How to Spot and Avoid Dark Patterns on Indian Shopping Websites

Dark patterns are interface tricks that push you toward a purchase, disclosure or subscription you did not freely choose. On an Indian shopping site, pause when a countdown creates pressure, an extra appears in your cart, a decline button is shaming, or the final amount changes at checkout. The safest method is to rebuild the order yourself: verify the seller, item, quantity, delivery, fees, taxes, add-ons and recurring charges before paying, then save evidence if the site misled you.

What dark patterns mean in India

The Central Consumer Protection Authority (CCPA) issued the Guidelines for Prevention and Regulation of Dark Patterns, 2023 on 30 November 2023 under section 18 of the Consumer Protection Act, 2019. The government describes a dark pattern as design and choice architecture used to deceive, coerce or influence consumers into choices that are not in their best interest. The guidance treats these practices as unfair trade practices under the Act.

The Ministry of Consumer Affairs used this wording in its 8 December 2023 release: “Dark patterns involve using design and choice architecture to deceive, coerce, or influence consumers into making choices that are not in their best interest.” That definition is about the effect of a design, not whether the page looks polished or whether a consumer eventually clicked the button.

The CCPA identified 13 specified patterns. A page can show more than one at once: for example, a “limited-time” banner can be false urgency, while a preselected protection plan is basket sneaking and a late fee is drip pricing.

The 13 dark patterns you may encounter

Pattern What it does Warning signs while shopping
False urgency Creates pressure to act immediately by implying that time or stock is running out without a reliable basis. A countdown resets after refresh, “only a few left” appears on every item, or a sale-ending claim has no date or explanation.
Basket sneaking Adds a product, service or quantity to the basket without an intentional selection. Insurance, donations, tips, memberships, add-ons or duplicate quantities appear in the cart.
Confirm shaming Uses guilt, ridicule or embarrassment to steer you away from declining. A clear “accept” button sits beside wording such as “No, I prefer to miss out.”
Forced action Makes an unrelated action a condition of viewing or completing a purchase. You must install an app, create a marketing account, disclose extra data or opt in to messages before checkout.
Subscription trap Makes a trial or membership easy to start but difficult to understand or stop, allowing automatic renewal. The renewal price, date, frequency or cancellation route is hidden, vague or shown only after payment details are entered.
Interface interference Uses visual hierarchy, defaults or layout to privilege the business’s choice over an equally valid consumer choice. The paid option is prominent while “continue without” is tiny, greyed out or buried in another menu.
Bait and switch Advertises one product, variant, seller or condition, then substitutes another when you select it. The headline offer changes to a costlier model, seller, colour, size or shipping method at selection or checkout.
Drip pricing Reveals unavoidable charges in stages instead of showing the meaningful total at the outset. Delivery, platform, handling, convenience or other fees appear only on the final checkout screen.
Disguised advertisements Presents paid promotion as an ordinary result, recommendation or editorial choice. A sponsored or influencer placement is not clearly labelled, or a promoted listing looks identical to an independent result.
Nagging Repeatedly prompts you after you have declined or dismissed an option. Notification requests, app-install banners, sign-up pop-ups or marketing prompts return on every page.
Trick wording Uses ambiguous, confusing or misleading language so that a reasonable person can misread the choice. Two buttons use similar colours, a double negative, an unclear checkbox or a label that does not match the action.
SaaS billing Uses software-as-a-service billing arrangements that obscure recurring charges or make cancellation unusually difficult. A tool appears free, but a paid plan starts automatically; invoices, renewal dates or the cancellation control are hard to locate.
Rogue malwares Uses malicious or malware-like behaviour to compromise a device or manipulate a consumer. Unexpected downloads, redirects, fake security warnings or a demand to install an unknown file to finish shopping.

A quick test before you buy

Use the following sequence whenever a page feels unusually pressuring or confusing. It separates a genuine bargain from a choice the interface is making for you.

1. Slow down an urgency claim

Record what the timer or stock message says, then refresh or return later. A countdown that restarts, a permanent “last chance” label or an unexplained stock warning is a reason to stop rather than speed up. A legitimate promotion should identify the relevant end condition clearly enough for you to understand it.

2. Read the whole page, not just the large button

Look for the seller, exact model or variant, quantity, delivery promise, return conditions and any recurring service. Compare the text beside the accept and decline controls. Declining an optional item should be as understandable as accepting it; an insulting or frightening decline message is a confirm-shaming or trick-wording signal.

3. Treat every default as unselected until you verify it

Inspect checkboxes, radio buttons, sliders and quantity selectors. A filled checkbox, an extra unit or an add-on already in the order is not evidence that you chose it. Remove it unless you deliberately want it.

4. Follow the advertised offer through selection

Choose the advertised size, colour, seller and delivery option yourself. If any of those changes to a more expensive choice, stop and photograph both screens. Do not assume the change is harmless; it may be bait and switch.

5. Calculate the payable total independently

Write down the product-page price, cart subtotal, delivery charge, platform or convenience fee, taxes, discounts and final amount. An unavoidable charge that appears only late in the flow is a drip-pricing warning. Check that a displayed discount has actually reduced the total rather than merely changing the label.

6. Inspect recurring commitments

For a trial, membership or software service, identify five facts before entering payment details:

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.
  • the amount charged at renewal;
  • the first renewal date;
  • the billing frequency;
  • whether renewal happens automatically; and
  • the exact cancellation path and its deadline.

If any one of these is missing or difficult to find, treat the offer as a subscription-trap or SaaS-billing risk.

7. Separate promotion from independent information

Look for “Sponsored,” “Promoted,” influencer or other paid-placement labels. A prominent result can still be useful, but it should not be presented as an ordinary recommendation when it is advertising. Give badges such as “popular choice” the same cautious treatment as star averages and scarcity messages.

8. Reject repeated prompts and suspicious files

Dismiss notification, app-install and marketing prompts. If the same request returns, that is nagging. If a page redirects unexpectedly, presents a fake security alert or asks for an unknown download, close it. Never install a file merely to complete a purchase.

How to audit your cart before payment

The cart is where several patterns become visible together. Perform this audit on the final review screen and again immediately before authorising payment.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.
  1. Confirm the item. Match the title, model number, colour, size, seller and condition with the product page or advertisement.
  2. Confirm quantity. Change the number to what you intended. Look for a second unit hidden below the visible product line.
  3. Remove unsolicited extras. Delete insurance, protection, donations, tips, memberships, gift wrapping and other add-ons unless you selected each one knowingly.
  4. Check delivery. Verify the destination, delivery speed and charge. A “free” option should not silently become a paid express service.
  5. Reconcile money. Compare the product price with subtotal, discounts, taxes, delivery, platform fees and the final payable amount. Expand collapsed sections before accepting the total.
  6. Check payment timing. Confirm whether the amount is a one-time charge, a deposit followed by another charge, or the first payment in a recurring schedule.
  7. Review permissions. Untick optional marketing, data-sharing and notification permissions. If the site will not let you proceed without an unrelated permission, record that forced action.
  8. Save the evidence. Capture the product page, cart, checkout total, wording and timestamp before you click “Pay.” Keep the order ID, invoice, payment confirmation and relevant emails.

Subscription and trial traps: a safer decision rule

A free or low-cost trial is not necessarily deceptive. The risk is a design that highlights starting the trial while hiding the later obligation. Treat a trial as acceptable only when you can answer the five renewal questions above without searching through unrelated pages.

Before starting

  • Locate the plan or membership page and record the ordinary price, not just the introductory amount.
  • Find the renewal date and frequency in the same flow where payment details are entered.
  • Open the account or help menu and confirm that cancellation can be completed online, rather than only by an unexplained phone call.
  • Set your own calendar reminder several days before renewal; do not rely on a promotional email.

After starting

Save the confirmation showing the trial end date and plan. If you cancel, keep the cancellation confirmation and check the next statement. Software services deserve the same scrutiny as retail memberships: recurring billing hidden in an apparently free tool is the SaaS-billing pattern identified by the CCPA.

What to compare when choosing between shopping websites

A lower displayed price is not the only measure of a safer site. Compare the complete buying experience using the same product and destination.

Comparison point Questions to ask Safer sign
Total-price transparency When do delivery fees, taxes and platform charges appear? The meaningful payable total is visible before payment authorisation, with line items that can be expanded.
Declining optional items Can you refuse insurance, memberships, marketing and add-ons without guilt or a detour? Accept and decline controls are both clear, neutral and available in the same step.
Subscription clarity Are renewal amount, date, frequency and cancellation route stated together? The recurring obligation is prominent before payment and cancellation is easy to locate.
Sponsored-content visibility Can you distinguish paid placements from ordinary results and reviews? Sponsored or promoted results are labelled in a way that is visible before you click.
Seller and review transparency Can you identify the seller, fulfilment party and context behind ratings? Seller identity, review context and relevant product variant are shown rather than implied by a badge.
Grievance access Is there a working contact route for a wrong charge, cancellation or misleading listing? The grievance contact and escalation information are easy to find and produce a reference number.

Reviews, badges and social proof

The Bureau of Indian Standards notified a voluntary framework, Online Consumer Reviews — Principles and Requirements for their Collection, Moderation and Publication, on 23 November 2022. Its principles include integrity, accuracy, privacy, security, transparency, accessibility and responsiveness.

That framework does not make every rating genuine, and a voluntary standard is not a guarantee that a particular listing follows it. Treat review volume, star averages, “popular choice” labels and scarcity messages as signals to investigate. Read reviews for the exact variant and seller, look for specific observations rather than repeated slogans, and check whether critical reviews are addressed. Do not let a large number of ratings substitute for checking the product, price and terms yourself.

What to do when you find a dark pattern

Capture a complete record

Take screenshots that show the page address or app screen, the wording, the product or service, the cart, the final total and the date and time. Preserve the order ID, invoice, payment record, emails, chat transcripts and cancellation confirmations. If a timer or stock message changes, capture both states.

Correct the order before paying

Remove preselected extras, reduce quantities, choose the advertised variant and decline optional subscriptions or marketing permissions. If a suspicious download or redirect appears, leave the page and use a trusted device-security process rather than continuing.

Use the platform’s grievance channel

Ask for the specific remedy: removal of a deceptive charge, cancellation of a recurring plan, correction of the advertised item, refund or deletion of an unwanted account or permission. Attach the screenshots and transaction records, and request a written response and reference number.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

The Consumer Protection (E-Commerce) Rules, 2020 outline e-commerce responsibilities and customer grievance redressal. Use the contact details and escalation route displayed by the platform, and keep copies of every submission. If the platform does not resolve the issue, use India’s current consumer-protection complaint routes. Portal names and access details can change, so verify the current official route at the time you file rather than relying on an old saved link.

When payment or security is involved

For an unauthorised payment, contact your bank or payment provider promptly through its official channel and preserve the complaint number. For malware-like behaviour, stop using the affected page, disconnect a compromised device as appropriate, run your normal security checks and change credentials from a clean device. A shopping dispute and a device-security incident may require separate reports.

Common mistakes that let dark patterns work

  • Trusting the first total. The product-page price is not necessarily the payable amount; inspect the final line-item breakdown.
  • Assuming a tick means consent. A default is a design choice by the site, not proof of your choice.
  • Rushing because of a timer. A countdown is a prompt to verify the claim, not a reason to skip checks.
  • Confusing difficulty with illegality. A cluttered page is frustrating, but the CCPA guidance focuses on deceptive, coercive or manipulative choice architecture. Record the concrete wording, default or charge that affected you.
  • Relying on a badge or rating alone. Popularity and review volume do not verify seller identity, variant, price or renewal terms.
  • Failing to save proof. Dynamic pages can change after an order; screenshots and confirmations preserve what you actually saw.

A printable pre-payment checklist

  • Seller, item, variant and quantity match what I intended.
  • No insurance, donation, tip, membership or other extra was added without my deliberate choice.
  • Delivery method and destination are correct.
  • Product price, discount, delivery, taxes and every fee reconcile to the final payable amount.
  • Any subscription states its renewal amount, date, frequency, automatic-renewal status and cancellation route.
  • Accept and decline controls are equally clear and free of shaming or confusing wording.
  • Sponsored results and influencer promotions are labelled.
  • No unrelated app install, data disclosure or marketing opt-in is required.
  • I have saved screenshots, the order ID and payment evidence.

What changed in official oversight

On 5 June 2025, the CCPA advised e-commerce platforms to self-audit for dark patterns within three months and make self-declarations based on those audits. A 22 July 2025 Ministry of Consumer Affairs release said platforms were advised to “conduct self-audits to identify dark patterns, within three months of the issue of the advisory” and provide self-declarations. These measures place responsibility on platforms, but they do not remove the need for a consumer to inspect a particular transaction and retain evidence.

Bottom line

Pause when a site creates urgency, guilt, confusion or a surprise charge. Verify every choice and every rupee, especially recurring commitments, and rebuild the cart instead of accepting defaults. If the interface still manipulates the transaction, stop, document it and use the platform’s grievance process with your evidence.
