Verify the people and business behind the offer, the token’s actual rights, the legal claims that apply where you live, and the exact contract and transactions your wallet would use. A white paper, professional website, ticker symbol, or audit badge is not proof that a presale is legitimate. No checklist can guarantee a safe investment or recovery of lost funds; if an important claim cannot be independently checked, treat it as unknown and do not send money until it is clarified.
What should you check before considering a crypto presale?
A presale, token sale, coin sale, or ICO is an early token offering. The label alone does not establish who is offering it, what rights the token carries, whether the offer is lawful, or whether the project can deliver. Work through these checks in order rather than relying on the promoter’s claims.

- Identify the people and legal entity. Find the issuer’s legal name and the people responsible for the offer. Independently check their histories and affiliations. Confirm claimed advisers, executives, and partners through those parties’ own channels—not just the presale website. Difficulty finding information about the people or affiliates is a warning sign, as the Commodity Futures Trading Commission (CFTC) notes in its customer advisory.
- Separate what exists from what is promised. Look for a comprehensible business plan and evidence of the product or service as it exists now. Compare that with roadmap promises. A planned launch, future partnership, or proposed use is not proof of present delivery.
- Read the offer terms before assessing the price. Record the token’s stated purpose and rights, how proceeds will be used, sale terms, allocation and vesting details, transfer restrictions, and how buyers claim tokens. Find out whether refunds are available, who is responsible for honoring them, whether resale is possible, and what limits apply. Investor.gov specifically recommends asking how and when money can be returned and whether tokens may be resold. If these terms are vague or absent, withhold funds until they are explained.
- Check legal and registration claims for your jurisdiction. Do not treat labels such as “utility token,” “not a security,” or “registered” as legal conclusions. Check claims against the regulator and rules relevant to both the offer and you as a buyer.
- Authenticate the domain and token contract. Reach the project through independently trusted channels. Compare the domain spelling and the contract address across the project’s corroborated website and official documentation. Then use an explorer for the correct blockchain to inspect that contract. A familiar ticker, transaction history, or community explorer label does not authenticate a token.
- Examine the code and any claimed audit. Find published code and, if an audit is cited, obtain the report from the auditor’s own domain. Check the report’s date and scope and whether it covers the code deployed at the contract address you verified. An audit is limited evidence about reviewed code; it does not prove the promoters are honest, the economics are sound, or future performance is safe.
- Test the exit assumptions. Ask whether a buyer can actually sell, where, and under what restrictions. A dashboard balance, displayed price, or promised exchange listing does not establish that a market exists or that you can sell at that price. If the token has no reliable tradable market yet, its presale liquidity claim cannot be confirmed on-chain.
- Stop if the pitch or wallet request is suspicious. Guaranteed returns, quick-wealth claims, countdown pressure, hard selling, unsolicited approaches, hidden promoters, and unclear disclosures call for extra scrutiny. Never share a seed phrase or private key with a promoter or website. Read wallet transaction details and permissions; do not sign a transaction or approve an allowance whose purpose you cannot explain.
How do legal checks differ by jurisdiction?
United States
The SEC’s explanation of the Howey test describes an investment contract as involving an investment of money in a common enterprise with a reasonable expectation of profits derived from the essential managerial efforts of others. The SEC also explains that a crypto asset that is not itself a security may still be offered subject to an investment contract, depending on the facts and representations. A promoter’s label does not settle that analysis.

If a US offering claims registration, Investor.gov says registration statements such as Form S-1 can be searched through SEC.gov/EDGAR. If the offer claims an exemption, check what conditions apply rather than assuming the offer is open to every buyer.

The Financial Conduct Authority (FCA) says whether an ICO falls within its regulatory perimeter is decided case by case. For a firm claiming FCA registration or authorisation, search the Financial Services Register by firm name or reference number and make sure the listed activities, permissions, and contact details match the offer. A registry entry is not an endorsement or a guarantee against loss.
Nigeria and other jurisdictions
Nigeria’s SEC directs users to its operator portal to verify promoters and platforms and has issued specific unauthorized-offering warnings. Its June 5, 2025 alert about Punisher Coin ($PUN) applies to that named offering; it is not a general ruling on other presales. Elsewhere, consult the relevant local regulator’s current records and guidance. These US, UK, and Nigerian examples are jurisdiction-specific, not a universal rule for all token sales.

How can you tell whether a token contract or website is genuine?
Token names and symbols can be duplicated. Ethereum.org warns that cloned sites may direct users to attacker-controlled addresses or interfaces and that an interface can trick a buyer into signing a harmful transaction or granting a token allowance. Use this authentication sequence:
What’s actually slowing this PC down?
Pick the symptom - the matching free tool is one click away.
- Do not trust a domain or contract address supplied only in an unsolicited message, advertisement, or social-media reply.
- Corroborate the project’s official channels independently, then compare the contract address shown there with its official documentation.
- Open the address in an explorer for the correct blockchain and check that you are looking at the intended contract, not a similarly named token on another chain.
- Do not treat a familiar ticker, apparent balance, transfer events, or explorer activity as proof of identity. Malicious contracts can imitate these signals.
- Before signing, inspect what the wallet request does and what permissions it grants. If you cannot explain the transaction, reject it and seek clarification through a separately verified channel.
What does an audit prove—and what does it not prove?
Investor.gov recommends asking whether the blockchain is open and public, whether code has been published, and whether an independent cybersecurity audit has been performed. If an audit is claimed, verify the report with the auditor directly and check that its scope and date cover the relevant code. Then compare the reviewed code with the contract actually deployed at the address you authenticated.

An audit does not establish that an issuer’s identity or claims are truthful, that token terms are fair, that the project will deliver, or that you will be able to exit at a particular price. Treat an audit badge without a verifiable report—or a report that does not match the deployed code—as unconfirmed evidence.

Which warning signs mean you should pause?
- The offer promises guaranteed returns or quick wealth. The CFTC states, “There is no such thing as a guaranteed investment or trading strategy.”
- You are pushed to act immediately, approached unexpectedly, or discouraged from checking claims independently.
- The people behind the offer, their affiliations, token rights, proceeds, refund terms, or restrictions are difficult to verify or understand.
- The site asks you to connect a wallet or sign a transaction before you can explain what it does, or urges you to reveal a seed phrase or private key.
- A promoter claims registration, approval, a partnership, or an audit but cannot be independently confirmed through the relevant regulator, partner, or auditor.
The FCA warns that fraudsters may use professional-looking websites and manipulated prices or returns. It also reports that reports to it about crypto investment scams “have more than doubled since 2020”; that statement is the regulator’s wording and does not specify an endpoint or count in the cited passage. The CFTC’s advisory cites historical estimates that fraud affected “5 percent to more than 80 percent of ICOs,” based on several studies and news reports. That is ICO-era context, not a current estimate of the share of presales that are scams.
What should you do if you suspect a scam?
- Preserve records. Save the offer terms, URLs, wallet addresses, transaction hashes, messages, and payment records before access to a site or account changes.
- Report through official channels. Use the appropriate regulator or law-enforcement reporting channel for your jurisdiction. The CFTC advisory links to its complaint channel, and the FCA accepts reports of suspected ICO scams and provides contact information for crypto scam concerns.
- Be wary of recovery-fee offers. The FCA warns that fraud victims may be targeted again by people promising to recover funds for an upfront fee. Reporting does not ensure reimbursement.
Regulatory protections vary by jurisdiction and activity, and crypto investments can lose all their value. Verification can help uncover avoidable warning signs; it cannot guarantee safety.
