1Scan for outdated or missing drivers - takes under a minute2Repair Windows errors before they cause bigger problems3Fix the driver behind crashes, sound loss and screen glitchesUse AI to organize a refund or complaint, not to make the final decision. The safer pattern is a bounded workflow: an AI tool can collect facts, classify the issue, retrieve the applicable policy, draft a response and complete a checklist, while an experienced employee approves eligibility, exceptions, payment execution and escalation.
Keep a dated case record containing the transaction, policy version, evidence, requested remedy, decision and communications. This gives the customer a clear route to a person and gives the business an auditable way to correct errors. It also matches the UK Competition and Markets Authority (CMA) distinction between predefined-rule automation and agentic systems that can sense, decide and act.

Why a fully autonomous refund agent is the wrong default
A refund decision changes a customer’s money, legal rights and relationship with a business. An autonomous agent may be able to read an email, inspect an order and call a payment API, but that capability does not make it competent to resolve disputed facts or interpret every applicable right. A safer system separates assistance from authority.

For refund requests, a business must account for statutory rights, contractual terms and different time limits or amounts. Customer-service answers must be accurate about prices, products and rights, and must not make it difficult for consumers to exercise those rights. The CMA also recommends that an experienced person regularly review exchanges and decisions.

That risk is higher with an agentic system than with a conventional rules engine. The CMA describes agentic AI as technology that can sense, decide and act; traditional automation follows predefined instructions. Current deployments are concentrated in bounded customer-operations workflows, while authority facing consumers is usually limited and human escalation remains common. Giving an agent unrestricted authority over refunds therefore adds accountability and monitoring obligations without removing the business’s responsibility.
What can go wrong when autonomy is too broad
- Wrong policy: the system applies a standard return window when a warranty, cancellation rule or jurisdiction-specific statutory right applies.
- Invented eligibility: a language model fills gaps in the record with plausible but unsupported facts.
- Inconsistent exceptions: two customers with the same evidence receive different outcomes because wording or conversation history changes the model’s response.
- Payment mistakes: an agent refunds the wrong amount, currency, order or payment instrument.
- Blocked complaints: a customer cannot reach a person, misses a deadline or is repeatedly asked for documents already supplied.
- Unsafe handling of vulnerable customers: a customer with a disability, limited language proficiency, financial hardship or another vulnerability is routed through an unsuitable automated path.
- Overstated capability: marketing or support staff imply that the system gives legal or professional advice without evidence that it performs to that standard.
The Federal Trade Commission’s September 2024 Operation AI Comply release stated, “Using AI tools to trick, mislead, or defraud people is illegal,” in a statement attributed to FTC Chair Lina M. Khan. In the same release, the FTC alleged that DoNotPay had not tested whether its chatbot matched a human lawyer and proposed a $193,000 settlement, notices to affected subscribers and limits on unsupported professional-substitution claims. For refund operations, the practical lesson is to substantiate capability claims and test decision quality before granting a system authority over consumer outcomes.
Safer alternatives, compared by control rather than novelty
There is no single replacement for an autonomous agent. Choose the lowest-autonomy option that solves the operational problem, then add human approval where the consequences become material.
| Approach | What the software does | Who decides the outcome | Strengths | Main risks or limits |
|---|---|---|---|---|
| Rules-based workflow with human review | Checks dates, order status, product category and other predefined conditions; routes cases and prepares a decision packet. | An employee approves eligibility, exceptions and payment. | High traceability, repeatability and policy versioning; easy to explain to a customer. | Needs careful maintenance when policies or jurisdictions change; unusual facts still require a person. |
| AI-assisted intake and classification | Extracts order numbers, identifies the complaint category, summarizes correspondence and asks for missing evidence. | An employee applies the policy and chooses the remedy. | Reduces manual data entry and speeds triage without delegating authority. | Extraction and classification errors can misroute a case unless confidence checks and review are used. |
| Retrieval and draft-reply assistant | Retrieves the policy text in force for the transaction and drafts a response with citations to internal clauses. | An employee verifies the policy, facts, tone and deadlines before sending. | Improves consistency and makes the source of an answer visible. | Retrieval can select the wrong edition or jurisdiction; a draft can still contain unsupported statements. |
| Human-in-the-loop agent with approval gates | Performs several bounded steps, such as collecting evidence, proposing a remedy and preparing a payment instruction. | An authorised reviewer must approve each high-impact action. | More efficient for high volumes while retaining a clear control point. | Approval can become a rubber stamp if queues, interfaces or incentives discourage scrutiny. |
| Autonomous agent with payment authority | Senses the request, decides eligibility and executes the refund with little or no review. | The software, subject to post-hoc monitoring. | Potentially lower handling time for simple cases. | Highest accountability, legal, payment and customer-harm risk; not a safe default for disputed or high-impact cases. |
Compare any proposal on seven questions: does a human approve the outcome; can the business show the policy version used; are the evidence and actions auditable; how quickly can a customer reach a person; how are errors corrected; how are vulnerable customers treated; and which jurisdictions are covered? A rule-based workflow with human review generally performs better on traceability and control. A more autonomous agent may reduce handling time, but it requires stronger monitoring, testing and accountability.
Design a bounded AI refund workflow
The following eight-stage process keeps automation around the edges of the decision. Each stage should record its inputs and outputs so a reviewer can reconstruct what happened.
1. Capture the request and verify identity
Start with a form, email parser or chat intake that collects the order or transaction number, purchase date, product or service, purchase channel, customer name and preferred contact method. Verify identity using the controls appropriate to the account and payment method before revealing order details or changing a payment record.

- Give the customer a reference number immediately.
- Record the date and time, channel and language of the interaction.
- Allow free-text explanation in addition to structured fields; do not force a customer to select a category before describing the problem.
- Offer a human route at the start, not only after an automated refusal.
AI can extract fields or identify missing information, but it should not infer identity from conversational confidence or disclose account information because a message sounds plausible.
2. Retrieve the policy that actually applies
Show the reviewer the return, warranty, cancellation and refund terms in force for the transaction. Include the customer’s jurisdiction, the sales channel, product type, purchase date and any extended or promotional policy. Store a policy identifier and version, not merely a link to a page that may change later.
A retrieval assistant may locate the relevant clauses, but the reviewer must check that the result covers statutory rights as well as contractual terms. If the policy and the facts do not align, route the case to an experienced person rather than asking the model to resolve the conflict.
3. Preserve the evidence
Retain receipts, invoices, payment records, warranties, photographs, repair orders, delivery records and prior correspondence. The FTC advises consumers to gather these records and keep originals; a business should likewise preserve a reliable copy of the evidence it used. Record who supplied each document and when it was received.
- Keep the original file and a readable representation used by the reviewer.
- Record metadata such as upload time and the account that submitted it.
- Mark evidence as missing, contradictory or unverifiable instead of silently discarding it.
- Restrict access to payment and identity information to staff who need it.
4. Classify the issue with explicit rules
Use a controlled taxonomy such as defective goods, non-delivery, billing error, misrepresentation, poor service, cancellation, duplicate charge or suspected fraud. An AI classifier can suggest a category and confidence level, but the category must be editable by a reviewer and must not itself create eligibility.

5. Ask what remedy the customer wants
Have the customer state whether they seek a full refund, exchange, store credit, repair, markdown or another remedy. The FTC identifies these as examples of remedies a consumer may request. Recording the requested outcome prevents the business from treating a preferred internal option as if it were the customer’s choice.
The requested remedy is not necessarily the remedy required by law or policy. It is an input for the reviewer, not an instruction for an agent to execute automatically.
6. Require a human decision at defined gates
An experienced reviewer should approve every exception and any case involving disputed facts, a vulnerable customer, a high-value transaction, suspected fraud, a statutory-rights question or a mismatch between policy and evidence. The reviewer should see the extracted facts, source documents, applicable policy clauses, proposed remedy and any model uncertainty before deciding.

Set monetary and risk thresholds in the operating procedure, and make the thresholds visible to staff. A reviewer must be able to reject the recommendation, request more evidence, change the remedy or escalate the case without fighting the interface.
7. Execute and explain the outcome
Use a controlled payment system for an approved refund. The person who approves the decision should not be able to alter the audit record after execution. Reconcile the payment instruction with the order, amount, currency and original payment method before release.
Send a notice that states the decision, the remedy or reason for denial, the amount and timing, any action the customer must take, and the deadline or route for review. Include a human contact path. Do not let an AI-generated explanation cite a policy clause that the reviewer has not verified.

8. Audit, correct and learn
Sample completed cases, review complaints and compare outcomes across categories, jurisdictions and customer groups. Track misclassification, wrong-policy retrieval, incorrect amounts, delayed escalations and repeated requests for the same evidence. The CMA recommends monitoring errors, bias, complaints and unintended outcomes and refining systems quickly when non-compliant results appear.
When a problem is found, pause the affected automation if necessary, correct the customer’s case, preserve the original record, identify other cases with the same failure mode and update the rule, prompt, policy index or reviewer guidance. A correction that changes future behavior but leaves past customers without a remedy is incomplete.
When a refund request must go to a person
Make escalation automatic rather than discretionary when any of these conditions appears:
- The customer alleges a statutory-rights violation, discrimination, unsafe product or regulatory breach.
- The request involves legal action, a regulator, a chargeback, a threatened lawsuit or a public safety issue.
- The evidence conflicts, the transaction cannot be matched confidently or the policy edition is uncertain.
- The amount exceeds the organisation’s approval threshold or the customer has multiple related transactions.
- Fraud, account takeover, money laundering or payment abuse is suspected.
- The customer is vulnerable, asks for an accommodation or cannot use the automated channel effectively.
- The system’s confidence is low, the requested remedy is outside the taxonomy or a previous automated answer was challenged.
- The customer asks for a person or has already repeated the same information.
Escalation should transfer the case record, not force the customer to start again. The receiving employee should see the conversation, evidence, policy version, proposed outcome and reason for escalation.

Escalate an unresolved complaint in stages
Internal escalation should be clear before a customer considers an external route.
- Front-line response: acknowledge the complaint, state what is known, request only necessary evidence and give a date for the next response.
- Manager review: ask a manager or experienced specialist to reconsider the facts, policy and remedy without relying solely on the first automated recommendation.
- Formal written decision: provide the reasons, evidence considered, remedy, deadlines and the name or role of a human contact.
- External consumer help: in the United States, the FTC advises consumers to contact a state attorney general or consumer-protection office, use national consumer organisations, report fraud to the FTC where appropriate and check USA.gov complaint resources.
- Mediation or arbitration: mediation uses a neutral third party to help the parties reach a voluntary agreement. Arbitration can produce a decision that may be legally binding, depending on the contract and jurisdiction.
- Small claims or legal advice: these may be options when internal and informal routes fail; eligibility, deadlines and procedures vary by location.
Do not describe an external route as a threat or a substitute for handling the complaint. Give the customer the information needed to make an informed choice, including any contractual requirement to use a particular process.
Use refund-program operations as a control model
The FTC describes six operational steps in its refund programs: identify eligible recipients, determine the allocation, send refunds, update contact information and resend payments, consider another distribution and send remaining money to the Treasury. A private business can adapt the control logic even though it is not a government agency: define eligibility, reconcile amounts, keep contact records current, retry failed payments under supervision, review whether another distribution is needed and document the final disposition.
The FTC reported that 59% of eligible consumers had cashed their refund payment as of December 31, 2024, and expected average participation to exceed 70% after distribution activity completed. In 17 FTC cases whose first distributions were completed in 2024, the average participation rate was 81%. Claims processes generally received claims from 5% to 50% of potential claimants. These figures show why sending a payment is not the end of the workflow: undelivered or uncashed funds require reconciliation, contact updates and a documented next step.
For a business, the equivalent controls are an approved recipient list, a calculated amount tied to a rule or decision, payment reconciliation, a process for returned or failed payments, a second-review decision about recontacting customers, and a final accounting. Never allow an AI agent to silently mark an uncashed or returned payment as resolved.
Test the system before expanding its authority
Start with a shadow or draft-only mode. Let the system classify cases and prepare recommendations while employees make every decision. Compare its output with reviewed outcomes across ordinary requests, edge cases and deliberately ambiguous records.
Test cases to include
- Purchases just inside and just outside each time limit.
- Different jurisdictions, currencies, channels and policy editions.
- Defective goods, non-delivery, duplicate billing, cancellation and misrepresentation.
- Missing receipts, conflicting dates, partial deliveries and previous repair attempts.
- High-value orders, suspected fraud and multiple related transactions.
- Customers who ask for a person, use assistive technology or communicate in a different language.
- Threats of legal action, regulator contact or chargeback.
- Prompt-injection attempts or documents that instruct the model to ignore the workflow.
Measure more than average handling time. Record false approvals, false denials, wrong amounts, wrong policy retrieval, missed escalations, time to human contact, repeat contacts, complaint rates and differences in outcomes across customer groups. Set a stop condition for serious errors, such as an incorrect payment or a missed statutory-rights issue.
Recommended Free Tools
Keep capability claims narrow and testable. Saying that a tool extracts order numbers or drafts replies is different from saying that it determines legal entitlement. The DoNotPay action described by the FTC illustrates why unsupported comparisons with human professionals create avoidable risk.
Implementation checklist for a controlled rollout
- Write the refund and complaint taxonomy, including categories that always require a person.
- Assign an owner for each policy and record effective dates and jurisdictions.
- Build an append-only case record before connecting any AI tool.
- Limit the tool’s permissions: read only the data needed for its task, and do not grant direct payment authority during the pilot.
- Add approval gates for exceptions, disputed facts, vulnerable customers, high-value transactions, fraud indicators and statutory-rights questions.
- Show source policy clauses and evidence beside every recommendation.
- Provide a visible human contact option and transfer the full record on escalation.
- Run shadow-mode tests, review errors and sign off on thresholds before enabling any automated action.
- Reconcile every payment and investigate returned, duplicated or uncashed refunds.
- Sample cases continuously, publish internal error trends and pause automation when controls fail.
The practical boundary is simple: automate preparation, not accountability. A bounded assistant can make a human reviewer faster and better informed; it should not turn a contested consumer outcome into an opaque machine decision.
