Assume a digital game is a license, not property you can resell, unless the product’s contract clearly grants a transferable right. A storefront button that says “Buy” describes the transaction, not what you receive. The controlling terms are the store agreement, the game’s end-user license agreement (EULA), any subscription or publisher-account terms shown during checkout, and mandatory consumer law in your country.
Before paying, identify the account that will hold the entitlement, search the legal text for transfer and suspension clauses, check platform and territory limits, and save the terms displayed at checkout. Those steps tell you whether you are obtaining a personal permission to use software or an entitlement that can legally move to another person.

What a digital game license means
A software license is permission to run or access a program under stated conditions. It can be perpetual or time-limited, but it does not normally give you the copyright, a copy independent of the platform, or the right to hand the entitlement to someone else. The agreement may require a particular account, device, client application, internet connection, territory, or publisher service.
Transferable ownership is a different contractual result. It means the law or the contract lets you pass the entitlement to another person, usually while giving up your own access. A genuine transfer mechanism will explain who may receive it, what happens to your access, and whether the platform records the change. If the terms only grant personal, non-commercial use, call the purchase a license even when the price is paid once and the game can be downloaded.

“Ownership” in a marketing description can therefore be misleading. The practical question is not whether money changed hands; it is whether the legal entitlement can survive outside your account and be assigned to a new user.
How the major storefront agreements classify digital games
The leading platform contracts reviewed for this guide use licensing language. Their details differ, so read the agreement for the exact edition and region you are buying.

These statements do not eliminate statutory rights. A local consumer-protection rule can override a contract term, but you should not assume such an exception exists without checking the law where you live.
The six-step test to run before checkout
1. Open the exact product page and its legal links
On the store page, expand links labelled EULA, license terms, subscription terms, additional terms, or similar. PlayStation says applicable license terms are made available during the purchase flow. Read the terms for the specific edition, bundle, add-on, and country; a deluxe bundle can include separate online services or virtual items.
2. Search for words that define your rights
Use the browser’s find function for transfer, non-transferable, personal, account, linked device, resell, sublicense, subscription, suspend, and terminate. “Personal,” “non-commercial,” and “non-transferable” indicate permission to use rather than an asset you can assign. A clause allowing a narrowly defined marketplace transaction is not the same as a right to sell the game license.

3. Identify the account that will hold access
Write down every account required to launch the game: the store account, the console account, and any separate publisher account. A second account creates a second dependency. PlayStation’s UK terms specifically warn that unlinking or losing a third-party account can remove access. If a family member buys the game on their account, your own account may not receive an independent entitlement.
4. Check platform, device, territory, and online requirements
Confirm the supported operating system or console generation, whether the license is limited to a territory, and whether the game needs an internet connection for activation, updates, or every launch. Microsoft places compatibility responsibility on the buyer and notes that some digital goods are territory-limited. Nintendo’s default rule links a license to a Nintendo Network ID and associated device unless an exception applies.

5. Read the failure and end-of-service clauses
Look for what happens after account suspension or closure, a delisting, a server shutdown, loss of a publisher’s distribution rights, or cancellation of a subscription. Steam may require an account, the Steam client, or an internet connection. Microsoft lists service cancellation and loss of distribution rights among circumstances in which access or capabilities may end. Note whether you can redownload after a delisting and whether an already installed copy continues to start offline.
6. Preserve the terms and receipt
Save a PDF or screenshots of the terms shown at checkout, the product description, the order receipt, and any region-specific refund notice. Record the account email, edition name, platform, and purchase date. Terms can change later; preserving the version you accepted helps establish what was promised and which cancellation window applied.
Contract signals that you are receiving a license
- The text says “licensed, not sold,” “limited license,” or “permission to use.”
- The grant is “personal,” “non-exclusive,” “non-commercial,” or “non-transferable.”
- The entitlement is registered to an account, network ID, or linked device.
- The agreement prohibits selling, assigning, lending, sublicensing, or sharing credentials.
- Use depends on a subscription, client application, authentication server, or continuing online service.
- The provider reserves the right to suspend an account, change features, or end distribution.
None of these phrases alone proves that every use will stop immediately after a service change. They do show that your rights are defined by the contract and platform operation rather than by possession of a standalone copy.

What account suspension, closure, or a ban can mean
Account-based delivery makes the account part of the access path. If the store suspends or closes it for a terms violation, unpaid chargeback, fraud investigation, or another stated reason, you may lose the ability to authenticate, download, update, or use games attached to it. The precise consequence depends on the platform’s enforcement and appeal rules; a ban is not automatically the same as deletion of local files.

Before requesting closure, check whether licenses can be moved (usually they cannot), whether another household account has independent purchases, and whether you can still access receipts needed for a refund dispute. Never give another person your login as a workaround: credential sharing can itself violate the account agreement and does not create transferable ownership.
A required publisher account adds another failure point. If that account is unlinked, suspended, or retired, the store entitlement may remain listed while the game cannot authenticate. Treat the account chain—store, console, and publisher—as one combined dependency when assessing long-term access.
Can you resell or transfer a digital game?
For ordinary storefront purchases, the reviewed agreements generally do not grant a resale right. A transfer would require an express platform feature or a mandatory rule in your jurisdiction. Moving a whole account is usually prohibited, and transferring only a game is impossible where the platform has no assignment function.
Do not confuse a permitted transaction in a virtual-item marketplace with ownership of the game software. Steam’s marketplace language can cover particular virtual-item license rights while keeping those rights licenses. A game’s add-on, season pass, or subscription can also have a separate transfer rule from the base game.

If a seller offers an account containing games, you are buying control of someone else’s credentials, not receiving a clean title to each game. The original owner may recover the account, the platform may close it, and support may refuse to change the account holder. Such a transaction also exposes your payment details and personal data.

Physical media is often easier to hand to another person because the disc or cartridge itself can be delivered. That does not guarantee independent play. A release may require a one-time code, a publisher account, a large download, an online service, or continuing console terms. Some discs contain only an installer and still need a server to activate.
Check the exact physical edition for four things: whether the complete executable is on the media, whether the first launch needs an online check, whether important content is a download code, and whether multiplayer requires a service that could later shut down. A used cartridge with a consumed code may provide less access than a new copy. Physical ownership improves your ability to possess and hand over the medium; it does not erase software licenses or service dependencies.
Refunds, cancellation, and regional consumer rights
Refund rights are separate from ownership. They depend on your country, the product’s delivery status, the platform’s policy, and the contract you accepted.
PlayStation’s UK terms explain that consumers in the European Economic Area can have a 14-day cancellation period for digital content. If delivery begins after you expressly consent and acknowledge that the right will be lost, the ordinary change-of-mind cancellation right can be limited. Faulty content and other statutory remedies may still apply.
EU digital-contract rules require pre-contract information and provide conformity remedies, with the details implemented through national law. A defect, failure to match the description, or persistent access problem can therefore raise a different claim from simply changing your mind. Keep evidence of the error, support correspondence, and the terms displayed at purchase.
Outside the EEA, deadlines and conditions vary widely. Check the store’s country-specific policy before downloading or launching if you may rely on a change-of-mind refund; those actions can affect eligibility.
How to compare two ways of buying the same game
When choosing between a digital storefront, a physical edition, a subscription catalogue, or a key from an authorized seller, compare the rights and dependencies rather than only the price.

Three purchase decisions, worked through
You want to give the game to a friend later
Start with the transfer clause, not the price. If the entitlement is personal and attached to your account, plan on no legal handoff. A physical edition may be more practical only after you verify that it contains playable software rather than a single-use code and does not require your account.
You share a console with family
Determine whether the platform’s sharing feature grants use on the designated device or creates ownership for each profile. The purchaser remains the account holder unless the terms say otherwise. Keep purchases on the account that will remain available and review what happens if the console is replaced or deactivated.
You expect to play for many years
Prioritize an edition with a documented offline mode, complete local content, and a clear redownload policy. Preserve installers, patches, receipts, and account-recovery information where the terms permit. No checklist can guarantee future availability when a provider retains a service-termination right, but identifying that dependency lets you choose knowingly.
A pre-purchase record you can complete in five minutes
- Copy the exact game title, edition, platform, and territory from the checkout page.
- Save the store terms, EULA, subscription terms, and refund notice as a PDF or screenshots.
- Highlight every clause containing transfer, resale, account, device, suspension, termination, delisting, or redownload.
- List all required accounts and write down which one receives the entitlement.
- Test whether the product page states offline play, activation, and online-service requirements.
- Record the cancellation deadline and the event that starts it in your country.
- Keep the receipt and your evidence in a folder you can access without the game client.
If the documents never grant assignment or resale, treat the purchase as a personal license. That conclusion is safer than inferring ownership from the checkout button, a paid-up-front price, or the fact that a download remains on your drive.
