1Clear out junk files and repair common Windows errors2Fix the driver behind crashes, sound loss and screen glitches3Repair Windows errors before they cause bigger problemsAs of 18 October 2026, UK retail traders still cannot be sold, marketed or distributed cryptoasset derivatives. That covers the dealing and financial-promotion activity around products such as crypto futures, options and derivative-based contracts that reference covered cryptoassets. The Financial Conduct Authority (FCA) has not reopened general retail access. Its 2025 reform created a narrow exception for qualifying crypto exchange-traded notes (cETNs) listed on the Official List and traded on a UK Recognised Investment Exchange (UK RIE); those notes are not crypto derivatives.
An exchange being incorporated outside the UK does not, by itself, remove UK financial-promotion obligations. If communications can affect UK consumers, the promotion may fall within the UK regime even when the website, servers and trading company are overseas. A VPN changes neither your UK-resident status nor the firm’s obligations.

The rule in one view
| Question | Position on 18 October 2026 |
|---|---|
| Can a UK retail client be sold a covered crypto derivative? | No. COBS 22.6.5 prohibits a covered firm from selling or distributing it to a retail client. |
| Can a firm market that derivative to UK retail consumers? | No, where the communication is likely to be received by a retail client. |
| Did the 2025 change lift the derivatives ban? | No. It opened a restricted route for qualifying cETNs on a UK RIE. |
| Does an overseas exchange avoid the rules? | No. UK financial-promotion rules can apply to communications originating outside the UK if they are capable of having an effect here. |
| Does a VPN make access lawful? | No. It does not change your client classification or the exchange’s UK-facing conduct. |
What the FCA’s retail derivatives ban actually covers
When it started and why
FCA Policy Statement PS20/10 took effect on 6 January 2021. It prohibited the sale, marketing and distribution to retail clients of derivatives and exchange-traded notes (ETNs) referencing certain unregulated transferable cryptoassets. The FCA estimated that avoiding the prohibited retail harm could save between £19 million and £101 million a year, an estimate published in 2020.
What’s actually slowing this PC down?
Pick the symptom - the matching free tool is one click away.
The rule is not limited to the moment a customer clicks “buy”. Current Handbook wording in COBS 22.6.5 covers a covered firm selling or distributing a cryptoasset derivative or a non-UK-RIE cryptoasset ETN to a retail client, and marketing it where the communication is likely to be received by a retail client.

Marketing is broader than an advertisement
For this purpose, “marketing” includes communicating or approving a financial promotion. “Distribution or sale” includes dealing. A firm can therefore create regulatory exposure through its website, mobile application, social-media posts, referral arrangements, affiliate material or approval of another person’s promotion, even if the final order is executed elsewhere.
The practical distinction is important: an exchange cannot assume that removing a “UK” button from its trading screen resolves the issue if UK consumers can still see the promotion, open an account, fund it or engage with the promoted activity.
What “retail” means in this context
The prohibition is directed at retail clients. Professional-client classification is a separate regulatory question and is not an automatic workaround for an ordinary individual. A firm must apply the applicable UK classification and conduct requirements; a trader cannot simply label an account “professional” to make a prohibited retail offer lawful.
Can UK residents trade crypto futures, perpetuals or CFDs?
Futures, options and similar contracts
Crypto futures, options, swaps, perpetual-style contracts and other instruments whose value is derived from a cryptoasset are derivatives. A UK retail client should treat a platform offering such products as unavailable unless the firm can demonstrate a lawful basis that is genuinely outside the retail prohibition. The FCA’s ban remains in force; there has been no general reopening for retail crypto futures.

Crypto CFDs are not rescued by the ordinary CFD safeguards
The FCA’s wider CFD regime has protections such as leverage limits from 30:1 to 2:1, a 50% margin close-out rule, negative-balance protection, inducement bans and standardised risk warnings. The FCA estimated those measures could save retail consumers £267 million to £451 million a year in a 2019 assessment.
Those safeguards do not cancel the separate cryptoasset-derivatives prohibition. A product can be subject to the general CFD framework in other circumstances while a cryptoasset CFD offered to a UK retail client remains prohibited under the crypto-specific rule. Checking only the leverage or risk-warning language is therefore not enough; first identify whether the instrument is a covered cryptoasset derivative.
Why a qualifying crypto ETN can be available when a derivative is not
The narrow change from 8 October 2025
From 8 October 2025, retail consumers gained access to qualifying cETNs only when both conditions are met: the instrument is listed on the UK’s Official List and admitted to trading on a UK Recognised Investment Exchange. Its prospectus must be reviewed and approved, and the product is treated as a Restricted Mass Market Investment.
| Feature | Qualifying UK cETN | Covered crypto derivative |
|---|---|---|
| Retail availability | Permitted only within the 2025 conditions. | Prohibited for UK retail clients. |
| Venue | Must trade on a UK Recognised Investment Exchange. | No general retail route through an overseas or non-UK venue. |
| Documentation | Prospectus reviewed and approved; classified as a Restricted Mass Market Investment. | These ETN conditions do not make a derivative eligible. |
| Regulatory status | An exchange-traded note, not a reopening of crypto derivatives. | Still within the FCA’s retail derivatives restriction when covered by COBS 22.6. |
What the distinction means for a trader
An ETN is a listed security that gives exposure according to its terms; it is not the same contract as a futures or CFD position. Listing, prospectus review and the UK-RIE requirement provide the regulatory framework for this limited access, but they do not remove investment risk. The FCA described the change as giving consumers more choice while retaining protections, not as declaring cryptoassets safe.

In June 2025, FCA executive director David Geale said lifting the ban under consultation would let people decide whether a high-risk investment was right for them, while warning that they could lose all their money. In August 2025, he said the market had become more mainstream and better understood and that the new route was intended to provide information and protections. Those statements concern the cETN change; they do not authorise retail crypto derivatives.
How overseas exchanges come within UK financial-promotion rules
The four lawful promotion routes since 8 October 2023
Since 8 October 2023, a promotion of crypto-related services to UK consumers must use one of four routes:
- The communication is made by an FCA-authorised person.
- An unauthorised person makes the communication, but an FCA-authorised person approves it.
- The communication is made by or for an FCA-registered cryptoasset business relying on the Article 73ZA exemption.
- The communication falls within another exemption in the Financial Promotion Order.
These routes concern the promotion. They do not automatically make a prohibited product lawful, and registration is not the same as full FCA authorisation for every activity.

Why overseas location is not a safe harbour
The FCA says the restriction can cover communications originating outside the UK when they are capable of having an effect in the UK. A promotion does not need to name Britain or expressly target British customers. If UK consumers can view it and potentially engage with the promoted activity, it is likely to be relevant to the UK regime.

That can include a publicly accessible exchange website, an app available in a UK app store, social-media content, influencer or affiliate links, email campaigns and referral codes. The legal question is not simply where the trading engine sits; it is whether the communication and resulting activity can affect UK consumers.
Geo-blocking and relationships with unregistered businesses
The FCA discusses geo-blocking as a control that can help prevent UK consumers from seeing or using a service. Effective controls need to work across the customer journey, including website content, account opening, identity checks, deposits, withdrawals, application programming interfaces and marketing distribution. A disclaimer saying “not for UK persons” is not equivalent to actually preventing access where the service remains available.
The FCA has also warned regulated payment and crypto firms about relationships with unregistered overseas businesses. That makes banking, card processing, custody, referral and liquidity arrangements relevant compliance questions, not just the exchange’s own domain name.
Recent enforcement signal
In February 2026, the FCA announced legal proceedings concerning alleged continuing UK promotions by HTX on a website and social-media channels. The announcement is an enforcement signal, not a final court finding. It demonstrates that overseas promotion and distribution remain active enforcement priorities.

Does using a VPN make an overseas exchange legal for a UK resident?
No. A VPN can alter the apparent internet location, but it does not change residence, client classification or the substance of the transaction. If you ordinarily live in the UK, the exchange may still be dealing with a UK retail client, and its UK-facing promotion may still be within scope.
- It may breach the exchange’s terms. Platforms commonly prohibit bypassing geographic controls; any resulting account restriction, liquidation or withdrawal delay is a contractual risk.
- It does not cure the firm’s promotion problem. A UK consumer who discovered the service through UK-visible advertising remains part of the factual picture.
- It can complicate compliance checks. Inconsistent IP addresses, identity documents, tax residence and payment details can trigger enhanced review or account suspension.
- It does not convert a prohibited product into a permitted one. A derivatives contract remains a derivative regardless of the connection method.
A practical way to assess a product or venue
Before opening an account or responding to an advertisement, work through the following checks. Keep screenshots of the product description, legal entity, venue and financial-promotion wording; those details can change.
| Check | What to establish | Why it matters |
|---|---|---|
| Product type | Is it a derivative, a qualifying UK cETN, spot crypto or another instrument? | The retail derivatives ban is product-specific; the cETN exception is narrow. |
| Client classification | Are you being treated as retail, and is any professional status validly assessed? | The prohibition applies to retail clients; self-description is not enough. |
| Venue | For a cETN, is it on the Official List and traded on a UK RIE? | An overseas or non-UK venue does not meet the cETN conditions. |
| Promotion route | Who communicated or approved the promotion, and which exemption is relied on? | Since 8 October 2023, UK-facing promotions need a lawful route. |
| Geographic controls | Does the firm genuinely block UK users, or merely display a warning? | Access controls and visible marketing are separate compliance issues. |
| Permissions and registration | Which legal entity provides each service, and is it authorised or FCA-registered for that activity? | A registration may cover one activity but not every product or service. |
| Leverage and loss protection | What leverage, margin close-out, negative-balance and liquidation terms apply? | These affect risk but do not override the crypto-derivatives ban. |
What UK retail traders can realistically do
Consider qualifying listed cETNs only on the stated terms
If your objective is market exposure through a listed product, verify all of the 2025 conditions rather than relying on the word “ETN” in a platform description. Confirm the Official List entry, the UK Recognised Investment Exchange admission, the approved prospectus and the product’s Restricted Mass Market Investment treatment.

An account that can be created, funded or displayed from a UK IP address is not proof that the product is lawfully promoted or sold to you. Access and legal permission are separate questions.
Check the exact firm and service
Crypto businesses often use different legal entities for spot trading, derivatives, custody, payments and marketing. Identify the entity named in the client agreement and the entity making the promotion. Then check the relevant FCA status and restrictions for that specific activity.
What an overseas exchange should do before serving UK consumers
- Map every product. Separate derivatives, non-UK-RIE ETNs, qualifying UK cETNs and other crypto services.
- Decide whether UK retail access is allowed. Do not treat the 2025 cETN change as a broad reopening.
- Inventory every promotion. Include websites, apps, social media, affiliates, influencers, email, referrals and paid search.
- Select a lawful financial-promotion route. Document the authorised approver, Article 73ZA basis or other Financial Promotion Order exemption.
- Build effective geographic controls. Apply them to advertising, onboarding, funding, trading and customer support, and test for leakage.
- Review third parties. Check payment providers, introducers, affiliates and liquidity partners for UK exposure and registration concerns.
- Keep evidence. Retain approvals, geo-block tests, customer classifications, product terms and decisions about UK availability.
Firms needing help with this workflow may seek independent UK crypto financial-promotion compliance training; no training provider is endorsed by the FCA merely because it uses that description.
Bottom line for a UK retail trader
The FCA’s retail ban on covered cryptoasset derivatives remains in force. Futures, options and derivative-style contracts cannot be marketed, sold or distributed to UK retail clients through a lawful general-access route. The exception introduced on 8 October 2025 is limited to qualifying cETNs on the Official List and a UK Recognised Investment Exchange. Overseas incorporation, a non-UK website or a VPN does not remove UK financial-promotion exposure, and current FCA enforcement activity shows that advertising and access controls matter as much as the final trade.
