A working prototype is a useful starting point, not proof that an invention qualifies for a patent. To pursue one, identify the protectable contribution, check what already exists, manage disclosure carefully, and prepare an application that explains the invention and defines the protection sought.
Start with what the prototype contributes
Patentability turns on the invention you describe and claim—not simply on whether you built a working model. A useful first step is to explain, in plain language, what problem the prototype addresses, which parts or steps solve it, how those parts work together, and what is different from existing solutions.

Then separate the invention’s function from its appearance. A useful mechanism or process may point toward a utility patent; a new, original ornamental appearance may point toward a design patent. A prototype can involve both, but the two patent types cover different subject matter. The U.S. Patent and Trademark Office (USPTO) describes utility and plant patents as having terms of up to 20 years from the first nonprovisional filing date, and design patents as having a 15-year term from grant. Those are patent terms, not estimates of how long an application will take.

| Decision | Option | What it covers or means |
|---|---|---|
| What to protect | Utility patent | A useful process, machine, manufacture, composition of matter, or improvement; the focus is function. |
| What to protect | Design patent | A new, original ornamental design for an article; the focus is appearance. A provisional application is not available for a design invention. |
For a utility patent, the general criteria include that the invention be useful, adequately described, new, and not obvious. Whether a specific invention meets those standards depends on its details, the prior art, and the claims in the application. A prototype alone cannot settle that question.

Search for similar inventions before spending heavily
Look for relevant patent publications and other publicly available material before committing substantial time or money to an application. The USPTO provides Patent Public Search and advises applicants to search for similar inventions. A search can reveal that an apparently distinctive feature is already known, or help you focus on the particular improvement your prototype contributes.
Finding a similar product does not, by itself, answer whether your own invention is patentable. The relevant comparison is between what is already publicly available and the specific contribution you would seek to claim. A patentability assessment for a particular prototype requires a fact-specific review of that material and the proposed claims.
Manage disclosure before you file
Posting a build video, demonstrating the prototype, offering it for sale, or otherwise making details public can affect patent rights. The consequences depend on the circumstances and the countries where protection is sought. U.S. law provides a limited one-year inventor-disclosure exception in the relevant context, but that is not a safe general license to disclose first and file later. A pre-filing disclosure may bar protection abroad even where a U.S. exception could apply.

If you are considering publicizing or selling the invention, get advice from a registered patent attorney or agent about the timing and geographic consequences before doing so. Filing earlier can preserve options, but only an application that adequately describes the invention can support the rights being sought.
Document how the invention works—not just how you built it
A notebook of dates, sketches, and build iterations may help preserve your development history, but it is not a substitute for patent-application disclosure. The application needs to explain the invention itself: how to make it, how to use it, how its components or steps interact, and what alternatives or variations are relevant. Include explanatory drawings when they are needed to understand the invention.
For a utility application, the specification must describe the invention in full, clear terms and teach a person skilled in the relevant field how to make and use it. Claims state the boundaries of the protection being requested. The USPTO puts it directly: “The claims define the scope of the protection of the patent.” In practical terms, claims are not just a label for the prototype; they determine which aspects of the invention the application asks to protect.

A later nonprovisional application receives the benefit of a provisional application’s filing date only for subject matter the provisional actually supports. A short or incomplete description can therefore leave important features without the earlier date, even if the prototype existed at the time.
Choose how and when to file
| Path | What it does | Main consideration |
|---|---|---|
| Provisional application, followed by a nonprovisional | An optional early filing for eligible utility or plant inventions. It is not examined and is not a patent. A corresponding nonprovisional generally must be filed within 12 months to claim its benefit. | Can establish an early filing date for adequately supported subject matter while giving time to assess next steps, but does not replace preparing and filing the later application. |
| Nonprovisional application directly | Submits the application for examination without first relying on a provisional application. | Requires preparing the full application at the outset. |
A provisional application does not mature into a granted patent on its own. The USPTO says independent inventors should understand that further submissions are required. The 12-month period is a filing deadline for claiming the provisional’s benefit, not a promise about examination or approval. Provisional applications are not an option for design inventions.
Whether to file a provisional first or proceed directly with a nonprovisional depends on how complete your disclosure is, your resources, and your timing. If the invention’s appearance is the subject of protection, investigate the design-patent application path rather than trying to use a provisional.

Prepare the nonprovisional application
A nonprovisional utility application includes a specification, claims, drawings when necessary, an oath or declaration, and fees. Its description must support the claims and explain how to make and use the invention. The claims define the requested scope, so drafting them is a substantive part of the application—not an administrative formality.
- Describe the invention completely. Explain the problem, components or steps, how they work together, and useful alternatives. Do not rely on an examiner or reader to infer missing details from the fact that a prototype exists.
- Prepare drawings that clarify the disclosure. Show relevant components, relationships, or stages when visual explanation is needed to understand the invention.
- Define the claims sought. Claims should correspond to what the written description actually teaches. Their wording determines the scope requested.
- Complete the required application materials. A utility nonprovisional includes its specification, claims, any necessary drawings, an oath or declaration, and fees. Check current USPTO requirements and fees when preparing to file because amounts and procedural information can change.
For a design application, the focus is the ornamental appearance, and the visual disclosure is central. The utility-application components described above should not be assumed to map identically to a design filing.
Decide whether to prepare it yourself or get professional help
The USPTO publishes guidance for applicants filing on their own and says applicants may hire a registered patent attorney or agent. There is no universal answer for every prototype. The choice depends on the invention’s complexity, your resources, and whether you can prepare a clear, complete disclosure and claims.
Because a provisional only supports what it actually describes, and claims define the scope sought, consider professional help if you are unsure how to describe the contribution or frame the claims. A patent attorney or agent can advise on application preparation and filing; no general guide can determine whether your particular invention qualifies.
Quick Recap
What you can—and cannot—conclude from the process
- A prototype demonstrates that you have built something; it does not establish novelty, nonobviousness, adequate disclosure, or patentability.
- A search is a practical early check, but a result from Patent Public Search is not by itself a legal determination about your application.
- A provisional filing is neither an examination nor an issued patent, and its filing date helps only for subject matter it supports.
- Application costs depend on the filing and applicable fees; there is no single cost or examination timeline that applies to every applicant. Check current USPTO fee and processing information before budgeting.
