The February 2026 U.S.–India announcement is not yet a fully operative free-trade agreement. It is a framework for an Interim Agreement, with negotiations continuing toward a broader Bilateral Trade Agreement. Until the governments publish final implementing text, an entry-into-force date and product-level customs instructions, businesses should treat the headline terms as policy commitments—not as a universal duty rate that can be applied to every shipment.
What the February 2026 U.S.–India deal actually is
The February 6, 2026 joint framework describes the intended terms of an Interim Agreement. It is meant to lead toward a wider Bilateral Trade Agreement, but the official material available as of October 19, 2026 does not establish that the Interim Agreement has entered into force. It also does not publish a complete Harmonized System (HS) tariff annex for every product.

That distinction matters. A political announcement can set negotiating commitments, while customs agencies need legally effective text, tariff-line instructions, effective dates, exclusions, quotas and documentary rules before an importer can claim a particular treatment at entry. Until those items are issued, a broker or importer should not assume that a quoted “deal rate” will be accepted by U.S. Customs and Border Protection (CBP).
Did the countries sign a free-trade agreement?
Not on the evidence currently published. The framework is an interim step, not a completed, comprehensive free-trade agreement. A final Bilateral Trade Agreement would require its own text, implementation process and operative customs schedules. Businesses should describe the February document as a framework or interim agreement under negotiation, rather than as an effective free-trade agreement.

The tariff numbers businesses should model
| Measure | What the published material says | How to use it now |
|---|---|---|
| U.S. reciprocal tariff on originating Indian goods | An 18% rate is stated for originating Indian goods in listed sectors under the February framework. | Use 18% as a planning scenario, then verify the product’s sector, origin and effective date. It is not a universal confirmed rate for every Indian product. |
| Possible reciprocal-tariff relief | Some categories may receive removal of the reciprocal tariff if the Interim Agreement is successfully concluded. | Do not apply the relief until the final agreement and implementing instructions identify the qualifying products and effective date. |
| Separate Section 301 measure | An Indian Ministry of Commerce and Industry notice dated July 25, 2026 reports a final additional 10% ad valorem duty on imports from India under U.S. Section 301 forced-labour measures. The notice says this was reduced from a proposed 12.5%. | Treat it as a separate tariff layer. Confirm the exact HTS scope, exclusions and effective-date rules for each line. |
| Ordinary U.S. duty | The normal HTS duty still depends on the product classification and any existing trade-remedy measure. | Classify the merchandise before adding any framework or Section 301 layer. |
| Negotiation baseline | The 2025 USTR Terms of Reference fact sheet cites a 17% average applied Indian tariff and a 3.3% average applied U.S. tariff, using a 2024/2025 baseline. | These are economy-wide averages, not the rate for a particular shipment and not a promise that every product will move to either figure. |
The 18% and 10% figures therefore answer different questions. The 18% is the headline reciprocal rate in the February framework for specified originating Indian goods. The reported 10% Section 301 duty is a separate action. An importer may also owe the ordinary HTS duty and another product-specific trade remedy. The final payable amount is product-specific.
Why the deal matters economically
USTR’s 2026 country profile estimates total U.S. goods-and-services trade with India at $239.6 billion in 2025. Goods trade was $149.1 billion, consisting of $103.8 billion of U.S. goods imports from India and $45.4 billion of U.S. goods exports to India. The resulting U.S. goods trade deficit was estimated at $58.4 billion. Those figures explain the political focus on market access, but they do not determine the tariff on an individual entry.
What U.S. importers of Indian goods should do
Importers should build a shipment-level duty model rather than multiply an invoice by 18% and stop. The following process keeps the legal and commercial questions separate.
Do these 3 things before closing this tab:
1Scan for outdated or missing drivers - takes under a minute2Clear out junk files and repair common Windows errors3Fix the driver behind crashes, sound loss and screen glitches- Identify the exact product and HTS classification. Record the commercial description, material composition, function, processing and packaging. A broad product name is not enough for a customs determination.
- Determine origin under the applicable U.S. rules. The country from which a shipment is dispatched does not, by itself, establish origin. Obtain manufacturing and processing facts and document the analysis used to determine whether the good is Indian-originating.
- Calculate the ordinary duty first. Use the current HTS line and check whether an antidumping, countervailing, safeguard or other product-specific action applies.
- Test the 18% framework layer. Determine whether the line falls within a sector covered by the February framework, whether the good satisfies the applicable origin rule and whether the Interim Agreement’s treatment is legally effective on the entry date.
- Check the separate 10% Section 301 layer. Review the latest USTR and CBP instructions for the product’s HTS line, effective date, exclusions and any special reporting or payment mechanism.
- Check for later implementing notices. Before entry, look for the latest U.S. and Indian government notices covering tariff annexes, quotas, exclusions, entry procedures and documentary requirements.
- Reprice the transaction. Recalculate landed cost, Incoterms exposure, brokerage, merchandise processing fees, carrying costs and the price offered to the customer. Put a change-in-law mechanism in long-term contracts if the parties have not agreed who bears a new duty.
Illustrative duty-stack calculation
Assume, purely as a method demonstration, that a product has a 5% ordinary HTS duty, is covered by an effective 18% reciprocal layer and is also within the reported 10% Section 301 measure. The importer must ask how each duty is assessed and then apply the legally prescribed calculation to the customs value. The planning stack would contain three distinct entries—5%, 18% and 10%—but this example does not establish that any real product carries those rates or that the percentages can simply be added without checking the governing instructions.

Records to keep
- HTS classification rationale, including product specifications and binding-ruling research where applicable.
- Commercial invoice, purchase order, packing list and transport documents.
- Customs-value support, such as assists, royalties, commissions and related-party pricing records when relevant.
- Manufacturing records and an origin analysis showing why the claimed country of origin applies.

- Entry summaries, duty calculations, broker communications and corrections.
USTR describes customs formalities as a necessary part of international trade and says that customs valuation must be fair and uniform. A complete file is therefore useful even when no preferential rate is claimed.
What changes for U.S. exporters to India
The framework says India will eliminate or reduce tariffs on all U.S. industrial goods and a broad range of U.S. food and agricultural products. The examples named in the joint statement include dried distillers grains (DDGs), red sorghum for animal feed, tree nuts, fresh and processed fruit, soybean oil, wine and spirits.
It also addresses non-tariff issues that can prevent a shipment from reaching the market even when the customs duty falls. The subjects identified include medical-device barriers, information and communications technology import licensing, standards and food and agricultural requirements. Exporters should distinguish a tariff commitment from a regulatory approval: a lower duty does not remove a licensing, labeling, testing, sanitary or conformity obligation unless the Indian implementing rules expressly do so.
How exporters should quote prices
- Classify the product under the Indian HS schedule and identify all required permits, standards and registrations.
- Check whether India has published the promised reduction or elimination for that exact line, rather than relying on a sector description.
- Confirm the effective date and whether the treatment is immediate, staged, quota-limited or conditional on completion of the Interim Agreement.
- Obtain the origin and commercial documents the Indian customs authority requires.
- Quote the buyer with an Incoterm that clearly allocates duty, clearance and delay risk.
Until India publishes product-level schedules and notifications, an exporter should avoid promising “duty-free” delivery solely because the framework lists the product category.

Origin evidence and certificates: what is known
Rules of origin determine whether a good is considered originating and therefore qualifies for preferential tariff treatment. They are separate from the commercial invoice and from the location of the seller. A product bought from an Indian company may still require a detailed manufacturing analysis, while an item shipped through India may not qualify as Indian-originating.
The February framework materials do not establish one universal certificate-of-origin form for every shipment. Whether a formal certificate, an importer declaration, a producer statement or another record is required will depend on the final agreement and each customs authority’s instructions. Until those instructions are published, maintain origin evidence and be prepared to provide the document specified for the relevant HTS line. Do not create a certificate solely to match the 18% headline.
How to distinguish an effective preference from a policy announcement
| Question | Why it matters | Evidence needed before claiming treatment |
|---|---|---|
| Has the Interim Agreement entered into force? | A commitment may not yet be legally available at entry. | Official entry-into-force notice and implementing text. |
| Is the product in the covered sector or tariff list? | Sector language does not replace an HS-line schedule. | Final tariff annex or customs instruction identifying the line. |
| Does the product meet origin rules? | Preferential treatment generally attaches to originating goods, not merely goods shipped from a country. | Production records and the required origin declaration or certificate. |
| Does another measure apply? | Reciprocal relief may not remove ordinary duty or a separate Section 301, trade-remedy or national-security measure. | Current HTS, USTR and CBP notices for the entry date. |
| Is the customs value documented? | The percentage cannot be applied correctly without a supportable customs value. | Invoice, payment, assists, related-party records and valuation workpapers. |
Implementation gaps that remain as of October 19, 2026
The official material available for this article does not publish a definitive entry-into-force date for the Interim Agreement or a complete HS-code tariff annex. It also does not establish one universal rate for every Indian product. The framework contains sector references, conditional exclusions and commitments that still require implementation. The July 25 Indian notice reports the separate 10% Section 301 measure, but the exact scope and effective-date rules must still be checked line by line.

Operational checklist for companies trading across the corridor
- Assign an owner for monitoring U.S. and Indian tariff notices.
- Maintain a product master containing HS codes, origin, supplier, manufacturing location and valuation terms.
- Run separate calculations for ordinary duty, the 18% reciprocal scenario, the reported 10% Section 301 duty and any other measure.
- Ask suppliers for production and origin records before the first preferential claim.
- Update purchase orders and sales contracts to state who bears a new or retroactive duty.
- Give brokers the complete product description and supporting documents, not just an invoice value.
- Retain records for the applicable customs retention period and document corrections when a classification or origin conclusion changes.
Frequently asked questions
Is the 18% rate the total duty on every Indian product?
No. It is the headline reciprocal rate stated for originating Indian goods in listed sectors under the February framework. Ordinary HTS duty, the separately reported 10% Section 301 layer and other measures may also apply, and the framework is not yet a complete product-by-product customs schedule.
Can a company claim the framework rate on a shipment today?
Only if the relevant implementing text is effective and the product, origin and documentation satisfy the published requirements. The available official material does not establish a universal effective date, so confirm the current USTR and CBP instructions before entry.
Does an invoice from an Indian seller prove Indian origin?
No. Origin depends on the applicable rules and the facts of production. Shipping point, seller address and invoice wording are not substitutes for an origin analysis and supporting manufacturing records.

Which U.S. exports are positioned for lower Indian tariffs?
The framework identifies all U.S. industrial goods and a wide range of food and agricultural products, including DDGs, red sorghum for animal feed, tree nuts, fresh and processed fruit, soybean oil, wine and spirits. Product-level Indian notifications are still needed before an exporter can quote a definitive reduced or zero duty.

Frequently Asked Questions
What is the latest U.S.–India trade deal?
As of October 19, 2026, it is a February 2026 framework for an Interim Agreement, with negotiations continuing toward a broader Bilateral Trade Agreement. Final implementing text, a confirmed entry-into-force date and a complete tariff annex are not established in the available official material.
Do Indian goods automatically receive preferential treatment because they were shipped from India?
No. Eligibility depends on the applicable origin rules, the product’s tariff line and the required customs evidence. Shipment location alone is insufficient.
Is the reported 10% Section 301 duty part of the 18% reciprocal tariff?
It is described as a separate tariff action. Importers must check whether both measures and the ordinary HTS duty apply to the same line.
