available.

Make a decision map: identify which local body handles land use and which other local, state, or federal agencies may review matters such as water, air, wetlands, wastewater, electricity service, or construction. The Pennsylvania local-government planning toolkit is designed to help communities move from an initial inquiry through zoning, permitting, and longer-term planning. Michigan’s project overview emphasizes that applicable reviews depend on the site and design. These are useful examples, not a universal list of powers or permits.

- What approvals are being requested, and when will each decision be made?
- Which parts of the proposal are fixed, and which may change during later phases?
- Will expansions, additional buildings, or changes in operations come back for public review?
- Where can residents find the application, technical studies, meeting notices, and written decisions?
Check whether the site fits local plans and community priorities
Compare the proposed location and use with the comprehensive or master plan, zoning, redevelopment plans, nearby land uses, transportation access, and priorities already identified by residents. Consider the whole campus and its phases—not only the first building shown in a presentation.

Ask for site plans that show building footprints, setbacks, buffers, access roads, lighting, and areas reserved for utility equipment or future construction. Discuss construction impacts as well as ongoing operations. New Jersey’s baseline community-benefit agreement guidance treats conformance with the master plan and early engagement as important groundwork before terms are finalized.
- Would the proposed use require a zoning change, variance, or other discretionary approval?
- How close are homes, schools, parks, or other sensitive uses to buildings, generators, loading areas, and access roads?
- What limits or review points would apply if the campus expands or changes its operating plan?
- Which residents, workers, and businesses may be affected by construction, traffic, noise, or lighting?
Request project-specific infrastructure evidence
Ask for a written impact assessment and its underlying assumptions, not only summary slides or broad statements that services are available. Have municipal engineering and public-works staff review it with the relevant electric and water or sewer providers, fire districts, and emergency services. Each should assess the demands that fall within its role.
Electricity, grid upgrades, and rate questions
Request projected electricity load, peak demand, and the expected timing of that demand. Ask what interconnection steps have been completed, what generation or transmission upgrades may be needed, how upgrade costs would be allocated, and whether large-load tariff treatment is being considered. Ask the utility or regulator to explain what is known about potential rate effects; do not treat a developer’s general assurance or a community’s concern as a substitute for a project-specific utility analysis.

Water, cooling, and wastewater
Ask for projected average and peak-day water use, the proposed cooling technology, the water source, and expected wastewater or other discharge needs. Request the assumptions behind each projection, including how demand may change across seasons and project phases. Ask the water and sewer providers whether existing systems can serve the project and what upgrades would be needed.
Cooling design matters to water demand, so a single annual estimate may not show the highest demand the system must accommodate. New Jersey’s Municipal Resource Hub specifically identifies peak-day usage and cooling technologies as evaluation topics. Ask whether conservation, reuse, or other measures are planned and how performance would be reported.
Roads, emergency response, and on-site hazards
Assess road and bridge capacity, construction traffic, site access, and any public improvements needed. Emergency planning should address water supply for firefighting, communications, access, and the fire department’s ability to respond to hazards associated with generators, fuel storage, batteries, and uninterruptible power supply (UPS) installations. Ask who will fund needed response or infrastructure improvements and how those improvements will be completed before they are needed.

Examine environmental and quality-of-life effects
First identify which environmental reviews apply to the actual site, design, and operations. Michigan’s overview lists potential reviews involving water withdrawals, wetlands, lakes and streams, stormwater, wastewater, air emissions, drinking water, and contaminated sites. It also cautions that not every project requires every permit. Confirm current requirements with the agencies responsible for the particular location.
Noise and lighting
Request a noise assessment that identifies measurement locations, times, existing background conditions, and expected operating conditions. It should address low-frequency sound, backup-generator testing, and any proposed limits or complaint process. Ask what lighting will be used, where it will be directed, and how construction hours and traffic will be managed. Noise and light are impacts communities may seek to mitigate through project review or negotiated terms.
Residents can use a consumer sound meter to document informal observations consistently, noting the time and location. Such records can help describe a concern, but they do not replace an expert acoustic study or measurements made under legally applicable standards.

Seek clear descriptions of construction traffic routes, work hours, lighting, and how residents can report problems. Separate temporary effects from recurring or long-term effects so the review and any proposed mitigation address the right period.

Test the fiscal case, including public costs
Request a transparent fiscal analysis that shows both expected public revenue and the public costs associated with the project. It should identify tax revenue, abatements or other incentives, infrastructure expenses, added service demands, construction impacts, employment assumptions, and the period covered by each estimate. Ask which assumptions are projections and which are secured commitments.
Test what happens if the project is delayed, investment or job projections are missed, or the campus expands. New Jersey’s Municipal Resource Hub points municipal reviewers to fiscal-impact assumptions, peer comparisons, and protections for cases where projected revenue does not materialize. An independent review can help officials assess the assumptions and compare them with the costs and risks borne locally.
- What public infrastructure or service spending is required, and who pays for it?
- What incentives are proposed, how long do they last, and what conditions apply?
- How are construction jobs, permanent jobs, and other economic benefits defined and counted?
- What reporting, repayment, or other remedy would apply if a material commitment is not met?
Negotiate commitments that can be measured and enforced
A community-benefit agreement can be a legally binding contract between a developer and a host municipality or community group. New Jersey’s guidance describes these agreements as a way to address specific impacts, combine financial and non-financial benefits, and set transparent expectations. Whether a local body can require a particular term—and the right legal structure for it—depends on local authority and should be reviewed by local counsel.

Possible subjects include funded road, water, or sewer improvements; fire and emergency-service upgrades; noise and light mitigation; workforce training or apprenticeships; community investment; and public reporting. Avoid relying on broad promises such as “support local jobs” without defining what that means.

For every commitment, specify:
- the responsible party;
- the amount, measurable standard, or defined action;
- the deadline and any conditions that trigger performance;
- how progress and results will be reported, and to whom;
- how long the commitment lasts; and
- the enforcement route or remedy if it is missed.
Engage affected residents and workers early enough for their concerns to inform the review and proposed terms. Keep a public record of commitments and assign responsibility for checking performance after approval; otherwise, even specific promises can be difficult to track over time.
Compare options on the same basis
If the community is considering multiple proposals, sites, or designs, use the same categories and assumptions for each. Project size, location, design, and operating plans can materially change the comparison. A side-by-side review helps distinguish a genuine trade-off from a difference in how proposals were presented.
| Review area | What to compare |
|---|---|
| Land use | Plan and zoning compatibility, campus footprint, phasing, buffers, and proximity to affected uses. |
| Electricity | Peak and annual demand, timing, interconnection status, required grid upgrades, cost responsibility, and any large-load tariff treatment. |
| Water and wastewater | Average and peak-day use, cooling design, water source, discharge needs, and system upgrades. |
| Environmental and neighborhood effects | Air, stormwater, wetlands or other site reviews as applicable, noise, lighting, construction effects, and proposed mitigation. |
| Infrastructure and emergency services | Roads, bridges, site access, fire protection, communications, response capacity, and funding for needed improvements. |
| Fiscal and economic claims | Revenue, incentives, public costs, service demands, employment assumptions, and the duration of each projection or commitment. |
| Accountability | Whether commitments have clear owners, measurable standards, deadlines, reporting, remedies, and a workable monitoring plan. |
Keep the review specific to the jurisdiction and project
Permits, public authority, utility processes, and available technical assistance differ by location. Pennsylvania’s planning toolkit, Michigan’s project overview, and New Jersey’s Municipal Resource Hub provide state-specific examples; none establishes what a different municipality can require or which permits a particular project needs. Obtain the actual application and current local requirements, and confirm the relevant agency and utility reviews before drawing conclusions.
For New Jersey municipalities, the NJEDA Municipal Resource Hub offers technical assistance and points to the Board of Public Utilities for grid and rate questions and NJDEP for environmental questions such as water, air permitting, noise, and environmental justice. Those contacts and programs are specific to New Jersey.
