Do you need consent to text a customer? Sometimes; it depends on the message, the technology and route used, and the applicable rules. A customer-service purpose does not automatically exempt a text from the Telephone Consumer Protection Act (TCPA), and a message that adds advertising or telemarketing can change the consent analysis. Build support texting around a clear purpose, appropriate consent, effective opt-outs, limited use of personal data, and the registration rules for your messaging provider and route.
This guide covers U.S. customer-support SMS. It explains the federal framework and operational practices, but it is not legal advice or a determination that a particular message or workflow complies. State privacy laws and sector-specific obligations can also apply.

When does customer-support SMS require consent?
There is no safe blanket rule that every support text is exempt or that every support text requires the same type of consent. The TCPA and Federal Communications Commission (FCC) rules cover specified technologies and circumstances. FCC materials treat texts sent using an autodialer as calls for purposes of covered robotext provisions. Whether a particular message is covered depends on facts such as the technology, its content and purpose, and any applicable exception (FCC 23-107; FCC 24-24).

A message needed to address a customer’s order, appointment, account question, or support case is different in purpose from a promotional message, but calling a message “support” is not conclusive. If a covered robotext includes or introduces an advertisement or constitutes telemarketing, FCC materials describe a prior-express-written-consent standard. A service update with an added offer may therefore need a different analysis from a message limited to resolving the customer’s issue. Assess the actual message and sending workflow rather than relying on the label attached to a campaign.

Keep support and marketing permissions distinct
Ask for permission in a way that identifies the business and explains the support-message purpose. Where marketing is optional, present it as a separate choice rather than making a customer’s service request appear to authorize promotions. Record the disclosure and the customer’s choice. A prior relationship with the customer should not be treated as permission to disregard a later opt-out.
Consent does not settle every issue: privacy obligations, provider or carrier controls, and rules that apply to a particular industry may still matter. Conversely, a provider’s registration approval is not a legal determination that a business has obtained the consent required for its messages.
What should an SMS consent disclosure say?
There is no single universal disclosure established here for every business and every message route. A useful disclosure should make the choice understandable at the point where the customer opts in and should match the messages the business will actually send. At minimum, explain who is texting, why the customer will receive support texts, and how to stop them. If the program also sends marketing, explain that separately and make that choice clear.

For campaigns submitted through Twilio’s A2P 10DLC process, Twilio’s campaign-collection guidance asks for a detailed explanation of how end users opt in. For a website opt-in, that guidance calls for privacy-policy and terms URLs and lists disclosures including non-sharing of mobile numbers, message frequency, and “message and data rates may apply.” Those are documented provider and campaign-review requirements; they are not a complete universal legal checklist.
Example of a clear support opt-in
“[Business name] may text you about your [order/support request], including updates and replies to your questions. Reply STOP to opt out. Message and data rates may apply. See our [Privacy Policy] and [Terms].”
Adapt the wording to the real program, channel, and provider requirements. Do not imply a frequency, privacy practice, or opt-out capability that the business does not actually provide. If marketing texts are offered, describe that program and obtain the applicable permission separately rather than quietly adding promotional content to support messages.

What happens when a customer texts STOP?
Make revocation straightforward and operationally effective. In FCC 24-24, the FCC states: “We conclude that ‘stop,’ ‘quit,’ ‘end,’ ‘revoke,’ ‘opt out,’ ‘cancel,’ or ‘unsubscribe’ via reply text message constitutes a per se reasonable means to revoke consent.” These are not the only possible expressions: other reasonable requests can count depending on context and the totality of circumstances.
Do these 3 things before closing this tab:
1Repair Windows errors before they cause bigger problems2Scan for outdated or missing drivers - takes under a minute3Clear out junk files and repair common Windows errorsWhen a customer revokes consent, record the request, apply it to the relevant messaging program or programs, and suppress future covered messages accordingly. Do not assume that an existing support relationship lets the business ignore a clear request. If a business believes it needs to preserve a distinct, service-critical texting channel, it should define and disclose the channel’s scope and legal basis with counsel rather than silently continuing texts.
Make opt-out handling work across the support stack
- Decide how the team and systems will recognize the listed reply keywords and other clear opt-out language.
- Route opt-out requests into a suppression process that updates the systems sending messages, not just the agent’s view of a conversation.
- Test that suppression works across relevant campaigns and connected tools, and retain a record of the request and action taken.
- If the system does not support reply-text opt-outs, FCC 24-24 addresses disclosing that limitation and providing reasonable alternative revocation methods in the circumstances described by the order. Confirm the applicable requirements for the actual workflow.
Is CTIA guidance a law?
No. CTIA’s Messaging Principles & Best Practices is industry guidance for organizational senders and related partners, not a statute. It recommends opt-in consent and an opt-out mechanism. Carriers and messaging providers can also apply filtering or other ecosystem controls, so a business’s belief that it has legal consent does not guarantee delivery.

For practical purposes, treat legal compliance and deliverability as related but separate questions: the first concerns applicable law and the facts of the message; the second can also depend on route, provider, registration, and carrier controls.
Do support texts need A2P 10DLC registration?
It depends on the route and provider. Twilio describes A2P 10DLC as the U.S. carrier system for verifying and managing application-to-person SMS/MMS sent over 10-digit long-code routes. Twilio says senders using its 10DLC numbers to message U.S. recipients need registration and identifies CUSTOMER_CARE as a campaign use case for support and other customer interaction. This is provider-specific guidance, not a universal statement about every route or provider.

Prepare accurate campaign information
- Describe the program plainly. Explain the support messages customers will receive and how they opt in. Keep submitted campaign examples consistent with actual message content.
- Provide the requested website details. For a website opt-in, Twilio’s campaign guidance calls for privacy-policy and terms URLs and lists disclosures including mobile-number non-sharing, message frequency, and “message and data rates may apply.”
- Keep records of the consent flow. Store when, where, and how consent was obtained, along with the version of the disclosure the customer saw.
- Review changes before sending them. Revisit campaign descriptions, disclosures, and registration details when the message purpose or workflow changes, and follow the selected provider’s current instructions.
How should a business protect privacy in support texts?
A phone number and the contents of a support conversation can be personal information. The materials cited here do not establish one U.S.-wide privacy rule specific to every customer-support SMS program, and an A2P registration checklist does not exhaust state or sector requirements. Consider the laws that apply to the business and the data involved, including relevant state privacy, financial, health, and other sector rules.
- Minimize message content. Include only what is needed to move the support issue forward. Assess security and sector obligations before sending sensitive account or health information by SMS.
- Limit access. Give staff access to customer conversations and phone numbers only as needed for their work.
- Set retention rules. Decide how long message and consent records are kept, and how they are securely handled afterward.
- Review vendors and integrations. Check access, retention, and data handling when connecting messaging to case-management or other business systems, or when changing a workflow.
Does CAN-SPAM govern customer-support texts?
CAN-SPAM is an email law, not the SMS consent rule. The Federal Trade Commission describes the CAN-SPAM Act and its rule as applying to commercial electronic mail. For texts, the relevant analysis instead includes the TCPA and FCC rules, applicable privacy and sector laws, and carrier or provider requirements (FTC, CAN-SPAM Rule; FCC 23-107).
A practical compliance checklist before launch
- Map each message type. Separate support replies and updates from messages that advertise or promote. Review message content as well as the campaign label.
- Capture permission clearly. Name the business and purpose at opt-in, separate optional marketing choices, and retain the disclosure version and consent details.
- Choose and verify the route. Identify whether messages use 10DLC, toll-free, short code, or another route, then follow the selected provider’s current registration guidance for that route.
- Test opt-outs end to end. Verify that listed keywords and other clear requests reach the right suppression process and that connected sending systems honor it.
- Keep messages and records proportionate. Limit sensitive content, restrict access, set retention practices, and review applicable state and sector obligations.
- Reassess material changes. A new use case, promotional content, provider, integration, route, or consent screen can change what needs review.
Frequently Asked Questions
Does a customer texting the business first authorize future marketing texts?
Not by itself as a blanket permission. Treat an inbound support message as context for responding to that issue, not as automatic authorization for a separate marketing program. Assess any later promotional message under the applicable consent rules.
Does A2P 10DLC registration mean the business has obtained valid consent?
No. Registration is a provider/carrier-system requirement for the specified route; it does not establish that the business captured the legally required consent for its message content or satisfied privacy and sector obligations.
Can an agent reply to a customer who opted out of marketing?
Do not assume the prior support relationship overrides a clear opt-out. Whether a particular service-related reply is permissible depends on the request, the scope of the revocation, the message and applicable rules. Keep marketing and support programs distinct, honor the suppression request, and get legal guidance if a necessary service channel may need separate treatment.
