They apply according to the item’s technical characteristics and classification, the destination and recipient, the recipient’s ultimate parent, the intended end use, and any applicable license or exception. As of October 4, 2026, rules and policies have changed repeatedly, so a product name or past shipment is not enough to determine whether a particular export is allowed.
What determines whether a GPU export is controlled?
The relevant rules sit in the U.S. Export Administration Regulations (EAR), administered by the Bureau of Industry and Security (BIS). The analysis is about a specific item and transaction—not just a product category or a manufacturer’s marketing label.

- Item: Technical characteristics and formal classification determine which controls may apply. Performance and performance density have been relevant to advanced-computing controls; memory and interconnect characteristics may also matter under the applicable rule. The parameters and thresholds depend on the current EAR text.
- Destination and recipient: The destination, the recipient’s location, and—in some cases—where its ultimate parent is headquartered can affect licensing requirements.
- End use and end user: Certain restricted end uses or users can trigger additional authorization requirements, even when an item’s technical classification alone would not answer the question.
- Authorization: A license requirement may be affected by an applicable license exception or a specific BIS policy. An announced review policy is not itself an approval for every shipment.
That is why neither “gaming GPU” nor “AI accelerator” is a complete export-control determination. The examples below describe particular rules and NVIDIA’s reported experience; they do not establish the current classification of every product.
How the China-related rules and policies changed
The timeline below is limited to the measures described by BIS and NVIDIA. It shows why older assumptions about what could ship may no longer apply. Legal requirements can change, and the applicable EAR and guidance should be checked for the transaction date.

| Date | What changed | Practical significance |
|---|---|---|
| October 2022 | BIS added certain advanced and high-performance computing chips, and computer commodities containing them, to the Commerce Control List. It also added license requirements tied to specified China-related supercomputer and semiconductor-development or production end uses and expanded controls over certain foreign-produced items. | BIS identified October 21, 2022, as the effective date for the advanced-computing and supercomputer controls. The controls were tied to item characteristics and specified destinations or end uses, not simply to whether a chip was described as an AI product. |
| October 2023 | BIS updated the advanced-computing controls to use either the earlier performance threshold or a new performance-density threshold. The update removed interconnect bandwidth as a parameter for identifying restricted chips and established a notification procedure for some chips below the restricted threshold. | For notifications covering China and Macau, BIS said it would determine within 25 days whether a shipment could proceed under the exception or instead required a license. NVIDIA’s subsequent filing said products exceeding specified thresholds included the RTX 4090, as well as data-center chips and systems. |
| January 13, 2026 | BIS announced case-by-case review of license applications for NVIDIA H200, AMD MI325X, and similar chips for China, subject to safeguards. | Applicants must show that exports will not reduce global capacity available to U.S. customers, that Chinese purchasers have compliance procedures including customer screening, and that independent third-party testing in the United States has verified performance and security. Case-by-case review is neither blanket authorization nor a guarantee of approval. |
| May 31, 2026 | BIS clarified how covered advanced-computing license requirements apply to entities headquartered in Country Group D:5 or Macau, or whose ultimate parent is there, even when the entity itself is located elsewhere. | BIS said exporters should continue to seek licenses unless a specified exception applies. Its guidance also addressed the 2025 AI Diffusion Rule and its non-enforcement position on that later rule’s new compliance requirements. |
AI accelerators and gaming GPUs can face different commercial outcomes
Data-center accelerators and consumer graphics cards have different typical roles, but role alone does not decide their legal treatment. Technical controls and transaction details remain decisive.
| Comparison axis | Data-center AI accelerator | Gaming or workstation GPU |
|---|---|---|
| Typical role | Model training or inference in data-center systems. | Desktop gaming, creator, or workstation graphics. |
| Control analysis | Apply the relevant technical thresholds and classification, then check the destination, recipient, parent, end use, and available authorization. | Use the same item-and-transaction analysis. A consumer or gaming label does not establish that a card is controlled or uncontrolled. |
| Reported China-market outcome | NVIDIA said it was effectively foreclosed from competing in China’s data-center compute market, despite limited activity under the H200 licensing program. | NVIDIA said gaming and workstation products were among the uncontrolled products it could ship to China at the end of its fiscal 2027 second quarter; its filing also named the RTX 4090 among products covered by the October 2023 threshold requirements. |
The two reported statements about gaming products are not contradictory: the filing describes more than one product and control circumstance. It does not provide a universal rule for all gaming GPUs, or a model-specific determination for every card.

What NVIDIA reported about business effects
NVIDIA’s Form 10-Q for its fiscal 2027 second quarter describes the company’s own experience with U.S. licensing requirements and PRC restrictions. These figures are company-reported charges, not estimates of the total cost of export controls to the GPU industry.
Do these 3 things before closing this tab:
1Scan for outdated or missing drivers - takes under a minute2Repair Windows errors before they cause bigger problems3Fix the driver behind crashes, sound loss and screen glitches| Reported amount | Period and item | What NVIDIA said it related to |
|---|---|---|
| $4.5 billion | NVIDIA fiscal 2026 | A charge associated with H20 excess inventory and purchase obligations after new licensing requirements and diminished demand. |
| $0.4 billion | NVIDIA first half of fiscal 2027 | A charge associated with H200 excess inventory and purchase obligations. |
NVIDIA attributed constraints in China’s data-center market to the combined U.S. licensing environment and PRC government restrictions on sales. It reported that licensed H20 inventory could not be sold after PRC restrictions, that it had not been able to sell all H200 products for which it had U.S. licenses, and that it had made only a fraction of allowed H200 shipments by the end of the quarter. A U.S. license therefore did not, by itself, guarantee a sale in China.

What the rules mean for a consumer GPU example
NVIDIA presents the GeForce RTX 5090 as a card for gamers and creators and lists 32 GB of GDDR7 memory. That makes it an example of a consumer graphics product, not proof that its export to a particular destination is either permitted or restricted. NVIDIA’s filing does not establish the RTX 5090’s specific export classification. Nor should the RTX 4090’s inclusion in the filing’s discussion of 2023 thresholds be used to infer the RTX 5090’s treatment.
AI training does not automatically require a license
BIS’s May 13, 2025 policy statement describes circumstances in which activities involving advanced-computing items for AI training may trigger authorization requirements under EAR Part 744. Those requirements depend on relevant knowledge and covered military-intelligence or weapons-of-mass-destruction end-use or end-user conditions. The statement does not say that every AI training job, or every ordinary GPU purchase for training, automatically requires a license.

How to assess a real export decision
- Identify the exact item. Confirm the model, technical specifications, system configuration if applicable, and formal classification. Do not substitute the product’s marketing category for the classification.
- Check current controls. Consult the EAR and current BIS guidance for the applicable technical thresholds, destination controls, and any rules covering foreign-produced items.
- Screen the transaction parties. Verify the recipient, relevant ultimate parent, destination, and any other parties whose status matters under the applicable rule.
- Establish the end use and end user. Assess whether the transaction involves a controlled end use or end user, including applicable AI-training, military-intelligence, supercomputer, or WMD-related provisions.
- Determine the authorization route. Check whether a license is required and whether a specific license exception or policy applies. If a license application is reviewed case by case, do not treat the review policy as permission to ship.
The BIS measures described here do not establish one current ECCN or licensing answer for every consumer GPU. For an operational decision, verify the current EAR, applicable BIS guidance, and transaction-specific license status; seek qualified export-control counsel when needed.
