EPA and Texas regulators found that wastewater from SpaceX’s Starship launch-pad deluge system was discharged without the individual permit it required. That establishes a Clean Water Act permitting violation—not a finding that the water was toxic to people or that it caused lasting environmental harm. TCEQ issued SpaceX a final industrial wastewater discharge permit on February 18, 2025.
What regulators found at Starbase
The water used to protect the launch pad during Starship operations was not treated as ordinary stormwater. In an April 15, 2024 letter, EPA said deluge-system wastewater was industrial or process wastewater, was not covered by Texas’s Multi-Sector General Permit for stormwater discharges (TXR050000), and required an individual permit for discharge authorization.

The FAA’s environmental assessment records that EPA and TCEQ found earlier discharges were unauthorized. The agencies said those discharges violated the Clean Water Act, 30 Texas Administrative Code §305.42(a), and Texas Water Code §26.121(a)(1). The violation was the discharge without required authorization; it does not, by itself, establish toxicity or ecological injury.

The deluge system sprays water during launch operations to cool and protect the steel launch-pad plates and help suppress fire, heat, dust, and debris. Some water turns to vapor, some is retained in ponds, and some can flow beyond the paved launch area as sheet flow or through outfalls.

- A COMPLETE LAUNCH-PAD SCENE: This starship model adds a tower, capture arms and storage-tank details around the rocket for a more immersive desktop display.
- MIST AND RED LIGHT IGNITION EFFECT: The built-in humidifier and LEDs work together beneath the rocket to simulate a dramatic launch plume without heat or propulsion.
- SIMPLE RESERVOIR CARE: The integrated water system is straightforward to operate; refill as needed and wipe the atomizing plate regularly to limit mineral buildup.
- HIGH-DETAIL 3D-PRINTED STRUCTURE: Contrasting silver, black and white components make the launch system easy to examine from multiple angles in offices, classrooms and exhibits.
- A DISPLAY GIFT FOR SPACE ENTHUSIASTS: Suited to adult collectors, engineers and students; place on a stable surface and handle the fine tower and arm details carefully.
For an operation analyzed in its 2025 assessment, the FAA estimated the following disposition of approximately 422,000 gallons of deluge water:
| Estimated disposition | Volume |
|---|---|
| Vaporized | Approximately 316,500 gallons |
| Detained at the vertical launch area | Approximately 17,600 gallons |
| Dispersed outside the constructed area | Approximately 87,900 gallons |
These are FAA estimates for the analyzed operation, not a claim that every launch uses or releases the same amount. The assessment also quotes the National Weather Service’s figure of approximately 27 inches of average annual rainfall for the area; rainfall context does not change the permit status of the deluge wastewater.

What sampling did—and did not—show
SpaceX sampled discharges on March 14, April 5, and May 8, 2024. The FAA assessment says the results showed all sampled constituents below Texas Multi-Sector General Permit effluent limits, and that TCEQ determined the discharges covered by SpaceX’s permit application would not cause adverse environmental risk.
Those findings are not the same as a determination that the discharges were authorized under the stormwater permit: EPA said the wastewater was outside that permit’s coverage and required an individual authorization. Nor do the reported sampling results prove that every possible constituent or every discharge was harmless. The official findings summarized by the FAA do not establish human toxicity or demonstrated lasting ecological damage.

Was SpaceX fined, and does it have a permit?
The record establishes multiple enforcement actions, including EPA’s Consent Agreement and Final Order and TCEQ’s Agreed Order. The available details here do not state a penalty amount, so they do not support a specific claim about how much SpaceX was fined—or whether a monetary penalty was imposed. TCEQ did issue the final individual industrial wastewater discharge permit on February 18, 2025; the Agreed Order’s stated requirements included effluent limits and discharge sampling.
