There is no single sanctions list that covers a cross-border transaction. The rules that apply depend on your people, entities, locations, currency and payment route, goods or services, ownership and conduct. A transaction can have U.S., EU and UK connections at the same time, so a business may need to screen OFAC datasets, the EU consolidated financial-sanctions list and legal acts, and the UK Sanctions List before deciding whether it can proceed.
The short answer: jurisdiction is cumulative
Sanctions obligations follow legal connections, not just the address on an invoice. U.S. persons and U.S.-incorporated entities generally bring OFAC rules into scope. EU nationals, people located in the EU and businesses operating there can trigger EU measures. UK persons, UK-located activity and UK-incorporated entities can trigger UK sanctions. The same deal may therefore require analysis under all three systems.

Screening a name against one database is only an initial control. A clear result does not answer whether a transaction involves a blocked owner, a restricted sector, controlled goods, a prohibited service, a sanctioned route or a license requirement. The underlying program, regulation, directive or UK sanctions regime determines the legal result.

When OFAC applies to a non-U.S. business
OFAC states that all U.S. persons must comply with U.S. sanctions. That includes U.S. citizens and permanent residents wherever they live, all individuals and entities in the United States, and U.S.-incorporated entities and their foreign branches. A company outside the United States can therefore have OFAC exposure through its ownership, employees, branch structure, bank, payment route or other U.S. connection.

What to screen
The OFAC Sanctions List Service provides the current Specially Designated Nationals and Blocked Persons List (SDN List), non-SDN consolidated data, search functions and downloads. The SDN List covers designated individuals, entities, groups, vessels and aircraft subject to blocking measures. Non-SDN lists do not all have the same legal effect: the program tag and the applicable regulation or directive must be read before a decision is made.
OFAC programs can be comprehensive or selective. They may block property and interests in property, prohibit particular trade, restrict a sector or impose other transaction limits. A name match must therefore be resolved with identifiers and then tested against the program rules rather than treated as an automatic answer for every transaction.
Why non-U.S. persons still need an OFAC analysis
Non-U.S. persons may face program-specific prohibitions, restrictions on evasion or circumvention, and risk if they cause or facilitate conduct prohibited for a U.S. person. A foreign company should examine whether a U.S. person is involved, whether a U.S. bank or other U.S. financial-system connection is used, whether the currency or route creates a U.S. nexus, and whether the conduct is designed to evade a restriction.

How the EU framework differs
EU sanctions are regulation-led. A restrictive measure becomes EU law when the relevant act is published in the Official Journal. The obligations bind EU nationals, people located in the EU and businesses operating there, but the exact prohibition comes from the applicable regulation and any relevant Member State implementation.
Use the list and the legal act together
The European Commission sanctions map helps identify regimes and legal acts. The Commission’s consolidated list identifies individuals, groups and organizations subject to EU financial sanctions. A potential match is an important warning, not a complete legal conclusion. For each EU-connected transaction, record the regulation, the prohibited activity, the goods or services covered, the ownership or control test, the competent Member State authority and any exception or authorization procedure.
EU measures can include financial, trade and other restrictions. Two transactions involving the same listed party may have different outcomes if they involve different goods, services, sectors, dates or authorizations. Do not infer that a restriction in one Member State or under one regulation automatically describes every EU measure.

The UK list changed on 28 January 2026
UK sanctions regulations cover individuals, businesses and organizations located in or undertaking activities anywhere in the UK, UK-incorporated or constituted businesses, and certain UK persons outside the UK. The framework includes financial, trade, immigration and transport restrictions.

From 28 January 2026, the UK Sanctions List became the only source for UK sanctions designations. The former OFSI Consolidated List of Asset Freeze Targets and its search tool are no longer updated. Screening systems, vendor feeds and internal procedures that still rely on the old list can miss changes or create a false sense of coverage.
The official UK list recorded new designations, variations, corrections and delistings through 16 October 2026. Save the list version or retrieval time used for each decision so that an audit can show what information was available when a transaction was approved, rejected or paused.

Ownership can block an unlisted company
OFAC’s 50 Percent Rule
Under OFAC guidance, an entity is generally blocked when one or more blocked persons own, directly or indirectly, 50 percent or more in aggregate. The entity does not need to appear as a separate name on the SDN List. For example, two blocked owners holding 30 percent and 20 percent can meet the aggregate threshold even though neither owner individually holds 50 percent.
Investigate the full ownership chain, including intermediate companies and indirect interests. An exact-name search that finds no match is not enough where blocked persons may own or control the entity.

EU and UK ownership or control tests are not identical to OFAC’s rule. The applicable EU regulation, Member State guidance, UK regime and related guidance determine whether an unlisted entity is treated as owned or controlled by a designated person. Record the test used instead of importing the OFAC threshold into an EU or UK decision.

A practical workflow for a cross-border transaction
- Map the transaction. Identify every contracting party, beneficial owner, director, intermediary, bank, insurer and carrier. Record the goods or services, currency, payment route, destination, origin and transit points.
- Identify each nexus. Check for U.S. persons, U.S.-incorporated entities, a U.S. bank or financial-system connection, dollar routing, EU nationality or location, EU business activity, UK persons, UK location and UK incorporation.
- Choose the official datasets. Screen the OFAC SDN List and any applicable non-SDN lists; the EU consolidated financial-sanctions list and its underlying legal acts; and the UK Sanctions List.
- Resolve possible matches. Compare dates of birth, nationality, addresses, registration numbers, aliases and vessel or aircraft details. Do not treat a similar name as a confirmed match or dismiss it without checking identifiers.
- Trace ownership and control. Apply the OFAC 50 Percent Rule where OFAC is in scope. Apply the ownership or control test specified by the relevant EU regulation or UK regime for those jurisdictions.
- Classify the restriction. Determine whether the issue is an asset freeze, transaction ban, sectoral restriction, trade control, transport restriction, professional-service restriction or another measure.
- Check permissions. Review licenses, exceptions, wind-down provisions and competent-authority procedures before releasing funds, goods or services.
- Act and document. Block or reject when required, make required reports, and retain the names searched, identifiers reviewed, list versions, legal provisions and decision rationale.
- Monitor after approval. Re-screen parties and relevant ownership when lists, programs, licenses or guidance change. Sanctions updates can occur daily.
How the rules apply in common business situations
A UK company selling to an EU customer
The UK company’s incorporation brings UK rules into scope. Its UK personnel, bank and logistics providers may add further UK considerations. The EU customer’s location and the business activity in the EU require an EU analysis as well. Screen the UK Sanctions List and the EU consolidated list, then read the relevant UK regulations and EU legal act for the product, service, ownership and destination.
A non-U.S. company paid in U.S. dollars
A dollar payment or U.S. financial-system connection can create a U.S. nexus, particularly where a U.S. bank or U.S. person participates. Screen applicable OFAC datasets and examine whether the payment, goods, service or routing is prohibited. The currency alone does not describe every legal consequence; the complete payment path and parties matter.
A company with no list hit but a restricted owner
An unlisted entity may still be blocked or restricted through ownership or control. Trace beneficial ownership before relying on a clean search result. Under OFAC, aggregate ownership of 50 percent or more by blocked persons generally blocks the entity. EU and UK outcomes require the test in their respective legal framework.
Controls that screening cannot replace
- Goods and technology review: check whether the item, destination, origin or end use is subject to a trade restriction.
- Service review: determine whether professional, financial, technical or other services are restricted even when no party is listed.
- Routing and intermediaries: examine banks, insurers, carriers, brokers and transshipment points for additional jurisdictional connections.
- Licensing and exceptions: verify the exact license, exception or wind-down provision and its conditions before relying on it.
- Circumvention risk: assess unusual ownership, payment structures, routing, intermediaries or attempts to conceal the true party or destination.
- Reporting: follow the reporting rules of the applicable authority when property is blocked, a transaction is rejected or a breach is identified.
Common implementation mistakes
- Using one list for every deal: OFAC, EU and UK obligations can apply cumulatively.
- Treating every OFAC entry alike: SDN and non-SDN entries carry different restrictions, and program tags matter.
- Relying on the EU consolidated list alone: the legal act defines the prohibition, scope and exceptions.
- Continuing to use the old UK consolidated list: it stopped being updated on 28 January 2026.
- Searching only exact names: aliases, transliterations, identifiers and indirect ownership can determine the outcome.
- Stopping after a clear screen: screening does not resolve goods, services, routing, licensing or circumvention questions.
- Failing to preserve evidence: without list versions, timestamps and legal analysis, it is difficult to explain a past decision.
What a defensible decision record contains
For each material transaction, keep a record of the parties and beneficial owners, jurisdictions and nexus analysis, screening sources and retrieval times, identifiers used to clear or escalate a match, ownership calculations, the applicable program or regulation, license or exception analysis, approvals, reports and the final disposition. Assign responsibility for monitoring updates to OFAC datasets, EU legal acts and lists, and the UK Sanctions List.
The practical test is not “Did the name search pass?” It is “Can the business show why this specific transaction, with these parties, goods, services, payment route and ownership, was permitted under every applicable regime?”
