Some advanced-computing chips and servers that contain them may require a Bureau of Industry and Security (BIS) license; in other cases, a license exception may be available if its conditions are met. A product’s label alone does not determine the result.
What do the controls cover?
The EAR regulates exports, reexports and certain transfers in-country of specified items. BIS uses terms such as “advanced computing ICs” and “commodities containing advanced computing ICs”; the latter can include certain servers. Depending on the item and its technical parameters, relevant classifications can include ECCNs 3A090 and 4A090. Not every GPU or server falls under the same classification or has the same licensing requirements.

The practical question is therefore not simply whether a product is a GPU or an AI server. It is whether the particular item is subject to the EAR, how it is classified, and what the applicable rules require for the full transaction.

- Identify the item. Determine its EAR status and applicable ECCN, if any, using its actual technical specifications. BIS’s guidance and EAR Part 742 are starting points; a marketing name is not a classification.
- Identify the transaction and destination. Establish whether the activity is an export, reexport or transfer in-country, and check the destination and applicable country-group restrictions.
- Screen the parties. Consider the consignee, end user and relevant headquarters and ultimate-parent locations, as well as other party-related restrictions.
- Assess the end use and relevant knowledge. Consider what the exporter knows about the item’s intended use and users, including any potentially restricted AI-training, military-intelligence or weapons-of-mass-destruction connection.
- Check the license requirement and review policy. If an application is required, the applicable review policy and any information or certification requirements depend on the specific pathway.
- Evaluate any proposed exception. Confirm that the item, destination and transaction qualify under the current EAR provision, and meet every notice, certification and continuing condition.
How do China, Macau and party locations affect the analysis?
BIS guidance dated May 31, 2026 states that a license is required for covered advanced-computing items to entities headquartered in Country Group D:5 or Macau, and to entities whose ultimate parent is headquartered there—even when the entity itself is located elsewhere. The rule is relevant to party screening, not a substitute for classifying the item or reviewing the transaction’s other facts. It should not be read as saying that every chip, server or transaction has the same outcome.
What technical thresholds and application conditions matter?
BIS’s EAR Part 742 guidance describes a case-by-case review policy for specified commodities destined to end users in China or Macau when total processing performance (TPP) is below 21,000 and “total DRAM bandwidth” is below 6,500 GB/s. These are criteria for a defined application pathway—not general safe harbors, universal limits or permission to ship without a license. The relevant item scope and other conditions still matter.

EAR Part 748 also sets out certification conditions for certain applications. Depending on the provision, these include an aggregate-TPP comparison and statements addressing military, military-intelligence and WMD risks, as well as risks associated with parties to the transaction. Applicants must follow the actual provision’s scope and requirements; the figures and certifications should not be detached from that context.

Do AI-training end uses automatically prohibit a shipment?
No. AI training by itself is not an automatic ban under the guidance summarized here. BIS’s May 13, 2025 guidance describes circumstances in which knowledge that commodities will be used to train AI models for specified WMD or military-intelligence end uses or users can trigger licensing requirements. The specific end use, user and exporter’s knowledge are material; do not broaden that rule to all AI training.

Can a license exception be used?
Possibly, but an exception is not a blanket waiver. The EAR exceptions—including NAC, ACA and AIA—have defined scopes and eligibility limits. Depending on the exception and transaction, requirements may include prior notification, certification or additional controls. Check the current text in EAR Part 740 and satisfy all applicable conditions before relying on an exception.

On January 13, 2026, BIS announced that it would review applications for Nvidia H200, AMD MI325X and similar chips on a case-by-case basis if specified security requirements were met. This was a dated statement about application review, not a general authorization to export or a finding that every such transaction qualifies. Check the current EAR and BIS guidance for later changes and the requirements that apply to a particular shipment.

What should a business verify before shipping?
- The item’s technical specifications, EAR status and classification.
- The transaction type, destination and applicable country restrictions.
- The consignee, end user, headquarters and ultimate parent.
- The intended end use and information relevant to the exporter’s knowledge.
- Whether a license is required, the applicable review policy and any application conditions.
- If relying on an exception, its current scope and every notice, certification and continuing requirement.
This is a practical orientation, not a transaction-specific classification or legal determination. The controlling answer depends on the full, current EAR and facts about the item and transaction. BIS guidance and dated policy announcements can be superseded, so verify the operative rules before acting.
