UK Cyber Security Bill vs EU AI Act: Which Rules Apply to Your Business?

By Freedom251 Team · · 12 min read

Short answer: the proposed UK cyber-security regime is primarily triggered by the sector or service your organisation operates, while the EU AI Act is triggered by your role in the AI value chain, the system’s risk category and its connection with the EU. A business can be in scope of both, one or neither.

Use the decision process below to map your services, suppliers, AI systems, locations and dates. The UK framework is still being developed through consultation and secondary legislation; the EU regime is already applying in stages.

What each law is designed to regulate

These are not two versions of the same rulebook. They address different sources of risk and use different tests for scope.

The UK Cyber Security and Resilience Bill

The UK Government describes the current baseline as the 2018 Network and Information Systems (NIS) Regulations. They cover operators and digital services in sectors including energy, transport, health, drinking water and digital infrastructure, plus some digital service providers. The proposed Cyber Security and Resilience Bill is intended to widen that framework and strengthen the Government’s ability to respond as technology and threats change.

Planned additions include data centres, managed service providers (MSPs) and large load controllers. The policy statement says the Bill will also allow the Government to act against emerging threats without needing new primary legislation. That is a policy direction, not a complete list of final duties: scope, commencement, designation and detailed controls still depend on consultation and secondary legislation.

The EU AI Act

Regulation (EU) 2024/1689 is a comprehensive framework for artificial intelligence. It assigns obligations according to what an organisation does in the AI value chain: provider, deployer or provider of a general-purpose AI (GPAI) model, among other roles. Requirements then vary with the system’s risk category and the system’s connection to the EU market or use in the EU.

Research, development and prototyping before a system is released on the market are exempted under the European Commission’s FAQ. Once a system is supplied, placed into service or used in circumstances that create an EU connection, the relevant role and risk rules must be assessed.

How to test whether the UK regime applies

Start with your service, not your software label

A company is not automatically covered because it uses cloud computing, hosts an application or has a cyber-security team. The first question is whether it operates in a listed sector or provides a service that the legislation designates. Map the revenue-generating services you provide, the infrastructure behind them and the customers who depend on them.

  • Existing NIS areas: energy, transport, health, drinking water, digital infrastructure and certain digital services.
  • Planned expansion: data centres, MSPs and large load controllers, subject to the final Bill and regulations.
  • Potential designated suppliers: a supplier that is critical to an in-scope operator may face obligations or information requests even when it is not itself an operator of essential services.

Do not treat the Government’s proposed categories as enacted law. The UK Government said in 2026 that it planned an implementation consultation, followed by a response and secondary legislation and then an adjustment period for stakeholders. Until those steps are completed, exact commencement dates, duties and designation mechanisms can change.

When an MSP is likely to be relevant

The policy statement describes an intended managed service as one that is:

The Information Commissioner’s Office (ICO) is intended to regulate MSPs. The UK Government estimated that bringing MSPs into scope could secure a further 900–1,100 MSPs (UK Government, 2025). That is an estimate of potential coverage, not a count of enacted registrations or a definitive list of affected companies.

What evidence a UK-regulated organisation should prepare

The comparison material published by the Government points to a cyber-resilience evidence set rather than an AI product file. Depending on the final designation, expect to demonstrate governance around:

  • identifying and treating cyber risks;
  • technical and organisational security controls;
  • incident detection, response and reporting;
  • continuity and recovery arrangements; and
  • supply-chain and critical-supplier oversight.

Keep an inventory of systems, dependencies, responsible owners, incident routes and records showing that controls operate in practice. A written policy without evidence of testing, escalation and remediation is unlikely to be persuasive to a competent authority.

How to test whether the EU AI Act applies

Identify your AI role

Classify every relevant system by the function your organisation performs, rather than by the vendor’s marketing terminology.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.
  • Provider: the organisation that develops an AI system or model and supplies it under its name or trademark.
  • Deployer: the organisation that uses an AI system under its authority, such as an employer operating a recruitment tool or a company using an AI service in customer operations.
  • GPAI provider: the organisation that places a general-purpose AI model into the EU market and therefore has model-level responsibilities in addition to any downstream system duties.
  • Other value-chain participant: importers, distributors, product manufacturers and authorised representatives may have specific duties depending on the transaction and the system.

A UK company can therefore be a provider for one product, a deployer of another company’s model and a supplier in a third-party product chain at the same time. Make the classification per system and per transaction.

Classify the risk category

The Act uses a risk-based structure. Prohibited practices have the strictest outcome: the practice cannot be offered or used where the prohibition applies. Other systems may be subject to transparency, literacy, documentation, human-oversight or monitoring requirements. High-risk systems face the most extensive technical and governance obligations.

High-risk examples named in the timeline include uses involving biometrics, critical infrastructure, education, employment, migration, asylum and border control. High-risk AI embedded in regulated products, including medical devices, toys and lifts, follows a separate timetable. Do not infer that every AI feature in one of these industries is automatically high-risk; classify the specific intended purpose and deployment context.

Check the EU connection

Ask whether your organisation places an AI system or GPAI model on the EU market, puts it into service in the EU, deploys it for people or organisations in the EU, or supplies a product whose AI function is used there. EU customers, EU users and an EU-facing product launch are clear signals to obtain a documented scope analysis.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

A system used only for internal research and development before market release falls within the Commission’s stated exemption for research, development and prototyping. That exemption does not automatically cover a production pilot supplied to customers or a released product that happens to be labelled a beta.

Evidence required under the Act

The evidence set depends on the role and risk class, but a practical inventory should cover:

  • the system’s intended purpose, users and operating context;
  • the role your company performs and the upstream and downstream parties;
  • the risk classification and the reasoning behind it;
  • AI-literacy measures for people who develop, deploy or supervise the system;
  • transparency information where users must be told that they are interacting with or receiving AI-generated content;
  • technical documentation, logs, testing and monitoring for systems where those duties apply; and
  • human-oversight arrangements, escalation routes and corrective actions.

Keep the classification decision and supporting evidence together. If a regulator or customer asks why a system was treated as outside a high-risk category, a dated rationale is more useful than an unsupported statement that the tool is “just automation.”

Can one company be subject to both?

Yes. The tests are independent, so overlap is common when a technology company supplies critical services and also develops or deploys AI.

Example: a UK MSP offering AI monitoring to EU customers

The managed-service question is assessed under the UK framework: does the service involve ongoing external management, administration or monitoring of customer systems with network access? If the final rules designate that activity, UK cyber duties may follow. Separately, the AI-monitoring product must be classified by role and risk, and its EU-facing supply or use can bring it under the AI Act. One contract can therefore require both cyber-resilience evidence and AI documentation.

Example: a hospital using an EU vendor’s diagnostic AI

The hospital may be a UK health-sector entity within the NIS framework while also acting as a deployer of an AI system. The vendor may be the provider, and the product may be a high-risk AI system embedded in a regulated medical device. The parties should allocate documentation, monitoring, incident escalation and human-oversight responsibilities contractually rather than assuming the vendor’s compliance covers the hospital’s deployment duties.

Example: a UK SaaS company with no regulated-sector customers

A general business-software provider may fall outside the UK expansion if it is not an in-scope digital service, MSP, data centre, large load controller or designated supplier. Selling an AI feature to EU businesses can still create an AI Act analysis: determine whether the company is a provider or deployer, whether the feature is prohibited, transparent or high-risk, and which deadline applies.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Example: an internal UK research team

Pre-release research, development and prototyping are exempted under the Commission FAQ. The UK cyber question remains separate: the organisation’s sector and service can still bring its network and information systems into scope even when the AI project itself has not reached the market.

A practical compliance decision sequence

  1. Map UK activities. List every service, facility and infrastructure function. Mark energy, transport, health, drinking water, digital infrastructure and digital-service activities, then separately flag data centres, MSP offerings and large load-control functions.
  2. Map customer and supplier dependency. Record which customers rely on your systems, what access you have to their environments and whether you are a critical supplier to an in-scope operator.
  3. Build an AI inventory. Include models, third-party APIs, embedded features, decision tools, chatbots, biometric functions and AI inside regulated products. Assign a business owner and technical owner to each item.
  4. Assign the AI role. Document whether you are provider, deployer, GPAI provider, importer, distributor, product manufacturer or another participant for each transaction.
  5. Assess EU connection and risk. Note EU customers, users, deployment locations and market placement. Classify the intended purpose and check prohibited, transparency, GPAI and high-risk obligations.
  6. Apply the dates. Treat 2025 and 2026 AI obligations as active where applicable. Work to the 2 December 2027 or 2 August 2028 high-risk date that matches the system, while checking Commission updates. For the UK, track the consultation, response, secondary legislation and any adjustment period rather than inventing a commencement date.
  7. Assign evidence and incident owners. For cyber controls, name owners for risk, resilience, reporting and supplier governance. For AI, name owners for classification, literacy, documentation, monitoring, transparency and human oversight.
  8. Recheck the map. Review it when you launch a feature, change a model, add an EU customer, alter network access, enter a regulated product market or when UK regulations and Commission guidance change.

Common mistakes and how to correct them

“We are not a critical-infrastructure company, so the UK Bill cannot apply.”

This misses the planned MSP, data-centre, large-load-controller and designated-supplier pathways. Analyse the service you provide and your customer access, not only your industry’s headline label.

“The vendor handles AI compliance, so our deployment is covered.”

Provider and deployer duties are different. Obtain the vendor’s role statement, risk classification, technical documentation and instructions, then document your own use, human oversight and monitoring.

“The AI Act starts in 2028.”

That is incorrect for many obligations. Prohibitions, definitions, literacy, governance, GPAI duties and the general application date have already taken effect on the dates listed above. Only particular high-risk categories have the later 2027 or 2028 dates.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

“A pilot is automatically exempt research.”

The exemption concerns research, development and prototyping before market release. A customer-facing pilot or production beta may no longer fit that description; record the project’s purpose, users and release status.

“The UK fine is already known.”

The supplied UK policy material does not establish final fine ceilings or commencement. Use the enacted Bill and secondary legislation once available instead of importing EU figures into a UK assessment.

“One checklist will satisfy both laws.”

There is useful overlap in governance, inventories, testing and incident escalation, but the evidence is different. A cyber-risk register does not replace AI risk classification and technical documentation, and an AI model card does not demonstrate network resilience or supply-chain controls.

What to do this quarter

  • Create a two-column legal map: UK service and sector triggers on one side, EU AI role and system triggers on the other.
  • Freeze an inventory date and record owners, suppliers, data flows, network connections and EU exposure.
  • Prioritise prohibited-practice screening and already-active AI obligations before later high-risk deadlines.
  • For MSP and data-centre activities, prepare control and incident evidence now while monitoring UK consultation outputs.
  • Put contract clauses in place for access, logging, incident notification, documentation, audit cooperation and allocation of provider/deployer responsibilities.
  • Schedule a formal review whenever the UK Government publishes secondary legislation or the European Commission updates guidance.

Bottom line for a UK business selling AI in Europe

Do not choose between the two regimes by company size or by calling your product “software.” The UK question is whether your sector, service, infrastructure role or supplier relationship is covered by the existing NIS framework or the Bill’s planned expansion. The EU question is what AI role you perform, what the system does and how it reaches or affects the EU.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Run both assessments independently, keep the evidence linked to each system and service, and treat the UK timetable as provisional until consultation and secondary legislation settle it. As the European Commission puts it, “The AI Act is the first-ever comprehensive legal framework on AI worldwide”; its dates are already operational, while the UK expansion remains a moving legislative programme.
