Short answer: Taking, recording, copying, threatening to share, and actually sharing an intimate image are separate legal questions. In many places, sending or posing for a photo does not give another person permission to distribute it. The controlling law depends on where the conduct occurred, where the people are located, the person’s age and capacity, the image and how it was obtained, the distributor’s knowledge or intent, and any statutory exception.
This guide compares selected official rules in the United States, United Kingdom, Canada and Australia. It is not a complete statement of any country’s law. State, provincial, territorial and devolved laws can change the result, so a specific case requires current local legal advice.

Consent to make or send an image is not consent to share it
Consent is specific to an act. Agreeing to be photographed, recording yourself, or sending an intimate image to one person does not ordinarily establish permission for that person to forward it, post it, sell it, or show it to others.

The U.S. Department of Justice puts the distinction plainly: “Even if you agreed to have your image taken or you took an intimate image of yourself and sent it to someone, it does not mean that you agreed to the images or videos being shared with others.” The same reasoning appears in laws and policy frameworks that treat later disclosure as a new act requiring its own consent analysis.

That does not mean every unwanted photograph or every disclosure is prosecuted everywhere. Definitions of an “intimate image,” privacy expectations, required mental state, exceptions, limitation periods and available remedies vary by jurisdiction.
Taking, recording, copying and sharing are different offences or claims
Start by separating what happened:
- Taking or recording: Capturing an image or video without permission, such as photographing someone in a private setting.
- Copying: Saving, duplicating or extracting an image that was sent for a limited purpose. Some newer proposals and laws address copying temporary or disappearing images.
- Sharing or publishing: Sending the file to another person, posting it online, displaying it, selling it or otherwise making it available.
- Threatening: Saying or implying that the image will be shared unless the person complies with a demand. A threat can be legally significant even when no publication occurs.
- Manipulating: Editing a real image or generating a fake sexual image that appears to depict a person. Treatment differs by jurisdiction.
A rule aimed at non-consensual disclosure may not cover every form of non-consensual capture, and a capture offence may require a privacy expectation that is absent in a public place. The same conduct can also trigger both criminal investigation and a civil claim.
United States: a federal civil remedy and a narrow federal capture offence
Federal civil action for qualifying disclosures
Under 15 U.S.C. § 6851, an identifiable person may bring a civil action when an intimate visual depiction is disclosed without consent in or affecting interstate or foreign commerce, or by using a facility of that commerce. The discloser must know that consent was absent or recklessly disregard that fact. The commerce requirement means this federal provision is not a universal rule covering every image dispute; state laws may supply additional criminal or civil remedies.
The statute expressly says that agreeing to creation does not establish agreement to distribution. Voluntarily showing an image to someone also does not establish consent to further disclosure. A court can award actual damages or the statute’s stated liquidated-damages amount of $150,000, along with costs and reasonable attorney fees. Injunctive relief may be available, and the court may protect the plaintiff’s anonymity.
There are statutory exceptions. They include specified good-faith disclosures, matters of public concern or interest, and disclosures reasonably intended to assist the depicted individual. Whether an exception applies depends on the facts and the statutory language, not on a general claim that the material was “already online.”

What the federal civil route does not do
The Department of Justice explains that this is a private lawsuit: government agencies do not represent the person bringing it. A plaintiff must pursue the case, usually with a lawyer or legal-aid assistance. The DOJ also notes that state criminal laws may apply independently. A civil damages figure is not a criminal penalty, and filing a federal civil action is not the same as obtaining an automatic platform takedown.
Federal law on non-consensual capture
18 U.S.C. § 1801 criminalizes specified intentional capture of a person’s private area without consent when the person reasonably expects privacy, but only within the statute’s special maritime and territorial jurisdiction. It is therefore a limited federal voyeurism offence, not a general nationwide prohibition on every non-consensual photograph. State law usually matters for incidents outside that narrow jurisdiction.
United Kingdom: sharing and threats, with implementation-sensitive newer measures
Section 66B of the Sexual Offences Act 2003
Section 66B addresses intentional sharing, or threats to share, an intimate photograph or film without consent. Its offence structure includes questions about whether the person had a reasonable belief in consent and, for some routes, what purpose or intent accompanied the conduct. The exact elements and territorial application should be checked in the current legislation for England and Wales or the relevant UK jurisdiction; Scotland and Northern Ireland have their own legal frameworks.
Crime and Policing Act 2026 factsheet
A GOV.UK factsheet updated 30 September 2026 describes intimate-image measures associated with the Crime and Policing Act 2026. The measures described include offences concerning taking or recording, copying temporarily shared images, and supplying image-generator tools. It also describes platform duties requiring timely removal after valid reports and refers to a 48-hour outer limit for relevant takedowns.
The factsheet uses future-facing language for some measures. Before relying on any newly described offence or deadline, check whether Parliament enacted the provision, its commencement date and the operative wording. The reported 48-hour period is not a universal rule for every platform or every report. A platform’s own process, the type of material and the applicable commencement provision can affect what happens.

Canada: the Criminal Code covers non-consensual publication and threats
The official Criminal Code text identifies an offence involving publishing, distributing, transmitting, selling, making available or advertising an intimate image without the depicted person’s consent. It also refers to threats to publish. The wording covers more than a public website post: sending a file to another person or making it available can fall within the conduct described.

Canadian cases turn on the current consolidated provision and its definitions. The applicable province, the age and capacity of the people involved, the evidence of consent and any available defence all matter. Check the current Criminal Code text and obtain Canadian legal advice before relying on a specific element, penalty or limitation period.
Australia: national principles guide policy; states and territories make the offences
Australia does not have one national statute created by the national principles on the non-consensual sharing of intimate images. The Attorney-General’s Department says the principles are non-binding and that states and territories are responsible for their criminal-justice systems. The law in the state or territory where the conduct occurred therefore controls the practical answer.
The principles identify a broad range of conduct for local frameworks to consider:
- Images made consensually and later shared without consent.
- Images obtained secretly.
- Threats to distribute.
- Doctored or manipulated images.
- Sharing through changing technologies and services.
Principle 1 states: “The distribution of, or threat to distribute, intimate images without consent is unacceptable and breaches community standards of acceptable behaviour.” Principle 5 cautions that a criminal framework should not capture conduct that does not warrant criminal sanctions, such as sharing intimate images between consenting adults or the depicted person’s initial taking or sharing of the image. Those principles guide legislative design; they do not replace checking the current law in the relevant state or territory.

|---|---|---|---|---|
| Non-consensual capture | Federal capture offence is limited to specified privacy violations in special maritime and territorial jurisdiction; state law may apply elsewhere. | Section 66B focuses on sharing and threats; newer capture measures described in the 2026 factsheet require enactment and commencement checks. | Not stated in the cited material; check the applicable Criminal Code and provincial or territorial law. | Handled through state and territory law; national principles identify secretly obtained images as conduct for local frameworks to consider. |
| Later disclosure | Federal civil action under 15 U.S.C. § 6851 when its commerce and mental-state requirements are met; state criminal and civil laws may also apply. | Intentional sharing without consent is addressed by Section 66B, subject to its elements and territorial application. | Criminal Code text identifies publishing, distributing, transmitting, selling, making available or advertising without consent. | State and territory offences vary; national principles are non-binding. |
| Threats | Available claim or offence depends on state and federal provisions; the cited federal civil statute concerns qualifying disclosures. | Section 66B includes threats to share. | The cited Criminal Code text refers to threats to publish. | National principles specifically identify threats; the applicable offence is local. |
| Mental element | Federal civil claim requires knowledge of absent consent or reckless disregard. | Section 66B includes intentional conduct and a reasonable-belief-in-consent question. | Not stated in the cited material. | Not stated nationally; state and territory law controls. |
| Remedies | Federal civil damages, possible injunction, costs and attorney fees; anonymity may be available. | Criminal and platform-removal routes depend on the current law and procedure. | Criminal process and local civil remedies require current legal advice. | Police, local courts and support services depend on the state or territory. |
What to do if an intimate image was taken or shared without consent
1. Deal with immediate safety first
If the person is threatening violence, extortion or self-harm, or you fear an immediate physical danger, contact emergency services in your location. Do not meet the person alone to negotiate removal. A threat to publish can be serious even when no file has yet appeared online.
2. Preserve evidence without spreading the image
Keep the original messages, account names, profile links, dates, times and threat wording. Save screenshots that show the context and the sender’s identifier. Do not forward the intimate image to friends or post it publicly to “prove” what happened. If a lawyer or police officer needs the file, ask how it should be transferred securely. Preserve evidence in a way that does not create new copies or expose additional people.
3. Use the service’s reporting channel
Report the specific post, message, account or threat through the platform’s intimate-image or sexual-exploitation reporting process. Record the report number and the time submitted. Removal policies are not the same as criminal law, and a platform may need a valid report, identity information or a court order. If the UK 2026 measures apply to your case after commencement, check whether the described statutory timetable covers that service and material.
4. Report to local authorities or a specialist service
Police, prosecutors, victim-support organizations and legal-aid services can explain the correct route for your location. Give them the jurisdiction, the age of everyone involved, how the image was obtained, where it was sent or posted, and whether there was a threat, payment demand or coercion. In the United States, the DOJ directs people to legal-aid, victim-support and hotline resources, but it does not act as the individual’s lawyer.

5. Ask about civil remedies and deadlines
A civil claim may seek damages, an injunction or an order protecting anonymity. The U.S. federal statute has specific commerce and mental-state requirements and a stated $150,000 liquidated-damages option; other claims may use different rules. Limitation periods, filing procedures and costs vary, so obtain advice promptly rather than assuming a platform report preserves every legal deadline.

Special issues that can change the analysis
Age, capacity and safeguarding
If anyone depicted was under 18, or lacked legal capacity to consent, stop treating the issue as an ordinary adult privacy dispute. Child sexual-abuse-image laws, safeguarding duties and mandatory-reporting rules can apply, with strict rules about possession and forwarding. Do not download, resend or store suspected illegal material. Contact local police, child-protection authorities or a qualified lawyer for instructions specific to your location.
Temporary or disappearing images
An image being sent through a disappearing-message feature does not automatically authorize copying it. Whether saving, screenshotting or extracting temporary content is separately prohibited depends on the jurisdiction and the provision in force. The UK factsheet describes a proposed or newly enacted measure concerning copying temporarily shared images; verify commencement and scope before relying on it.
Edited and AI-generated images
Some frameworks address doctored images or the supply of image-generator tools, while others use definitions that may not clearly cover synthetic material. Preserve the original post and the context showing how the image was made. Do not assume that a fake image is harmless or that every manipulated image is covered by the same offence as an authentic photograph.
Public-interest and good-faith disclosures
Not every disclosure is unlawful. The U.S. federal civil statute includes specified good-faith disclosures, matters of public concern or interest, and disclosures reasonably intended to assist the depicted person. Those exceptions are fact-specific and do not create a general permission to repost intimate material because the sender claims a warning or public-interest purpose.
Questions to answer before choosing a legal route
- Where did the capture, sending, posting or threat occur, and where are the people located?
- Was the image made, sent, shown, copied or published voluntarily, and what limits were communicated?
- Was there a reasonable expectation of privacy when it was captured?
- Did the recipient know consent was absent, act recklessly, or intend to cause a particular result?
- Was anyone under 18 or unable to give legal consent?
- Was there a threat, extortion demand, stalking, harassment or physical-safety risk?
- Is the material authentic, edited or AI-generated?
- What remedy is needed now: emergency protection, removal, a criminal report, damages, an injunction or anonymity?
The answer to “Is it illegal to share someone’s nudes without permission?” is therefore jurisdiction-specific, but the central rule is consistent across the sources discussed here: permission to create or send an intimate image is not automatic permission to share it. Identify the location and conduct precisely, preserve evidence safely, and use local legal or victim-support assistance before taking steps that could expose the image further.
