Safari, Chrome and Antitrust: Can Tracking Rules Become a Defense?

Safari’s tracking rules and Chrome’s cookie choices can shape competition debates, but the relevant cases do not establish privacy controls as a standalone antitrust defense.

Not by themselves. Safari’s tracking protections and Chrome’s cookie choices can matter in competition disputes because they affect access to user data and advertising measurement. But the available cases do not establish a general antitrust defense based on tracking prevention. The key is to distinguish browser privacy policies from legal remedies governing search defaults, distribution and data access.

What “antitrust defense tool” can—and cannot—mean

A company facing competition scrutiny might point to privacy or tracking rules to explain a product decision, a change in data access or an effect on advertising. Regulators may also examine whether a proposed privacy change redistributes competitive advantages among companies. Those are relevant arguments and questions, but neither makes a browser policy a defense that automatically defeats an antitrust claim.

The distinction matters in the examples here. The UK Competition and Markets Authority (CMA) investigated the competition implications of proposed Chrome cookie changes and accepted commitments without deciding whether Google had infringed competition law. Separately, a U.S. court’s search-case remedy regulates certain distribution and default-search agreements, including agreements involving Apple browser features. That remedy is not a finding about which browser offers better privacy.

How Safari and Chrome describe their tracking policies

The information below describes each vendor’s stated policy, not an independent test of how much tracking either browser blocks. Cookie behavior is only one part of tracking, so these descriptions do not establish that either browser prevents all tracking or is categorically more private.

Browser and source Third-party cookies Private-browsing context What the description does not establish
Safari, as described by WebKit WebKit says its default cookie policy disallows a third party from setting new cookies unless it already has cookies. It says this policy has been in effect since Safari 1.0 as part of “Prevent cross-site tracking,” and applies across Apple’s listed operating systems. The cited policy description does not give a separate ordinary-versus-private-browsing comparison. It is not a claim that Safari blocks every tracking method or that its overall privacy performance is better than Chrome’s.
Chrome, as described by Google Google said it would maintain users’ choice about third-party cookies and would not add a new standalone prompt. Google said third-party cookies would remain blocked by default in Incognito mode and that it would continue enhancing Incognito tracking protections. The announcement states Google’s policy and plans; it is not independent testing, nor proof that every planned enhancement has rolled out.

WebKit also describes measures against certain forms of cloaking, including a seven-day cookie-expiry cap in specified cloaking scenarios. That detail is limited to the scenarios WebKit describes; it should not be generalized into a universal seven-day limit on cookies.

What the antitrust cases actually addressed

UK: Chrome’s proposed cookie changes and Privacy Sandbox

The CMA investigated Google’s plans to remove third-party cookies from Chrome and replace related functions with Privacy Sandbox tools. The competition question was not simply whether cookie removal would improve privacy. It also concerned how removing an existing mechanism while shifting related functions to Chrome could affect competition.

In February 2022, the CMA accepted binding commitments intended to address its competition concerns and ended its investigation. It expressly made no decision on whether Google had infringed the Competition Act 1998. Commitments following competition concerns are not the same thing as an adjudicated finding of an infringement.

U.S.: search distribution and defaults

A U.S. district court issued a final judgment in the Google search case on December 5, 2025. The judgment regulates certain distribution and default-search agreements. Its provisions include constraints on conditioning payments for default-search placement on Apple features and browser access points, as well as terms concerning browser developers’ default choices and promotion of rival search and AI products.

  • Online video installation instruction: Easiest Installation - removing dust and aligning it properly before actual installation, enjoy your screen as if it wasn't there.

The remedy concerns search distribution and related competition. It does not find that Safari’s tracking controls are an antitrust defense, and it does not determine which browser is more effective at preventing tracking.

Implementation and appeals

The Justice Department’s case page lists post-judgment compliance and appellate activity through July 2026, including a technical committee appointment in January, a compliance status report in May and an appellate filing in July. Those entries show that implementation and legal posture remained active matters in the period covered; they do not, on their own, establish the outcome of later proceedings.

Where the FTC’s Safari cookie case fits

In 2012, Google agreed to pay a $22.5 million civil penalty to settle Federal Trade Commission charges that it misrepresented whether it would place tracking cookies or serve targeted ads to Safari users, in violation of an earlier privacy settlement. The FTC described Google as exploiting an exception in Safari’s cookie behavior.

This was a consumer-protection settlement, not an antitrust fine or a finding in the later Google search case. It is relevant background on Safari cookies and Google’s conduct, but it does not establish the legal theory or outcome of the newer competition proceedings.

How to assess claims about tracking and competition

  • Identify what is being measured. A claim about third-party cookies is narrower than a claim about tracking overall. Do not treat cookie blocking as proof that all tracking is prevented.
  • Separate vendor statements from independent evidence. WebKit describes Safari’s policy; Google describes Chrome’s policy and plans. Neither statement is an independent Safari-versus-Chrome test.
  • Ask what competitive mechanism is at issue. The examples here involve the possible effects of changing cookie-related tools, and the rules governing search distribution, defaults and access to data. These are distinct questions.
  • Read the legal outcome precisely. The CMA accepted commitments without deciding infringement; the U.S. judgment regulates specified distribution and default-search arrangements. Neither outcome is a general ruling that privacy protections excuse otherwise anti-competitive conduct.
  • Be cautious about winner claims. The sources described here do not provide a current, independently measured Safari-versus-Chrome tracking statistic. A privacy ranking would require a defined method and evidence that actually tests the relevant behavior.

What the evidence supports

Browser tracking rules can enter antitrust analysis when they affect data access, advertising measurement or the competitive position of browser and platform businesses. They can be part of a company’s explanation for a product choice and part of a regulator’s analysis of a proposed change. But the cases discussed here do not establish that tracking prevention alone is a legal defense. Safari’s stated cookie policy, Chrome’s stated choices, the CMA’s commitments process, the U.S. search remedy and the FTC’s earlier settlement each answer different questions.
