PIPEDA is Canada’s federal private-sector privacy law. See when it applies, how it overlaps with provincial laws, and what its principles and breach rules require.

PIPEDA is Canada’s federal private-sector privacy law. It sets rules for how covered organizations handle personal information in commercial activities and how federally regulated businesses handle employee information. Its 10 fair information principles guide that handling, but provincial privacy laws can govern some activities instead. The applicable law depends on the organization, the information and how it moves.

What PIPEDA means—and what counts as personal information

PIPEDA stands for the Personal Information Protection and Electronic Documents Act. It applies to organizations in respect of personal information they collect, use or disclose during commercial activities. It also covers employee and job-applicant information handled in connection with operating a federal work, undertaking or business. The Office of the Privacy Commissioner of Canada (OPC) identifies banks, airlines, telecommunications companies and interprovincial transportation businesses as examples of federally regulated organizations. The Act defines personal information as information about an identifiable individual. It can include names, ages, identification numbers, income, ethnic origin, blood type, opinions, evaluations, employee files, credit records, medical records and a consumer’s intentions. It need not be highly sensitive, and it need not be stored digitally. OPC overview of PIPEDA

Who and what are generally outside PIPEDA?

PIPEDA does not generally govern federal government institutions covered by the Privacy Act, provincial or territorial governments and their agents, information used solely for personal purposes, or information used solely for journalistic, artistic or literary purposes. Business contact information is excluded only when it is used solely to communicate with someone in relation to their employment, business or profession. Not-for-profits and charities are not automatically covered or exempt: whether the activity is commercial and the circumstances matter. Personal Information Protection and Electronic Documents Act

Does PIPEDA apply to my business?

Start with the activity involving the information rather than assuming one law governs everything an organization does. PIPEDA is relevant when personal information is handled in commercial activities that fall within federal jurisdiction, including certain interprovincial or international flows. It also applies to employee information handled by federally regulated businesses in connection with their operations. For activities within Alberta, British Columbia and Quebec, substantially similar provincial private-sector laws generally apply instead, subject to their scope and the specific circumstances.

Use these questions to identify the jurisdictional issues:

  • Is the organization federally regulated? PIPEDA applies to employee information connected with operating a federal work, undertaking or business, and it remains relevant to federally regulated organizations.
  • Where does the handling occur? Alberta, British Columbia and Quebec have substantially similar general private-sector privacy laws that generally govern covered activity occurring within those provinces.
  • Does the information cross provincial or national borders? PIPEDA continues to apply to relevant personal information moving across provincial or national borders in commercial activities, even when an organization is based in a province with substantially similar legislation.
  • Is the information personal health information? Substantially similar provincial health-information laws apply to personal health information in Ontario, New Brunswick, Nova Scotia and Newfoundland and Labrador.

Different parts of an organization’s work may be governed by different laws. The OPC says determining which law applies is case-specific; the province where a business is based alone does not settle the question. OPC overview of PIPEDA OPC guidance on provincial and territorial privacy laws

What are PIPEDA’s 10 principles?

Schedule 1 of PIPEDA sets out 10 fair information principles. The OPC’s principles page was modified May 29, 2025. OPC: Ten principles of PIPEDA

  1. Accountability: Take responsibility for personal information under the organization’s control.
  2. Identifying purposes: State why information is being collected before or at the time of collection.
  3. Consent: Obtain an individual’s knowledge and consent, except where the law provides otherwise.
  4. Limiting collection: Collect only information needed for the identified purposes.
  5. Limiting use, disclosure and retention: Use or disclose information for the identified purposes, and retain it only as long as needed for those purposes unless the law requires otherwise.
  6. Accuracy: Keep information as accurate, complete and up to date as necessary for its intended use.
  7. Safeguards: Protect information with safeguards appropriate to its sensitivity.
  8. Openness: Make privacy practices readily available and understandable.
  9. Individual access: Let individuals request access to their personal information, subject to legal limits.
  10. Challenging compliance: Provide a way for individuals to raise concerns about compliance.

The principles work together across the information lifecycle: from deciding why information is needed, through collection and use, to protection, access and disposal. A privacy notice by itself does not establish compliance. Consent is not absolute, and valid consent depends on what a person would reasonably understand about the nature, purpose and consequences of the handling. The Act also requires that any collection, use or disclosure be for purposes a reasonable person would consider appropriate in the circumstances. Personal Information Protection and Electronic Documents Act

When does PIPEDA require breach reporting?

A breach of security safeguards can involve loss of personal information, unauthorized access to it or unauthorized disclosure of it, resulting from a breach of safeguards or a failure to establish safeguards. An organization must report a breach to the Privacy Commissioner of Canada and notify affected individuals when it is reasonable in the circumstances to believe that the breach creates a real risk of significant harm. Both steps are due as soon as feasible after the organization determines that the breach occurred. Personal Information Protection and Electronic Documents Act

How to assess the risk

Significant harm can include bodily harm, humiliation, damage to reputation or relationships, lost employment or business opportunities, financial loss, identity theft, negative effects on credit records, or damage to or loss of property. Relevant factors include how sensitive the information is and how likely it is to be misused. The obligation is tied to the real-risk threshold; not every incident automatically requires reporting and notification.

What reports, notices and records must include

The Breach of Security Safeguards Regulations prescribe the information required in a report to the Commissioner, including known circumstances and cause, timing, the information involved, the number of affected people, mitigation steps, notification steps and a contact person. A notice to an individual must describe the circumstances, timing and information involved; mitigation steps; steps the individual can take to reduce harm; and a contact route. Direct notice is the norm. Indirect notice is permitted in specified situations, such as when contact information is unavailable, direct notice could cause further harm, or it would cause undue hardship.

Organizations must keep a record of every breach for 24 months after determining it occurred. This retention period is set out in the regulations registered in 2018, whose Justice Laws consolidation was current to September 21, 2026. Breach of Security Safeguards Regulations

How complaints and enforcement work

The Privacy Commissioner of Canada oversees PIPEDA. An individual may complain to the Commissioner, who can investigate and issue a report containing findings and recommendations. The Commissioner may also audit where statutory grounds exist and may enter into a compliance agreement. These processes are distinct from the court remedies available to a complainant.

After receiving a Commissioner’s report or notice that a complaint was discontinued, a complainant may apply to the Federal Court for a hearing within the statutory timeframe. The Court may order an organization to correct its practices, publish a notice of corrective action, or pay damages, including for humiliation. PIPEDA’s enforcement framework should not be confused with a routine system of administrative monetary penalties imposed by the Commissioner. What to do if the applicable law is unclear

For an organization, a practical first step is to map the relevant information handling: what personal information is involved, why it is collected, who uses or receives it, where those activities occur, and whether the information crosses provincial or national borders. Then assess whether the organization or activity is federally regulated, and whether a provincial private-sector or health-information law may apply.
