Unsolicited commercial email is a commercial message sent without the recipient’s prior request or consent. It is often called spam, but the term does not mean every message is fraudulent, and sending in bulk is not required for a message to fit the description.
What is unsolicited commercial email?
Unsolicited commercial email (UCE) is email that promotes a commercial product or service and reaches someone who did not previously request or consent to it. The Federal Trade Commission (FTC) used this descriptive definition in a 2001 statement, defining UCE as “any commercial electronic mail message sent, often in bulk, to a consumer without the consumer’s prior request or consent.” FTC statement, April 26, 2001

“Often in bulk” describes a common pattern; it does not make bulk volume a requirement. A commercial email sent to one person can still be unsolicited if the recipient did not request or consent to it.

How does the term relate to spam and scams?
UCE is often called spam, especially when it is sent in large volumes. But unsolicited describes the recipient’s relationship to the message, not whether its claims are dishonest or dangerous. In the same 2001 testimony, FTC official Eileen Harrington said, “Not all UCE is fraudulent.” Some unsolicited messages may be deceptive or fraudulent; the terms are not interchangeable.

What does U.S. CAN-SPAM law cover?
In the United States, CAN-SPAM uses a statutory category called a “commercial electronic mail message.” The FTC explains that whether a message falls into that category depends on its primary purpose: advertising or promoting a commercial product or service, including content on a commercial website. This is a legal framing distinct from the everyday description of UCE as unrequested commercial email. FTC CAN-SPAM Act compliance guide
The law is not limited to bulk campaigns. FTC guidance says CAN-SPAM can apply to commercial email between businesses as well as messages sent to consumers. Thus, message purpose matters; volume and whether the recipients are businesses do not, by themselves, settle the question.

Does unsolicited commercial email automatically violate CAN-SPAM?
No. “Unsolicited commercial email” is a descriptive term, not a finding that a message violates U.S. law. The FTC describes CAN-SPAM requirements that include accurate header information, non-deceptive subject lines, identification of advertising, and a way for recipients to opt out. Whether a particular message complies depends on the applicable requirements and facts; an unwanted message is not automatically a scam or a legal violation. No universal legal definition follows from the FTC’s U.S.-focused materials. The FTC’s wording is useful as a plain-language description, while CAN-SPAM supplies the relevant U.S. statutory context. Other countries may define and regulate marketing email differently; these U.S. sources do not establish those rules. What the FTC’s historical figures do—and do not—show
FTC staff said they reviewed more than 100,000 pieces of UCE for a prepared statement in 2001. That figure describes the collection examined for that statement, not current spam volume or the prevalence of unsolicited email today. FTC statement, April 26, 2001
