There is no universal answer. In the UK, the government’s stated position is that most loot boxes are not gambling under the Gambling Act 2005 when their rewards stay within the game and cannot be converted into real-world money. A prize that can readily be exchanged for cash may be treated as money or money’s worth, potentially bringing the mechanic within gambling definitions. The outcome depends on the game’s mechanics and the law where it is offered.
What makes a loot box a legal question?
A loot box is generally a game feature that gives a player a randomized reward. To assess whether a particular feature may be gambling, it matters how the box is obtained, whether the reward is random, whether the item can be transferred or sold, and whether a player can turn it into cash. The label “loot box” does not settle the legal question.

One especially important distinction in UK government guidance is between an item useful only inside a game and a prize with real-world monetary value. Transferability, third-party trading and cash-out routes can change that analysis. These are facts to investigate, not a universal checklist that decides legality in every country.
Are loot boxes gambling in the UK?
The UK government’s July 2022 response to its loot-box call for evidence said it did not intend to extend gambling regulation to loot boxes at that time. It said that most loot boxes did not meet the Gambling Act 2005 definition where rewards remained within the game and could not be exchanged for real-world money.

That position is conditional, not a blanket exemption for every randomized game purchase. The same response said that if a prize can readily be exchanged for cash, it may be money or money’s worth and could bring the mechanic within gambling definitions. The government also said games companies should prevent cashing out items obtained from loot boxes, including through third-party websites.
A February 2026 answer to a parliamentary question restated that prizes with no monetary value, which cannot be cashed out and are useful only within the game, are not legally classified as gambling. It separately noted that the Gambling Commission can act against products that amount to unlicensed gambling, including skin betting. Skin betting and loot boxes are distinct categories; the mention of enforcement against one should not be read as a ruling that all loot boxes are gambling.

How does the answer differ outside the UK?
There is no single international rule. The UK Gambling Commission’s overview of international approaches identifies Belgium and the Netherlands as examples where loot-box mechanics have been considered under broader gambling frameworks. The approaches described are not interchangeable, and they do not establish that every game or design is prohibited in either country.

For a specific country, the relevant questions include how its law defines gambling and a prize, whether a prize must have real-world value, whether items can be transferred or cashed out, and what current regulators and courts have decided. The UK Gambling Commission overview provides examples of variation, not a complete or current legal map of every country.

Does research show that loot boxes cause problem gambling?
The UK government’s 2022 evidence review summarized an assessment of 15 peer-reviewed empirical studies. It reported a stable association between loot-box use and measures of problem gambling, as well as emerging evidence of an association between higher spending and problem-gambling measures.
An association does not establish cause and effect. The government said the reviewed research had not demonstrated that loot boxes cause problem gambling; possible alternative explanations include shared risk factors or people with pre-existing gambling problems spending more on loot boxes. The evidence supports concern and further attention, not the claim that causation has been proved.

What protections should players and parents look for?
UK government objectives for industry guidance include requiring parental or guardian enablement before children can make loot-box purchases, making spending controls available and understood, and providing transparent purchase information. The guidance is industry-led, and the government noted that the working group involved did not cover the whole games sector. The protections available can therefore vary between games and platforms.

- Whether the reward is randomized and how the box is purchased.
- Whether the game explains odds or other relevant purchase information.
- Whether items can be transferred, sold, traded or cashed out, including through third parties.
- Whether a parent or guardian must enable a child’s purchases.
- Whether spending controls are available and how to set them.
These checks help clarify both the purchase and the facts relevant to a legal assessment. They do not replace advice about the law in the applicable jurisdiction.
What other UK rules may apply?
A conclusion that a loot box is not gambling does not mean that no other rules apply. UK government materials identify consumer law, data protection, advertising guidance and transparency as relevant frameworks. The government has emphasized that traders should give consumers meaningful information to support informed purchase decisions.
