Human Oversight for AI Email: A Practical Review Workflow

A practical workflow for reviewing AI-assisted email: assign authority, scale scrutiny to risk, check U.S. commercial-email requirements, and monitor for recurring errors.

A good human-in-the-loop process gives a named reviewer the authority to check, edit, reject, or escalate AI-assisted messages before they reach recipients. Match the depth of review to the message’s potential impact, keep legal checks in the approval path, and monitor the workflow after launch.

What human oversight should do

Human review is meaningful when a person can identify risks and intervene—not when someone merely clicks approve without the time, context, or authority to assess the message. The UK Government’s Data and AI Ethics Framework recommends a human-in-the-loop process for risky or high-impact AI use, with a person or team able to identify risks and intervene where appropriate.

The NIST AI Risk Management Framework is a voluntary framework for incorporating trustworthiness considerations into AI system design, development, use, and evaluation. It does not prescribe one email-specific approval template. The workflow below translates those principles into practical steps for email and outbound messaging.

Build a review workflow before messages go out

  1. Assign a reviewer with clear authority

Name the person or team responsible for review. Give them permission to edit or reject a message and a clear path to escalate issues they cannot resolve. Define who owns the decision when a vendor or contractor prepares or sends the email.

  2. Set review depth according to risk

Spend more time on messages whose claims, audience, or context could materially mislead or harm recipients. Consider what the message asks people to do, the potential consequences of acting on it, how well the audience fits the message, and how serious an error could be. This risk-based approach applies general AI oversight guidance to email; it is not a regulator-issued email checklist.

  3. Check the message and its intended recipients

Before sending, check that factual claims are supportable, the recipients are relevant, the sender identity is accurate, and the subject line reflects the message. Review the actual message in context, including any personalization and the destination of links or requested actions, rather than approving copy in isolation.

  4. Include applicable legal checks

For U.S. commercial email, include accurate header information, a non-deceptive subject line, required sender and opt-out information, and a process for honoring opt-outs. The FTC’s CAN-SPAM compliance guide also makes clear that a company cannot contract away its compliance responsibility by hiring another company to handle email marketing.

  5. Keep accountability when work is outsourced

A vendor may operate part of the workflow, but the responsible organization still needs to define approval authority, ensure requirements are followed, and know how to stop or correct a problematic send. Do not treat outsourcing as a substitute for internal accountability.

  6. Review performance and update the process

Track issues found before sending and problems reported afterward. Look for recurring errors, such as unsupported claims, poor recipient fit, or inaccurate personalization, and adjust review rules, prompts, or escalation paths. NIST describes its framework as covering use and evaluation as well as design and development.

Apply the right U.S. email rules to the message

CAN-SPAM is U.S. federal guidance for commercial email. Whether a particular message is covered depends in part on its primary purpose; transactional or relationship messages fall into narrowly defined categories. An email is not automatically exempt just because the recipient is an existing contact or an AI system helped write it. Assess the message and circumstances, and seek legal advice for your organization’s situation. The FTC explains the primary-purpose distinction in its CAN-SPAM compliance guide.

Protect email delivery without confusing security for review

Email authentication and transmission safeguards support trustworthy email operations, but they answer different questions from human review. NIST’s SP 800-177 Rev. 1, published in February 2019, recommends SPF, DKIM, and DMARC for domain authentication and TLS for transmission security. These controls help protect sender-domain trust and email in transit; they do not verify that a message’s claims are true, that its recipients are appropriate, or that it complies with marketing rules. Check current standards and deployment requirements before implementation.

Quick pre-send checklist

  • A named reviewer has authority to edit, reject, or escalate.
  • Review depth reflects the message’s potential impact and risk.
  • Claims, recipient relevance, sender identity, and subject accuracy have been checked.
  • Applicable opt-out and other commercial-email requirements are covered.
  • Vendor involvement has not displaced the organization’s accountability.
  • Authentication and transmission safeguards are maintained separately from content approval.
  • There is a way to learn from errors and revise the workflow after launch.
